Ingbretson 3600 Livingston Ave Wayzata, MN 55391 RE: City Code Violation at 3600 Livingston Avenue Property Identification Number: 17-117-23-34-0026 City staff received a complaint about weeds on the southeast corner of 3600 Livingston Avenue, which is in violation of City Code Section 58-1(b). � This letter will serve as your notice that the property must be brought into compliance before Mondav, September 17, 2012 in order to avoid legal action by the City. In order to bring the property into compliance the weeds must be trimmed or mowed to six (6) inches in length. Please be advised, if you fail to correct the violation prior to the deadline, the City will correct the violation and the costs to do so will be assessed against the property [Cite: City Code 58-1(c)J. Maintenance of private property. (a) It is the duty of the owner of every vacant property and the owner and occupant of every occupied property to maintain the property in a neat, clean and presentable manner free of any junk, debris, refuse, litter, dead trees, or noxious weeds, and to remove all other public health or safety hazards from the property. (b) The owner or occupant of every lot or parcel shall regularly cut or otherwise maintain all grass and weeds on the property at a height of not more than six inches, except this provision shall not apply to the following: (1) Publicly owned parks, trails or nature areas. (2) Property actively being farmed or used for agricultural purposes in conformance with chapter 78. (3) Residential properties in excess of one acre gross lot size when located in the RR-1A, RR-1B, LR-1A and RS rural residential zoning districts, provided that such properties or portions of properties shall be maintained in conformance with this subsection upon notice from the city that lack of such maintenance has caused complaints from abutting property owners and is thereby creating a public nuisance. (4) Wetlands vegetation as defined in chapter 78. (5) Grass, weeds or underbrush on any slope in excess of 100 percent(45 degrees). Since that time, the City has sent numerous letters in attempts to required the owner to keep the grass mowed, remove unlicensed inoperable vehicles, and to eliminate the exterior storage of building materials and a variery of other items in the yard. The last letter was sent on Apri123, 1996 and required the properry to be cleaned up by May 13, 1996. The property's renter, Donald Shaw, called and asked for two different extensions past that date. The extensions have expired and there has been no improvement. The City's objectives are to: 1. Require the owner to clean up the properry. 2. Remove the exterior storage and unlicensed inoperable vehicles. 3. Maintain the property in a neat, clean and presentable manner. 4. Assess a fine. Since the first notice was sent, the property condition has not improved and, in fact, it seems to have gotten worse. There is now an unlicensed, inoperable vehicle in the driveway also. The City's next step in this matter is to issue a citation and, unfortunately, the property owner is the one that gets cited and is required to appear in court.
