Dear Mr. Waagen:
On August 26, 1992 a demolition permit was issued to you for the removal of the house at 3433
Livingston Avenue in Orono. As of this date, the foundation remains and a hazardous basement
is left open. A recent inspection also found tlie grass has not been maintained this year.

1'l�is letter is to notify you that these items are in violation of Orono Municipal Code and must
be resolved befoce June 22, 1993. If this deadline is not tnet, the City may initiate legal action.

RE: Foundation Removal - Hazardous Excavation - 3433 Livingston Avenue
Dear Mr. Waagen:
On August 26, 1992 a Demolition permit was issued to you for the removal of the house at 3433
Livingston Avenue in.Orono. On June 8, 1993 the City sent you a letter requiring removal of
the foundation and filling of the hole. We spoke on the phone and you indicated you were
planning to build a new home on the site and stated you would like to remove the foundation
. when you start the new construction. As of this date, new construction has not been started and
the foundation and hazardous excavation remains.
This letter is to require removal of the foundation and filling of,the excavation before November
1, 1993. If this deadline is not met, the City will initiate legal action. If you have any
questions, feel free to contact me at my office.

Department staff reinspected the site on 8/17/94 and noted nc
actian had taken place to rectify the violation(s). Please take actior_ to
comply with the abcve ordinance requirement;s? by 8/29/94 A
follow-up .inspection will be made at that time to verify compliance. � I_`
this matter has not been resolved at that time a citation will be issued
which will require a court appearance.

Conditions exist on the indicated property which constitute a violation of
the following section(s) of the Grono Zoning Ordir.ance:
SEC. 9.50. JIINR CARS, FIIRNITURE, HODSEHOLD FIIRNISHINGS AND APPLIIiNCES
STORED ON PIIBLIC OR PRIVATE PROPERTY. It is unlawful to park or store
any unlicensed, unregistered or inoperable motor vehicle �acking
essential parts , household furnishings or appliances , or parts or
ccmponents thereof, on any property, public or private, unless hc��Gec;
within a lawfully erected building. Any viclation of this Sectioti is
declared to be a nuisance and upon seven days written notice to the
owner, as shown by the records in the office of the County Auditor, cf
private premises on which such material is tc�und, t:�e City may �e�^c`�e
the same and certify the cost of such removal as any other special
assessment. For the purpose of this Section, ar. inoperable motar
vehicle shall be defir.ed as la.cking, includir.g but not limited to,
parts essential to operation, sucr► parts beir.g wheels, tires, motor,
drive train, battery, or having two or more flat tires, or having `he
int�rior, �ncluding the driver's position, used for storage in suc'r. a
manner tnat no person can operate the vehicle.
SEC. �.55. I�L�INTSNANCE OF PRIVATE PROPERTY.
Subd. 1. It is the duty of the owner of every vacant property and the
ewner and occupant of every occupied pr�perty to maintain sarne _n a
neat, clean and presentable manner free cf any �unk, debris, refuse,
iitter, dead trees, or r.oxious weeds, and to remcve all other public
health or safety hazards therefrom.
