Regular Meeting of the Orono Council , 7 : 00 P.M.
October 26, 1981
The Orono Council met on th� above 3ate with the
following members present : Mayor Van Nest,
Councilmembers Butler , Frahm, and Hurr . Also
present : City Planner Olson, City Administrator
Mabusth, City Attorney Malkerson, City Engineer
Cook, Planning Commission member Goetten, and
City Clerk Strom. Absent : City Administrator
Benson .
Butler moved, Mayor Van Nest seconded, to remove CONSENT AGENDA*
items 3 & 4 from �the Consent Agenda* . Motion,
Ayes (4) - Nays (0 ) .
Butler moved, Mayor Van Nest seconded, to
approve the Cansent Agenda*, subject to removing
items 3 & 4 , with all staff reports concerning
items reviewed at this meeting to be attached to
the original copy of these minutes on file in the
City Clerk ' s office . Motion, Ayes (4) - Nays (0 ) .

Mr. William Sando, Orono ' s representative to the WILLIAM SANDO
Metropolitan Council, was present to introduce Metropolitan Council
himself and to explain his duties at the Metropolian
Council .
Mr. Sando informed the City Council that he was
visiting all of the local governments that were in
his district to become acquainted with all of the
City Councils and explained that he was ready to
help them whenever necessary with matters that were
before the Metropolitan Council. Mr. Sando stated
that the MUSA/MSSR lir.e would defi�itely be pulled
backin all around the metro area. ihis will be
one result of the whole metro planning project; also
that SAC charges must be addressed.

No comments from the Park Commission. PARK COMMISSION
Alan Olson, City Planner, presented the City PROPOSED FENCING
Council with a memo concerning proposed fencing
standa.rds dated October 23 , 1�81.
Discussion included height of fences, the difference
between a wall and a fence, and a clarification of
opaque .
No comments from the Planning Commission. PLANNING COMMISSION
No comments from the Lake Minnetonka Conservation LMCD
District. �
Alan Olson, City Planner, informed the City Council COMPREHENSIVE PLAN ,
that the Comprehensive Plan would be completed soon.
Alan Olson, City Planner, reviewed with the City MTC - BUS 51-N
Council his memo concerning the MTC Bus Route 51-N
dated October 22 , 1981 .
Mr . J. L. L�ppla, 4040 Dahl Road, was present.
Mayor Van Nest suggested to Mr. Leppla that he
locate the other persons that use bus 51-N and
bring in a petition of other riders that are
opposing the rerouting of the bus.

Islands to be held November 9, 1981 at 7 : 00 P.M.

Mayor Van Nest moved, Butler seconded, to request
staff to draft a resolution to deny the application
for a variance of Alden Anderson, 1900 Shoreline
Drive, per the Planning C�mmission recommendations of
July 20 , 1981, setting forth the reasons: 1) lack
of demonstrated hardship; 2) no sanitary sewer avail-
able ; 3) insufficient area; 3) insufficient width.

Hassel, attorney representing Mr. Hartman, 2709

Mr. Hassel stated that he wished to be on record
opposing the variance of Mr. Pluhm' s for his client,
Mr. Hartman.
Butler moved, Mayor Van Nest seconded, that the
hardcover variance to Ordinance 34 . 202 be approved
for Michael Pluhm, 2710 Walter ' s Port Lane, based on
the hardships enumerated on page 2 of the Zoning
Administrator ' s memo dated October 23 , 1981; that the
remains of the boathouse constructed within the 0-75 '
lakeshore setback area shall be removeci before a
certificate of occupancy is .issued; such agreement
to be signed-off by Mr. Pluhm on a resolution stating
that if the subdivisian is created, that an open space
easement will be granted to the City preventing a
second residential structure being built on this lot,
excluding the location of the tennis court and driveway,
and in addition, wt-iether or not the subdivision is
approved, the drainage problem in the rear will be
improved, subject to review by staff and the City

of the Highwood sewer project.
Mayor Van Nest moved, Butler seconded, to adopt RESOLUTION #1332
Resolution #1332 , A Resolution Approving The Private Private Connections
Connections To The 81-1 , Highwood Sanitary Sewer Project.
Motion, Ayes (4 ) - Nays (0) .
Glenn Cook, City Engineer , reported to the City TRAFFIC SIGNAL
Council that the traffic signal installation at #12 & Old Crystal Bay
#12 and the Old Crystal Bay Road will be completed
in January 1982 . -
Mayor Van Nest informed the City Council that the CABLE TV
status of the Cable TV will be discussed at the
Mayor ' s meeting to be held December 3 , 1981.

On �epteriber 22 , 1981 , the �rono City Cc�u:icil officia?ly ::,enied
Medina ' s request to tra��sfer two sew�r units From the M�dina-
Morningside area to the Fred Keller, Jr, propertY. This decision
was based upo;� the original intt�n�. of the sewer service agreem�r:t
cvhich is to serve the .�ledina--Morningside subdivision on�y , which
is �he only intended service ar��a in Medir.a. Servicing anct2-ier
subdivisien wou].d only eventually reduc2 thp nunber ��� sewer units
�.hat the City of Oror:a k�ould want for its property awners that now
have sewer �vaiyabl� , t�ut car.not connect b.�cause of hydraulic probiems .
If the M�dina-Morninqsic?e area does not eventually utiliza all �f �ts
statnd required 32 sPwer ur:its , then it would be appropriate to
redesignate these to our areas that t�,av` had munici�al. sewer a���.3il�b'e
�or thirteen years or lor.ger . •
I did discuss this with To3d Heglund in S�ptember , or: the teleK�none ,
when we were discussing Cable T`1 and other matters .
