HomeMy WebLinkAbout06-10-1982 Board of Review Minutes � t. ORONO BOARD OF REVIEW 1982 The 1982 Board of Review was called to order by acting Mayor Mary Butler, at 7: 35 p.m. , J_� 10 1982. Council members present were Jo Ellen Hurr, Tom Frahm an Tim Adams, also present were Don Monk, County Assessor and Milt Hilk, County Appraiser. Acting Mayor Butler stated the purpose of the Board of Review. She asked those persons appearing before the Board to state name, property identification number and/or street address. The Board will reconvene Tuesday, June 29th, at 7 : 30 p.m. , the place to be selected at a later date. Acting Mayor Butler announced that before the meeting star�s Mr. Sime would like to �nake a few comments. Mr. Sime stated he wished the audience would give Mr. Monk and Mr. Fiilk the benefit of the doubt. It is the state legislature that has put us in this situation, not Hennepin County. For a long time Orono has been below value of other areas. According to a M.A.I. file the sales ratio studies indicate that for the years 1979 and 1980 Orono was 1$ higher than the aggregate assessment ratio for Hennepin County. Secondly my prime argument and I think it applies to everyone is this room, first of all in order to understand what my argument is going ta be, there is a distinction between price and value. That distinction is very important in understanding my argument as to why our valuations are out of line. The price a property sells for does not necessarily equal its value. The reason for that is because below market financing rates must be discounted to arrive at a cash value. According to the legal defination of market value we are intitled to have our property valued at its cash value. An examp�e has been given to each of the Board members and the Assessors of the assessment figures of my home from the valuation figures. I respectfully ask the Board that you would ask the Assessor to please revalue all of our homes using the cash equivalency appraisal method to determine the true market value as it is legally defined, instead of using just sales price information, which he is currently using. Don Monk introduced himself to the audience and stated that in the course of the 10 days of ineetings there were about 160 requests for review, there are about 80 of these appraisals left to do. Our appraisers are swamped with work, they have gotten about half of it done by tonights meeting. Before the 20 days transpire that this Board has to act, all of those review appraisals will be done. You will be notified by phone or in writing or both and given opportunity to get an appeal, if you disagree with the results of the page 2 1982 Board of Review review appraisal. If you disagree with the review you should present your case with some evidence as to why we are wrong and the number of what you think is the right appraisal to this Board. This Board is now in control of the assessment. Acting Mayor Butler stated that this meeting has been duly called, the notice of the meeting has been printed in the Lake Minnetonka Sun, the official City newspaper, the certification of publication is available for inspection. A member of the audience asked Don Monk to explain how some properties were given a 10$ increase. He stated Minnesota statute requires assessor to physically look at at least one quarter of all the properties annually. The remaining 75$ receive a percentage increas� based on an analysis of sales that have taken place in the year preceeding the 1982 assessment. The Assessor has two primary jobs; one is to value all taxable property each year annually as of January 2, at its market value and; second is to place the classifications that have been given in the state of Minnesota, such as home- stead, commercial, industrial. The review process starts at the local level the next appeal is the County Board, State Board and there is also the Minnesota tax court and the abatement process. PII.L9BIIHY - PRFSIDENT 612-3.1a�!!7� June 10, 1982 - City Council City of Orono Box 66 Crystal Bay, Minnesota 55323 Dear Council Members The purpose of this letter is to ask for r�lief from the proposed valuation of certain property owned on Bracketts Point Road by Eleanor L Pillsbury. • Specifically, the identification numbers of the property valuations objected to are: 1d 117 23 32 0004 10 117 23 32 0005 1P 117 23 32 0006 1� 117 23 32 0009 , 1Q 117 23 32 0011 j All of the land involved is unimproved and none of it is � served by city water or sewer. The first three parcels (4, 5 and 6) , have an aggregate fair market value valuation as of January 1 , 1982 of $205,000 and include 2. 14 acres of property separated from other land owned by Mrs Pillsbury by either a public road or by land owned by a third party. The soil conditions of all of that property have been indicated to us to be Lc which we under- � stand to mean that it is unbuildable without city sewer or water. Because of the nature of the property we believe that the valuation should be reduced to reflect its status as a tot upon which, according to the Hennepin County soil maps, a residence could not be constructed and which is sep- arated from other property owned by the taxpayer. Tract 9 is a small parcel , less than one acre, with 100 feet ! I City Council -2- June 10, 1982 of frontage on Browns Bay. It is our understanding that current zoning regulations would not permit the construc- tion of a residence on that tract because it is under the two acre minimum zoning regulation for land not serviced by water and sewer. We believe that the value of $60,000 is excessive. Finally, Tract 11 consists of 4.62 acres which is comprised mostly of Lc soils with a portion of it being comprised of Hb6 soil . While extensive development work has not been done, it is clear to us that it would not be possible to obtain two, two acre lots with acceptable soils for building purposes. It may be that there is insufficient soils fo� a single house on the property. (n any event, given the un- certainties resulting from the soil conditions, we think a substantially lower valuation is required. In making the objections to the valuations set forth in this letter we are trying to obtain valuations which are fair in comparison of other property owners in Orono and which reflect realistic uses of the property given the rules and regulations of Orono which, we understand, have changed substantially in recent years and have become more restrictive in terms of permitting on-site septic systems.
