July 27 , 1981 The Orono Council met on the above date with the following members present: Mayor Van Nes�, Councilmembers Butler, Hurr , and Paurus. Absent: Councilmember Hannah. Also present: City Planner Olson, Zoning Administrator Mabusth, City Attorney Malkerson, City Engineer Cook, Public Works Coordinator Gerhardson, Planning Commission members Goetten, Jabbour , and Rovegno, Deputy Clerk Woytcke, and City Clerk Strom. City Administrator Benson arrived at 8 :20 P.M. Mayor Van Nest opened the public information meeting CASCO CIRCLE RINK at 7 : 10 P.M. Approximately fifteen Casco Circle residents were present. Mayor Van N�st informed the public that the skating rink would have a berm 12 inches high, no lighting, no parking, and no tree removal . The area would be left in its natural state and the riiik would be more convenient for the children of the area. The majority of persons present preferred not to have a rink in that area due to the fact that the City maintains a rink approximately one and three-quarters of a mile away on Casco Point Road. The residents also felt that a rink would disturb the natural state of the land and that it could generate more uses, such as motorized traffic or snowmobiles to the area. One resident, Mr . Jewett, was in favor of the rink, thought it was a good idea and wished more people were in favor of it. If the rink were low keyed, many people would not know its location. Mayor Van Nest closed the informational meeting at 7 : 52 P .M. Paurus moved, Butler seconded, to reconsider the original motion that approved a skating rink at the Casco Circle Park . Motion, Ayes (4) - Nays (0) . Paurus moved, Butler seconded, that the Park Commission take a total look at the Casco Circle Park and recommend uses of the land, not only for a skating rink, but other uses that would be advantageous to the benefit of every- body concerned with the natural state of the property. Motion, Ayes (4) - Nays (0 ) . Councilmember Paurus requested that the Chief of Police checkout the complaint of cars parking at the Casco Circle Fark. Chief of Police Mel Kilbo will be present at the CHIEF OF POLICE REPORT next Council meeting for his oral report on police activities. ..� • . Toni Berglund, Orono Community Education, ORONO COMMUNITY ED, was present to discuss the proposed Community Toni Berglund Education Budget for 1981-82 . Ms. Berglund explained the different funds , fees, classes, and teachers salaries . � Mayor Van Nest requested Ms. Berglund to contact other school districts for their community education budgets for comparison. Butler moved, Hurr seconded, to approve the CONSENT AGENDA* Consent Agenda* , subject to removing item #27 , with all staff reports concerning items reviewed at this meeting to be attached to the original copy of these minutes on file in the City Clerk ' s office . Motion, Ayes (4 ) - Nays (0) . No comments from the Park Commission. PARK COMI�IISSION Councilmember Paurus informed the City Council LMCD REPORT that there will be a boat ride on Lake Minnetonka on the Lady of the Lake August 8 , 1981. No comments from the Planning Commission. PLANNING COMMISSION Mr. George Rovegno, representative to Council PLANNING COMMISSION from the Planning Commission, arrived at 7 : 30 P.M. REPRESENTATIVE Alan Olson, City Planner , reviewed with the City COMPREHENSIVE PLAN Council a resolution and letter to Charles Weaver, Metropolitan Council , concerning Orono ' s Compre- hensive Plan Review, dated July 27, 1981. Paurus moved, Mayor Van Nest seconded, to adopt RESOLUTION #1298 Resolution #1298 , A Resolution Requestinc� Sewer Study Area �2 Exceptional Case Consideration By The Metropolitan Council For Orono ' s Sewer Study Area #2 , as amended. Raiche �ppeared at the Cour.cil n��eting �yer his letter dated ,7uly lb , 1981 , to request realignment of the tax par_cels consistent w.ith his Torrenv Title . H� st�.ted that the tax parcel discr�pancy had clouded his title . He refused to believe tha-� the City haci any claim on the parking Iot/alley. The Council stated that if Raiche could get agreements in writing from Union Oi� and/or Ulrich, that the City would assist the parties in corr�cting the tax c�escription� accordinqly. I3ut, the City w�ould continue to exert all legal effarts to preserve pub.lic ownership and effect clear title to the C.iti� alley. Raiche refused to deal ��rith tk�e City. Ne said h� cculd not provide a quit claim d�ecl to the alley portion because he "is not tl�e own�r - hr-� �zas sold ar.d closed and now has a worthless CD until he gets this cleared up" . He said the new owners were not interested in deeding anything to the Ci.ty, even if such a compromise might avoid litigation. Mayor Vari Nest statecl that the City has a recarded deed to the alley. We have ownership which we will press. We would prefer to work with you to resolve the matter in as ctuick and amicable way as possible . If you were to provide a quit cl.aim deed to the City for the alley, you could probably take a tax deductian for the value . If you do r.ot wish to wo.rk with us, we will have to get a court order_ to establish our rights. The Mayor asked Raiche to h�.ve his attorney respond in writing to the City Attorney ' s letters, Raiche then left saying al.l that he wanted to do was correct the tax statements, that he had warked on this for six months and was getting r.owhere . He was not interested in c]_earing up ownership of the alley, "that is the Ci�y ' s problem" , all he was concerned with was who was paying taxes on what. Jeanne Mabusth, Zoning Administrator, reviewed with VARIANCE the City Council the resolution of denial for an 1620 Shadywood Road after-the-fact variance for John Ericson, 1620 #622 Shadywood Road. John Ericson John Ericson was present. Paurus moved, Mayor Van Nest seconded, that the non- conforming structure of John Ericson, 1620 Shadywood Road, be moved back to the 75 ' lakeshore setback by February 15, 1982 . Motion, Ayes (4 ) - Nays (0) . Paurus moved, Butler seconded, to adopt Resolution RESOLUTION #1300 #1300 , A Resolution Denying An "After-The-Fact" 1620 Shadywood Road Variance Application Of John C. Ericson For Major John Ericson Structural Repair To A Non-Conforming Structure On Property Located At 1620 Shadywood Road, as amended. Motion, Ayes (4 ) - Nays (0) . Jeanne Mabusth, Zoning Administrator, read the following letter to the City Council signed by John C. Ericson, dated July 27 , 1981 : "As a property owner in the Vilage that has had my request for a variance denied, I request that you have the pagoda located on the Hennepin County Park praperty removed. It is also my request that any similar type of structure within the city limits be inspected and should they be found to be in disrepair as interpreted by the present zoning laws , that said property own�rs be advised to relocate or remove these structures. " John C. Ericson Jeanne Mabusth, Zoning Administrator, reviewed CONDITIONAL USE PERMIT with the City Council the after-the-fact conditional 1330 Sixth Avenue Nortt use permit request of Roger Veon, 1330 Sixth #625 Avenue North. Roger Veon Mr . Veon was present to explain his application. Butler moved, Mayor Van Nest seconded, to request staff to draft a resolution for the next Council meeting approvinq the after-the-fact conditional use permit request of Roger Veon, 1330 Sixth Avenue North, per the Planning Commission recommendations of June 15 , 1981 , and for Mr . Veon to sign-off on the resolution. Motion, Ayes (4 ) - Nays (0 ) . REGULAR MEETING OF THE ORONO COUNCIL, JULY 27, 1981 Page 5 Butler moved, Paurus seconded, to request staff to AMEND FEE SCHEDULE amend the fee schedule to include after-the-fact application penalties due to additional costs and to present to the City Council for their review. Motion, Ayes (4) - Nays (0 ) . An informational memo from Jeanne Mabusth, Zoning 3510 IVY PLACE Administrator, concerning the current status of Current Status 3510 Ivy Place was presented to the City Council. The City Council requested the Zoning Administrator to present a survey of the property at the next Council meeting. Glenn Cook, City Engineer, informed the City 1980-LS-1 & LS-2 Council that the 1980-LS-1 & LS-2 Sanitary Sewer Acceptance Project has been satisfactorily completed and is acceptable for hookup by the residents of the area. Mayor Van Nest moved, Butler seconded, to approve the 1980-LS-1 & LS-2 Sanitary Sewer Project per the City Engineer ' s recommendation and to request staff to prepare resolutions of acceptance for the next Council meeting. Motion, Ayes (4) - Nays (0 ) . Mayor Van Nest moved, Paurus seconded, to approve CHANGE ORDER #3 Change Order #3 , G & L Contracting, in the amount G & L Contracting of $745 . Motion, Ayes (4 ) - Nays (0 ) . Mayor Van Nest moved, Hurr seconded, to approve CHANGE ORDER #4 Change Order #4 , G & L Contracting, in the amount G & L Contracting of $902 . 75. Motion, Ayes (4) - Nays (0 ) . Mayor Van Nest informed the City Council that the PAINTER' S CREEK Minnehaha Creek Watershed Advisory Committee concerning the Painter ' s Creek Subwatershed will be held August 6 , 1981. Councilmember Butler discussed with the City Council CABLE TV REPORT the progress of the Cable TV Committee . Mayor Van Nest moved, Paurus seconded, to instruct the City Administrator to draft a letter to the Cable TV Committee, and the other three communities inv�lved, that the City of Orono would like to discuss with the Committee and participating cities our goals and commit- ments for Cable TV, and the possibility of imposing a one- year moratorium to allow sufficient time to evaluate and reaffirm our positions with the type of Cable TV service available and the management of this on-going commitment in future years . REGULAR MEETING OF THE ORONO COUNCIL, JULY 27, 1981 Page 6 Mayor Van Nest read the resolution to approve the WILLOW DRIVE RESOLUTION closure of Willow Drive between Brown Road South and Fox Street to through traffic and approving the installation of cul-de-sacs at three locations. Several residents were present opposing the closure of the road stating that they were concerned about the safety factor , more traffic, and the extra time for response for emergency vehicles. Mayor Van Nest explained the possibility of the County upgrading the road to Municipal State Aid road standards which would increase the traffic load considerably. Hurr moved, Butler seconded, not to approve the resolution for the closure of Willow Drive between Brown Road South and Fox Street to through traffic, as �resented. Motion, Ayes (3) - Nays (1) . Mayor Van Nest voted Nay stating that he felt that it was a mistake not to close the road. Mayor Van Nest moved, Butler seconded, to approve the SEWER AGREEMENT Sanitary Sewer Construction and Service Agreement, Long Lake/Medina/Orono City of Long Lake-City of Orono-City of Medina, as modified. Motion, Ayes (4 ) - Nays (0 ) . Mayor Van Nest moved, Butler seconded, to adopt RESOLUTION #1301 Resolution #1301, A Resolution Authorizing Lang, Special Prosecutor Pauly & Gregerson As Special Prosecutor For The City of Orono, as amended. Butler moved, Hurr seconded, to approve a public REVENUE SHARING FUNDS* hearing for the Federal Revenue Sharing Funds Public Hearing dates to be held Wednesday, August 26 , 1981 at 7 :00 P .td. and a budget hearing to be held Monday, September 14 , 1981 at 7 :00 P.M. The evidence of a sewage flow into the lake of Long Lake in Orono is being investigated by aur on-site disposal manager, Mr. Mike Gaffron ar_d the results of that investigation will be forwarded to you as soon as it has been completed. City staff investigated the manhole infil'-.ration problem noted by you, as manholes completely under water . The manholes as noted do become submerged in water due to a drastic grade change in the Long Lake ditch area down stream froTn the Orono area. It was discovered that the dirt banks in Long Lake had eroded, creating a three to four foot dam causing water to backup and flood out the existing manholes , which eventually created excess flow to the entire system. We have contacted ��our public works department and we will be working with them to resolve the problem. If I can assist you further in these matters, please feel free to call me . Lor� Lake residents living on the lake re— po:�ted large amounts of deter�ent like "seeds" floating across the northeast portion of Lor� Lake which is located in Crono. It has been suggested that this may be evidence of sewage flow into Long ;Lake. Councilmember Metz has also reported strikin� a long pipe with his boat motor which appears to originate from a home in Orono ar�ci reaches out into the lake. This has not been substantiated by ar�y other individuals. You may wish to look into this as I Imow you are concerned about water quality. Lusher : Thank you for your letter addressing excess infiltration into Orono ' s sanitary sewer system and the Metropolitan Waste Control Commission system. The City of Orono initiated an approved infiltration/inflow (I/I) analysis program in September, 1980 . The study, as planned, includes the following procedures : 1 . Review all previous data pertinent to planning and construction of existing sewer systems. 2 . Review existing sanitary sewer system records and plans to determine sewers under lake levels affected by groundwater . 3 . Review problem areas such as backups, lift station problems, and sources of I/I . 4 . Obtain lift station flow data. 5. Locate meters and weirs to monitor and measure flows. 6 . Obtain treatment and transmission cost and flow data from the MWCC. 7. Monitor lift station and transmission flows during spring runoff and rainfall occurance . 8 . Analyze all data obtained during the study from each sewer district for the existence or non-existence of excessive I/Z . Complete reports and submit to the MWCC and MPCA for their review and approval by October 15 , 1981. George, this process has been approved for funding by the MWCC and MPCA and hopefully will be completed as scheduled to identify areas of e:�cess infiltration. Our timetable was set back somewhat by the extremely dry fall and winter which made it very difficult to measure excessive flows. As soon as our City engineers have completed their study, reports will be submitted to you for your review and approval. Since the City of Orono is a qualifying community, allowing participation in the grant process, our contract with the Mt�CC will be adhered to to assure phase #1 is completed so that we can enter into the corrective measure phase and actually eliminate the documented infiltration as soon as possible . On another matter, I have responded to the City of Long Lake ' s letter, which was copied to you on July 14 , 1981, stating their concerns with sanitary sewer manholes located upstream from the City of Long Lake in the City of Orono. Upon investigation, it was found that dirt banks had eroded downstream in the City of Long Lake creating a three to four foot dam, which caused a backup of surface water to enter into the manholes in question. 69e are working with the City of Long Lake to correct this problem. �, i � If you have any further questions on these matter , please feel free � to call me at your convenience . While ti�e support your endeavors , it would appear to us there is another issue involved that has perhaps been overlooked. County Road 15 througn Orono, Minnetonka Beach, Spring Park, and Mound �:ould appear to be a logical access road to the proposed site north of Saint Bonifacius. The slowmoving truck traffic associated ��ith � land- fill would create co�siderable delays for the 15 ,000 cars per �ay that use County Road 15• ln addition , the character of the traffic created through the center of �linnesota 'a fourth largest lake area should , in ir_self , rule out the Saint 8onifacius site. if we can provide any further heip with tnis sicuation piease let us know.
