CITY JF ORO1V0
Regular Meeting of the Orono Council , 7 : 00 P.M.
February 23 , 1981
The Orono Council met on the above date with the
following members present : Mayor Van Nest, Council-
members Butler, Hannah, Hurr , and Paurus. Also
present : City Administrator Benson, City Planner
Olson, Zoning Administrator Mabusth, City Attorney
Malkerson, and City Engineer Cook.
Mayor Van Nest announced that now was the time and PUBLIC HEARING
place for the public hearing concerning a petition Sandy Beach
for Sandy Beach swimming area. City Administrator
Benson presented the Notice of Public Hearing, the
Affidavit of Publication, and the Certificate of
Mailing.
Dick Benson, City Administrator , read into the
record a petition to continue the Sandy Beach
swimming area, which states:
"We , the local residents of the Sandy Beach area
of Orono wish to speak out on the beach issue : the
beach has been here for years, enjoyed by parents
and children alike. It is the only public area
in the neighborhood within walking distance for
local residents to swim, relax and enjoy Lake Minnetonka
expecially for off-shore residents who would otherwise
be "choked-off" from the lake. People buy homes
and locate in the lake area hoping to enjoy the lake .
Any attempt to close the beach by a few property
owners in the area is selfish and certainly not in
the best interest of the entire community. We appeal
to the Orono Council to continue this needed recreational
facility. "
The above petition contains 100 signatures.
Mayor Van Nest requested a show of hands of those
in attendance in favor of closing the beach area.
Twelve hands were counted.
Those in favor not to close the beach area.
Fifteer hands were counted.
Mr. ,7ohn McCallum read into the record the attached
statement.
Statement Pages 2-9
Betty Hanson, 3826 Cherry Avenue : People are very
abusive , there is no supervision, and the beach area
has turned into an eyesore.

William Moeller, 5200 Bartlett Boulevard, Mound,
swimir, ing instructor : The problem is uncontrolled

Deborah Kullberg, 1736 Shorewood Lane, Mound, Director

Dear Orono City Council ;
titi'hen we bought our house we weren ' t even
aware there was a public beach so close . It
is so small very few people even know :it
exists . That is one of the things we like
so much about it . It is never crowded and
almost everyone there just walks to it .
It is usually pretty quiet too .
Frequently last summer a car load of older
kicis were there and that is the only tire ,
it got a little wild . The only time you
see more than one car is during swimming
lessons .
Please realize how important sirming
lessons are to our children , especially
with all these lakes . And alot of mot3iers
don ' t have cars to take their children te
lessons any where else .
There are no other beaches anywhere in
this area. Please try to understand what an
important part of the neighborhood it is .
The kids 2lso go there in the winter •
to play and skate on the ice .
We will be at the hearing . lVe hope you
aill consider the good of the najorit also .
Thank you , _

Mayor Van Nest : The City needs to know who the City
is licensing for this operation and who the boats
belong to. It appears to the City that there is a
dual use of the property involved. We need to know
exact number .of boats and we have to identify parking
facilities and who is the responsible person to be

Alan Olson, City Planner, reviewed with the City SUBDIVISION
Council the preliminary subdivision request of 2605 W. Lafayette Road
Bruce Hepp, 2605 West Lafayette Road, dated #545
February 19 , 1981 . Bruce Hepp
Mr . Jevne , attorney representing the applicant
Bruce Hepp, commented on his client ' s application
by stating that when considering the total building
envelope size, there is 40 ' allowed for a driveway
easement and 11 , 500 sq, ft. is still available for
the building envelope . We feel the 11, 500 sq. ft.
designates a buildable lot. Any restrictions can
be recorded on a permanent record. Technical code
violations have been noted. We request granting of
variances if they are needed. In maintaining the
character of the area, we want to address unique
technical problems that were not created by Mr . Bruce
Hepp. The proposed lot is still the largest in the
neighborhood. Mr . Hepp 's request is reasonable .
I have reviewed all findings. Variances have been
allowed before, have been noted i£ required and
should be reviewed and considered as part of our
request. There is no evidence of traffic problems
and staff have not documented such problems.

• REGULAR MEETING OF THE ORONO COUNCIL, FEBRUARY 23, 1981 Page 16
There appears to be an issue of two non-contiguous SUBDIVISION
parcels or lots. The parcel is still one parcel and 2605 W. Lafayette Rd.
one lot. The proposed driveway does not change the (Continued)
character of the lot. We are not combining two
parcels of land for other purposes, public, private,
or road easement does not apply to the Hepp proposal.
If it should, this should be considered as a variance .
This area is unique and not unusual to the Hannah
easement. Drainage problems do not exist that we
are aware of pertaining to the building envelope .
There are some unique conditions such as the cul de
sac and lagoon.
We do have many hardships. One is being denied
occupancy since my client purchased the land for a
residence. Mr. Hepp is being transferred to Italy
and wants to retain the lots for himself, wife , and ,
children and the City is imposing a real hardship
if they are not allowed to use the property. The
Council ' s statement that the applicant plans to sell
the property for a greater value is not true. The
Council ' s action on variances are quite technical and
have not been well thought out. Subdividing the
larger parcel into two lots will not cause deterioration
of the area.
Mayor Van Nest: Mr. Jevne, your application does not
meet City performance standards simply because it has
been assumed that this proposal would not require •
variances, when in reality, there are variances required.
The easement required to serve the existing house on
this lot leaves a building envelope that is much less
than required in a standard lot in the one acre zone.
In fact, the building envelope is only 39 of standard
with a 20 ' wide easement and a 10 ' building setback. This
is reduced to 23 with the required 35 ' building setback.
If the easement is granted at the required width of 50 '
with a 35 ' building setback, then the building envelope
is reduced to only 180 of standard. The location of the
easement destroys the lot. This is not a reasonable
building site, if youu are to meet the City code requirements.
I wish to note here that Mr. Hepp ' s application created the
easement, no one else did.
Mr. Jeven: Yes, that is correct.
Mr. Tom Lowe , 2630 West Lafayette Road: The hardships
were in existence when Mr. Hepp purchased the lot.

"This letter is being written on behalf of Lafayette

for variance at 3220 Navarre Lane . We understand that
the owners are applying for a variance to build a
four-unit agartment building by converting the existing
structure . We generally oppose that use as not being
in conformity with any number of requirements and
ordinances of the City of Orono. We recognize ,
however , that the present structure used as an industrial
building or in a vacate state could very well become a
public nuisance and an attractive amusement area where
children may be injured.
In the event that a tasteful application is made for
creating a duplex, we would be willing to reconsider
our opposition to this project.
In the event that the Council should elect to approve
the current application, we would appreciate being

Dear Diane :
I wish to thank you for considering our request for an extension
of the termination 3ate of our joint water agreement. Your
decision to cont;nue s-lpplying water to the area west of your
city until July, 1982 , will allow us to jointly complete a
feasibilit of apgrading the present syste:.i to a more aviceptable
suply of pressure for all of us in the future .
T met with rs. Todd Heglund, Mr. Tom Anderson, 1'Zayor of Medina,
and rir . Srad van Nest, Mayor of Orono, to solidify our objectives
and formulate a plan which will allow us all to work together
to eet future deadlines to accommodate all of our future water
needs .
i•ir . Heglund reviet•red with us th City of Long Lake 's desire to
construc a water tower near Highway 12 near the Robb Motel
. property to adequately furnish water pressure to the areas of
Long Lake nd Orono, which are contiguous to each other , that are
now served by your city. The new system would be in total , Long
Lake ' s system comnitted to jointly serve our a:eas as nee3ed
on a gallonage basis that would be rated the same for all of our
com-nunities. The increased revenues generated by your city for
the service would be used to retire the bnds sold for the project.
tfs . Tom Anderson, Brad Van Nest, and myself concurred with
:Ir . Heglund and aqreed to cntinue our efforts proceeding to
finalize an agreement with our city, as soon as possible . We
all feel we have a muual interest in serving our residents at
a cost that is fair and equitable to us all and we will work

we discussed a time-frame which to work within and we all
agreed to speed up the process and keep it going as quickly

•e fe?t if we could receive co:n..itments from everyone now, and

Dear ir . Heglur.d :
As you are aware , we have in the past, periodically discussed
your concerns with the a:ount of water that your city is receiving
fron the Orono area west of you, served by sanitary sewer . It
has been noted that the Metropolitan Waste Control Commission is
not properly calculating the sewage floa and charging back to
the City of Orono their fair share of the total sewage flow. It
has been suspected that Washington Scientific a:d Van Dale Manu-
facturing were pumping from private wells into the sewer system
that was.not being metered. ,
The City of Orono completed an inspection of these establishments
and eae have determined that Wash?ngton Scientific and Van Dale
wells are capped off and are not operative .
The only private well pumping into the municipal sanitary sewer
system is located at he Orono school complex, which is metered
for internal and external uses .
The Metropolitan Waste Control Commission obtains these well
meter readings, city water meter readings, neasures sewage
flow •from a weir in the last manhole leaving Orono and uses these
figures to determine Orono ' s sewage charge .
The City of Orono completed in 1980 , televising oi all of the
sewage lines in our area west of your city at a cost of $S ,OOQ ,
the end result was a repair of one deflected pipe in the entire
system. The entire cost of televising was shared by the City
of Medina, City of Orono, and our Z b Z Study inflow and
infiltration analysis which we are implementing on our entire
sewer system in Orono. This was accomplished to satisfy the
City of Medina that these sewer lines were in satisfactory
condition before Medina-Morningside is connected.

In 1980 , the City of Orono also televised the sanitary sewer
lines serving the Hackberry area and corrected infiltration
that was evident. Film of the televising is in our files
and available for your review if you so wish.
To conclude , I really believe the City of Orono has over-
extended itself in providing and maintaining a utility system
that is maintained at a level that is far superior to other
systems in the area. I there are other facts or data that
would be helpful to you or if here are other concerns elated
to the sanitary sewers adjacent to your city, please notify me
and I will assist you in these concerns.

SUBJECT : Private Well Use - Orono Long Lake Water System
At your request a field study was implemented to determine the number
of private wells in use today in the industrial area in Orono that is
served with municipal water by Long Lake .
7he field study was implemented to determine the number of private e11s
in use and if so the number of gallons of water pumped that flows into
the municipal sewer system.
It has been determined that in that area the Orono Middle School and
Elementary School are the only establishments that is using a private
well . ( one well serves both buildings ) However , there is a meter on
the ell to determine total gallons pumped that is used for outside
sprinkling etc . , number of gallons pumped that flows into the Munici -

The City of Orono is in receipt of your letter dated February 9 ,
1981 , com-ner.ting that you had not received a copy of our
Cotr,prehensive Plan.
I am somewhat puzzled by your letter since I do hace in my file
a receipt fro: United Parcel Service noting tnat Dr . Gayle
Lennon received Orono ' s Plan on June 25 , 1980 . On that date ,
plans were also delivered to the City cf Tonka Bay and the Mound,
Wayzata, and Excelsior School Districts.
t:e have received com.rlents from the other cities and school districts
and we are looking forward to hearing from you on this very important
matter .
tae feel that we should all be part of the planninq process and would
appreciate your review of our Plan as soon as rossible to allow
continuation of the review process by the Metropolitan Council .
If the Comprehensive Plan delivered to your office on February 9 ,
1981, should be misplaced, please call me and we will deliver
another to you to assure timely completion of your revie,a, since
your district is the last to repond to us.

Dear hir. Benson:
Than'{ you for your call concerning the fact that you have a

had not seen the plan until February 9th. Idy files show esponses

Even though ve ;ill be very late in our response, we do hope
the Rietropolitan Council will stil2 permit us to review and com, nent

ar Bill :
I am in receipt of your Feiruary 12 , 1981 , letter concerning
Orono ' s Comrehensive Plan and I wish to thank you for your
auick response . Considering the reason for the delay in
responding to our Plan, I am sure the :etropolitan Council
aiil allow adequate time for your co:rments to assure cornplete
corununication in the review process.
Bill, I 'ara very concerned with your coreu-nent ta me Wedflesday,
Fbruary 1 , 1981, concerning the City of Orono ' s Land L'se
Policy and your apparent feelings that the City, through its
iand use planning and zoning, is jeopardizing your student
popuiation count within the distrct.
Z am also very concernec with your statement that the present
chool Board is becoming more concerned with the lack oi
representation on the Orono City Council from areas within the
Orono School District, and that the present School Board is
concerned with Orono' s land use policies as they relate to
encouraging future development.
In order for us to resolve issues that are before us, I elieve
it is important for us to be objective and not alloca those issues
to overlap each other . One issue before us is the Orono-Long Lake
water matter. Another issue apparently, is Orono ' s Land Us
Policy or zonir.g.
As Z entioned to you before , I do not think it relevant to allow
your feeling wih Orono ° s Land Use Policl to interfere with
negotiating a new rater agreement with Long Lake . Unless the
Orono School Board has taken specific action concerning Orono ' s
Land Use Policy, and feel it is an integral part of furnishing

Ci.y water to aur residents, I feel staff should deal directly
with the matter at hand and not assume what action Council or
IIoard ne:nbers might take in the future. Your comment that more
Board members are showing resistance to Orono' s rural versus
urban plan deserves further explanation and hopefully, a
satisfactory conclusion as soon as possible.
I am officially requesting a committee of four be formulated
to continue these discussions to encourage participation at the
decision making level . Two members from your School Board and
two members from my City Council would stimulate input btween
our qoverning bodies and allow an understanding of present and
future policies consistent with the overall planning concept.
I would appreciate your discussing this with your Board Monday
evening, February 23 , 1981, and notifying me of your decision.

Dear Dick :
I have your letter of February 17 regarding the City of Orono' s
Comprehensive Plan. I did receive a call yesterday from Connie Kozlak
of the bletropolitan Council and she indicated that there will be time
for our Board to review and respond to the Plan. You were correat in
assuming that this would be the case.
Dick, I want to be sure that you understand ry role in the
Comprehensive Plan review process for our district . The Superintendent
assigned to ,me the task of reviewing the plans as they are received
from each city in the district , reporting back to him and' the Board
and, finally, preparing a written response. Orono' s is now the sixth
and last plan under review.
iy role is not one of speakin for the Superintendent or the School
Board. You are correct in that I did express to you a concern on the
part of some of our Board members regarding Orono' s Land lise Plan ,
as well as having only or. counci mmber from ou2 area.
The Board members ' concerns arise from the fact that by far the
area of greatest potential for grou•th for our district , within at least
the next• twenty-year period, is Orono ' s Rural Service Area. Your Plan
indicates that this entire area is to remain rural and that municipal
sana.tary sewers vill not be extended into the rural areas. It further
states that Orono ' s Urban Service Area (hiLSA) and the Sewer Service
Area (b4SSR) are fixed as described by Resolution of the Orono City
Council as shovn on your biap 6 in the Plan book.
Orono School District has dropped from a peak enrollment of over
2700 to 2272 at present . If present trends continue , we will be c3ovn
to 1950-2000 bS• 1984-85. Since enrollment , particularly at the high
school level , has an important bearing on the quality and diversitS•
of the curriculum and, because state aids are tied directly to pupils,
it appears to me that the impact of the Orono' s Plan , if adopted as is ,

could he very detrimcntal to the school System. It is tliis concern
that prompted me to sugst to you that it miht le very helpful if
our board members and your council members could meet and discuss these
item5 .
Until this past week , we felt we must reister concern regarding
Orono' s Land Use Policy as it relates to the water problem. This is
because Orono' s Plan leves all the land in the area north of the
Burlington tracks and west of Old Crystal Bay Road as a Rural Service
Area. Orono, because of Long Lake' s unwillingness to form a joint
agreement , was ready to proceed with plans to build a separate vater
s5stem for the school and the businesses in the area. This was set
forth in the Orono engineer's study entitled "Orono School Water
District" .
The School District and businesses affected realized that , under
most of the options given , water rates would be exorbitant and
therefore , Dick, I believe it highly relevant to consider Orono' s
Land Use Policy if Orono plans to build a separate system. Now that
this is apparently not going to be the case , I agree that it should
not interefere with negotiating a new water agreement with Long Lake.
?,irs. Engelstad, Orono School Board Chairman , contactaiDr. Lennon
regarding your official request for a meeting of board/council
members on the subject of land use. She is very receptive to this and
Dr. Lennon has placed the item on the agenda for our meeting next
biontay evening, February 23 , 1981 . Ye wiZl be in touch with you
following that meeting. •
Please convey to the counczl members that we appreciate very much
the efforts made to date to resolve the water problem. Let ' s hope
that a meaningfulagreement can be formed soon .
Sincerely ,

Once we finish the preliminary investigation, we will
