Regular Meeting of the Orono Council � June 28 . 1982
The Orono Council met on the above date with the
following members present : Mayor Van Nest ,
Councilmembers Frahm � Butler � and Hurr .
Councilmember Adams arrived at 7 ; 17 P .M. . Also
present : City Attorney Malkerson , CityEngineer
Cook , City Planner Olson � Zoning Administrator
Mabusth , and Deputy City Clerk Woyteke .
CONSENT AGENDA�
Butler moved , Hurr seconded � to remove item �2
from the Consent Agenda� for discussion purposes .

Butler moved , Hurr seconded , to approve the
Consent Agenda� � subjecttoremovingitem �2 , with
all staff reports concerning items reviewed at
this meeting to be attached to the original copy of
these minutes on file in the city Clerk' s office.

NINUTES
Butler moved , Frahm seconded to approve the
Minutes of the Regular Meeting of June 14 . 1982 as
amended,, to include the explanation of
Councilmember Hurr ' s abstaining on the Welsh
Conditional Use Permit . Motion , Ayes (4) - Nays
(0) .
PARK CONMISSION
COMMENTS
No comments from the Park Commission .

Councilmember Hurr reported that the LMCD
approvedtheWindward Marinepermitsub�ectto the
City approving a 1982 Commereial Dock License.
It was also reported that the LMCD approved the
budget for 1983 with no changes .

' PLANNING COMMISSION COMMENTS
No comments from the Planning Commission .
PUBLIC COMMENTS
Mr . Dave Stanlaski 3550 North Shore Drive asked
the couneil to consider passing a resolution to
extend the no parking area 180 feet further east
past his property .
� His re�sons for asking this of the aouncil was that
people parked in front of his property bloeking
his view of the lake and also they used his dock .
Councildirectedstaff toreviewthisproblem with
the Police Chief and come back to the next regular
meeting with a recommendation .
Councilmember Adams arrived at this time and was
therefore in time for the vote on the rest of the
agenda items .

SUBDIVISION
Mayor Van Nest announced at this time that he would
step down from the council table on this matter as
there was a conflict of interest. Acting Mayor
Butler would then preside for the council .
Mr . Conry representing Dicon was present .
Zoning Administrator Mabusth reviewed with the
council the preliminary subdivision for Dicon 155
Willow Drive North .
Councilmember Adams wanted the concerns �about
limiting number of curb cuts on perimeter roads to
be noted in the record .
Hurr moved , Frahm seconded to grant preliminary
approval of the Countryside Manor plat sub�ect to
the finding and conditions setforth by the
Planning Commission. Motion , Ayes (4) — Nays
( 0) .

was present. Zoning Administrator Mabusth
reviewed the Conditional Use Permit application
with council .
Hurr moved , Butler seconded , to grant conceptual
approval of the conditional use permit and the

request to hook up to the City Sewer . Staff �,�as
directedtodraftaresolutionforpresentation at
the next council meeting of July 12 . 1982 .

334o SHORELINE DRIVE
Hurr moved , Frahm seconded , to grant coneeptual
approval of the mini-storage use as a compatible
use in the B-1 Zoning District . Council also
requestedthatthisbeimplementedbyamending the
zoning codetopermitmini-storageasanaccessory
use through a conditional use permit . Such
structures would be subject to all required
setbacks , a single structure , concrete block ,
landscaping improvements , changes in curb cuts
and installation of grassed boulevard . This
will require Mr . Martin to file a formal
conditional use permit with the City . Motion ,
Ayes (5 ) - Nays (0) .
#5$5 SCHLEE BUILDERS

RESOLUTION #1390
Mr . Russ Fierst was present to represent Schlee
Builders and City Planner Olson reviewed with the
council the Subdivision application .
Van Nest moved , Hurr seconded � to conceptually
reapprove the preliminary plat design for double
homes based upon the sketch �2A indicating an
internal cul-de-sac . with all access direeted at
Blaine Avenue. A public information meeting
will be called at the July 12 , 19$2 Council meeting
to review this decision with the neighborhood .
In this motion Council also ordered afeasibility
study for the City Engineer to review designs ,
costs and possible assessment formulas , with the
cost of this study to be paid by Schlee Builders if
the development does not go foward .
Also in this motion the following conditions were
listed :
1 . Schlee Builders generally agree to proceed
with a subdivision layout similar to Sketch #2A .
sub�ect tofinal Council determiniation after the
public information meeting .
2 . Schlee Builders agrees to extend any prior
deadline for review of the preliminary plat and
for Couneil action on the final plat to allow
completion of the feasibility study and
completion of final plat documents .

3 . SchleeBuildersformally requests the City to
install the internal improvements as a City
project . subject to completion of thefeasibility
study and to subsequent Developer ' s Agreement
with the City which will stipulate the agreed upon
design plans and assessment formulas , including
an assessment appeal waiver . Schlee Builders
understands that such an Agreement and Assessment
Waiver must be signed prior to final plat approval
and/or ordering of actual construciton .
4 . Schlee Builders agrees that if the
Developer ' s Agreement and Assessroent Waiver is
notsignedwithinsixmonths , SchleeBuilders will
reimburse the City costs of the engineering
feasibility study . Motion , Ayes (5) - Nays ( 0) .
5 . Schlee Builders agrees to reroute the sewer to
the north to tie into the lift station on Togo
Road .
Van Nest moved , Hurr seconded to adopt Resolution
�� 390 A Resolution Ordering Preparation of a
Feasibility Report for Certain Described
Improvements . Motion , Ayes (5 ) - Nays ( 0) .
BIG ISLAND REPORT
City Planner Alan Olson rep'orted that he and Mike
Gaffron. Septic Systems Manager and Couneil-
member Hurr took a boat trip out to Big Island to
review all the lots and the conditions of the
septic systems . A photo was taken of all the
properties and will be kept on file in the City
Office .
Olson reported that the Island was in better shape
than he expected and he didn ' t find that many
problems . He then reviewed with the council the
various development densities for 6 subdividable
properties , and for the existing vacant lots .
Owners from the Island will meet at the Orono
Council Chambers Wednesday , June 30 . 1982 at7 : 30
P .M. .

Frahm moved , Butler seconded � to adopt the
Resolution �1391 written by Mr . Larry Blackstead
to support the Westonka Senior Citizen Residence
to be located in Mound behind the Our Lady of the
Lake Catholic Church . Motion , Ayes (5 ) - Nays

The council had no comments on this item.
WASTE MANAGEMENT BOARD
REPORT
Council accepted the Waste Management Board
letter dated May 27 , 1982 .
MINNEHAHA CREEK iIATERSHED
DISTRIC? MEETING
Council discussed the meeting of the Minnehaha
Creek Watershed District that was to be held June
29 , 1982 . Mayor Van Nest wanted to be present for
this meeting so that he could express the City ' s
concerns about the level of water discharge .
There is a conflict as he is to be present at the
Board of Review that is to be held at the same time .
Couneil felt it was important for Mayor Van Nest to
be present at both meetings . It was decided that
he would attend the Board of Review and if time
permitted he would leave and attend the Watershed
meeting also .
Mayor Van Nest also announeed that there will be
anothermeetingof theMinnehahaWatershedonJuly
15 , 1982 .

Council accepted City Administrator Benson ' s
letter to Mr . George Lusher dated June 24 , 1982 .

Council accepted Gayle M. Kincannon ' s letter
dated June 17 , 1982 and decided that City
Administrator Benson could call her if he felt she
should appear before the council .

Mayor Van Nest announced the Meetings of July 12 ,

CABLE T.V. REPORT
Councilmember Butler , representative from Orono
to the Cable T.V . Committee reported she had the
agreement for Cable T .V . that she wanted council
to sign and send back to the next committee
meeting .
Butler moved , Frahm seconded , to adopt the Joint
Powers Agreement for the Lake Minnetonka Cable
Comunications Commission � as written . Motion �
