July 13 , 1981 The Orono Council met on the above date with the following members present: Acting Mayor Butler , Councilmembers Hannah, Hurr , and Paurus. Absent : Mayor Van Nest. Also present: City Planner Olson, City Attorney Malkerson, City Engineer Cook, Public Works Coordinator Gerhardson, Planning Commission member Jabbour, Zoning Administrator Mabusth, Park Commission meriber Tomlinson, and City Clerk Strom. Lee Tomlinson, Park Commission Chairman, was PARK COMMISSION REPORT present to discuss the status of City parks . Mr . Tomlinson reviewed with the City Council the SUMMIT PARK status of Summit Park stating that the Park Commission recommends to the City Council to install trash barrels and picnic tables on that site but not make a swimming beach at the present time . Paurus moved, Hurr seconded, to request staff recommendations for use and suggested appurtenances and costs for Summit Park. Motion, Ayes (4 ) - Nays (0 ) . . . � . Tomlinson informed the City Council that BEDERWOOD PARK Bederwood Park has been improved with the addition of 68 trees, playground equipment installed, the well is operational, and the baseball field is almost completed. Mr. Tomlinson also informed the City Council that BIKE SAFETY PATROL the bike safety patrol is active now. A grant had been provided by the State to provide equipment and salaries for the patrol. Refurbished bikes that had been confiscated by the Police Department are being used. No comments from the Lake Minnetonka Conservation LMC� REPORT District representative . No comments from the Planning Commission. PLANNING COMMISSION Gabriel Jabbour, representative from the Planning Commission to the City Council was present; no comments . Alan Olson, City Planner, reviewed with the City SEWER SERVICE Council the request of Paul Smith, 2477 Dunwoody 2477 Dunwoody Avenue Avenue , for sewer service . Paul Smith Mr. Paul Smith was not present. Paurus moved, Hannah seconded, to table the request for sewer service for Paul Smith, 2477 Dunwoody Avenue , and give serious consideration to documenting all of the facts of the situation. Should this property be served with sewer or should it be found unsuitable for occupancy because of building code problems? Motion, Ayes (4 ) - Nays (0 ) . Alan O1son, City Planner , informed the City Council COMPREHENSIVE PLAN that on June 25 , 1981 , the full Metropolitan Council approved Orono ' s Community Management Plan stating that "No plan modifications are required" and adopted Resolution No. 81-128 . (Information only) Hurr moved, Hannah seconded, to approve the COMPREHENSIVE PLAN* letter from Senator George S. Pillsbury George Pillsbury Letter concerning Orono ' s Comprehensive Plan dated June 22 , 1981 . Motion, Ayes (4 ) - Nays (0) . Mrs. LaDean McWilliams , 1130 Willow Drive , PUFiLIC COMMENTS questioned the City Council regarding the closure of Willow Drive item not being on the agenda for this evening 's meeting. Acting Mayor Butler informed her that in view of the importance of this matter, it would be proper to have a full Council consider the issue and to act on it at the next meeting. Acting Mayor Butler stated that until this morning, when Councilman Paurus was informed that his meeting out of town was cancelled, there would have been only three Council members present tonight. Another resident in the audience stated that she was upset over a letter identifying her as a signer on a petition to close Willow Drive , when, in fact, she had not signed ar�y petition. It was explained that the letter in question had been sent in error to all persons on the mailing list and not just the signers of the petition, due to the fact that the meeting date had been changed from July 13 to July 27, 1981, for action by Council on the Willow Drive closure . Councilmember Hurr requested sta.ff to mail a letter of apology to the persons who had receivcd the letter in error . Hurr moved, Hannah seconded, to adopt Resolution RESOLUTION #1289* #1289 , A Resolution Approving A Conditional Use 2160 Wayzata Boulevard Permit For Gary Luchsinger And William Wear For Bill Wear Restaurant A Restaurant Located In The Orono Shopping Center Building At 2160 Wayzata Boulevard. Paurus moved, Butler seconded, to give preliminary approval for the PRD, preliminary subdivision request of George Hussman for 3660 Shoreline Drive , per the Planning Commission recommendations of June 15, 1981, and subject to no variances being granted. Mr . & Mrs. David Myhre were present to discuss their SUBDIVISION subdivision for 2590 Casco Point Road. 2590 Casco Point Road #615 Paurus moved, Hannah seconded, to approve the preliminary subdivision request of David Myhre for 2590 Casco Point Road, per the Planning Conunission recommendations of June 15 , 1981. Jeanne Mabusth, Zoning Administrator, explained to VARIANCE the City Council that the request of John Ericson, 1620 Shadywood Road 1620 Shadywood Road, for a conditional use permit #622 should be changed to a request for a variance . John Ericson John Ericson was present to discuss his application. Paurus moved, Hurr seconded, to request staff to draft a resolution of denial per the Planning Commission recommendations dated June 15 , 1981 for John Ericson, 1620 Shadywood Road. Motion, ' Ayes (4) - Nays (0 ) . John �ricson stated: I, as a citizen, request that a letter be sent to Hennepin County informing them to remove their building at the park by Noerenberg . bridge . Councilmember Paurus requested staff to check out the complaint of John Ericson concerning the building belonging to the Hennepin County Park Reserve at Noerenberg bridge . Larson Paurus moved, Hurr seconded, to approve the after- the-fact conditional use permit for construction of a retaining wall on the lakeshore bank subject to the applicant submitting plans signed by a licensed engineer, and to postporie action on tre lakeshore improvements until the applicant submits plans noting the Planning Commission ' s concerns as follows : 1 . Decrease hardcovf.r within the 75 ' setback area 2 . Possible removal of the boathouse. 3 . Relocate dock so it meets LMCD ' s setback requirements . Motion, Ayes (4) - Nays (0 ) . Seward, 1140 North Arm Drive 1140 North Arm Drive , for a conditional use permit. #630 Darrell Seward Acting Mayor Butler read the following petition that was presented this evening: "We , the undersigned, object to the recent Planning Commission approval of a commercial business variance granted to the Leo Duehn properties. As surrounding property owners, we feel we are within our tax paying rights to request that this property comply with its residential environment and permanently be zoned accordingly. " Ten signatures. Discussion included the number of cars on the property, definition of a home occupation, and the type of business that Mr. Seward is planning. Acting Mayor Butler read the following report prepared by Thomas Jacobs, Building Official , dated July 10 , 1981 , regarding the kennel license : (Continued) REGULAR MEETING OF THE ORONO COUNCIL, JULY 13 , 1981 Page 7 An inspection conducted July 8 , 1981, at the above KENNEL LICENSE subject property for kennel license� revealed the Ms. Koltes following: (Continued) 1 . There were four dogs on the property. Two on the deck, one in the house , and one running at large . 2 . No one was at home . One of the conditions of previous kennel license was that dogs would be kept in the house when no one was home . 3 . Al1 four dogs have licenses, although on previous inspections, owner has told me that the fourth dog (white sheepdog mix) is just visiting. Previous license was for three dogs. 4 . The property is in one-half acre zoning district. The area of the subject property is 28 , 900 sq. ft. The property is owned by Jacci Segner and rented to Ms. Koltes. 5 . Also a plat map showing locations of residents on both petitions. Glenn Cook, City Engineer, reported to the City TRAFFIC SIGNAL Council on the progress of the traffic signal at #12 & Old Crystal Bay Highway #12 and the Old Crystal Bay Road stating that work will begin this week. Glenn Cook, City Engineer, reviewed with the City SAUR SEWER Council his letter regarding the Sauer property Highwod Sewer Project in the Highwood sewer area dated July 8 , 1981 , which states : "The placement of storm sewer on the Sauer property would require 40 feet of 24" CMP plus one catch basin as discussed. The estimated cost of material is $900 if the work is to be completed by the City. The estimated cost to include the work in the contract with the sewer construction is $2 , 500 . The above figures do not reflect any surface restoration after the pipe is placed. " (Continued) . , .� . The final settlement is much higher than originally estimated but was necessary to continue the construction project as scheduled. The total contractors bid to construct the semaphore was much higher than originally esti:nated by the Minnesota Department of Transportation, but I think, we all agree that if we are to realize completion of the semaphore for the 1981-1982 school year, we will all have to accommodate increased costs for this project. I, and the Orono City Council, wish to extend to the Orono School Board of Education, you and your staff our sincere appreciation for your cooperative spirit and willingness to assist us in this very worthy project. All of our residents within the School District will benefit when this project does become a reality.
