May 11 , 1981 The Orono Council met on the above date with the following members present: Mayor Van Nest, Councilmembers Butler, Hannah, Hurr , and Paurus. Also present : Public Works Coordinator Gerhardson, City Attorney Malkerson, City Engineer Cook, City Planner Olson, and City Clerk Strom. Absent: City Administrator Benson. City Attorney Malkerson left the meeting at 9 : 20 P.M. and Attorney Desyl Peterson replaced him. Butler moved, Hannah seconded, to approve the Consent CONSENT AGENDA* Agenda* , subject to removing items 3 & 30 , with all staff reports concerning items reviewed at this meeting to be attached to the original copy of these minutes nn file in the City Clerk ' s office . Mayor Van Nest announced that the next meeting of PAINTERS CREEK MEETING the Advisory Comir�ittee for Painters Creek will be June 4 , 1981 held June 4 , 1981 at 7 : 30 P.M. at the Orono Council Chambers . PUBLIC COMMENTS REGULAR MEETING OF THE ORONO COUNCIL, MAY 11, 1981 Page 2 Mr. Daryle Uphoff was present to discuss his SUBDIVISION application for a subdivision at 2497-99 , 2501-03 2497-99 , 2501-03 Kelly Kelly Avenue. #568 Daryle Uphoff Hurr moved, Butler seconded, to approve a pre- liminary subdivision for Daryle Uphoff, 2497-99 , 2501-03 Kelly Avenue , subject to four individual lots; one Outlot A; again referencing the docks and driveway in a homeowner ' s covenant for improve- ments ,and single family residential detached dwellings will not be allowed. Motion, Ayes (5) - Nays (0 ) . Mr . Verne Hubbell, 3340 Watertown Road, was present CONDITIONAL USE PERMIT to discuss the resolution for an after the fact 3340 Watertown Road filling and grading of his property. #597 Mayor Van Nest moved, Butler seconded, to adopt RESOLUTION #1270 Resolution #]_270 , A Resolution Approving An After 3340 Watertown Road The Fact Application For A Conditional Use Permit Verne Hubbell Of Verne Hubbell For Grading And Fi.11ing On Property Located At 3340 Watertown Road, as amended, subject to Verne Hubbell signing off on the resolution. Motion, Ayes (5) - Nays (0 ) . Mayor Van Nest moved, Paurus seconded, to adopt RESOLTUION #1271 Resolution #1271 , A Resolution Regarding The Status Kellers Market Of Property Known As Kellers Market, 3800 Wayzata Boulevard. Motion, Ayes (5) - Nays (0 ) . No one was present concerning the North Star NORTH STAR MARINA Marina 1981 Marina License . 1981 License Discussion included an amendment to the proposed resolution to deny any dock on the Crystal Bay side and variances to the dock length on the Maxwell Bay side . Mayor Van Nest moved, Hurr seconded, to table the 1981 Marina License for North Star Marina until the next meeting. Motion, Ayes (5) - Nays (0 ) . No one was present concerning the Gayles Marina. GAYLES MARINA 1981 License Mayor Van Nest moved, Hannah seconded, to table the 1981 Marina License for Gayles Marina until the next meeting. Motion, Ayes (5) - Nays (0) . Mr. & Mrs. James Rivers were present to discuss WINDWARD MARINE their 1981 Nlarina License. Council directed staff 1981 License to redraft the proposed resolution to be presented at the next Council meeting. REGULAR MEETING OF THE ORONO COUNCIL, MAY 11 , 1981 Page 3 Mr. Timothy Mehner and Mr . Hubbard were present CRYSTAL BAY SERVICE to discuss a conditional use permit and a 1981 3398 North Shore Drive marina license for the Union 76 Service Station #608 at 3398 North Shore Drive . Timothy Mehner Discussion included the dock on Crystal Bay to be used for fueling and minor service of boats, but not to exceed three slips--two for service to be used only during the daytime and one to be used for over-night docking for the owner 's boat only. It was noted that the service station and the fueling dock on Crystal Bay were a needed service to the residents on land and in the water. Hurr moved, Hannah seconded, to direct staff to draft two resolutions : 1) conditional use permit for service station in a B-2 zoning district, 2) to approve a 1981 commercial dock license for proposed fuel dock and boat towing service on Crystal Bay. Both should reflect the need for a variance for lack of the one year operation and that the dock be constructed to meet all setback requirements of the Lake Minnetonka Conservation District and the City of Orono codes and approval of the Marina Committee. Motion, Ayes (5) - Nays (0 ) . Mr . John Vogt was present to discuss with the City SAILORS WORLD Council. his 1981 Marina License for Sailors World, 1981 Marina License 1955 Shoreline Drive . This item was tabled until the next meeting. Mr. Larry Hork and his attorney, Bruce Douglas, NORTH SHORE DRIVE were present to discuss the 1980 & 1981 Marina MARINA Licenses for the North Shore Drive Marina . Bruce Douglas stated that the real issue is the dock length along the northwest side of the property. Douglas stated that, in 1977 , the docks were damaged by ice and that the marina then applied for a building permit. Douglas alleged that the dock originally was at right angles to the main dock and was beyond the 200 foot limitation� but during the reconstruction in 1977, the winqs of the dock were angled back to be within 200 feet. The 1977 plan that was submitted then and later corrected to show a 929 .4 contour, which is made available to the City tonight, shows that the wings of the docks were intended to be constructed within 200 feet of the lakeshore . Douglas stated that before and after the docks were reconstructed, that the plan and the docks were reviewed and approved by Hank Muhich and Alan Olson of the City of Orono. Mr. Hork stated that Muhich inspected and measured the docks and said that they were all right and to go ahead with the construction. Douglas stated that a great amount of erosion had taken place in the last couple of years and as a consequence of this, the docks are now further from the shoreline than they were in 1977. (Cantinued) REGULAR MEETING OF THE ORONO COUNCIL, MAY 11, 1981 Page 4 Douglas also stated, that four or five years ago, NORTH SHORE MARINA the City was not as sophisticated as it is presently (Continued) in their terminology and Ways of ineasuring. He stated that the marina rebuilt the docks and believed them to be in compliance at that time. Douglas stated that the government entities no longer measure from 200 feet from the main dock area but now the Lake Minnetonka Conservation District (LMCD) and the City measures from the side lot lines and then extends a line across the property to include the authorized , dock use area. He indicated that if you applied that approach in all instances, in this case because of the lagoon, you would have an absurd result. Douglas stated this is a non-conforming dock and they should be granted a variance until such time as the docks are destroyed and then they will be rebuilt within 200 feet of the shoreline as it exists at that time . Hork stated that the ice took the weir out this year but it was replaced immediately. Hork stated that the LMCD did inspect the dock in 1977 and then licensed it. Mayor Van Nest stated that the 200 foot measurement has always been taken from the actual shoreline at the seawall which should also be the 929 .4 elevation. Bruce Malkerson asked whether or not this information had been submitted to the LMCD. Douglas stated that this information has not been presented to the LMCD and that the marina first wanted to obtain the approval of the City of Orono. Hork stated, that in 1977, Mixa of the LMCD agreed with them. Hork stated that the retaining wall that was built in 1977 never went the � entire way across the property from the lagoon to the western property line and it was only located next to � the lagoon. Mayor Van Nest stated that it was his recollection that the retaining wall in 1977 went all the way across that portion of the property and that the City always measured the dock length from this wall as being the shoreline. Douglas stated that because of the subsequent change in the way the LMCD and the City measured the dock length, that the dock is not now in compliance. Hork stated that he could bring in the surveyor who met with the LMCD and the City of Orono inspectors and who would testify that everyone was in agreement at that time. Hork stated that he will provide a copy of a letter from the surveyor to that effect if he can find it and has requested the surveying company to provide a copy of that letter. Mayor Van Nest stated that the City had not unconditionally approved the 1977 dock location and had, in fact, suspected that the docks were not beyond 200 feet, but that licenses had been issued based on Hork ' s statements confirming a location within 200 feet, subject to a confirming survey. (Continued) REGULAR MEETING OF THE ORONO COUNCIL, MAY 11, 1981 Page 5 Mayor Van Nest also stated that it took the City NORTH SHORE MARINA several years to obtain from the applicant the survey (Continued) showing the 929 . 4 elevation and because it was not provided in a timely manner, instead of denying the permit in each year , the City Council in an attempt to work with the marina, approved the license on that condition, and only to the extent that in fact it did meet the 200 foot setback from the 929 . 4 elevation. Douglas stated that there was no question but that if you measured the dock lengths from 929 .4 , then the docks are currently in violation of the ordinances. He stated that 1977 was a low-water year and because of this depth change and the amount of erosion, the docks that were then in compliance are no longer in compliance. He stated that if you had built the docks in 1949 at 200 foot length from that point, then they would even be much further out today because of the higher water and erosion. Douglas stated that certainly the City would not require that they cut docks that would have been 200 foot in length from the shoreline in 1949 and now need to be cut back because of erosion and high water. Douglas stated that these docks justify a variance because of the facts. Bruce Malkerson asked whether or not there was a Mark Hurd aerial of 1977 that would show the location of the shoreline at that time or any other evidence showing that the shoreline , in fact, was further out into the lake and that the docks were in compliance in 1977 . Mayor Van Nest stated that we granted the license in the past with the understanding that they did comply and it is now evident that they have not been in compliance for several years . Paurus moved, Butl.er seconded, to table the application for 1980 and 1981 marina licenses until additional facts and information are obtained. Discussion followed: Douglas stated that we should focus on this one issue and if the City is right and docks are not in compliance, the City should still feel they could grant a variance to the marina in order to work out an accommodation with the marina. Councilmember Paurus stated that 10 to 11 years ago, the original 200 foot requirement was adopted and this is the only marina on the lake that is now not in compliance with the 200 foot setback and it must come into compliance . Because of the changes in measurements and changes in definition, a businessman never knows what to do and the businessman needs to make a decision and so he hopes the City can make a decision in the near future . Date And Calling Hearing On The North Shore Drive/ North Shore Drive/ Highwood Area Sanitary Sewer Project. Motion, Highwood Sewer Ayes (5) - Nays (0 ) . John Gerhardson, Public Works Coordinator, was WILLOW DRIVE present to discuss the closing of Willow Drive Cul De Sacs and construc�ting cul de sacs. Mayor Van Nest requested staff to notify the persons concerned with the Willow Drive matter that this item will be acted on at the June 8 , 1981 Council meeting. Paurus moved, Butler seconded, to approve the BID AWARD low bid of Allied Blacktop, Inc. , for the 1981 1981 Sealcoating sealcoating program not to exceed the amount Allied Blacktop of $24 , 732 . 50 . Motion, Ayes (5) - Nays (0 ) . Mayor Van Nest moved, Butler seconded, to adopt RESOLUTION #1273 Resolution #1273 , a resolution approving the MnDOT Agreement agreement with the State of Minnesota, Department Traffic Signal of Transportation, for the traffic signal at Highway �12 and the Old Crystal Bay Road. Motion, Ayes (5) - Nays (0) . Mayor Van Nest moved, Butler seconded, to adopt RESOLUTION #1274 Resolution #1274 , a resolution to approve the plans Traffic Signal and specifications for the traffic_ signal at Plans & Specs. Mayor Van Nest moved, Butler seconded, to adopt RESOLUTION #1275 Resolution #1275 , a resolution to provide payment Traffic Signal Payment by the City of Orono to the State of Minnesota for the City ' s share of the cost of the traffic signal at Highway #12 and the Old Crystal Bay Road. I was extremely pleased to learn frcm your letter that you are now a corrnnissioner of the MWCC. The MI,fCC is certainly a com�licated and massive responsibility and it is nice to 4;roti�r that responsible people such as yourself are willinq to dedicate the necessary time and effort to such an important coranission. Your camments corcerning the amount of phosphorus traveling directly dov�n the stream to �ake Minnetonka is certainly a valid concern and one ��hich is presertiy being addressed by the htinnehaha Creek Llater- shed District and the cities involved. Our purpose in this special study, is to develop weirs along the creek that will retain the flowage in a number of pools which will spread out the water over the wetlands so a� to maximize the benefits of the phosphorus removing capabilities of these �letlands. Hickok and Associates, here in ;�tayzata, did a one year p�lot project for the EPA on the t�layzata marsh which showed that 77% of the phosphorus that came into this wetlands was removed prior to the discharge of the affluent into Lake Minnetonka. That study has been published by the EPA and it is the basis for what vre are trying to do in the Painter Creek 4latershed. After you have had some time to familiarize yourself•with the waste control corrmission facilities, I hope that we could get together for lunch someday to look at the Maple Plain plant and the Painter Creek Watershed, so that we may adequately express our concerns over this issue. A11 • land listed as "suitable" in the Orono-Long Lake area fa11s �vithin this line. 3) Orono has, over a period of many years , taken a position against any such development, preferring to designate al1 remaining land as rural with no urbanization of t�is area. 4) According to the IYaste Control Commission s-taff, there is sufficient sewer capacity to hardle any reasonable mix o�' urbanlrural growth along High�vay �12 as `ve11 as in the general-Orono area. Dir. Ode made this specific comment . 5) The hietropolitan Council essentially agrees �c=�zth Orono' s current gro�vth projections. The main concern they have had durinb the development of Orono' s Plan is how Orono plans to �istribute its grotvth. Metropolitan Council staff inembers encouraged us, even though Orono' s Plan is virtually completed and under review, to register any concerns we might have. Our overall impression is that it would be possa.ble, now or in the future, for Orono to ask for amendments to its Community b7anagement Plan , if such amendments meet current development � guidelines. jYe are still of the opinion that , from the standpoint o� the school district , a growth plan permitting a reasonable and sensible mix of urban/rural density for the present designated Orono rural area, �could be very beneficial to the scMool system. �Ye are certainly not in �avor of "massive density" growth which blr. Benson alludes to and we do recognize there �re limitations to grocvth. tiye would also like to state that, contrary tu 2vlr. Benson ' s Zetter, the district has lost approximately 450 students since Z974 and projections call for continued loss with serious ramificai;ions for our educational program.
