The Orono Cour�cil met on the above date with the PUBLIC HEARING
following members present: Mayor Van Nest, Council- Assessments
members Butler, Hannah, Hurr, and Paurus. Also present:
City Administrator Benson, On-Site Septic Systems Manager
Gaffron, Public Works Coordinator Gerhardson, City
Attorney Malkerson, Financial Consultant Bob Ehlers,
City Engineers Cook and Quincey.
Mayor Van Nest announced that now was the time and
place for the public hearing concerning the assess-
ments for Project LS-1980-1 & LS-1980-2 , Minnetonka
Bluffs, Orono Lane , West Ferndale, County Road #15/
Scotch Pine Lane and North Shore Drive. City Adminis-
trator Benson read the Affidavit of Publication,
Certificate of Mailing of Notice and supporting informa-
tion to all benefited property owners.
Mayor Van Nest explained the procedures to be followed
at this public hearing and asked the citizens to make
comments orally or in writing stating their name, address,
and which area they resided at: Minnetonka Bluffs, Orono
Lane, West Ferndale, North Shore Drive, or the marina area.
Mayor Van Nest reviewed the project commenting that new ,
bids will be received this Friday, September 12 , 1980 at
10 :00 A. M. After the bids are tabulated and reviewed,
this information will be mailed to you explaining what
the costs will be and a questionnaire will be enclosed
requesting your vote on the project. We will then have
another public information meeting the last of September
to review with you the enti're project. This public hearing
tonight is being held to hear your comments and then the
City Council will consider and vote on a resolutiorr� approving
or disapproving the assessment roll.
Mr. Steve Quincey, City Engineer, reviewed with the public
the calendar of events leading to this evenings meeting,
commenting that the City will be receiving bids on
Friday, September 12, 1980 at 10 :00 A. M. attempting to
attract lower costs to construct the sewer project
stating that the total project cost to date is $1,205,000 .
Mayor Van Nest read into the record property owners
who have submitted letters indicating their approval or
disapproval of the project and the petition submitted this
evening requesting installation of sanitary sewers for
their properties.

"PETITION FOR INSTALLATION OF SANITARY SEWER" PETITION
To the City Council of Orono, Minnesota:
We, the undersigned property owners petition the City
of Orono to install immediately that part of Sanitary
Sewer Project LS-1980-1, known .as West Ferndale Road
& Orono Lane, which is to service our property. We
understand and agree that if that part of the project is
ordered by the City to be installed during 1980 and/or 1981,
the City of Orono may now assess as a special assessment
against our property for its share of the project the
amount set forth hereinafter, the principal of which is
to be spread over 15 years at 9�$ interest per annum. "

Dick Benson, City Administrator, read into the record
the percentages for and against the project and the areas
that the recorded responses came from.
It was also noted that there are many property owners that
have not been heard from and a questionnaire will be
mailed requesting everyone to indicate their preference -
for or against the project.
Harold Carlson, 539 Keene Avenue, commented that the costs
were too high and what is the City ' s position going to be?
Mayor Van Nest commented that the City may adopt the
assessment roll tonight and wait for any appeals. All
letters submitted by this evening objecting to the project
allows the property owner to appeal within 30 days after
adoption of the assessment roll. Owners of property 65
years or older may apply for a deferment of assessments,
if they meet certain criteria.
Bob Ehlers, Ehlers & Associates, Orono ' s Fiscal Agent,
reviewed with the public the current bonding market and
procedures in selling bonds commenting that an 8$ interest
rate to sell appears to be the current market using a
9�$ rate for assessments.

Harold Carlson, 539 Keene Avenue: Can we pay our
assessments all at one time7
Mayor Van Nest: You have the opportunity to pay your
assessment in full within a limited time after adoption
of the assessment roll or you may make partial payments
over the life of the bonds, as indicated in our letter
to you.
Don Gamble, 1205 Shoreline Drive : How are the payments
setup?
Bob Ehlers: Equal principal payments, declining interest.
� James Rivers, 1442 Shoreline Drive : Why can ' t we have the
entire payments amortized equally over the bonding years?
Bob Ehlers: Declining interest appears to be the preferred
method. Accounting procedures are simplified this way.
Mayor Van Nest: The City prefers the declining interest
method. It is more consistent.
The Council will adopt the assessment roll tonight. The
final decision on the project will be made the first week
in October .
Kevin Dynan, 535 Hanlon Avenue: What are the alternatives?
Mayor Van Nest: The alternative is to enforce our present
code and bring all- present on-site systems up to today ' s '
standards.
Ed Cashin, 1305 Shoreline Drive : What is the purpose of
the proposed questionnaire?
Mayor Van Nest: The questionnaire will allow Council to ,
determine if the project is to go or not.
Craig Moen, 1387 Orono Lane: Can we remove Orono Lane
from the project?
Mayor Van Nest: Project bidding will not allow removal
of this area.
Mr. Moen: I am hoping questionnaire will make that
_ determination. I think people will want amortized bond
payments, not declining interest payments.
Councilman Paurus: The City has to consider all costs
to administer the project and also bond costs.
David Johnson, 500 Hanlon Avenue : We object to the project.
Our incomes will not support the project costs. We also
understand federal monies are not available.

Mayor Van Nest: The City has inquired and have contacted
all agencies. Federal funds are not available.
Mike Gaffron: The City has attempted to become eligible
on a municipal needs list. This was a year ago and we
have not succeeded. I did a survey of agencies, compiled
these into a list for federal monies. Each one contacted
informed us federal monies were not available. �
Mayor Van Nest: Medina-Morningside is a good example.
Orono has worked with Medina for two years attempting
to serve their area with sanitary sewer. All progress
stopped because of lack of grant monies. We have decided
if we cannot proceed with the LS-1980-1 and LS-1980-2 project
on a 100� ass�ssment basis, we have to immediately proceed
with upgrading present on-site systems. Orono ' s rating
doas not encourage grant monies. We are attempting to
make a decision this year. We cannot wait to enforce our
septic ordinance . We need action now.
Quentin Lauer, 1205 Dickenson Street: Rudy Boschwitz ' s
office tells me federal monies are available.
Mayor Van Nest: Federal funds are not sufficient to support
this project. If we wait, inflation will offset percentage
of federal money availability. This project is our only
out. We have to correct septic problems now.
Mr. Lauer: Why should not federal agencies solve our
problems?

Mayor Van Nest: Availability of funds determines this.
We cannot postpone our decision and wait. We have postponed
correcting your on-site problems for one year. We attempted
to get on a needs list a year ago. Now, its either go
with this or correct your on-site problems.
Mr. Lauer: Why was Medina-Morningside so cheap?
Glenn Cook, City Engineer: Different terrain, water table,
no lakeshore to contend with.
Newell Weed, 1385 Orono Lane : I am in support of municipal
sewers solving our problem but the cost is too high and
unacceptable. Minnetonka Beach turned their project down,
rebid three to four years later and saved themselves $3 to
$4 hundred thousand dollars. I am concerned with: 1) economics,
2) why do we have to include all of our areas in one project?
3) why are we being threatened with enforcing the septic
ordinance if we do not accept this project? I have been
a resident in Orono 20-25 years and I have never had an inspector
tell me my system is bad. Is tonight our last change to submit
to you in writing our objection in order to appear within 30 days?

Mayor Van Nest : Yes, this was explained in our letter
to you.
Mr. Weed: I did not see this in your letter to us. I
do not believe this was included.
Mayor Van NeSt: This was included in our letter to you
and was also in our legal notice in Orono ' s official paper.
Mayor Van Nest: For the record, Mr. Weed, our letters
to you not only spells out the appeal deadline , but also
tells you the condition of your present on-site system,
all hidden costs, and what the City intends to do to allow
all property owners input up to the October 10 , 1980
certification deadline. I believe the City has, through
our Administrator, informed you of all project details,
your assessment costs and yearly bond retirement costs.
We have for you additional handouts if you desire them now.
Mr. Weed : I did not receive a notice in 1979 of the
condition of my on-site system.
Mayor Van Nest: Mr. Weed, we all agreed to wait until
the interceptor was completed and on stream before we made
a decision. Now, that decision is up to you. The City
intends to enforce its ordinances and if there is no other
recourse , properties might have to be condemned.
Mr. Weed: In 1978-79 , we were not notified if we complied
or not. You are now threatening us and using your ordin�nce
to force us to sewer our areas.
Mayor Van Nest: Mr. Weed, we are giving you the facts as
we promised we would. Your property, as everyone elses,
has been identified in our letter to you explaining your
septic tank condition.
Mr. Weed: I want each property owner to be notified if
they comply or no�.
Dave Johnson, 500 Hanlon Avenue : Mr . Gaffro;n was very
helpful to me and to others in our area explaining
to us the problems. I am very disappointed in our engineers
and Council 's decision. The cost is impossible to absorb.
We need alternatives to finance this project.
Councilman Paurus : I am very concerned with the cost of
this project and I know others are too. We have attempted
to defer the upgrading of your septic systems until the
interceptor was complete. New septic tanks and drainfields
might not satisfy the problem or resolve the pollution issue.
Gordon Ritz , 1165 West Ferndale Road: Has everyone been
informed of their problems?
Mike Gaffron: I have tried to speak with each of you about
individual problems.

Bruce Clark, 540 Barrett Avenue : Can we get help
from the City?
Mayor Van Nest: We have not requested other citizens
to help us in the past. We do not want to do that now.
. Harold Carlson, 539 Keene Avenue: If we do not contruct
this year, will the City resubmit this project to us next year?

Mayor Van Nest: We will enforce our code .
Dave Johnson, 500 Hanlon Avenue : What condition will the
streets be restored to?
Glenn Cook: Streets will not be constructed this fall.
Only easements. Streets next year. Al1 streets will be
restored to original condition. Some will be blacktopped.
Dave Peterson, 3855 Bayside Road: I believe health
conditions should be protected. Why should not the Council
apply for federal funds?
Mayor Van Nest: We have attempted to obtain federal monies.
Our Block Grant monies are committed. Revenue Sharing monies
are not available for this. We are going to make a decision
now, not two years from now, when we again find grants are not
available. The City is not going to wait two more years
to enforce its on-site ordinance .
Mr . Peterson: Can 't the City design and install holding ,tanks?
Mayor Van Nest: No, the City cannot design and
install holding tanks.
Dave Hill, 521 Hanlon Avenue : When will the code be
enforced?
Mike Gaffron: We will issue orders now, enforce next spring.
I would say that 50$ of the present systems need major
repairs. 25o minor repairs, 25$ are satisfactory.
Don Gamble, 1205 Shoreline Drive: Amortized payments have
to be considered,
Dave Peterson, 3855 Bayside Road: Are there other monies
available to help relieve assessments?
Mayor Van Nest: There is an option to levy part of this on
the general tax payers or ad valorum. The City has not
done this in the past and I do not believe other taxpayers
that have paid 100$ for their sewers should have to support
this project.
Dave Peterson: Could we not apply some of the ad valorum
if properties are divided later?

Mayor Van Nest: This does not apply here.
Councilman Paurus: We have to make a decision tonight.
I am concerned with the project also. I recommend we
adopt the assessment roll this evening. The final
judgment will be up to you.
Mayor Van Nest: We are here tonight to consider the
assessment roll. If there are no further questions, we ,
will close the public hearing and vote on the assessment
roll.
Mr. Weed: We agree with you, you have to consider the
assessment roll tonight. We apprecicate being allowed
to have input on this project.
Herb Meyer , 1380 Fox Street: I wish to say that I have
found in my business that some inspectors are good,
some are bad. Mike Gaffron has done a good job for us.
Mrs. Lindberg, 865 West Ferndale Road: Could our homes
that are east of the Ferndale bridge next to the Wayzata
sewer line, still connect to Wayzata if the project does
not materialize?
Mayor Van Nest: Yes, you could.
After all persons present had an opportunity to be heard,
Mayor Van Nest closed the public hearing at 9 : 29 P.M.
Mayor Van Nest polled the public in attendance to determi�ne
which method of bond payment schedule would be preferred,
declining interest or amoritized payments. Declining
interest was determined as being the most favorable .
Mayor Van Nest moved, Paurus seconded, to adopt Resolution RESOLUTION #1198

Mayor Van Nest moved, Paurus seconded, to approve September 30 ,
1980 at 7: 30 P.M. for the next public information meeting to
review final project costs and questionnaire results.

Dear Property Owner :
Hopefully each of you has now received from the City a
notice for the special assessment hearing of September 8 , 1980
to consider the adoption of the assessment roll and the
proposed special assessment to be levied against your
property . Set forth hereinafter is a general description of
the remaining procedural steps to be taken by the City and the
answers to some frequently asked questions .
1. What is the status of Easement Acquisition?
The City needs approximately 45 signed easements for
the project . These easements have been mailed to the affected
property owners . Please execute those easements and return
them to the City. If you have any questions , call �ike Gaffron
at 473-7357 .
2. When will the assessment roll be adopted ?
The City Council most likely will adopt an
assessment ro�l on September 8 , 1980 , which assessment roll
will include the final special assessment for each property .
3. When will the final decision on the project be made?
The City Council will 'make the final decision on
whether to order the contractor to proceed with all of the
project , part of the project , or cancel the project on or about
October 10, 1980.
4. How will the project be financed?
Bonds will be sold in the amount of $1 , 205 ,000 or
lesser amount if only a portion of the project is ordered on or
about October 15-20, 1980. We expect the bonds will be
purchased at 8 - 8-1/2°� and will be repayable in equal
principal installments over 15 years .

5 . What if a portion of the project is cancelled?
If the project providing sewer to your property is
ordered by the City Council , the special assessment set forth
in the assessment roll will then be certified to the county to
be collected over the next fifteen (15) years along with your
general property -tax , commencing with the taxes due and payable
in 1981.

If the portion of the project providing sewer to
your property is not ordered by the City Council , then the
special assessment against your property will be cancelled and
not certified to the county . The City will then stringently ,
enforce the on-site Septic System ordinance . '
6. What will the interest rate be?
It is the bond consultant 's recommendation to sell
the bonds with a fifteen (15) year payback . The consultant
anticipates that the bonds will be purchased to yield an
interest of 8 - 8-1/2% annually to the bond buyer . Minnesota
statutes provide that a City may sell bonds up to an interest
rate yielding 12% and then add 1% in addition thereto , for a
total of 13% interest on the special assessment .
Because the City expects the bonds to be sold at
8-1/2�� interest , the City will charge only 9-1/2�o interest on
the special assessment . The 1� difference is necessary to pay
for the cost of processing the special assessments a�d roll
throughout the fifteen (15) years and to protect the City
against tax forfeitures .
7 . What will the interest and principal cost be to me
each year?
Based upon all of t�ie above assumptions , the
approximate principal and interest for each of the S special
assessment amounts is set forth in Exhibit A attached hereto.
As you know, the interest is deductible for tax purposes .
The total annual cost of the special assessment to
you , is still far less expensive than having to pay for holding
tanks , the monthly cost of pumping the tanks , and/or repair
costs for on site septic systems . Moreover , the benefit
conferred upon your property because of the municipal sewer can
be realized upon the eventual sale of the property .
