November 9 , 1981 The Orono Council met on the above date with the following members present: Mayor Van Nest, Councilmembers Butler, Frahm, and Hurr. Also present: City Planner Olson, Zoning Administrator Mabusth, City Attorney Malkerson, Planning Commission members Callahan, Goetten, and Rovegno, and City Clerk Strom. Absent: City Administrator Benson and City Engineer Cook. ` Mayor Van Nest announced that now was the time and INFORMATION MEETING place for a public information meeting concerning a Lake Minnetonka proposed moratorium for Lake Minnetonka Islands Islands under the jurisdiction of the City of Orono. City Planner Olson presented a memo regarding the moratorium dated November 5, 1981. (Pages 2-4 ) Mayor Van Nest explained the purpose of the information " meeting stating that, at present, no plans are being considered for rezoning the islands, but that the meeting was called for the purpose of getting input from the residents of the islands as to their ideas for future use . Mayor Van Nest also informed the residents :_�sent that no condemnation of property is planned1 �ut that a moratorium is necessary until a review of the islands has been made to determine the best use of the properties. Mayor Van Nest suggested to the citizens present to form a committee and present their ideas to the City Council at a later date. After all persons present had an opportunity to be heard, the meeting was closed at 7 :40 P.M. Olson DATE: November 5, 1981 � SUBJECT: Public Hearing - Proposed Moratorium - Lake Minnetonka Islands Under separate cover I sent each Councilmember a copy of the public hear 'ing notice and a draft copy of a moratoriur,i ordinance . The hearing notice was �o have been published on November 4 , 1981, but the Sun Newspapers left it out. Their courier picked it up on Friday, October 30, 1981, but their office says they never received it. The notice has been properly posted and on Wednesday, October 28, 19III it was mailed to all property owners of record. As of today, I have received six calls and one letter. Some callers were merely curious. At least one was very irate and said the island was organizing to secede. I do expect the hearing to be well attended. The ordinance as drafted is for a complete development moratorium with a duration of six months. Per state statute, the initial duration could be as much as one year. If necessary, the moratorium can later be extended for a total period not to exceed 2� years. I have prepared a master map with ownership patterns indentified. ' The three Iargest owners are the State (Vets Camp) , Hennepin Park , Reserve (3 disconnected parcels) and Erickson` s (private) . There are a total of 66 �separate landown�rs on Big Island, and one owner of Deering Island. Parcel size varies from about 10, 000 sq ft to the Park Reserve ' s 40+ acres. Most cabins and small-lot owner- � � ship patterns are a1-ong the west side at Recreation Point and the southeast side between Crown Point and the Vets Camp. Facts and issues to be investigated include: 1) existing lot sizes and development potential 2) existing development (buildings, condition, use, etc. ) 3) public health (septic systems and wells - on-site manager has not yet visited the islands) 4) sanitation (garbage removal - we are aware of at least one illegal landfilling operation) 5) public safety (police - fire - medical service) 6) access during all seasons (especially for public safety personnel and equipment) 7) public land (including undeveloped public streets) 8) wetlands and wildlife habitat 9) governance and administrative difficulties (includes much work done w/o permits - inspection problems) 10) assessment policy and land values 11) public vs private development 12� future use of veteran' s camp property - ' �,. CITY WILL ENCOURAGE THE STATE DNR TO RESTRICT USE OR ALTERATION �� OF S90LSFELD WOODS. This is a unique nature area � I that should not be developed for active use , but ' should remain in its natural state . In addition , , access and traffic control is extremely limited from County Road 6 . " THE CITY WILL ENCOURAGE THE STATE DNR TO MAINTAIN AND I'�iPROVE THE t LUCE LINE TRAIL, AND TO MANAGE ITS USE CONSISTENT WITH THE RURAL � RESIDENTIAL AREA IT TRAVERSES. The City will encourage � extension of the trail , especia2ly on the eastern end , �� and interconnection with other city or regional trails to provide a coordinated linkage between a wide variety j� : of recreational facilities. The City will encourage i ' the DNR to limit motorized trail usage to west of McCuZley Road and the new trail access area . 8 . THE CITY WILL ENCOUR.AGE RETENTION AND CONTINUED OPERATION OF THE PRIVATE GOLF COURSES. These pzivate facilities provide major active recreation in the City and in addition � provide aesthetic open space and open vistas to the benefit of all adjacent property owners and the public alike . The City will discourage conversion of these facilities into non-recreational land use because of � the benefit of this recreational opportunity and because the City has lia►ited public services necessary � for accommodatinq any other use. � � CMP 8-12 � ' . Page 4 l pN � E JUNE, 1980 PRIVATE OPEN SPACE A significant amount of the recreation-open space in Orono is that controlled by private golf and country clubs. Large acreages are are owned by the Wayzata Country Club , Woodhill Country Club, and Lakeview Golf Course . While technically private , these areas provide open space benefits to all nearby residents plus active recreational facilities for many Orono and lake area citizens . LAKE MINNETONKA ISLANDS Land on Big Island , Mahpiyata Island and Deerinq Island has been privately owned for years and has been used for a significant . number of seasonal cottages plus a few year-round homes . The City of Orono cannot provide cost effective public sezvices to these islands . Homes .have been Iost because of fire , vandalism rates are significant , sanitation and garbage problems exist , and transportation problems are difficult . Therefore , it has long been the policy of the City to encourage eventual public ownership of the islands as recreational resources for general lake users . The City continues to encourage control by the Hennepin County � Park Reserve as the most appropriate aqency for this purpose . � The City understands that this conversion is a necessarily slow process . The City does not intend to encourage condemnation or � active acquisition programs . The City does encourage the Park � Reserve to acquire any and all. island property as it becomes � available . For the past several years I have owned several continguous parcels of property located on the southeast side of Big Island. This land was originally subdivided into fifteen individual lots and was approved by the City of Orono. Approximately two years ago I decided to sell one building lot on this property and to retain the balance on which I intended to build my personal residence. It was, under the then zoning conditions, necessary to combine several lots into one, and thoubh I did not particularly like it, I agreed to it. At that same time I was interested in saving enough property so that there would be no question about my ability to build on that portion of the land which I retained. These were clearly my stated intentions when I dealt with the village officials at that ti�e. Thereafter, in preparation to build, I obtained a permit from the City of Orono to dig a residential well on my remaining �-�' portion of the property. Likewise, I had electricity installed on the � site. I have now applied for a building permit a�d fully expect and intend to have that permit granted and to proceed to build a dwelling house upon the subject property. The first purpose of this letCer to you is to state to you my objections to any zoning changes which would require r�ore than two acres per building site on Big Island. If it is your intention to make a park of Big Island, you should condemn the existing buildings and pay for them. Zf you do not intend to make a park of Big Island, you should have a realistic approach to the zoning thereof. I can conceive of ao environmental consideration which would dictate that lots have more than two acres per site. My second purpose for writing this letter to you is to put the City of Orono on notice that if any zoning changes are to be made it is expected that my plan will be grandfathered into the new regulations, allowing me to build my house. Loren Butterfield Mr. Butterfield was present to review his application. Mayor Van Nest moved, Butler seconded, to approve the conditional use permit request of Loren Butterfield, 3925 Watertown Road, per the Planning Commission recommendations of October 19 , 1981 , subject to the condition that Building B be rebuilt to 98 ' X 24 ' . Motion, Ayes (4) - Nays (0 ) . Jeanne Mabusth, Zoning Administrator, reviewed with RECONSIDER MOTION the City Council the request of William Sexton, 1495 Greentrees Road 1495 Greentrees Road, for a reconsideration of a William Sexton previous Council motion concerning the caretaker ' s house at the above location. Mr. Sexton was not present. Mayor Van Nest moved, Butler seconded, to table the request of William Sexton, 1495 Greentrees Road, for a determination of the caretaker ' s house being lived in at present and what hardship exists that necessitates a delay of removal of the house until May, 1982. Staff to notify Mr. Sexton that the City Council does not look favorably on extending the date of removal of the house and also the City Council does not look favorably on the certificate of occupancy being issued for the new house while the caretaker ' s house is still there. Motion, Ayes (4) - Nays (0) . John Gerhardson, Public Works Coordinator, presented TRAFFIC SIGNAL the City Council with a memo concerning the traffic #12 & Old Crystal Bay signal being installed at Highway #12 and the Old Crystal Bay Road dated November 4 , 1981, which states : The construction of the turn-lanes, installation of storm sewer, final grading on slopes and in ditches and temporary striping has been completed. There will be seeding done and possibly some sodding, if possible this fall. Final paving will be done in early summer, 1982. The latest report has indicated that the traffic signal may be installed and working as early as January, 1982 , weather permitting. REGULAR MEETING OF THE ORONO COUNCIL, NOVEMBER 9, 1981 Page 11 Mayor Van Nest discussed a bill that is pending MAYOR' S REPORT before the State Legislature. The bill involves education, non-public schools. The two points he brought out in the billwere, (1) To require all non-public schools to report to the public school superintendent in the district which that non-public school is located a series of things; Names, addresses of both students and teachers. The complete curriculum and all sorts of important information. (2) That all non-public schools must hire only Minnesota licensed teachers . The real problem with this law is there is no method in the proposed law of excluding any non-public schools from this bill that are accredited with an accepted .non-public school certifying agency. It was felt that the laws intent was to attack the families that are removing their children from the public school system and educating them at home. Also, an attempt to attack some Christian schools that are removing them from the public school systems and teaching in facilities without adequate personnel and curriculum. Mayor Van Nest move�,Butler seconded, to authorize the City to draft a letter expressing our disagreement + with a law that would require these regulations to schools that are accredited by acceptable non-public school certifying agencies. Motion, Ayes (4) -Nays (0) � Mayor Van Nest began the discussion concerning ADMINISTRATIVE POLICY r� clarifications for the personnel polic_y for the City of Orono. Councilmember Butler stated that she had put together "some words" for consideration of the City Council . But�er felt that the words "or volunteer work" should be included in Section LIII Employment of Related Persons , page 24 . Mayor VanNest agreed except that "except by variance of the City Counci�" be added for the reason that a related person could have a very specialized talent and could be of value to the City. Mayor Van Nest stated that he is not as concerned about re�ated emp�oyees as he is of the Council ' s involvement but that staff is concerned about any related person, that everybody should be included. Butler stated that the original policy was designed for employees but that it should also apply to the City Counci� . In places where it is stated "employees" it should also include appointed and elected personnel. Mayor Van Nest stated that that could be handled by a definition section at the be- ginning of the document. (Continued) REGULAR MEETING OF THE ORONO COUNCIL, NOVEMBER 9, 1981 Page 12 Other areas mentioned for review included classifi- PERSONNEL POLICY cations and positions , retirement age, maternity leave, (�ontinued) sick leave for intoxication, jury duty, and physical examinations . Councilmember Frahm discussed Section XII Disciplinary Actions , page 7 , stating that he felt that the wording should be different. That the City Council should not get involved in implementation of disciplinary action but to just set guidelines. It was determined that the present policy is out-dated and should be redone, but that the present policy should be in effect and enforced until a new policy is adopted. Attorney Malkerson was instructed to look into policies of other cities and draft a new policy for review. Mayor Van Nest moved, Frahm seconded, to strengthen the language in the existing personnel policy to include a ' nepotism clause to preclude and include all employees paid or not paid, to exclude any relative of any employee or councilmember working on a paid basis or volunteer basis for the City to be enforced, with the excep�ions to be made by the City Council and City Administrator, to be brought back to the City Council as an amendment by Resolution. Motion, Ayes (4) Nays (0) City Attorney Malkerson reviewed with the City MEDINA SEWER PROJECT Council a resolution and agreement from the City of Medina concerning the Medina-Morningside Sanitary Sewer Project stating that the City of Medina has omitted the Keller property from the project, per the request of the City of Orono. Mayor Van Nest moved, Butler seconded, to approve the agreement as submitted with the stipulation that the City of Orono would not be paying until it is approved by City Administrator Benson. Dr. Fiansen agreed with the City policies 1000 and offered any assistance in the future. He is going to draft a letter as to why you should not a.11ow dredging in wetlands and/or maintenance dredging. Tt was suggested that in the nex-� issue of the new�letter we explain our city policies of wetlands .
