The Orono Council met on the above date with the following members present : Mayor VanNest , Councilmembers Butler, Frahm, Adams , & Hurr. Also present : Desyl Petersen, representing Bruce Malkerson, Planning Commission member J. Diann Goetten , City Enqineer, G1ennCook , and City Deputy Clerk Woytcke. City Adminis- trator Benson arrived at 8 : 30 P.M. Mayor VanNest called the meeting to �rder at 7 : 03 P.M. Chief Mel Kilbo was present with all of the ORONO POLICE RESERVES Police Reserves . He read the ordinance and informed council all members understood the ordinance and were ready to sign it. He also introduced each person and told a little about each one. Total hours volunteered in 1981 were 20792. Mayor Van Nest handed out their certificates. Van Nest moved, Butler seconded, to appoint the reserves to their positions �or another year. Motion, Ayes (5) - Nays (0) Adell Dahl of the Suburban Community Services WESTONKA COUNSELING FOR was present to ask the council to accept the OLDER ADULTS PROGRAM agreement for the Westonka Counseling for � Older Adults. � Discussion followed with questions of how many Orono residents were he�ped in this program. The figures were 211 people in all 9 communities� 46 of them Orono residents� and only 28 of these 46 received 246 hours of counseling. Council suggested to City Administrator Benson to look further into this program and come back at the next meeting with a recommendation. Butler moved , Hurr seconded to approve the CONSENT AGENDA* Consent Agenda* , subject to removing items 5 , 11 ,26 , 29 ,35 , & 37 , with all staf� reports concerning items reviewed at this meeting to be attached to the original copy of these minutes on file in the City Clerk' s Office. Motion , Ayes (5) - Nays (0) , ' REGULAR MEETING OF THE ORONO COUNCIL, JANUARY 11 , 1982 PAGE -2- No comments from the Park Commission . PARK COMMISSION Councilmember Hurr, Orono' s representative to the LMCD, reported concerns of citizens LMCD REPORT regarding deicing permits and the impact they have on adjoining property owners ; what input does an adjoining property owner have regarding a deicing permit? Mayor Van Nest stated that annual deicing perinits are issued for Marinas . The LMCD should be aware of com- plaints of property owners contiguous to a deicing permit application and to be notified before issuance of the permit. No comments from the Planning Commission PLANNING COMMISSION REPORT No comments from the Public present. PUBLIC COMMENTS Zoning Administrator, Jeanne Mabusth stated AFTER THE FACT that Mr. James Thaxter was not able to be CONDITIONAL USE present and needed more time to prepare . PERMIT 1965 Tamarack Mayor Van Nest moved, Adams seconded, to table the Conditional Use Permit request of Mr . James Thaxter of 1965 Tamarack Drive until the next regular council meeting. Motion , Ayes (5) - Nays (0) Butler moved, Frahm seconded , to approve the PRELIMINARY SUBDIVISION 2 lot plat, subdivision application of Albin Albin F . Thies F. Thies and Ruth L. Phillips based on the 830 Old Crystal Bay Rd. finding that the newly created lots satisfy all standards of the RR-1B zoning district and that each lot has direct access to a , public road . This approval is subject to all the conditions found by Planning Commission . Motion Ayes (5) - Nays (0) Mr. Petersen was not present , Mr. Newman was CONDITIONAL USE PERMIT present to represent Mr. Petersen . 280 Oronc Orchard Road Discussion followed that Mr. Newman had Timothy Petersen permission from Mr. Petersen to state that if the neighbors did have any problems with their equipment and it was in his control , and/or caused by his equipment, that he would pay for all modifications to neighbors equipment. Councilmember Butler stated she felt that the permit should be issued only with the stipulation that a tickler file be kept on this matter and each year in December the surrounding neighbors be notified so that if there is any problem it can be settled and revoke the permit if so needed. REGULAR MEETING OF THE ORONO COUNCIL, JANUARY 11 , 1982 PAGE -3- Butler moved , Mayor Van Nest seconded , to CON' T. OF TIMOTHY PETERSEN conceptually approve the conditional use permit application permitting the erection of a 65 ' antena and directed staff to draft a resolution setting forth the conditions of that approval for final action at their January 25th council meeting, and Mr. Petersen will be asked to sign this resolution. Motion , Ayes (5) - Nays (0) Mr. and Mrs . Kent Swanson , their attorney Mr. R. VARIANCE Larson, and the architect Mr. Mark Nesset were Kent Swanson present. 3229-B Casco Circle Discussion of this variance was the documen- tation of the following hardships : 1 . Shape of lot - pie shape 2 . The lakeshore setback requirements has placed severe restrictions on the build- ing envelope . 3 . House located on site prior to lakeshore setback requirement. 4 . Only feasible location for the addition is to the "front lakeside" of the house. Frahm moved, Adams seconded , to conceptually approve the variance application of Kent Swanson as follows : 1) A hardcover variance permitting a hardcover increase of 436 sf . within the 75 ' - 250 ' setback area. 2) 2 . 5 encroachment of 472 sf addition into lakeside setback area. 3) 17 ' encroachemnt for 3 ' walkway into lakeshore setback area. 4 ) To permit the roofing and screening of 9 . 8 ' X 16 . 1 ' deck subject to the removal of 6 X 12 ' roofed deck . Based on the following findings : 1} A net reduction in hardcover within i-he 0 . 75 ' set back . 2) Actual 0 . 75 structure encroachment is only 25 sf even though total addition is 472 sf . Council has directed staff to draft a resolution setting forth the conditions of this approval for presentation and action at the January 25 , 1982 meeting. Motion , Ayes (5} - Nays (0) Butler moved, Hurr seconded , to defer setting ISLAND MORATORIUM* a date for the Island Moratorium until staff had time to provide more information to the council . HIGHWOOD SEWE'.� PROJECT Motion , Ayes (5) - Nays (0) Mayor VanNest moved, Butler seconded , to accept MAYOR' S REPOIZT City Administrator Benson ' s memo regarding the Maple Plain Treatment Plant. Motion, Ayes (5) - Nays (0) Mayor VanNest announced that at the Mayor' s Association Meeting they planned to talk about the Infiltration and Waste Control Commission and how they are bi�ling the Cities at their next meeting. Mayor VanNest moved, Butler seconded, to approve City Administrator Benson' s memo regarding the Site "M" Landfill . Motion, Ayes (5) - Nays (0) A memo from E. A. Hickok and Associates LAKE KATRINA/PAINTER pertaining to the Painter Creek Study, it CREEK REPORT stated that City Administrator Benson would be draftinq a letter to the Orono residents. After this letter has been hand delivered there will be an informa- tional meeting with the owners in the first part of February. Mayor VanNest moved, Butler seconded, to have CABLE T.V. REPORT City Administrator Benson inform the Mayor of Minnetonka Beach, Long Lake, and Medina that the Orono Council has asked him to dra�t a letter to the southshore cable area requesting that the urban area within the M.U. S.A. & M. S. S.R. lines of the city be included in southshore cable T.V, service area, and that the sewer or municipal water area of Chevy Chase, Ferndale Green, Minnetonka Bluffs , Ferndale West that are dense urban areas within the rural area to, be served by Wayzata. Motion , Ayes (5) - (0) Mayor VanNest moved, Butler seconded, to have CABLE T.V. SURVEY the City send out the Cable T.V. survey to the Orono urban area to be served asking residents if they want Cable T.V, and informing them o� projected costs. The City Council agrees that the closing of County Rd. #6 would not create any transportation problems . Butler moved, Hurr seconded, to approve the Hennepin County Five-Year Capital Improvement Plan with the stipulation that a letter be drafted stating that the City would agree to the closing of County Road #6 but would not agree to the closing of the Hendrickson Bridge completely , stating that one lane must remain open at all times.
