Special Neeting ef the Grono Council, 7 : 30 P.M.
October 8 , 1980
,..� The Orono Council met on the above date with
the following members present : Mayor Van Nest,
Councilmembers Butler , Hannah, Hurr , and Paurus .
Also present : City Administrator Benson, City
Planner Olson, Financial Consultant Chenowith,
Finance Director Kuehn, and City Attorney Malkerson.
Mayor Van Nest reviewed the proposed sewer projects 1980 LS-1 & LS-2
commenting that this meeting is a Special Council
Meeting called for the purpose of making a final
decision on the four areas included in the 1980 LS-1
and LS-2 , (1) County Road #15 (Marina area) (2) Orono
Lane , West Ferndale , (3) North Shore Drive (4 ) Minne-
tonka Bluffs. The City has held its public hearings
receiving input from the affected residents and a
public hearing was held September 8 , 1980 concerning
the assessment roll which has been adopted. This
evening, we will discuss each area in the following
sequence : (1) County Road #15 , Marina area, (2) Orono
Lane , West Ferndale (3 ) North Shore Drive (4 ) Minnetonka
Bluffs . Our City Engineer Mr . Glenn Cook will review
with you each area and the present status of easements,
appeals, the final tabluation of the questionnaires
mailed to each of you, and a summary of construction
costs . I would like to again remind all of you that
i:� as�ticipation of appeals and reluctance to submit
ease�::ents to the City, we have included that cost in
each assessment. If these problems can be resolved,
your assessment will be reduced.
T-�rea #1 - County Road #15 (Marinas)
Mr . Glenn Cook reviewed area #l, the Marina area, com-
menting that all easements are obtainable , there are
no appeals pending for this area and the City has
had no negative response to this par�icular sewer
project. This project will have a reduction in
assessments because of obtainable easements and lack '
of appeals, if there are no other unforeseen costs. A
public hearing will be held in the future and a per-
centage of the assessment will be abated when final
costs are determined. The present assessment roll
for this area is $9 , 641 per unit. Because the project
is separated out from the other projects,the assessed
cost according to contractors bids should be $7 , 900 .
James Rivers, 1440 Shoreline Drive : Please start the
project now.
Mayor Van Nest commented that it appears �hat this
project could be reduced another $2, 000 to $2 , 500 per
assessment because of no litigation and if all easements
are executed.

Dick Benson, City Administrator, commented that Mr . Born
called and reQuested the sewer as soon as possible .
Butler moved, Mayor Van Nest seconded, to adopt RESOLUTION �1210-A
Resolution #1210-A, a resolution ordering in the County Road #15
sewer imp�avement and proceed with the sewer (Marina Area)
construction for County Road #15 (Marina area) ,
awarding the construction project to Latour
Construction Company as the low and responsible
bidder as per the City Engineer and bid tabulation,
autnorizing the �ayor and City Administrator to
sign contracts. Motion, Ayes (5) - Nays (0 ) .
Area #2 - Orono Lane - West Ferndale '
City Engineer Cook reviewed Area #2 - Orono Lane
and West Ferndale .
Easement Phone Calls - Exhibit #1
Bill C. Fox - Will be out of town next week
(Wednesday, Thursday) Has no problem with signing
an agreement.
Maurice L. Melamed - 473-8839 Mrs. Melamed (473-2588
office) is handling the easement. She says they have
no problem with signing the easement.
Frederich Betlach - work 473-8833 (off Mondays) Will
sign easement. May want to change location of the
line slightly. I indicated that I will make an appoint-
ment at a later date to settle the easement.
Don Gamble - Will sign this easement if he is reassured
that someone in the area will not ask for a lot of
money for easements .
Gordon Ritz - Same as above

Mr . Cook commented if the project is ordered in and
the City does not incur added cost to resolve easement
and appeal costs, the adopted assessment can be reduced
proportionately. I feel a reductic�n of $2 , 000 to $2 , 500
per assessment can be justified, if all easements and
appeals are resolved without a further cost to the City. ,
These costs can be abated when final project costs are
determined. The project assessment for this project
area is $20 ,197 per unit for West Ferndale and $14 , 481
per unit for Orono Lane .
Mayor Van Nest commented that we have stated previously
you will not be penalized with an interest charge if
your assessment is all prepaid by November 15, 1980 .
Mr . Glenn Cook commented that we do have a
commitment from the Metropolitan Waste Control
Commission as neogitated by Mr . Benson to allow
the City to pump into the force main. '

' This letter is a follow up of our meeting of September 29, 1980 respond-
; ing to your resubmitted plan (received September 19) on sanitary sewers
� in the City. These sanitary sewer projects (I-Tanager Lake , II-Orchard
! Road South and III-North Shore Drive) have been revised to show alternate
I construction for each of the projects.
I � The Commission reviews and approves connections to our interceptor based
; � on location of existing stubs , ability to isolate and determine sewage
flow from an area, and whether the potential new connection may influence
� ' the structural integrity of the wastewater. These conditions were con-
j � sidered when we responded in our letter of September 2 to your earlier
; submittal of these projects.
In accord wi.th our meeting of September 29 and after reviewing the bids
for the Project II system the Commission agrees that the direct tap
i I connection to o�r interceptor as proposed is the most cost effective
� i alternative. Detailed drawinqs on how the tap connection is to be made
I
� must be submitted for our review and approval prior to the issuance of a
connection permit. Since the sanitary sewer system described under "
Project . II serves a substantial area , it is proposed to install a meter
under-your contract at or near Lift Station No. 1 in a location accessible
for routine service and maintenance. The Commission will reimburse you for
� installing the pr�posed meter which meets our standards and in accord G,�ith
� � an agreement. Please transmit costs figures to our attention when they
� I become available.
� � As per our agreement the alternate in Project III is the only acceptable
solution for service in the area of North Shore Drive. The type of pump
� necessary to pump against a sr�all uniform head is much more desirable and
less costly than one designed to pump into the high variable head of the
interceptor forcemain. For the foregoing reason and that this flow can
be measured on the existing Orono meter (M-429A) , Alternate I is the
acceptable mode of service.

via a direct connection to the interceptor pipe. No connection
will be perr,�itted to the cleanout manhole (OP. 2�+00) as indicated

I do not feel we should relocate the lift station.
If part of the project does not go, as the Minnetonka
Bluffs area, we will have to assess part of the lift
station cost to the Bluffs area, because the station
will eventually be used by them.
Mayor Van Nest : I think we should assure Mr . Gamble
and Mr . Ritz that the City will negotiate easement
costs with them if others in their project ,are paid
for their easements , and are not part of litigation .
Butler moved, Mayor Van Nest seconded, to authorize
the Engineer to submit a letter to Mr . Gamble and
Mr . Ritz that the City will accept their easements
subject to return and renegotiate easement cost if
other residents in their area project are paid for
easements, which are negotiated separately from litigation.
Gordon Ritz , 1165 Ferndale Road West : I do not
believe West Ferndale was included in the City ' s
original request for Federal funding.
Mayor Van Nest : Mr . Ritz, I have before me copies
of a November 20 , 1979 memo to the Council and an
October 10 , 1979 letter to Deborah Thurston of the
Pollution Control Agency. The attached map does
show West Ferndale as being included in the request
for Federal monies . I ask that these memos and
letters be entered into the minutes.

Mr . Weed, 1385 Orono Lane : Aren 't the Pollution
Control Agency people coming out this month? Can 't
we wait?
Mayor Van Nest: Priorities, which mean being
entered on the municipal needs list, have to be
accomplished. It will be years before a determina-
tion ,is made' if Orono is to receive funding.
Mr . Weed: I would like to see us wait. I want the
project delayed until after the Pollution Control
Agency determination. There are many including
Mrs. Kelley, Mr . Thomas and others that live on
Orono Lane that object to the sewers.
Henry See , 1389 Orono Lane : Is Orono Lane lumped into
one project?
Mayor Van Nest: Yes, but Orono Lane and West Ferndale
are bid separately from other areas.

I met with Mr . Duane Anderson, P . C.A. Grant Coordinator , and Mr . Rooer
Bjork, Grant Planning Analyst. Their comment was they found it
very difficult to explain to Dr . Lauer that in reviewing Orono ' s
plans for sewering their area , they determined a need for the sewer
project but it had not been determined ii Orono would be officially
entered on a needs list, monies were not available at this time and
it could be three years , if at all , if 'funds would be available .

Orono ' s basic philosophy is that further high-density de��elopment
would be det-imenLal to �he Lake ?�Sinnetonka ecosystem_ This type
of develormen� normally occurs with the ad.�ent cf municipal se�.ers.
T�ere�ore, we intend to develop with septic systems on two anc
r five acre lots in the existing unsewered are�s , with, an active
permanent program of plan review, construction inspec�ion, and
regular existing system inspection with mandatory maintenance_
This will necessarily include finding alternatives to septic svstem"s
in a iek existing developments �:here site conditions or lot sizes
Tr�ake it essen�ially imposs�ble to adequately treat se�:aae with or.-
site methods. Once these existing problen� areas are remedied , all
future development should continue in an orderly fashion without
the problem of "leap-frogging sewers" .
Our present priority list for remedying existing problems is :
1. Minnetonka Bluffs - Feasibility Study about to be called
- (construction 1980?)
2 . Shoreline Drive - Feasibility Study about to be called
(construction 1980?)
3. Crystal Bay Area - Proposed within three years of interceptor

Ti�le II of the � Federal k'ater Pollution Control Act A.mencments of
1972 and �he Clean Iti�ter Act of 1977 authorize the award of con-
s�ruction grants for wzstewater treatment facilities . Under the
prograrc, funds are allocated by the U . S . Enviro:-�-nent�l Protec�ion
Agency (EPf) to the State on the basis oi need and population. 1/
Of the to�al eligible costs of a project , the federal share is
%5 percent.
Grznts are �warded to nunicipalities of the State according to a
priority sysLem outlined in State Water Pollution Control Rule 34
(WPC-34) incorporating criteria specified by �he EPA. � L,�C- 34 pro-
vides a State match of 15 percent of the total eligible cost ,
leaving 10 percent to be borne by the municipality.
In adcition, the 1977 Clean Water Act authorizes zederal grants
oi 85 percent ior projects which utilize innova�ive and altern�-
tive treatment technology. :
The construction of a federally funded waste treatment facility
" in3olves three sep�ra�e grants . The iirst g;ant (Step 1) is for
facilities •planning , which includes a cost-effective analysis and
enzTiron�en�al asses'sment of alternative �modes o� trea�ment and an
anzlysis of infiltration/inflow into any existing sewer systems .
If infiltration/inflow is excessive, a sewer system evaluation
survey is also done during the Step 1 phase . A public hearing
must be held to allow co�ment on the completed facility plan and
it must be submitted for State and regional planning agency
review.

will be $162 , 611 , 700 ir. FI 19 7fi through FY 1�79 _ The E�A con-
ducted a surve}� o` e�is�ing �:astewater trez�men� needs in T�sinr.esota
in 1978 and determined that based on 1978 dollars , it i�ili require
$1 . 226 million to correct all e�:isting treatment needs in 2�Zinnesota.
Deter�inarion of Fundin� Priorities
�ne cri�eria ior deter�:iining the order in �,�hich projects will be
funded is set forth in EPA Construction Grants Regulations
(40 CFR 35. 915) and in WPC-34 (State of T:innesota rules) . 2/ The
criteria include iactors such as : (a) population; (b) degree of
� need,; which is determined by the current use of tne receiving
water bod��, s�ringency of effluent standards which must be �et ,
and classiiica�ion of recei�=ing river se�ent ; and (c) abili�y to
participate in areawide (multi-cou�nunity) treatment .
For administration purposes treatment projects have been cate-
gorized as : (a) wastewater treatment works ; (b) major interceptor ; .
(c) interceptor ; and (d) sewer s}�stem. �n December 1973 , t�e
� Ninnesota Pollution Control Agency (r�'CA) Board adop�ed a polic��
which ranked these categories for iunding. This polic�� is
reflected in the 1978 revisions to WPC-34 so that wastewater �reat-
ment works and major-interceptors receive the highest priority and
interceptor and collection system projects receive respectively
lower priority. 3/

of scope will be made by the Regiona� Aamir.istrator or tY�e EPA
when gran�� assistance is ��:arded. After June 30 , 1975 , nei �ner
facilities planning nor plans and specifications may be ini�iated

Bruce Malkerson: The City; if it should continue to
have problems acquiring easements in this area,
should consider avoiding these easements and construct
sewers in the street. This will mean a much higher
cost to connect to the sewer pipe .

Mayor Van Nest : The City does have options.
Mr . Wilson, 2485 North Shore Drive : This easement
will have a severe impact on my property.
Mrs. Jester , 2515 North Shore Drive : I am opposed
to the project.
Mr . Phil Chenowith, Financial Consultant, reviewed
the current bond market commenting that the market
today is 820.
Mayor Van Nest: The City is faced with inflationary
construction costs in attempting to sewer small
dense areas and the City might have to apply some
of the cost to the ad valorum taxes.
Mayor Van Nest moved, Butler seconded, to adopt RESOLUTION #1219
Resolution #1219 ordering in the sewer improvement North Shore Drive &
and proceed with the sewer construction for North Scotch Pine Lane Sewers
Shore Drive and Scotch Pine Lane , awarding the
� construction project to Nodland Associates, Inc. -
as the low and responsible bidder as per the City
Engineer and bid tabluation, authorizing the Mayor
and City Administrator to sign contracts. Motion,

Area #4 - Minnetonka Bluffs
Mr . Glenn Cook, City Engineer, reviewed Area #4 ,
Minnetonka Bluffs area, noting that the original
assessment was $14 , 515 per unit.
Bruce Malkerson stated that in reviewing the appeals,
it appears that there are some that are not valid
because an objection to the assessment was not
filed by September 8 , 1980 which was the assessment
hearing date and is required by law. '

Mayor Van Nest : This area has a very Y�igh percentage
of appeals. Also easements are not being executed
which really inflates the cost to construct sewer
in this area. If the residents in this area would
agree to provide easements to the City at no added
cost and agree to stipulated settlement of appeals,
we can eliminate some engineering, legal, and
administration cost and lower each assessment for �
this area to $7 ,g00 or $7 , 500 .
There are options :
1. Do not construct sewers in the area and assess
part of lift station and other technical costs
2 . Or�er in the project and reduce the assessment
noW if we eliminate easement and appeal cost
3 . Approve project, leave the assessment roll as it
is and abate some monies by November 15 , 1980
if easement and appeal costs are reduced
Dave Johnson, 500 Hanlon Avenu�, asked if he could
review the summary of the construction costs .
Mr . Cook and Mr. Malkerson reviewed the cost
summary with the resident.
Summary of Costs - Pages 31-35
Mr . Herr , attorney representing appellants: What
are my clients going to receive in reduced assessments?
We object to giving up our appeal rights. What is
the bottom figure?
Mayor Van Nest: The City will make that decision
tonight. Friday, October 10 , 1980 is the last day
the County will accept the assessment roll for this ,
project. If we are to construct this year, we must
certify the costs now. The City has already
� assumed some legal, engineering and administration
costs. I fe�l we should assess each unit in the
Minnetonka Bluffs area their portion of the costs
also their portion of the lift station the City
has to construct to accommodate future flows.
Councilmember Hurr : Mr. Herr, would you like to
meet with us again, possibly Saturday morning to
work this out?
Mr . Herr : My clients do not want that.
Mayor Van Nest: If this project fails, the City
will have to assess to each Minnetonka Bluffs unit
a trunk charge. ' �

our last project was much higher than this. Tfie City
would take advantage of grant monies if it were available .
But it appears, it is not.
Mayor Van Nest: After reviewing this, I would be �
receptive to setting the assessment now at $9, 833 and
reducing this $2 , 500 if, by November 1, 1980 , we have
received assurances that easements and appeals have
been resolved without added City expense . This will
allow the City Council to act by their meeting of
November 10 , 1980 .
Richard Ford, 500 Orono Orchard Road South: I cannot
afford to live here unless the cost is reduced $3 , 000 .
Mr . John Massopust, 550 Orono Orchard Road South:

on their own.
Mayor Van Nest moved, Butler seconded, in the event the
City orders in the Minnetonka Bluffs project at the
assessed cost of $14 , 515 per unit, the City will review
this assessment cost at their November 10 , 1980 Council
meeting and reduce the assessment to $7, 333 per unit, if
all easements and appeals are negotiated to eliminate
additional cost to the resident. Motion, Ayes (5) -

Hurr moved, Butler seconded, to assess only the
Minnetonka Bluffs area units a portion of all preliminary
costs to date including a portion of the lift station
to be constructed to serve the Orono Lane , West Ferndale
and Minneto�ka Bluffs areas. Letter to be mailed to
all Bluffs residents outlining these costs which total
$1,834 . 68 per unit. Motion, Ayes (1) - Nays (4) .

the City does adopt a resolution to order in the sewer
improvement for the Minnetonka Bluffs area and to proceed
with the sewer construction for the Minnetonka Bluffs
area and award the construction project to the. low and
responsible bidder , the City of Orono will modify the
Minnetonka Bluffs assessment roll and reduce the assessment
to $9 , 833 . In the event the City of Orono does receive
easements andsettlement of appeals at no added cost to
the City prior to November 10 , 1980 , the City Council
at that Council meeting will reduce the assessment
for the Minnetonka Bluffs area $2 , 500 to $7, 333 per unit.

Ladi,es and Gentlemen:
I received in the mail the notice of a special meeting for
October 8 on the sewer project. I am unable to be present
at the meeting, but I do wish to repeat one point which
again perhaps has not been mentioned for some time.
The area through which the proposed sewer would pass along
North Shore Drive is at the edge of the wetland area formed
by French Lake, and the pipe will pass through part of that
wetland. Although the part on our side of the road is par-
tially dammed from the other portion of the area by the road
itself, and although the wetlands may not be cansidered. of
great natural beauty by themselves , they do add considerably
to the enjoyment of the area in which we all live because of
the variety of birds, such as heror., bittern, pheasant, geese,
ducks of various kinds, red-wing blackbirds, and even because
of various small animals which live around it. Moreover, they
contribute to the openness and general charm of the area.
Although there are a number of such areas in Orono, they are
not too numerous in the metropolitan area as a whole. Damage
to even part of the system damages the whole.
Considering the fact that the installation of the sewer can at
the very best only be marginally justified on the basis of
possible future need, it seems that you should consider the

possible risks of damage to the area in which the sewer w��.l d

be put as well. This possibility of damage arises from toe�'o o Z

Iu the first place, it is impossible to tell what the res t �
of digging the sewer and piling the bottom on a 50-foot e e- � �
ment strip during the course of construction will be on t� o rn
swamp as a whole. Whatever the engineers and contractors ay, ;.�
it is evident that it is impossible to tell because it is�hat �
fact which makes the bid for the sewer as high as it is i�our �
area. The obstacles to be met by the contractor in digging
through. the wet area are so uncertain that the bid must be as
high as possible to protect the contractor. And if in the dig-
ging, or in the use of machinery and the piling of heavy mud on
the soil along the trench, even for a relatively short period of
time, the bottom or general drainage is damaged or the area
flattened, it will be a very long time before it returns to its
present state, if it ever does . One thing is certain, the area
will not be returned to its present state regardless of any form
of contract because the nature of the soil and the work done will
prevent it. This wetland condition probably runs from at least
the edge of the Jester' s land across that land, our land, the
Eastman land and on up toward Highway 84 .
In the second place, a fact which will have a bearing upon the
matter mentioned in the previous paragraph, the land in that
area is extremely unstable. It is so unstable, and unstable in
such an uneven -fashion, that in the springtime it is quite com-
mon for even a car as light as a Toyota to get stuck in soft
spots in the driveway while other parts of the driveway remain
hard and stable. It is so unstable that historically it has
proved impossible to pave the driveway even after corduroying
it with willow logs because the logs heave out of the ground and
the driveway breaks up. As a consequence, the long stretches of
pipe which will be used will be whipped up and down much as one '
might crack the end off of a whip, or bend a coat hanger until
� it splits from constant bending. Of course, the contractors and
engineers• will describe the tensile strength of the pipe being
used and the flexibi•lity of the material, but even if true this >
fact will simply transfer the pressure of the movement to the
joints, and the area from one side of our lot to the driveway
of the Eastman' s is a long area. Should it be that the engineers
are wrong and the pipes or joints break, the accumulated sewage
from Scotch Pine Lane down to the point of the break will flow
into the swamp. That such a possibility exists can be seen from
the situation which developed in the Wayzata-Ferndale area near
the end of their system close to the Lindberg' s where another
wetland area exists. And should such a situation develop, the
damage is not such as can be corrected by spending a few dollars .
When Mr. Luke was speaking of this possibility of breaking, he
mentioned that at least on his land the•re was a large area suitable
for drainage, but if the effluent is discharged into the wetland,

there is no method of getting it out. And it will be concen-
trated in its discharge. Whatever the current situation, at
least the lots and the points of discharge are scattered over
a broad and diffuse area, and it is certain that the Scotch
Pine Lane area and the Lukes do not need their present systems
revised nor in any event would they be discharging in the
direction which the gravity flow envisions will occur with the
proposed sewer.
