Regular r9eeting of the Orono Council , 7 : 00 P .M.
September 15, 1980
The Orono Council met on the above date with the
following members present: Mayor Van Nest , Council-
members Butler , Hurr , and Paurus. Councilrnember
Hannah arrived at 7 : 02 P .M. Also present : City �
Planner Olson, City Engineer Quincey, City Attorney
Peterson, and City Clerk Strom. City Admir.istrator
Benson arrived at 8 : 30 P.M.
Ms . Diane Nelson, American Automobile Association, AAA AWARD
was present to present a two-year pedestrian
safety � award plaque to Mayor Van Nest and Acting
Chief of Police Burmaster .
Police Officers Kurt Erickson and Robert Fiscrier OFFICER ERICKSON
were present for recognition for tneir part in OFFICER FISCHER
saving the life of N�r . Sylvester R. Sotebeer
who was struck by lightning on the Arcola Bridge
on August 7, 1980 .
Police Officer Bruce Anderson was present for OFFICER ANDERSON
recognition of saving the life of an eighteen-
month old boy from drowning in the family pool .
Police Officer Charles Courtney was present for OFFICER COURTNEY
recegnition for his emergency first-aid for a
severe cut on a young lady ' s leg and transporting
her to the hospital .
Staff reports concerning items reviewed at this NEW FORMAT
meeting are attached to the original copy ot these
_ minutes on file in the City Clerk ' s office .

No comments from the public present. PUBLIC CONLMENTS
Councilman Gregg Hannah vacated his seat at the VARIANCE
Council table to discuss the variance and resolution 1410 Bohns Point Road
regarding the Jack Rhode property at 1410 Bohns Point
Road. ,
Mr . Hannah stated that he has no objections to Mr . Rhode
building his house on this property but that he would
like to state his position concerning the easement to
the lake. He commented that when Fred Rogers, then the
owner of the property, sold a lot to Jason Becker , Mr . Rogers
moved the easement to another lot to accommodate Mr . Becker .
Mr . Hannah stated that he was uncomfortable about the
easement and checked with the City of Orono and the Lake
Minnetonka Conservation District and both informed him
that there was no problem with the easement.

Mr . Hannah entered into the record a survey done VARIANCE
in 1974 showing the easement that ran with the 1410 Bchns Point Road
property. He also informed the Council that he (Continued)
was not aware of Resolution �851 until six months
after adoption.
Mr . Swenson, Jack Rhode ' s attorney, was also present.
He informed the City Council that he was not aware
of the amended resolution and needed more time to
review it.
Paurus moved, Mayor Van Nest seconded , to table
this application until the next Council meeting.

Mr . Orton Wisegarver , Keller ' s riarket, was present COI�?DITIONAL USE PERMIT
to discuss his application. 3800 Wayzata Blvd.
Keller ' s Market
Discussion centered around the non-conforming use
status of the property for the former owner and the
present expansion of the property by Mr . Wisegarver.
Numerous violations of the present owner were
reviewed by the City Council.
Mayor Van Nest moved, Butler seconded, to table the
application for Orton Wisegarver , Keller ' s Market,
until the next Council meeting in order for Mr . V�'ise-
garver to prepare more information. Motion,
Ayes (5) - Nays (0) .
Mrs . Donald Nelson, 2705 Walters Port Lane , was present
concerning her variance application.
Butler moved, Paurus seconded, to adopt Resolution RESOLUTION #1199

Mr . Robert Nortenson was present to discuss his CONDITIONAL USE PERMIT
application for a conditional use permit for a 3280 Watertown Road
greenhouse at 3280 Watertown Road. #572
Robert Mortenson
Several neighbors from the area were present to
discuss their opposition to the greenhouse stating
that a business in the area would create more
traffic problems, it would have a deleterious
effect on the neighborhood, and that it was a
commercial business not a hobby.
Mayor Van Nest moved, Paurus seconded, to table
the conditional use permit request of Robert
Mortenson for a greenhouse at 3280 Watertown Road
for two weeks for review of the information presented.

were in attendance to discuss their license 1980 License
application for Sailors World.
Councilmember Butler : It appears that a staff
on-siLe inspection reveals illegal uses of a dock
and slips on the north side of the marina . The
bottomline is that you are only allowed so many
boats and slips.
Mr . Desentis : We have removed that dock since the
last ir.spection .
Mayor Van Nest : There is an overuse of the property.
You have to meet setback requirements and boats and '
slips are not allowed in this setback area. It also
appears that you are continuing to store boat trailers
on residential property at the east end of Railroad
Avenue . This property is not zoned for commercial
uses and the City will not allow it to be used for
commercial purposes.
Councilmember Hurr : Does this property belong to
Sailor ' s World?
Mr . Desentis : No, it belongs to Paul Fahlin.
Mayor Van Nest : I want the record to show that
fishing or contests of any kind are not allowed
and is not a permitted use of the area. Also,
in reviewing Mr . Olson ' s report, it is evident
that Sailors World is storing more boats and
allowing more slips to be used than what was
originally applied for and what has been approved
by the Lake Minnetonka Conservation District . The
City is concerned with constant over use of the
- property and will not allow uses of the area not
originally allowed. Your application is for 130
boats.

Resolution #1200 , A Resolution Directing Staff Sailor ' s World
To Issue A Commercial Dock License To Sailor ' s
World At Paul ' s Landing Subject To Conditions
Noted Herein For The Period Of January l, 1980
To December 31, 1980 , subject to adherence to
original plan and exhibit A, and to meet all
parking requirements. Motion, Ayes (5) - Nays (0 ) .

Mayor Van Nest reviewed the proposed resolution NORTH STAR I�^.ARINA LICE'•�SE
for North Star Marina corn.TMienting triat there are
specifications of non-compliance that should be
reviewed with the applicant .
Mr . s Mrs. Kane , who reside at 3332 North Snore
Drive , showed pictures of their residence cor,�rnenting
that when the North Star Marina regraded their
parking lot it caused storm water to flood their
property and that garbage , and winter and summer storage
of bo�ts have caused problems that North Star operators
refuse to discuss with them.
It was noted for the record that the owners of
North Star Marina were not present to discuss '
their license application.
Mayor Van Nest moved, Hurr seconded, to table the
1980 marina license application for the North Star
Marina for further staff review. Motion, Ayes (5) -

Alan Olson, City Planner , reviewed with the City NORTH SHORE DRIVE MARINA
Council a proposed resolution setting out conditions
for denial of the 1980 commercial dock license for
North Shore Drive Marina.
Mr . Larry Hork and Bruce Douglas were present.
Mr . Douglas stated that there are a number of facts
in the resolution that do not apply to North Shore
Marina, although they might apply to other areas:
l. We did plant vines as requested but they failed
to grow. We do not believe lilac hedges were
' part of the original agreement and were never
agreed to
2 . Our dry stack units seem to be working properly �
and are keeping boats out of the water as the
City agreed to
3 . Baffler weirs have been installed, are working,
and are containing pollutants
4 . There are no rental boat storage units in the lagoon
5 . The dock length has never been resolved to our
satisfaction and we are ready to litigate , if necessary.
One dock wing might not be in conformance but that
is all.
6 . Our docks are pile driven and do conform to your
require�ents.

conditions as outlined in the proposed resolution.

Mrs. Ellis, A'1rs . Hartmann, Bill Reese , and Mrs. WALTER ' S PORT
Nelson were present .
Mr . Richard Crist, 2699 Kelly Avenue , was present
to discuss his rip rap permit co�ranenting that we
all agreed to a new plan at the August 11, 1980
Council meeting. Mr . DeGregory is not in favor ,
of rip rap and will not sign the agreement. I did
not receive Mr. Hartmann ' s nor Mr. Reese ' s signatures
either . This is a highly volatile situaiion. In
1979 , there were seven in favor and one abstained, now
we have a serious problem. Several homes have storm
water problems. I am requesting permission to rip rap
my property.
Jean Nelson: We cannot sign anything until the lawsuit
is settled.
Mrs. Hartmann : Rudy will not sign because Mr . Crist ' s
request is not part of our project.
Jean Nel'son: We want a City engineer to give us an
opinion on storm water runoff . We are willing to
pay for our own water problems .
Bill Reese : We have water standing on our properties
at all times.
Mayor Van Nest moved, Butler seconded, to ariend the
August 11, 1980 Council minutes removing hold harmless
and signing off on agreement by a majority of inembers
of the association as a condition to constructing
rip rap and seawall . Motion, Ayes (5) - Nays (0) .
Alan Olson, City Planner , reviewed the August 25, 1980 SEWER CONNECTION
Council action for Gladys Olson, 1340 Baldur Park Road. 1340 Baldur Park Roa�
Gladys Olson
Mr . Ray Westerlund and Mrs. Gladys Olson were present
to discuss the sewer availability of their property.
Alan Olson commented that Mrs. Olson has agreed to
connect to the City sewer if her original plan does
not succeed by June 1 , 1981 .
Butler moved, Hurr seconded, to approve a final
extension of the deadend line to connect to municipal
sewer allowing applicant sufficient time to prepare
a development proposal subject to:

l . The property must be connected to municipal SEWER CONNECTION
sewer not later than June 1 , 1981 , whether or (Continued)
not any development occurs.
2 . Prior to September 30 , 1980 , Mrs. Olson must
sign a letter to the City agreeing to make the
municipal sewer connection before June l , 1981
� as above .
3 . Prior to September 30 , 1980 , Mrs. Olson must
provide financial security to back the above
promise in the form of an irrevocable letter of
credit, or a performance bond, in an amount of
$5 , 000 . Such security must be in a form acceptable
to the City . '
4 . Prior to October 31 , 1980 , the existing drainfield (s)
must be deactivated with the septic tank outlet
sealed. From that point until the sewer connection
is made , the septic tanks will act as holding tanks
and must be regularly pumped. Work permits must be
secured at the City and an inspection made to assure
the completion of this condition.

"This letter is in response to a letter from
Bonestroo, Rosene , Anderlik and Associates, Inc .
of August 25 , 1980 recjarding Sanitary Sew2r Improve-
ments in the City of Orono.
We have reconsidered the comments regarding each
of the connections to our forcemain and still
support our original position as to where connections
should be made .
This position is maintained based on the concept of
permitting only a limited number of connections to the
forcemain (stubs provided at Stations LL2+00 ,
OR 37+25 and OR 72+50 ) because of the wide range
of discharge pressures in the forcemain and that
flow measurement in some form is necessary at

In fact Elk River Concrete once called me and told me you had not provided
to them the aodemdum concerning the culvert specificatior.s which ::as part
of the contract .

3. Rebuttal: Tne su��,.,er was not unusually uet and it is our opinion that the
grading work could have been co�pleted by the end of :�vgust nad your grad-
ing subcontractor rerained on tne project. '?'he completion date in tne
contract does not allow adjustment for wet weather and no request for a
ti�e extension on tne project �;as received from you until Novcmber 28,
1979 , 13 cays after the deadline had passed. In fact , our records show
onl�• five rain da}•s out of ZO for the ti�e p2riod of the end of August and
t;-�e e�rly part of September.
The es�irnate submitted on August 1 , 1979, b}' Robasse Construction Co�pany,
your grading subcontractor, indicated that severt�-one �71) percent of the
grading was completed on the Ring Route. Your grading sub�ontractor moved
off tne project the week of Ai;gust 6 and did not resume work until the
week of September 10, 1979. T'he grading on the Rir.g Route was not compie-
ted to a paint whcre class 4 could be placed on it until the week of Octo-
der 25, 1979. You are responsible for your subcontracters and insuring
that they re�.,ain on the job as necessary. In fact , you later admitted at
a meeting last winter that you had other jobs �or Robasse to work on for
' you in other Cities and you made the �usiness decision to .pull Robasse off
this job. You must live by your own business decisions.
4. �uffaio Bituminous asserts : "The Minnesota custom as expressed in Minne-
sota Sta�e Highway Department Specifications is t'r,at no "2351 �e�ring
course mix" sha11 be laid after Septe*�ber 15 , unless there is s speciiic
order from the engineer. Obviousiy, this work could not be done in the
winter or spring weather and everything had to wait until spring of 1980.
In passing , it is also the Minnesota custom and practice not te count such

4. Febuttal: The important item as far as p:ace:�ent of the 2361 wearing is
concerned is that tnere was no opportunity for the City Engineer to make
sny decision as to c:nether or not to place the 2341 binder course until
the spring of 1980. As you knov, the binder cou:se �:as not laid by you
until 1980 , so we never had the option as to G;-,ether or not to lay the
2361 wearing course in the fall of 1974.

ously never in effect for tnis project , since you finisned paving the base
course on the Ring Route on November 16 , 1979 . The project c:as to have
been completed on ?vove�ber 15 , 1979. Tne Cit�• never told vou not to pro-
ceed through the winter or late fall if tnat is what vou desired to do.
The maintensnce procedures uhicn were estab'_isned b� the Git} on the proj-
ect weze necessitated because of your failure to complete the project on
time.
6 . Buffalo Bitu�inous asserts: "'ihe City caused right-o`-»a� problems in not
naving sone easements ready when necessar}�. A*�ong other thi.^.gs , in tne
sp:ing of 1980 some of the easements were not read}• �nd Buf.`alo bituminous
had to pull off tne job until tney were procured. �air. , obviously they
couid not h�ve warked on these items dur:ng tne winter for the above rea-
sons, plus lack of easement reasons ."
6 . Rebuttal: The alleged right-of-�a� prob;em alluded to probably involved
Ti�othy Sweezo property on Co. Rd. 6. As �ou ray recall , at the precon-
struction meeting on June 13 , 1979, before any construction� in fact had
ta}:en place on tne project , we info:r.;ed �•ou t;:at we we:e considering the
construction of a retaining wall on tne S::eezo property instead of the
g:ading of tne erilbankment over onto the S;:eezo property. ke asked ;�ou ic�r
an i�nediate response to a suggested char.ge order and we did nat receive
that cn�nge order from �ou with prices noted thereon until Feor�ary 4 ,
- i980. Even as to that cnange order, you cid not note �ny probiem with any
ease�ents or an}- need for ex�easions . Moreoyer, the City as of *".ay 12,
:980, had the rignt of entry agreement si�-ned for Swe2zo so that you could
- have gone on the property as early as *'.a} 12, 1980. 'r.o»ever, as you know, �
tne contrsct betueen vou and tne City provides t;,at no work could take
p.ace on Co. Rd. 6 until the Ring Route �:as first opened and you did not
complete tne Ring Route until spring, 1980 . Tnere�ore , tne Caser.,ent was
available at all times if you had gotten to ti-�at portion of the project
but you iailed to do so. Even if the ease:�,ent �-,ad not been a�ailable, you
were not in a position to do vor�: on Co . Rd. 6 vntil 1980.

City Planner , concerning City building improvements.
Mayor Van Nest requested staff to determine the
cost of moving the Council Chami�ers to serve as
- an adjoining building to the present Administration
building and enter this on the September 29 , 1980
agenda.
Mayor Van Nest moved, Butler ' seconded, to approve 1981 POLICE CONTRACTS
the 1981 Police Contracts for the cities of Long
Lake , Minnetonka Beach and Spring Park. Motion,
Ayes (5) - Nays (0 ) .
Mr . H. R. Johnston was present to discuss his SALE OF CITY LAND
development. H. R. Johnston
Dick Benson, City Administrator, corrli-nented that it
appears that the land in question is unbuildable
and unassessable , therefore , the recommended value
is $4 , 000 .
Mayor Van Nest moved to negotiate with Mr. Johnston
a selling price of $4 , 000 for the lot in question.

benefits for Officer Roger Ward dated Septernber 12 ,

City Administrator Dick Benson iniormed the City JOHN EIDEM
Council that Mr . John Eidem, iormer Liquor Store
Manager, and now part-time employee , has terminated
his employment with the City of Orono and will not
be �eplaced at this time .
