Conditions exist on the indicated property which constitute a violation of
the following section(s) of the Orono Zoning Ordinance:
XX SEC. 9.50. JUNK CARS, FURNITURE, HOOSEHOLD FURNISHINGS AND APPLIANCES
STOR$D ON PUBLIC OR PRIVATE PROPERTY. It is unlawful to park or store
any unlicensed, unregistered or inoperable motor vehicle lacking
essential parts, household furnishings or appliances, or parts or
components thereof, on any property, public or private, unless housed
within a lawfully erected building. Any violation of this Section is
declared to be a nuisance and upon seven days written notice to the
owner, as shown by the records in the office of the County Auditor, of
private premises on which such material is found, the City may remove
the same and certify the cost of such removal as any other special
assessment. For the purpose of this Section, an inoper�ble motor
vehicle shall be defined as lacking, including but not limited to,
parts essential to operation, such parts being wheels, tires, motor,
drive train, battery, or having two or mare flat tires, or having the
interior, including the driver's position, used for storage in such a
manner that no person can operate the vehicle.
SEC. 9.55. MAINTENANCE OF PRIVATE PROPERTY•
Subd. 1. It is the duty of the owner of every vacant property and the
owner and occupant of every occupied property to maintain same in a
neat, clean and presentable manner free of any junk, debris, refuse,
litter, dead trees, or noxious weeds, and to remove al 1 other public
health or safety hazards therefrom.
Subd. 2. Grass and Weeds. The owner or occupant of every Iot or
parcel shall regularly cut or otherwise maintain al 1 grass and weeds
thereon at a height of not more than six (6) inches, except this
provision shall not apply to the following:

City Staff has observed a fence constructed at the above address which violates City Code Section
78-1405(7)a. The 6-foot privacy fence is constructed within the side-street yard. Your property is
located within the LR-1 C zoning district where a 15-foot setback is required from a side street. Fences
, constructed within the required yard may not exceed 42" in height.
_ This letter will serve as your notice that the property must be brought into compliance by
� July 1, 2010 in order to avoid legal action by the City. In order to bring your property into
compliance the fence must be either removed from the property ar modified to meet the required side
street yard setback and/or the height limitations by July 1, 2010.
Please be advised, if you fail to correct the violations this matter will be sent to the City Attorney for

Sec. 78-1405 Nonencroachments.
The foilowing shall not be considered to be encroachments on yard requirements:
(7) Fences erected in all zoning districts are considered as a nonencroachment when they conform
to the following standards:
a. Non/akeshore lots.
1. Fences and walls within a required front yard or side street yard shall not exceed
a height of 42 inches above original grade.
2. Fences and walls within a required rear or side yard shall not exceed a height of
six feet above original grade.

Location
Fences are permitted up to a property line. The fence owner is responsible for locating property
lines before construction of any fence.
Height
Height limitations apply to fences located within required yards:
• No fence within the required front street vard may exceed 42 inches in height. The required
front street yard setbacks are:
0 30 feet in the R-1 B and LR-1 C districts
0 35 feet in the R-1 A and LR-1 B districts
0 50 feet in the LR-1A and RR-1B districts
0 100 feet in the RR-1A district
Exception: The top rail of a three-rail, split rail fence may be up to 48 inches high.
• No fence within a required side vard may exceed six feet in height. The required side yard
setbacks are:
0 10 feet in the R-1 A, R-16, LR-1 B and LR-1 C districts
0 30 feet in the LR-1A and RR-1 B districts
0 50 feet in the RR-1A district -
• No fence within the required rear vard may exceed six feet in height. The required rear yard
setbacks are:
0 30 feet in the R-1 B, LR-1 B and LR-1 C districts

• On a corner lot no fence may exceed 36 inches in height within the siqht trianqle. The sight
triangle is defined as follows: Beginning at the intersection of the projected curblines (or
edge of pavement if no curb) of two intersecting streets; thence 30 feet along one curbline;
thence diagonally to a point 30 feet from the point of beginning on the other curbline; thence
to the point of beginning.
To determine the zoning of your property check the zoning map under Maps — City of the City's web
page or contact the Planning and Zoning Department.
The zoning code defines yards in a way that may be different from your definition. If you wish, the
Planning and Zoning Department will prepare a drawing of your property indicating maximum fence �
heights.
Yards are measured from the property line. The street property line is not the curb or edge of the
road surface. The property owner is responsible for locating this property line.
Fence height is measured from existing ground level to the top of the fence panel or fabric.
Materials and Maintenance
Fences must be installed with the finished side facing neighboring properties or the street. The term
"finished side" means that side having no structural supports
The fence owner must maintain it in a condition of reasonable repair and appearance and not allow
it to become or remain in disrepair or in a dangerous condition.
Fire Hydrant Access
No fence may obstruct free access to a fire hydrant.
Swimming Pool Fences
The City does not require fences around swimming pools.
Permits
A building permit is required for a fence if it is over six feet in height as measured from the ground
to the top of the fence panel or fabric. Permits are not required for fences less than six feet in height
but they still must comply with the height and location restrictions. For information on obtaining a

RE: City Code Violation at 3596 Livingston Avenue

City staff received a complaint about weeds on the southwest corner of 3596 Livingston
. Avenue, which is in violation of City Code Section 58-1(b).
• This letter will serve as your notice that the property must be brought into compliance
� before Mondav, September 17, 2012 in order to avoid legal action by the City. In order to
bring the property into compliance the weeds must be trimmed or mowed to six (6) inches in
length.
Please be advised, if you fail to correct the violation prior to the deadline, the City will correct the
violation and the costs to do so will be assessed against the property [Cite: City Code 58-1(c)].
Those costs will be certified to the County Auditor and will be collected in the same manner as
special assessments against the property.

Sec. 58-1. Maintenance of private praperty.
(a) It is the duty of the owner of every vacant property and the owner and occupant of every occupied
property to maintain the property in a neat, clean and presentable manner free of any junk, debris, refuse,
litter, dead trees, or noxious weeds, and to remove all other public health or safety hazards from the
property.
(b) The owner or occupant of every lot or parcel shall regularly cut or othen�vise maintain all grass and weeds
on the property at a height of not more than six inches, except this provision shall not apply to the
following:
(1) Pubticly owned parks, trails or nature areas.
(2) Property actively being farmed or used for agricultural purposes in conformance with chapter 78.
(3) Residential properties in excess of one acre gross lot size when located in the RR-1A, RR-1 B, LR-1A
and RS rural residential zoning districts, provided that such properties or portions of properties shall
be maintained in conformance with this subsection upon notice from the city that lack of such
maintenance has caused complaints from abutting property owners and is thereby creating a public
nuisance.
(4) Wetlands vegetation as defined in chapter 78.
(5) Grass, weeds or underbrush on any slope in excess of 100 percent(45 degrees).
(c) Any violation of this section is declared to be a nuisance and a public safety and welfare hazard, and
upon seven days' written notice to the owner, as shown by the records of the office of the county auditor,
of private premises on which such material is found or any conditions in violation of this code section
exist, the city may remove such matter or correct any conditions in violation, and certify the cost of such
removals or corrections as any other special assessment.
