Special Meeting of the Orono Council, 7 : 30 P .M.
August 14 , 1980
The Orono Council met on the above date with the
following members present: Mayor Van Nest, Council-
members Butler, Hurr, and Paurus. Absent: Council-
member Hannah. Also present: City Administrator
Benson, City Planner Olson, City Engineer Quincey,
City Attorney Malkerson, and Public Works Coordinator
Gerhardson.
Steve Quincey, City Engineer , reviewed with the MINNETONKA BLUFFS, OR01
City Council his letter dated August 14 , 1980 , which LANE, WEST FFRNDALE,
relates to revised plans and specifications for the #15, NORTH SHORE DRIVE
Minnetonka Bluffs, West Ferndale Road, Orono Lane, SEWER PROJECTS
County Road #15 and North Shore Drive sanitary sewer
improvements and the affidavit for G & L Contracting
and Orfei and Sons to sign-off on allowing the City
of Orono the right to retain their bond and bids
until October 14 , 1980 .

"Please find enclosed the revised set of construction
plans and specifications for the above referenced
project. Note that the project has been divided
into three parts as follows:
Part I - Minnetonka Bluffs and County Road 15 -----
Part II - Ferndale Road and Orono Lane ---
Part III - North Shore Drive _
The project will be bid using one set of plans and
specifications rather than breaking these up into
three separate plans and specifications, as was
discussed at the Council meeting of August 11, 1980 .
Doing things in this manner � will minimize costs of
the rebidding process.
Please be advised that our added engineering fees
due to the rebidding -will be $500 . If you have
any questions regarding this letter, please contact
this office. "

The purpose of this report is to establish the effect on the value �
properties because of the installation of a sanitary sewer.
The added value to the two lots that would become buildable if a
sewer project is installed would be considerable. The 1980 estimated
market value for these properties is 8500 for Map �33. The 1980 EMV
for adjacent building sites ranges from $15,000 to $20,000.
The 1980 estimate market value for Map �54 is $2,200, this lot
appears to be mostly s�amp and low land as observed from the aerial
photos. The nature of properties along West Ferndale is entirely. .
different than that of the riinnetonka Bluffs area, and the adjoining
building sites have a 1980 EMV of $45,600 and up.
There are 34 lots that have major problems severe enough to warrant
the immediate use of holding tanks if sanitary sewer is not installed.
The value of these properties would drastically be effected if they were
forced to install holding tanks. The loss of value, to a prudent buyer,
would be through the maintenance, pumping, of the holding tanks. Tanks
would most likely have to be pumped twice a month at an average cost of
$70 to $80 per pumping. That is an annual cost of approximately $1, 800
plus for the first year. Future costs could be anticipated to increase
at a rate of 10 to 20$ per year. That would mean a cost, over 15 year
period of $62,900 ranging from $1, 800 the first year to $:7,500 in the
fifteenth year. These f igures are assuming $1, 800 the first y_ear with
� a 10$ annual inf��tion. -
Also, many>banking institutions will not finance a property that
does not have adequate on-site systems or that is not hooked up to
municipal sewer. The FHA is also withholding approval of mortgage
guarantees on properties that do not meet on-site or sanitary sewer
requirements. The cost of continually, maintaining holding tanks and
the inability to get financing would have a markedly adverse effect on
the value of these properties.
There are 13 properties where major changes to the existing on-site
systems are now neeessary. • In manX cases these repairs would only be
delaying the inevitable of requiring holding tanks or some other means
of sewage disposal. Again, there would be _a loss of value to a knowledg
able buyer because of these problems. It would also be difficult or im-
possible to get financing in properties that have major problems as thes
do_ The cost of repairs and likelyhood of future problems along with tt
difficulty in obtaining financing would have an adverse effect on value
these properties.
There are 20 properties where minor repairs could be required. The
properties are all contiguous to, or located iri, areas where major prob]
now exist. The value of these properties could be adversely effected be
cause of these adjoining properties_ A knowledgable buyer would not pa�
as much for property that could experience problems in the foreseeable
future_ Banking institutes familliar with the area could be reluctant
to finance such properties which could have an adverse effect on value.
Because of the large range in values of the properties in question

and the lack of comparable sales, this appraisal report speaks in
general terms. Some property values will be effected more than others.
Generally speaking it is my opinion that the construction of the municip�
sanitary sewer will enhance the value of the properties hown in the
assessment roll in an amount equal to if not greater than the assessment
proposed as of September 8, 1980.
I presently have no personnal interest in any of these properties
effected by this report and do not anticipate any future personnal inter�

The City Engineer has completed the feasibility study for 80-1 and 80-2
and .is completing final plans and specifications for both projects.
City staff and the Council have had numerous meetings with the affected
residents to keep lines of communication open and expedite the process.
We have reviewed the engineering, construction and legal requirements ,
combined with the neighborhood' s desires and sugges.t that the Council

The proposed assessment roll is on file for public inspection at the
office of the City Clerk. Written or oral objections will be considered.
No appeal may be taken as to any amount of any assessment unless a� written
objection signed by the affected property owner is filed with the municipal
clerk prior to the assessment hearing or presented to the presiding off icer
at the hearing.
If such written objection is so filed, the owner may appeal an assessment
to District Court pursuant to 429. 081 of Minnesota Statutes by serving
notice of the appeal upon the Mayor or Clerk of the municipality within
30 days after the adoption of the assessment and filing such notice with
the District Court within 10 days after the service upon the Mayor or
Clerk.
Owners of homestead property who are 65 years or older may apply for a
deferment of the special assessment if they meet the criteria set forth
in the attached Resolution No. 1093.

SUBJECT: Determination of Existing Site Conditions and Probable
Disposition of Existing On-Site Sewage Treatment Systems
" Should 3ewer Not Become Available. -
In the event that Projects 80-1 and 80-2 are not constructed, the
On-Site Sewage Treatment Code will be enforced strictly to ensure
that the existing pollution and health hazards are remedied. This
enforcement process may require drastic measures on certain properties,
and may include repair, reconstruction, or replacement of existing
systems, alternative soil treatment systems, or even conversion to
holding tanks. The degree of required work in each specific case
depends on the condition of the existing septic system and the exis�ing
site conditions including depth to water table, soil types, lot size
and topography, location of structures, hardcover, water wells, and
other fixtures, and proximity to lakes or wetlands.
I have listed each .property involved in the project area under on.�:of
the following five- categories: __ ___
a) Properties "(including vacant lots) where holding tanks will
be required based on state/local limitations and the observed
site conditions.
b) Properties where major changes to existing systems will be
required based on state/loca7 limitations and obsereed
conditions.
c) Properties where minor changes to existing systems may be
, necessary; existing systems essentially meet code or can be
made to meet code. '
d) Vacant properties which might be buildable if served by sewer
but are probably not- buildable without sewer.
e) Properties which will not be served by sewer yet are within
or near the project area.
The specific observed site conditions for each property are listed.
Source material for the determinations includes, but is not limited to,
visual observations by City staff, building and zoning files, city
ordinance No. 210 (On-Site Sewage Treatment Code) , U of Minnesota Extensio�
Bulletin No. 394 - revised 1978 "Shoreland Sewage Treatment - Recommendatic
for ldentifying and Eliminating Non-Conforming Systems" , and the Fiennepin
County Soil Survey. Generally, where lots are too restricted to legally
contain both a well and septic system, it is assumed that the well must
remain and the septic system can be converted to holding tanks.

Also where the observed and/or assumed high water table occurs less
than 3 ' from the surface, it is assumed that no type of soil treatment
system is allowable. At the time of enforcement of the Code, if the
property owner feels that his site conditions are favorable for
installation of a soil treatment system, it would be up to the property
owner(s) to prove to the City that any proposed system would be feasible
and meet all code requirements. . •
Should the sewer projects be abandoned, it is likely that orders to
make systems conforming within one year would be immediately issued
by staff. .

to the affected property owners in the LS-1980-1
and LS-1980-2 sewer project notifying them of a
public information meeting on August 20 , 1980 at
7 : 30 P.M. and reminding them of the assessment
hearing on September 8 , 1980 at 7 : 30 P .M.
Letter - August 14 , 1980
"The City of Orono has received the bids for in-
stalling sanitary sewer in your area.
The bids were considerably higher than the engineer ' s
estimate, therefore, the Orono Council has designated
August 20 , 1980 at 7: 30 P.M. as a public information
meeting to inform you of the status of the project
and to get your impact as an affected property owner .
The assessment hearing will be held on Monday,
September 8 , 1980 at 7 :30 P.M. at the Orono Council
Chambers. You will be receiving an assessment notice
prior to that meeting. "

Mayor Van Nest informed the City Council that he FARVIEW LAKE ACCESS
received a call from Mr . Harold Hendrickson,
attorney representing Mr. & Mrs. Gibbs, commenting
that a vehicle had left the lake access road
located next to the Farview Addition and had caused
damage to resident ' s property nearby and asked if
a temporary gate or fence could be installed.
Paurus moved, Hurr seconded, to authorize staff to
install a temporary gate . This action not to
preclude future resolving of the lake access matter ,
but to immediately control vehicular traffic until
premanent action is taken. Motion, Ayes (4) - Nays (0) .

Sanitary Sewer Improvements
Dear Members of the Council:
As noted in Glenn Cook's August 6th letter to Mr. Dick Benson, bids taken on
the above referenced project were considerably higher than the preliminary
report estimate. We have the following comments as to reasons for the high
bids: ---- -
1 .) Tight work�g conditions - Due to resident concerns about dest"ru�tion of
personal property we required that the contractor "back cast" a12 dirt
excavated for sewer pipe placement. Contractors have indicated that this
item alone added 50� to 100� to the pipe placement costs.
, 2. ) Close proximity to Lake Minnetonka - The wet and bad soil conditions along
the North Shore Drive, Qrono Lane, Ferndale Road areas had a larger
influenee on the bid prices than we had anticipated.
� 3.) Easement Negotiations - In discussions with residents we have been
req uired to alter alignment of sewer, add manholes, plant trees,
transplant trees, and miscellaneous other items.
In conclusion, this job has developed into a much more difficult job than
anyone anticipated at the time that the preliminary costs were produced. �e
restrictions that have been put into the contract will have adverse effects on
project progress and have affected the bid prices accordingly.
