A RESOLUTION GRANTING
VARIANCES TO
MUNICIPAL ZONING CODE
SECTIONS 10.03, SUBDIVISION 12,
10.03, SUBDIVISION 14 (C) AND
10.25, SUBDIVISION 6 (B) -

W�gE�, William Allen (hereinafter "the applicant") is owner of the property
located at 3475 Livingston Avenue within the City of Orono (hereinafter "City") and legally
described as follows:
Lot 10, Block 5, Navarre Heights, Hennepin County, Minnesota (hereinafter "the
property"); and
WHEREAS, the applicant has applied to the City for a variance to Municipal
Zoning Code Section 10.03, Subdivision 12 to allow less than the required to�allowaaaside
between two structures, and a variance to Section 10.25, Subdivision 6 (B)
setback of 6' where a 10' side setback is normally required, and a variance to Section 10.03,
Subdivision 14 (C) to allow structure n�oe�e existing residen ee 15% limit, such variances

NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #1953.
2. The property is located in the LR-1C, Single Family Lakeshore Residential
Zoning District.
3. The Orono Planning Commission reviewed this application on August 15, 1994,
and September 19, 1994 and recommended on a vote of 4-0 that the side setback

be approved at 6', that the structure-to-structure setback be held to a minimum
of 7' by reducing the addition to 12'x14', that the deck not be approved but a
stoop and steps be approved, and that the variance for lot coverage be allowed in
light of the 1,500 s.f. allowance for small lots. Planning Commission based the
above recommendation upon the following findings:

� C. The 7' structure-to-structure setback yields a more open visual impact and
thereby has minimal impact on visual density in the neighborhood.
D. Lot coverage as proposed is acceptable considering the small size of the
lot and the fact that lot coverage will be less than the 1,500 s.f. limit for
small lots. The lot is .15 acres in area and 50' in width, similar to a
majority of lots in the area. The proposed improvements are not
inconsistent with the Navarre Heights area.
4. The City Council has considered this application including the fmdings and
recommendations of the Planning Commission, reports by City staff, comments
by the applicant and the effect of the proposed variance on the health, safety and
welfare of the community.
5, The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variance would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would not merely
serve as a convenience to the applicant, bu�t I� �eea substantialiproperty
demonstrable hardship or difficulty; is necessary P

Zoning Code and Comprehensive Plan of the City.

CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above fmdings, the Orono City Council hereby grants a variance
to Municipal Zoning Code Section 10.25, Subdivision 6 (B) to allow a room addition to be
located 6' from the side lot line where a 10' setback is normally required, and grants a variance
to Section 10.03, Subdivision 12 to allow a structure-to-structure separation of 7' where a 10'
separation is normally required, and a variance to Section 10.03, Subdivision 14 (C) to allow
structural cover�ge of 1,349 s.f. or 20.0% where structural coverage of 15% or no more than
1,500 s.f. is normally allowed, subject to the following conditions:
1. The room addition shall not exceed 12' in depth and 14' in width, as shown on
the site plan attached to this resolution as Exhibit A.
2. No deck structure shall be allowed on the property, however, the necessary stoop
and stairs for access to the rear entry will be allowed.
3. The applicant is advised that with the proposed additions, hardcover on the
properry will be at approximately 31.5% in the 500-1,000' zone where up to 35%
hardcover is normally allowed.
4. Improvements to the property which must be completed as part of this project
include taking measures to solve the drainage problem adjacent to the house,
repairing or properly abandoni.ng the well, and painting the residence.
5. Authorities granted by this vanance run with the property not with the applicant,
but are permissive only and must be exercised by application for a building
permit within one year of the date of Council approval, or this variance will
expire on that date (October 10, 1995).
6. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a misdemeanor.

7. The undersigned applicant has read, understood and hereby agrees to the terms
of this resolution and on behalf of himself, his heirs, successors and assigns,
hereby agrees to the recordi.ng of this resolution in the chain of title of the
property.
Adopted by the Orono Ciry Council on this lOth day of October, 1994.
