February 23 , 1981 The Orono Council met on the above date with the following members present : Mayor Van Nest, Council- members Butler, Hannah, Hurr , and Paurus. Also present : City Administrator Benson, City Planner Olson, Zoning Administrator Mabusth, City Attorney Malkerson, and City Engineer Cook. Mayor Van Nest announced that now was the time and PUBLIC HEARING place for the public hearing concerning a petition Sandy Beach for Sandy Beach swimming area. City Administrator Benson presented the Notice of Public Hearing, the Affidavit of Publication, and the Certificate of Mailing. Dick Benson, City Administrator , read into the record a petition to continue the Sandy Beach swimming area, which states: "We , the local residents of the Sandy Beach area of Orono wish to speak out on the beach issue : the beach has been here for years, enjoyed by parents and children alike. It is the only public area in the neighborhood within walking distance for local residents to swim, relax and enjoy Lake Minnetonka expecially for off-shore residents who would otherwise be "choked-off" from the lake. People buy homes and locate in the lake area hoping to enjoy the lake . Any attempt to close the beach by a few property owners in the area is selfish and certainly not in the best interest of the entire community. We appeal to the Orono Council to continue this needed recreational facility. " The above petition contains 100 signatures. Mayor Van Nest requested a show of hands of those in attendance in favor of closing the beach area. Twelve hands were counted. Those in favor not to close the beach area. Fifteer� hands were counted. Mr. ,7ohn McCallum read into the record the attached statement. I am opposed to the Sandy Beach beach area. (Continued) Don Shaw, 3325 Crystal Bay Road : I would like to see the beach area maintained as it is . William Bennett, 1453 North Arm Drive : The beach area has been there for many years and was there before the present people in the area moved in. I want the beach area to remain as it is . William Moeller, 5200 Bartlett Boulevard, Mound, swimir,ing instructor : The problem is uncontrolled dogs and parking problems. Deborah Kullberg, 1736 Shorewood Lane, Mound, Director water Activities : The dock design should be changed from an L to a T design. Buoys should be extended around the swimming area. A phone and beach rules readily available should be installed. The program now does have a paid life-guard present during swimming lessons. Cindy Lynn, 1550 North Arm Drive : I believe there is a certain crowd causing problems at the beach area. Mayor Van Nest: If residents would furnish license numbers of cars causing problems, the police would respond immediately. Bob Anderson, 3843 Cherry Avenue : We want the beach area to be kept open. Don O'Reilly, 3928 Cherry Avenue : We need this type of recreation. Closing the beach is not acceptable. We want the beach to be kept open and the facilities improved as they now exist. Linda White , 3908 Cherry Avenue : Our concerns are : parking, emergency vehicle access, and controls at beach area. Kelly Dobbs, 1535 Minnie Avenue : We want the beach area kept open. Mayor Van Nest: We need the residents to work together and help enforce rules and regulations. We need your complaints when problems occur . After all persons present had an opportunity to be heard, Mayor Van Nest closed the public hearing at 8 : 10 P.M. Mayor Van Nest moved, Butler seconded, to direct staff and the Park Commission to review the Sandy Beach area and enter this matter on the April 27 , 1981 Council agenda for Council action. It is so small very� few people even know :it exists . That is one of the things we like so much about it . It is never crowded and almost everyone there just walks to it . It is usually pretty quiet too . Frequently last summer a car load of older kicis were there and that is the only tir�e , it got a little wild . The only time you see more than one car is during swimming lessons . Please realize how important s��ir�ming lessons are to our children , especially with all these lakes . And alot of mot3iers don ' t have cars to take their children te lessons any where else . There are no other beaches anywhere in this area. Please try to understand what an important part of the neighborhood it is . The kids 2lso go there in the winter • to play and skate on the ice . No comments from the Park Commission. PARK COMMISSION Mr . Gary Desentis, representing Sailor ' s World SAILOR' S WORLD MARINA Marina, discussed the marinas 1981 license application. Mayor Van Nest : The City needs to know who the City is licensing for this operation and who the boats belong to. It appears to the City that there is a dual use of the property involved. We need to know exact number .of boats and we have to identify parking facilities and who is the responsible person to be licensed. City standards have to be met at this location and for this operation. Mayor Van Nest moved, Paurus seconded, to direct staff to identify use of property, number of boats, who they belong to and parking facilities . Motion, Aye s (5) - Nay s (0 ) . Alan Olson, City Planner, reviewed with the City COMPREHENSIVE PLAN* Council his letter to Thomas Anderson, Mayor of Medina Medina, concerning Medina ' s Comprehensive Plan. No comments from the public present. PUBLIC COMMENTS Alan Olson, City Planner, reviewed with the City SUBDIVISION Council the preliminary subdivision request of 2605 W. Lafayette Road Bruce Hepp, 2605 West Lafayette Road, dated #545 February 19 , 1981 . Bruce Hepp Mr . Jevne , attorney representing the applicant Bruce Hepp, commented on his client ' s application by stating that when considering the total building envelope size, there is 40 ' allowed for a driveway easement and 11 , 500 sq, ft. is still available for the building envelope . We feel the 11, 500 sq. ft. designates a buildable lot. Any restrictions can be recorded on a permanent record. Technical code violations have been noted. We request granting of variances if they are needed. In maintaining the character of the area, we want to address unique technical problems that were not created by Mr . Bruce Hepp. The proposed lot is still the largest in the neighborhood. Mr . Hepp 's request is reasonable . I have reviewed all findings. Variances have been allowed before, have been noted i£ required and should be reviewed and considered as par�t of our request. There is no evidence of traffic problems and staff have not documented such problems. The parcel is still one parcel and 2605 W. Lafayette Rd. one lot. The proposed driveway does not change the (Continued) character of the lot. We are not combining two parcels of land for other purposes, public, private, or road easement does not apply to the Hepp proposal. If it should, this should be considered as a variance . This area is unique and not unusual to the Hannah easement. Drainage problems do not exist that we are aware of pertaining to the building envelope . There are some unique conditions such as the cul de sac and lagoon. We do have many hardships. One is being denied occupancy since my client purchased the land for a residence. Mr. Hepp is being transferred to Italy and wants to retain the lots for himself, wife , and , children and the City is imposing a real hardship if they are not allowed to use the property. The Council ' s statement that the applicant plans to sell the property for a greater value is not true. The Council ' s action on variances are quite technical and have not been well thought out. Subdividing the larger parcel into two lots will not cause deterioration of the area. Mayor Van Nest: Mr. Jevne, your application does not meet City performance standards simply because it has been assumed that this proposal would not require • variances, when in reality, there are variances required. The easement required to serve the existing house on this lot leaves a building envelope that is much less than required in a standard lot in the one acre zone. In fact, the building envelope is only 39� of standard with a 20 ' wide easement and a 10 ' building setback. This is reduced to 23� with the required 35 ' building setback. If the easement is granted at the required width of 50 ' with a 35 ' building setback, then the building envelope is reduced to only 180 of standard. The location of the easement destroys the lot. This is not a reasonable building site, if youu are to meet the City code requirements. I wish to note here that Mr. Hepp ' s application created the easement, no one else did. Mr. Jeven: Yes, that is correct. Mr. Tom Lowe , 2630 West Lafayette Road: The hardships were in existence when Mr. Hepp purchased the lot. Heglur.d : As you are aware , we have in the past, periodically discussed your concerns with the a�:�ount of water that your city is receiving fro�n the Orono area west of you, served by sanitary sewer . It has been noted that the Metropolitan Waste Control Commission is not properly calculating the sewage flo�a and charging back to the City of Orono their fair share of the total sewage flow. It has been suspected that Washington Scientific a:�d Van Dale Manu- facturing were pumping from private wells into the sewer system that was.not being metered. , The City of Orono completed an inspection of these establishments and eae have determined that Wash?ngton Scientific and Van Dale wells are capped off and are not operative . The only private well pumping into the municipal sanitary sewer system is located at �he Orono school complex, which is metered for internal and external uses . The Metropolitan Waste Control Commission obtains these well meter readings, city water meter readings, �neasures sewage flow •from a weir in the last manhole leaving Orono and uses these figures to determine Orono ' s sewage charge . The City of Orono completed in 1980 , televising oi all of the sewage lines in our area west of your city at a cost of $S ,OOQ , the end result was a repair of one deflected pipe in the entire system. The entire cost of televising was shared by the City of Medina, City of Orono, and our Z b Z Study inflow and infiltration analysis which we are implementing on our entire sewer system in Orono. This was accomplished to satisfy the City of Medina that these sewer lines were in satisfactory condition before Medina-Morningside is connected. I did receive a call yesterday from Connie Kozlak of the bletropolitan Council and she indicated that there will be time for our Board to review and respond to the Plan. You were correat in assuming that this would be the case. Dick, I want to be sure that you understand r�y role in the Comprehensive Plan review process for our district . The Superintendent assigned to ,me the task of reviewing the plans as they are received from each city in the district , reporting back to him and' the Board and, finally, preparing a written response. Orono' s is now the sixth and last plan under review. �iy role is not one of speakin� for the Superintendent or the School Board. You are correct in that I did express to you a concern on the part of some of our Board members regarding Orono' s Land lise Plan , as well as having only or.� counci� m�mber from ou2 area. The Board members ' concerns arise from the fact that by far the area of greatest potential for grou•th for our district , within at least the next• twenty-year period, is Orono ' s Rural Service Area. Your Plan indicates that this entire area is to remain rural and that municipal sana.tary sewers �vill not be extended into the rural areas. It further states that Orono ' s Urban Service Area (hiLSA) and the Sewer Service Area (b4SSR) are fixed as described by Resolution of the Orono City Council as sho�vn on your biap 6 in the Plan book. Orono School District has dropped from a peak enrollment of over 2700 to 2272 at present . If present trends continue , we will be c3o�vn to 1950-2000 bS• 1984-85. Since enrollment , particularly at the high school level , has an important bearing on the quality and diversitS• of the curriculum and, because state aids are tied directly to pupils, it appears to me that the impact of the Orono' s Plan , if adopted as is , DR. It is tliis concern that prompted me to sug��st to you that it mi�ht l�e very helpful if our board members and your council members could meet and discuss these item5 . Until this past week , we felt we must re�ister concern regarding Orono' s Land Use Policy as it relates to the water problem. This is because Orono' s Plan le�ves all the land in the area north of the Burlington tracks and west of Old Crystal Bay Road as a Rural Service Area. Orono, because of Long Lake' s unwillingness to form a joint agreement , was ready to proceed with plans to build a separate �vater s5�stem for the school and the businesses in the area. This was set forth in the Orono engineer's study entitled "Orono School Water District" . The School District and businesses affected realized that , under most of the options given , water rates would be exorbitant and therefore , Dick, I believe it highly relevant to consider Orono' s Land Use Policy if Orono plans to build a separate system. Now that this is apparently not going to be the case , I agree that it should not interefere with negotiating a new water agreement with Long Lake. ?,irs. Engelstad, Orono School Board Chairman , contactaiDr. Lennon regarding your official request for a meeting of board/council members on the subject of land use. I have reviewed this information with you generally at the City Council meeting of February 23 , 1981 . This will confirm my understanding that the City Council wishes us to proceed with further investigation and to take what action is necessary in order to ensure tha1� the City ' s interests are protected. This matter will be handled primarily by Jim Steilen of our office since he is more of an expert than I in the area. of land title registrations, legal descriptions, etc . Of course , I will be involved in the overall direction of the review and any negotiations. Once we finish the preliminary investigation, we will contact the present property owner to see whether or not that property owner would be willing to relinquish control of the parking lot to the City instead of having the property tied up in title objections and possible litigation for an extended period of time .
