August 24 , 1981 The Orono Council met on the above date with the following members present: Mayor Van Nest, Councilmembers Hurr and Paurus . Councilmember Butler absent. Also present : City Planner Ulson, City Attorney Malkerson, City Engineer Cook, Planning Commission members Frahm, Goetten, Jabbour , and Rovegno, Park Commission Chairman Tomlinson, and City Clerk Strom. Absent : City Administrator Benson and Zoning Administrator Mabusth. Hurr moved, Paurus seconded, that items 2 , 3, 9, 11, CONSENT AGENDA* & 39 be removed from the Consent Agenda. Motion, Aye s (3) - Nays (0 ) . Paurus moved, Hurr. seconded, to approve the Consent Agenda* , subject to removing items 2 , 3 , 9 , 11, & 39, with all staff reports concerning items reviewed at this meeting to be attached to the original copy of these minutes on file in the City Clerk ' s office . July 27 , 1981 Motion, Ayes (3) - Nays (0 ) . :iurr moved, Paurus seconded, to approve the Minutes MINUTES of the Regular Meeting of August 10 , 1981, as amended. August 10 , 1981 Motion, Ayes (3) - Nays (0 ) . Mr . Steve Pauly, Chaska Marine , was present to discuss CHASKA MARINE with the City Council his company ' s purchase of the North Star Marina property. He stated that he has received a copy of Resolution #1286 (North Star Marina' s 1981 License) and has met with Jeanne Mabusth several times to go over the resolution and conditions of the license . Mr . Pauly stated that Chaska Marina has no problem with the conditions of that resolution and that all conditions will be met. Chaska Marine intends to operate the marina primarily for boat servicing, but that there will also be slip rental and new boat sales. Mr. Pauly discussed some of the changes proposed for the property. Most of the boats will be moved down to Shakopee for winter storage with on-premise winter storage the same as in past years , which will probably not be as many as stated in the resolution. Chaska Marine will not be looking for dry-stack storage . They would like to fence the eastern edge along the Permatop property, but probably not until next season. (Continued) � REGULAR MEETING OF THE ORONO COUNCIL, AUGUST 24 , 1981 Page 2 Mr. Pauly informed the City Council that the old CHASKA MARINE house used as the Permatop building will be removed (CUnt?nu�d) by the owner, Mr . Kempf, by October 1, 1981 according to the pur.chase agreement . The existing baat pumpout station will also be relocated to the service dock. Mayor Van Nest: I want you to clearly understand �he philosophy of this City. The Mayor explained the history of the B-2 zoning regarding marina businesses stating that th�y now include boat sales, rental slips, etc . whereas the zone was created primarily for boat rental and servicing businesses . May�r Van Nest stated that the rental of slips on the surface of the public waters are �onsidered to be legal non-conforming uses in -the B-2 zone and that they are not a permitte� nor a conditional use . Mr . Pauly: You 've said nothing that surprises me and I hope that we don 't surprise you. Mr . Pauly also stated that the present North Star Marina owners will not have any interest whatsoever in the Chaska Marine operation. Concerning the drainage problem, as stated in a letter from Sandra Ramberg, 3332 North Shore Drive , dated August 18 , 1981, pertaining to the retaining wall on the west side of the property, Mr . Pauly stated that h` met with her on Saturday afternoon and saw th� problem as state�, Today we started digginq out the old retaining wall and are installing a new one . Mrs . Ramberg stated that she was satisfied with the work done on the wall . Mayor Van Nest moved, Hurr seconded, to request staff to draft a letter to Chaska Marine requesting Mr. Pauly to make f�rmal application for the transfer of the 1981 commercial dock license from North Star Marina, and to approve a 60-day temporary license to take over the operation of the North Star Marina according to the full terms and conditions of the 1981 license , per Resolution #1286 . Motian, Ayes (3) - Nays (0) . Mayo.r Van Nest informed Mr. Pauly that upon receipt of the 1981 commercial dock license applicativn, the application will be reviewed by the Marina Committee befcre being sent ta the City Couricil for approval. Mayor Van Nest also informed Mr. Pauly that no dock wi11 be allowed across North Shore Drive on �rystal Bay. John Gerhardson, Public Works Coordinator, had prepare� a memo and diagrams for parking lots at the Dayton property. � The City Council xequested Mr. Gerhardsan to cneck- out the 75 ' lakeshore setback for a parking lot and the possibiiity of a mowed area for parking with less expendit�are . Mayor Van Nest requested that John Gernardson be present at the ne�t Council meeting to discuss the property, Councilmember Paurus reported that the Lak� Minnetonka Lb7CD REPORT Conservation District �oard meeting will be held August 26 , 1981 at 8 : 00 P.M. to draft a r�solution opposing the landfill site at Minnetrista. No comments from the Pl.annzng Commission representative PLANNING C0�4MISSION Tom Frahm. The fol.lowing letter was received from the Metropolitan STJDY AREA #2* Council dated August 14 , 1981 : "The Metropolitan Council has received your letter of August 5 , 1981, with attached Resolution #1298 relating to "Study Area #2 . " The Council will review this matter and respond as soon as possibZe .
