A recent house fire resulted in extensive property damage. The fire started in the kitchen and caused extensive smoke and water damage due to firefighting efforts. The house is full of trash and garbage causing unsanitary conditions. The city has attempted without success to have the owner repair or remove the hazardous condition of the property. Based on the findings in the attached report, staff recommends proceeding with a Hazardous Building Action. It is anticipa�ed that all remediation and legal expenses associated with this cause of action will be assessed against the property. ACTION REQUESTED: Motion to adopt the attached resolution ordering abatement of hazardous building at 3572 Livingston Avenue, Orono, MN. � o� � 0 0 '����a�.- � CITY of ORONO � � � � :���� � titi � G RESOIUTION OF THE CITY COUNCIL L`�kEsKo4� rvo. � � 6 7 RESOLUTION ORDERING ABATEMENT OF HAZARDOUS BUILDING WHEREAS,the Chief Building Official of the City of Orono has attempted without success to have the owner of certain property remedy the hazardous condition of the unoccupied residence due to fire situated on property at 3572 Livingston Avenue, Orono, Minnesota; and WHEREAS,the City Council has determined that the residence on the property constitutes a hazardous building and is a health hazard within the meaning of Minnesota Statutes § 463.15, Subd. 3; and NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Orono , Minnesota: 1. Pursuant to Minnesota Statutes § 463.16 et s�.,the City hereby adopts and approves the Demolition Order for Removal of Hazardous Building attached hereto as Exhibit"A". 2. The City of Orono finds that the condition of the property located at 3�72 Livingston Avenue, Orono, Minnesota, is a health and safety hazard and contains a hazardous building within the meaning of Minn. Stat. § 463.15, Subd. 3. 3. The City's le�al counsel, Campbell Knutson,P.A., 317 EaQandale Office Center, 1380 Corporate Center Curve, Eagan, Minnesota 55121, is directed to serve the Demolition Order and to proceed with enforcement in accordance with Minnesota Statutes � 4631� et se�c. The subject property contains a single family detached dwelling partially destroyed by fire. The inspections revealed that the house as presently situated on the property is unfit for human habitation and the property constitutes a health and safety hazard to the residents of the City of Orono. All personal property and fixtures shall be removed from the building within twenty (20) days from the date of service of this Order. If you fail to remedy the situation the City will seek permission from the District Court for the City to do so. The City will move the District Court for summary enforcement of this Order pursuant to Minnesota Statutes §463.19 unless you remedy the situation within said twenty(20) day period or unless 159022 � � � 606T an answer is filed within twenty(20) days of service of this Order upon you. On arrival I was unable to confirm all were out or enter the residence because of heavy smoke. Long Lake Fire arrived,searched the residence and extinguished the fire.No people were found inside but a dog and three cats had been killed in the fire. The fire apparently originated in the kitchen but Fire was unable to deteimine the exact cause of the fire pending an investigation.Homeowner is Mark Cuff and the house is currently being rented by Greg Ward.Ward was notified by phone and responded home. No one appeared on behalf of the property owners. Based upon the verified petition,testimony, evidence, and arguments presented, and a11 of the files,records, and proceedings,the Court makes the following: FINDINGS OF FACT l. The above-entitled matter came on before the Honorable Referee Mark Labine in the Hennepin County District Court Housing Court pursuant to the Notice of Motion and Motion of the City of Orono for relief regarding the property located at 3572 Livingston Avenue, Orono, Minnesota. 2. In an inspection on June 28, 2011, the City Building Official found that the home had numerous building code violations and structural deficiencies, including the determination that the building on the site is hazardous due to inadequate maintenance, dilapidation, physical damage and disrepair. The condition of the home is the result of a fire that started in the kitchen and went through the roof. The home sustained severe fire, smoke and water damage. _ 3. On August 12, 2011, the City of Orono issued an Order for Abatement of Hazardous Building and Property existing at 3572 Livingston Avenue, Orono, Minnesota. This Order for Abatement of Hazardous Building and Property was posted and published pursuant to Minn. Stat. § 463.17, subd. 2 (2008). 4. The named owners or interested parties of the property are as follows: Mark Cuff, 3572 Livingston Avenue, Orono,Minnesota 55391; _ and Mortgage Electronic Registration Systems, Inc. (MERS), 1901 East Voorhees Street, Suite C,Danville,Illinois 61834. 161480 ] 5. Since the owner, owner of record and lienholder of record have not complied with the City of Orono's Order, they seek an Order from this Court for enforcement thereof. CONCLUSIONS OF LAW l. Pursuant to Minn. Stat. § 463.19 this Court, upon the presentation of such evidence as it may require, has the authority to affirm or modify the Order for the Correction of Hazardous Conditions and Abatement of Public Nuisances and enter judgment accordingly, fixing a time after which the governing body may proceed with the enforcement of the Order. The Court Administrator shall cause a copy of the judgment to be mailed forthwith to persons upon whom the original Order was served. 2. Rule 602 of the Housing Court Rules for Hennepin County authorizes the Housing Court Referee to preside ever proceedings involving health, safety, h��asing, b��ilding and fir;, prevention or housing codes. ORDER 1. The motion of the City of Orono for Correction of Hazardous Conditions and the Abatement of Public Nuisances existing at 3572 Livingston Avenue, Orono, Minnesota, is hereby granted. 2. The City of Orono or its agents are authorized to enter the property to correct the condition of the property so it is no longer hazardous and complies with all applicable building codes and ordinances. This includes the removal of the house, all accessory structures, vehicles and miscellaneous debris located on the property. 3. The City may thereafter seek an assessment on the property of costs of the repairs, razing, correction or removal, including attorney's fees and costs in accordance with Minn. Stat. §§ 463.21 an 463.22. 4. The City of Orono shall make a good faith effort to have this Order served on the above name owners of the property. 5. This Order shall be binding on all owners and lienholders of record as well as their successors in interest, if any. 6. SERVICE OF ORDER: The Clerk of Court shall either give to the parties or mail to the parties by first class mail a copy of this Order. Contractor shall comply with all applicable laws, rules and regulations regarding the disposal of all demolition material,junk, refuse and debris from the Property. 5. Pavment. The Work including all labor, materials, and equipment needed to accomplish the same, shall be completed by the Contractor for the sum of Eight Thousand Eight Hundred Thirty and no/100ths Dollars ($8,830.00) (the "Contract Price")to be paid to the Contractor in one installment upon completion of the Work to the satisfaction of the City. The Contractor agrees to furnish the City with all Mechanics Lien Waivers and evidence of the proper disposal of all demolition material,junk, refuse and debris deemed necessary by the City, prior to full payment of the Contract Price. The Contract Price shall constitute the sole compensation payable to the Contractor for completion of the Work. 6. Storage and Protection. Contractor shall be responsible for the storage and protection of all equipment and materials to be supplied under the terms of this Agreement until the Work is complete and the City has accepted the Work. 7. Clean-up. Contractor shall maintain an orderly and clean work site, and shall daily remove and properly dispose of all waste, and debris resulting from performance under this Agreement. 1 161939 8. Permits and Licenses. The Contractor shall secure all permits and licenses necessary to the completion of the Work and shall comply with all federal, state, and local laws, ordinances and regulations in the performance of the Work. 9. Change Orders. In the event of changes in the scope of work as described by this Agreement, written"Change Orders"must be executed by both parties. The "Contract Price" shall be increased or decreased in the amount agreed upon in the Change Orders. Both parties hereby agree that the Contract Price shall neither be increased nor decreased, nor shall the Contractor be entitled to an increase in the "Contract Price" for work not agreed upon in writing by both parties. 10. Waiver of Liability. The Contractor understands and agrees that the Work is undertaken at the sole risk of the Contractor. The Contractor does expressly forever release the City from any claims, demands, injuries, damage actions or causes of action whatsoever, arising out of or connected with the Work. 11. Indemnification. Any and all claims that arise or may arise against the Contractor, its agents, subcontractors or employees, as a consequence of any act or omission on the part of the Contractor while engaged in the performance of the Work shall in no way be the obligation or responsibility of the City. The Contractor shall indemnify, hold harmless and defend the City, its commissioners, officers, and employees, against any and all liability, loss, cost, damages, expenses, claims or actions, including attorneys fees which the City, its commissioners, officers, or employees may hereinafter incur or be required to pay, on account of injury or death of any person(s) or damage to any property arising out of or by any reason of any act or omission of the Contractor, its agents, servants or employees in the execution, performance or failure to adequately perform its obligations under this Agreement, whatever the cause of such injury or damage. 12. Insurance. The Contractor agrees that in order to protect itself and the City under the indemnity provisions set forth above, it will at all times during the term of this Agreement, keep in force, at a minimum, policies of insurance as indicated herein. The Contractor shall not commence work until a Certificate of Insurance covering all of the insurance required by this paragraph is approved and a written Notice to Proceed is issued by an authorized representative of the City. The following insurance policies must be certified to the City for approval: a. The Contractor shall purchase and maintain a commercial general liability insurance policy (CGL) to insure its operations. The fire started in the kitchen and went through the roof. The entire house has extensive smoke and water damage. The property was left open to trespass and after due notification the city caused the building to be secured. The property is in forectosure and attempts to contact the mortgage company have been ignored. Based upon my June 28, 2011 inspection it is my recommendation that the city proceed with Hazardous Building Action to require the building to be repaired or removed. Under 1311.0206 Section 206 of the 2007 Minnesota State Building Code "Unsafe Buildings or Structures" it states (and I paraphrase) All buildings or structures regulated by these guidelines that are structurally unsafe or that are otherwise dangerous to human life are, for the purpose of this section, unsafe. Any use of buildings or structures constituting a hazard to safety, health or public welfare by reason of inadequate maintenance, dilapidation, obsolescence, fire hazard, disaster, damage or abandonment is, for the purpose of this section, an unsafe use. All unsafe buildings, structures or appendages are public nuisances and must be abated by repair, rehabilitation, demolition, or removal, according to Minnesota Statutes, sections 463.1 to 463.26. As the City of Orono Building Official, I submit that the house at 3572 Livingston Road be declared a public nuisance and be repaired or demolished, and the foundation filled in, as permanent relief of this neighborhood nuisance. I offer the following descriptions as support for the request to abate: 1) The house was damaged by fire. 2) The home is vacant, was left open to trespass and attempts to contact responsible parties have failed. 3) The fire started in the kitchen and went through the roof 4) The entire house has extensive smoke damage 5) The house has extensive water damage due to the firefighting efforts. 6) The entire house is full of trash and garbage causing unsanitary conditions.
