HomeMy WebLinkAbout05-27-1981 Council Minutes o� CITY OF ORONO Regular Meeting of the Orono Council , 7 : 00 P.M. May 27 , 1981 . The Orono Council met on the above date with the KURT ERICKSON following members present : Mary Butler , Acting WSSI AWARD Mayor, Gregg Hannah, JoEllen Hurr. Absent were Mayor Brad VanNest, City Administrator , Dick Benson and Norm Paurus . Attending also were : City Attorney, Bruce Malkerson, Zoning Administrator , Jeanne Mabusth and Building Inspector , Tom Jacobs , Public Works Coordinator, John Gerhardson , City Engineer Glenn Cook, Deputy Clerk Sandi Woytcke , and Planning Commission member Tom Frahm. At 7 : 00 P.M. , acting Mayor Butler introduced KURT ERICKSON Chief Kilbo and Chief Kilbo introduced Mr . and WSSI AWARD Mrs . Charles Schoen who would be presenting Kurt Erickson the WSSI Award for outstanding service as a Police Officer for investigating a $24 , 000 forgery case which involved a year and a half of investigation which led to con- viction. At 7 : 10 P.M. Public Hearing for Fire Lane pUgLIC HEARING Ordinance was open. FIRE LANE Butler asked for any public opinion or questions and Mr. Fred Riebel of 440 Stubbs Bay Road did ask what the Ordinance consisted of . Butler explained the proposed ordinance commenting that this ordinance would control parking and allow the Police Department to keep such areas clear for emergency vehicles . They discussed clarifying paragraph 19 . 210B to explain which buildings the ordinance would address itself to. JoEllen Hurr moved to adopt the Ordinance as proposed with the proper clairification. Hannah seconded. Motion , Ayes (3) Nays (0) Hannah moved, Hurr seconded, that approve CONSENT AGENDA* consent agenda with the removal of item #3 Motion : Ayes (3) Nays (0) . Hurr moved, Butler seconded, to approve the Minutes of the Regular Meeting of May 11 , 1981 with the corrections stated. Motion : Ayes (3) Nays (0) . No comments from the Park Commission. PARK COMMISSION - REGULAR MEETING OF THE ORONO COUNCIL, MAY 27 , 1981 PAGE -2- No comments f_rom Lake Minnetonka Conservation LMCD REPORT District. No comments from the Planning Commission. PLANNING COMMISSION Tom Frahm was present as it' s representative. At this time Butler asked for any public PUBLIC COMMENTS comments . Mr. Fred Riebel of 440 Stubbs Bay Road did comment on the railroad crossing. John Gerhardson stated that he called the railroad and they were not available to discuss this matter. Mr. Riebel stated that he felt the crossing could be fixed better. Mr. Gerhardson stated he would get a letter off the roadmaster this week to meet with him and check what has to be done. Jeanne Mabusth, Zoning Administrator, reviewed #599 JOHN LAURENT with the City Council the final subdivision for 625 FERNDALE ROAD Mr. John Laurent at 625 North Ferndale Road. FINAL SUBDIVISION RESOLUTION. Mr. Laurent was not present. Discussion followed, comments were the resolution should state no variance would be granted at any time after approval of sub- division . Also the fact that this property does not have an approved access to the city street . Mabusth stated that it did have an appro�ed easement, and that it did meet our code . Hannah moved, Butler seconded to approve this resolution as amended in terms of no variances to be granted. Motion , Ayes (2) Nays (1) Hurr Jeanne Mabusth reviewed the proposed subdivision RICHARD RAICHE commenting that it is the very same plat that 2901 WATERTOWN RD . council approved in 1979 . PRELIMINARY SUB DIVISION. Mr. Raiche was not present at the time of discussion but later did come into the meeting. Hurr moved, Hannah seconded to approve subdivision for Richard Raiche 2901 Watertown Road. STRONG preliminary subdivision for 420 Brown Rd. 420 BROWN ROAD SOUTH South. PRELIMINARY SUB- DIVISION Hurr moved, Hannah seconded to approve the Ruxton R. Stronq preliminary subdivision at 420 Brown Road South with the understanding they were granting the variance to lot #1 to our 2 acre contiguous standard based on the hardships of the location of the wetland and the road outlot. Hannah moved, Hurr seconded to insert in the RICHARD RAICHE Richard Raiche Application the same ruling of the road maintenance and utilities agreement . Motion , Ayes (3) Nays (0) Mr. Davis was not present but he had called JACK DAVIS and asked that his application be tabled at 1345 VINE PLACE such a time that he could be �resent . VARIANCE #610 Hurr moved , �annah seconded to table Jack Davis ' s variance until such time he could be available. Motion , Ayes (3) Nays (0) This applicant asked that his item be tabled NORTH STAR MARINA as he is ill and not able to attend. 1981 MARINA LICENSE Hannah moved, Hurr seconded to table North Star Marina 1981 License . Motion , Ayes (3) Nays (0) No one was present from Gayles Marina . GAYLES MARINA 1981 MARINA LICENSE Discussion was that staff has visited Gayles Marina just to see what he was doing exactly. We believe the fence is on County right-a-way. The Hennepin county office was reoresented and we don ' t have any idea what they are doing so at the meeting they will have with Mr. Whittig will find out just what they are planning. Hurr moved, Hannah seconded to table this item until such time staff ineets with Mr. Whittig. Motion , Ayes (3) Nays (0) Mrs. Rivers was present for Windward Marine WINDWARD MARINE this was just an information item, she knew nothing about update of Torrens . Butler wanted it noted in the record that any action that has been asked has been reponded to forthwith and with great speed. There is no problem with the City or the Marina regarding the license it is just a matter of legal torrens action. - REGULAR MEETING OF THE ORONO COUNCIL MAY 27 , 1981 Page -4- Crystal Bay Service. The Mehner ' s were present. Tom Frahm from Planning Commission made a statement of the fact they discussed at the Planning Commission meeting that this place and North Star Marina are private properties zoned private, not commercial , in one case we were going to turn one fellow down and in another case we are giving a dock license , and he felt we better have some good reason for this . If we are going to allow one commercial dock in a residential zone how can we not allow another one . Hurr moved and Hannah seconded to adopt the resolution for the 1981 dock license for Crystal Bay Service. Motion, Ayes (3) Nays (0) Butler had a few problems she discussed as far CRYSTAL BAY SERVICE as item 9 page 2 of the resolution. That it 12 B should say the service station should be limited as to how many cars should be parked outside at the station. Mr. Mehner stated it would be limited and would not appear as a junk yard. JoEllen Hurr wants a survey of the site plan scale. Or at least a drawing that shows the parkinq. Hurr moved Hannah seconded to adopt the resolution for a conditional use permit for a service station for Crystal Bay Service. Motion , Ayes ( 3) Nays (0) Tom Jacobs was introduced at this time to IVY PLACE MATTER discuss the Ivy Place Matter . Tom stated what has been done is clearing of land, cleaning the brush out. The staff will be meeting with Mr. Wilson, Thursday May 28 , 1981 . Neighbors attending the meeting were as follows : 1 . Quention Johnson 3509 Ivy Place 2 . Mary Lang 3271 Casco Circle ; REGULAR MEETING OF THE ORONO COUNCIL MAY 27 , 1981 Paqe 5 � Mr. Wilson was not present , Butler asked if there was any comments from people in the audience. They were concerned that he is trying to control the access as his own and was discouraging the use of the access. Wanted boundaries to be established so people know �hat is public . Council directed staff to meet with Mr. Wilson and Mr. Lovest.rand and get back to them. Butler moved and Hannah seconded, that staff get a survey of the fire lane if all fails. Motion , Ayes (3) Nays (0) City Engineer Glenn Cook reported the ENGINEERS REPORT sewer pr ject is running smooth so far. LaTour will finish the 2 week project startinq week of June 1 , 1981 . Hannah moved, Hurr Seconded to approve the electrial connections at Vaughns in the amount of $567 . 00 and not to exceed $600 . 00 Motion, Ayes (3) Nays (0) The letter they received a copy of in the agenda was just a blanket letter sent to all communities whether they had signed up for and I/I Analysis or not. It was just for information. Mayor Brad VanNest was absent , there was MAYORS REPORT no report. Butler stated she had not had a chance to get CABLE T .V. REPORT minutes typed up as yet. She mentioned there will be a resolution to adopt designating persons to serve on a commit}ee to develop and coordinate the franchise process of cable T.V. and bylaws . She would have this ready by the June 22 , 1981 council meeting. No report. TRANSPORTATION REPORT Council was made aware by Public Works Coordinator LAKE ACCESS John Gerhardson that we had received a petition re- 3683 NO. SHORE DRIVE garding the Crystal Bay Lake Access. Council reviewed the petition and directed staff to monitor the activity of the access and report back to them. Council received a memo and information regarding HENNEPIN COUNTY the new market values proposed by Hennepin County ASSESSING j ' RE�ULAR MEETING OF THE ORONO COUNCIL MAY 27 , 1981 Page 6 They wre also informed of a board of review to be held June 11 , 1981 7 : 30 P.M. in the Council Chambers. City Attorney Bruce Malkerson reported CITY ATTORNEYS that four of the homeowners in the REPORT sewer project have requested to be hooked up to the sanitary sewer line. He noted that the City had agreed in the acquisition of the easements that it would be responsible for or pay the homeowner the amount for the hook up. He recommended the City to pay the homeowner the amount of money that the lowest bidder quoted, which in this case was Widmer Brothers , and let the homeowner be responsible for hookup. This would eliminate problems in the future. It was also noted that the restoration would be extra and he also recommended that the City pay the amount for restoration to the homeowner and they could contract with someone else or with the contractor of the sewer project.
