Regular Meeting of the Orono Council , September 13, 1982 The Orono Council met on the above date with the following members present : Mayor Van Nest, Councilmember Butler , Frahm, Adams, and Hurr. Also present : City Planner Olson, Zoning Administrator Mabusth, Public Works Coordinator Gerhardson, City Building Official Jacobs, City Attorney Malkerson, City Engineer Cook , and Deputy Clerk Woytcke. Absent : City Admini- strator Benson. PUBLIC HEARING Revenue Sharing Budget At approximately 7 : 03 P.M. Mayor Van Nest called thePublicHearing toorderconcerning the Revenue Budget. Deputy City Clerk Woytcke presented the afadivit of publication. No one was present regarding this hearing and it was closed at 7 : 04 P.M. �518 C. Rex Welsh 650 North Arm Dr. Dredging Resolution Deputy City Clerk Woytcke , who was present at the meeting has reviewed a transcript of this portion of the meeting which is attached as Exhibit A and adopts it by reference as the minutes for this portion of the meeting . Frahm moved , Butler seconded , to approve and accept the resolution prepared by the City Planner as amended by the City Planner . Motion, Ayes (5) - Nays (0) . Clarification of T�ietlands Easements Resoultion �1413 Butler moved , Frahm seconded , to adopt the Resolution #1413 as amended regarding Clarifi- cation of Wetlands Easement Lot 1 , Block 1, Fazendin Forest Addition. PUBLIC COMMENTS No comments from the Public . #669 TONRA LARE PROPERTIES 1340 Baldur Park Road Preliminary Subdivision Van Nest moved , Butler seconded , to conceptually approve the 3 lot plat per plan dated June 18 , 1979 and to formally recognize the applicants request to table action on his original 4 unit PRD. Thomas Sarenpa was present. Butler moved , Adams seconded to approve the side setback of 3. 5' and hardcover variance . Motion, Ayes (5) - Nays (P1) • #696 HILDUR HOLLANDER 250 Hollander Road Preliminary Subdivision Zoning Administrator Mabusth reviewed for the Council the Preliminary Subdivision application of Mrs. Hildur Hollander . Mrs. Hollander was present. Van Nest moved , Hurr seconded , to approve the preliminary subdivision per Planning Commis- sion' s recommendations subject to staffs inspecting the possibility of a private driveway easement through lot 3 and 4 to serve lot 5, council is concerned with direct access to County Road 5 off lot 5. Motion, Ayes ( 5) - Nays (P1) . �698 MARVIN SEIBOLD 1699 North Farm Road Variance Mr . Marvin Seibold and his attorney Mr . Bob Mitchell was present for this application. Councilmember Tim Adams wanted it stated in the record that he was a parterner in the farm that Mr . Seibold purchased and he did not feel he had a conflict of interest, if anyone on the council felt he did , he would step down. Council saw no problem and decided it would be acceptable for councilmember Adams to stay seated at the council table. Van Nest moved , Butler seconded , to approve a 30' lakeshore width variance for lot 6 blk 1 subject to the filing of an amended Flowage and Conservation easement permitting construction of a joint or single residential dock per L.M.C.D. standards. Applicant is to work with staff in determining the best method ofreaching shorelinewithlimited use of hardcover . Dockage limited to two slips. Motion, Ayes (4) - Nays (0) . Councilmember Adams abstained . (1) . �699 WILLIAM WEAR 2160 Wayzata Blvd. Variance Mr . Kevin Gonyea representing Q Petroleum was present. Zoning Administrator Mabusth reviewed the variance application with the council . � REGULAR MEETING OF THE ORONO COUNCIL, SEPTEMBER 13 , 1982 PAGE-4- Hurr moved , Butler seconded , to approve a 42 sf. sign area varaince approving a 20' high pylon sign located 27' off of Highway 12. The sign may not exceed 5 ' X 7' in area. This approval is subject to the following conditions. 1) Property limited to 2 individual signs (directory signs 30' high and Q Petroleum sign 20 ' high) 2) Update on landscape plan summer of 1983. 3) City will require a temporary sign permit whenever the temporary mobile sign was in use on the site - must be stored inside when not in use . TAX EXEMPT APPLICATION 525 Leaf Street Van Nest moved , Frahm seconded , to respond to the state requesting a hearing and to delay approval till such time staff can research the file and determine the use of the building. Motion, Ayes (5) - Nays (�1) . WATER TOWER CHANGE ORDER �1 Adams moved , Hurr seconded , to approve the change order #1 for extension of time until the 17th of September . Motion, Ayes (5) - Nays (0) . RESOLUTION �1414 Navarre Utility & Street Improvements Butler moved , Hurr seconded , to approve Resolution #1414 accepting the Navarre Utility & Street Zmprovements specs and plans subject to attorneys making changes on the contract reserving the City the right to award or not to award the contract. Motion, Ayes (5) - Nays (0) . CITY ASSESSOR Mayor VanNest reviewed the assessor contract with the County. The City is now in the second year of the assessment contract and if the City decides to get their own assessor we will have a time of duplication before Hennepin County has fulfiled its current contract. Van Nest moved , Butler seconded to have City Administrator Benson draft a resolution stating the City Council desires not to renew the contract with the County for anything past the term of the existing contract and that the Council is instructing our staff to proceed with a study and a recommendation to the Council as to how it is , �EGULAR MEETING OF THE ORONO COUNCIL, SEPTEMBER 13 , 1982 PAGE -5- intended to replace the County Assessing Department for the assessing year due 1985. The Council would like information back to them no later than February 1, 1983. Motion, Ayes (5) - Nays (0) . MAPLE PLAIN TREATMENT PLANT STATUS Mayor VanNest reviewed with the Council the Maple Plain Treatment Plant will have a permit to operate but only through December 31 , 1984 , when at this time will be closed and the sewage will flow through a newly constructed interceptor routed through the City of Mound not to Orono and Long Lake. MINUTES SEWER SERVICE AREA ADVISOR BOARD The minutes of the Sewer Service Area Advisory Board Group C were available for the Council to review. LARE MINNETONRA TASR FORCE Mayor VanNest reviewed the Lake Minnetonka Task Force meeting with the council . Regarding Public Accesses on Lake Minnetonka . CABLE T.V. REPORT Representative Mary Butler reviewed the Cable T.V. Resolution and Agreement from Shorewood and also the minutes of the last meeting . The Shorewood Agreement and Resolution was included in the packet for their reviewal . HENNEPIN COUNTY DEPT. OF TRANSPORTATION GETTER DATED 8-27-82* Butler moved , Hurr seconded to accept City Administrator Benson' s letter to Mr . Dennis Hanson, Traffic Engineer at Hennepin County Dept. of Transportation. Motion, Ayes (5) - Nays (0) . LETTER DATED 9-1-82 DENNIS HANSEN* Butler moved , Hurr seconded , to-accept the Letter dated9-1-82from DennisL. Hansen, County Traffic Engineer . SIME, JR.* Butler moved , Hurr seconded , to accept the letter of commendation to the Orono Police Dept. from Mr . Wm. Sime, Jr . Motion, Ayes (5) - Nays (0) . TEMPORARY EMPLOYMENT* Kevin Wagman Butler moved , Hurr seconded , to approve the temporary employment of Kevin Wagman at the Orono Golf Course at an hourly rate of $3. 35 per hour effective September 7, 1982. Motion, Ayes (5) - Nays (OJ) . HANDICAP ACCESS* ADMINISTRATION BLDG. Butler moved , Hurr seconded , to approve the Handicap Access construction to the Adminis- tration Building . SPECIAL MEETING - BUDGET WORRSESSION* Butler moved , Hurr seconded , to accept the memo regarding the special budget meeting set for September 16, 1982 at 7 : 3PJ P.M. in the Orono Council Chambers. Motion, Ayes (5) - Nays (0) . CAPITAL OUTLAY PURCHASES* Butler moved , Hurr seconded , to accept the memo regarding the Capital Outlay Purchases in 1982. Motion, Ayes (5) - Nays (0) . TEMPORARY SET-UP LICENSE ORDINANCE* Attorney Bruce Malkerson reviewed with the council the new law explaining the temporary set- up license . Mrs. Eilene Hock of the Minnesota Center of Arts was present to request a temporary license . � REGULAR MEETING OF THE ORONO COUNCIL, SEPTEMBER 13 , 1982 PAGE -7- Hurr moved , Frahm seconded , to approve the Ordinance Amending Chapter 43 of the Orono Municipal Code Providing for Temporary "Set-Up" Permits. Motion, Ayes (5) - Nays (�) . AMENDING FEE SCHEDULE Hurr moved , Butler seconded , to amend the Fee Schedule to state the fee for the one day Set-Up permit to be $25. 00. Motions, Ayes (5) - Nays (�1) • ART CENTER SET-UP PERMIT. Hurr moved , Frahm seconded , to approve under ;the newlyadopted Ordinance the One Day Set-Up permit for the Minnesota Center of Art for September 25, 1982. Motion, Ayes (5) - Nays (0) . It was suggested by the Council that the Art Center ' s attorney contact the City Attorney so that the explanation of this permit be explained throughly. CITY ATTORNEY'S REPORT At approximately 10 : 00 P.M. the council went into executive session, to discuss the Logre Litigation. . .
