The Orono Council met on the above date with the following members oresent : Mayor VanNest, Councilmembers, Hannah, Paurus , and Hurr. Absent were Butler, and Dick Benson. Also present Public Works Coordinator Gerhardson , City Attorney Malkerson , City Enqineer Cook , City Planner Olson and Deputy Clerk Woytcke. At 7 : 05 P.M. Mayor Brad VanNest opened the PUBLIC HEARING public hearing on the North Shore Drive/ NORTH SHORE DRIVE/ Highwood Sewer Project. Mr. Glen Sauer was HIGHWOOD SEWER the only resident present at the time so it was left open until others were present. At 7 : 30 P.M. more people in the area showed up and the hearing was reopened. Mayor VanNest stated this was a sewer project that was requested by petition from the home- owners in the neighborhood and the City has done a feasibility study and the City is now discussing if the City should go ahead with the next step. Glen Cook, City Engineer then reported that • this project would provide for the construction of a sanitary sewer to serve the Highwood area near County Rd. �19 and #51 . The project would serve somewhere between 4 and 6 units and esti- mated cost to serve those units $49 , 030 . 00 . This project will require easements to allow construction. Alan did talk to some property owners and they are willing to provide easements . Their easements would drop the cost of the sewer project about $8 , 000 . 00 . Mayor Brad VanNest asked if there were any questions. Mr. Skip S�gar, 4064 North Shore Drive asked why these plots of land were , ignored when the sewer went in. Mayor VanNest stated he did not know wh�� he suspected it was the cost of getting there and there were people who petitioned to stay out of the project. This was the project of 1967 and the records of then are not to good �o they could not show him this was fact but it was believed that is why it did not go in at that time . Mr. Mertin Crooker representing his wife Mrs. Veronica Crooker, stated that he was • not approached regarding the sewer and all he heard was that it ended at the corner. VanNest said he just didn' t know why it did not aet in . REGULAR MEETING OF THE ORONO COUNCIL JUNE 8 , 1981 Paqe 2 . J Mr. William Saqar, 4064 North Shore Dr. NORTH SHORE DRIVE/ stated that he was the original person HIGHWOOD SEWER that went around to get people to sign up for the sewer project. There was three that signed and there were four peonle that did not sign. He stated that his main concern was the cost to them. Mayor VanNest explained the cost. If you looked at the charge of $8 , 170. 05 there would be the 15 payments that would be due under this assessment. In 1982 your oayment would be $1 ,514 . 86 . This is the payment required including principal and interest to pay for the initial install- ation of the sewer line itself. This does not pay for your hookup from your house to the sewer, you have to pay that in addition to this . Secondly , there is a SAC charge (sewer availability charge) paid to Metro which is now $425 . 00 , then there is a hookup charge to the city $20 . 00 permit. You are required to hookup at least within 16 months, and at the time you hookup you have to pay the cost to run your stub from your house to the sEwer, you then would pay the SAC charge of $425 . 00 and the $20. 00 fee to the City. Mayor VanNest explained that if the property owners encouraged the City to go foward the next step that the City would take would be to order plans arid specs . And then our enqineering staff would go out and spend money to design this system, the pipe size,the exact location and they would write the bids and then when the bids would come in the City could give you an exact assessment roll; what it would exactly cost. Mr. Sagar asked if he had to pay the assessment monthly and Mayor VanNest exp�ained that he could pay the amount initially and not pay any interest at all or if he took the option of spreading it over 15 years they appear on his tax statement. Mr. Glen Sauer 4104 Highwood Road asked if he could get a culvert put in by his property because when the sewer was put in in 1967 he talked to the village about the drainage problem when he had 8 feet of water in his back yard. He was told that nothing could be done about it because it was private property, unless we wanted to put in a storm sewer. Mayor VanNest asked John Gerhardson , Public Works if this was feasible and John stated it was . Mayor VanNest moved, Paurus seconded that if this project was ordered the City would accept the staff recommendations of asses:�ing 5 units that would include the 25 , 000 sq. ft. Kovac/Johnson site and it would declare the Crooker lot to be unbuildable. Motion : Ayes (4) Nays (0) Mayor VanNest explained the reason the eost WILLOW DRIVE CLOSURE of the cul-de-sacs was only $3 ,550. 00 was because that most of the shoulder existed and the city labor was $550. 00. He also stated that the city had traffic counts that were taken again at the request of the last meeting. The counts were taken on the 30th of April through the lowest spot on Willow just south of Fox Street, there werP 213 cars c locked on that day. There v�ere 3 g cars clocked on Shevlin going up into Webber Hills. And on the other end of Willow Drive cominq onto County 146 there were 315 cars. The tWo entrances gainq into Webber Hills from Fox St. there was 111 cars , from County 146 there was 198 cars . There were approximately 1500 cars on County Road 146 . We clocked exactly 1470 right out on Willow Dr. , and clocked 1527 just south of Fox St. on Brown Road and clocked 1609 cars just north of Fox St. on Brown Rd. Fox St. generally looks like 500 cars going through. Fox St. just west of Willow Dr, had 590 cars and there were 504 goinq north on Willow north of Fox St. . It looked at this time somewhat consistent as to what counts we had before. Mayor VanNest asked for any comments and Mrs . S.G. McWilliams asked that the council think about thejoggers and bicyclist that use that road to get to the Luce Line. She says she just cannot understand why the city is even thinking about closing this road. Mayor VanNest explained that a lot of thinking has gone into this and our popula-- tion is going to grow in Orono, and to the communities west of Orono, and the city knows as time goes on there will be more people usinq these roads . � REGULAR MEETING OF THE ORONO COUNCIL, JUNE 8 , 1981 Page 4 This road will cost more to maintain because WILLOW DRIVE CLOSURE of the poor base of that road. Mayor VanNest moved, Paurus seconded that the staff draft a resolution instructing the city to close Willow Drive as per the result of the petition that came forth and as citing all the studies that has been done by staff and other people and the recommendations that are proposed by city staff to close the road at the earliest possible time. Including the environmental concerns , costs , requirements to maintain the road at sometime in the future. Motion : Ayes ( 3) Nays ( 1) Councilmember Hurr Nay. JoEllen Hurr moved Paurus seconded that staff - prepare a memo regarding a feasibility of providing a walking and non-motorized vehicle path between the three cul-de-sacs on Willow. PARK COMMISSTON No comments from Lake Minnetonka Conservation District. LMCD REPORT No comments from Planning Commission to Council PLANNING COMMISSION Alan Olson, City Planner discussed the Orono CITY PLANNER' S REPORT Comprehensive Plan with Mayor VanNest and told him that he would be meeting with Connie Kolzak later in the week to discuss preliminary staff draft of the Physical Development Committee Plan Review Re�ort. Eric Sorenson will be getting a resolution MINNETRISTA SLUDGE for consideration as soon as tiossible. DISPOSAL SITE Mayor VanNest moved and Hurr seconded to pass RESOLUTION #1279 Resolution #1279 Motion : Ayes (4) Nays (0) Mayor VanNest moved Hurr seconded to approve LMCD VEGETATION the ordinance of the proposed LMCD Vegetation ORDINANCE Ordinance encouraging the policy of the District that the shoreland of the lake be maintained in as natural a state as possible . Motion : Ayes (4 ) Nays (0) Paurus moved VanNest seconded to accept staff TAX FORFEIT LAND recommendations and adopt Resolution #1280 RESOLUTIONS #1280 Tax Forfeit Land Retained For Public Use By AND #1281 'rhe City Of Orono and Resolution #1281 Tax Forfeited Lands Released For Public Sale. Elsie Weiss asked i£ there was anything that could be done to clean up the eyesore at 2256 Shadywood Road. Mayor VanNest directed Tom Jacobs to check for safety and welfare and it should be on the agenda for the next meeting. Paurus moved Hurr seconded to adopt resolution JAD4ES F. ALLENBURG #1282 A Resolution Approving A Metes and Bounds Subdivision and Lot Line Rearrangement for Gordon Wolsfeld. Mayor VanNest moved Paurus seconded to have a resolution be drafted subject to the approval of the Planning Commission that the house be adjusted in such a way that it puts the patio area in 40 ' setback and that it at least have a 2 car garage and that the minimum garaqe extension into the 40 ' setback. Hurr moved, Hannah seconded, to recommend approval of the variance subject to terms with the removal of the smaller shed; and cease using the rear access . The plan limitinq the parkinq places and how many boats would be permissible. Mayor VanNest moved Paurus seconded that staff draft resolution on the matters discussed and submit it at the next meeting. Glen Cook gave the draft of the Wayzata agreement CITY ENGINEERS REPORT Ferndale Sewer to Bruce Malkerson to review. Mayor VanNest moved Paurus seconded that the City Attorney and staff review the proposed sewer agreement with Wayzata and submit it to Wayzata and to the City for the next meeting. He advised the City Council and City Staff to have a letter drafted and sent out to the people �fected and let them know the city willnot allow private use of public propert_y, as it does belonq to the City of Orono.
