Regular Meeting of the Orono Council, 7 : 00 P.M.
May 12 , 1980
The Orono Council met on the above date with the
following members present: Mayor Van Nest, Council-
members Butler, Hurr, and Paurus. Also present:
City Administrator �enson, Zoning Administrator
Mabusth, City Attorney Malkerson, City Engineer
Quincey, and Planning Commission member Wilson.
Absent: City Planner Olson.
Hurr moved, Butler seconded, to approve the Consent CONSENT AGENDA*

all staff data and supportive information to be
included in the Minutes in the sequence they occur.

Mayor Van Nest opened the public information meeting PUBLIC INFORMATION
concerning the Minnetonka Bluffs, Orono Lane , West MEETING
Ferndale Road, and County Road 15 sewer project at Minnetonka Bluffs, et
7 : 05 P.M. Sewer
Mayor Van Nest reviewed the past history of the
proposed sewer project outlining comments and
factual data discussed and presented at the March 20 ,
1980 public hearing.
Mr . Edward Cashin, 1305 Shoreline Drive , reviewed
his letter dated May 8 , 1980 and commente� that the
present restoration relative to th� inter�eptor con-
struction was not progressing satisfactori��.

Mayor Van Nest: Exempting a parcel of land in the
center of a project is not possible . Once a sewer
line is installed, you have sixteen months to connect
to the City sewers.
Mrs. Rodney Kelley, 1399 Orono Lane: What formula
will be used to determine the assessment?
Mayor Van Nest: This has not been decided but will
be determined at a later hearing.
I want to repeat what has been stated at other meetings.
The City will review with you the plans and specifications
for this project, when they are ordered and received. �
If a contract is awarded after goin� through the b�ddinq
proeess, an assessment hearing will be held.

Dear Mr. Gassron:
I understand that you are in charge of the sewer project
now under consideration in several parts of Orono .
We have lived at 1305 Shoreline Drive (County Road 15) for
20 years . Our house was built in 1928 and, as you probably
know, is situated on a rather high hill .
Only two of us , Mrs . Cashin and myself have occupied this
residence during all that time and the previous owners ,
Mr. & Mrs . Ray Bros were the only two occupants . In addition,
we have, for the past 20 years , spent only six months here
and the remaining six months in California. During all this
time we have never, to my knowledge, had any problem with
sewage or drainage or relateci problems .
I would like the opportunity to meet with you in an effort
� to have an exception made in our situation so that the un-
necessary connection with a sewer system can be avoided .
If we were situated on a small lot , we have over three acres
of land, and the land was low or near the lake I ' d be more
than willing to go along with this project .
I will appreciate your special consideration in this important
matter�

This will all be subject to a 30-day waiting period PUBLIC INFORMATION
allowing ample time for individual appeals . If MEETING - Minnetonka
significant numbers appeal, the City will reserve Bluffs, etc . Sewers
the right to cancel the contract and not construct (Continued)
sewers in your area. If sanitary sewers are not
constructed, the City will then request residents to
upgrade their present septic systems to current
acceptable State standards. '
Lauren Born, 1432 Shoreline Drive: I do not live
in my home year around and I do not believe municipal
sewers are justified.
Michael Gaffron, On-Site Systems Manager: All septic
systems in the project are either not up to present
code requirements or are not functioning properly.
There are cases where raw sewage is discharging into
the water table.
Mayor Van Nest: We are here because some of you
people indicated you favored municipal sewer. We
do have the option of requiring all systems to be
rebuilt to present code standards. The terrain,
water table, and lot sizes dictate the need for
sanitary sewers.
Unidentified person: Are the soil types adequate for
replacement of present septic systems?
Mr. Gaffron: The soil types are not favorable to
today ' s standards.
Mary Rivers, 1442 Shoreline Drive: Do market values
go up proportionately?
Mayor Van Nest: The assessments would most likely
exceed the increase in market values. In reviewing
ways to assess a project, it appears that the fairest
way to assess would be on a unit basis because parcels
and units are already established.
Herb Meyer, 1380 Fox Street: What are the easement
procedures?
Mayor Van Nest: We are hoping easements will be
dedicated by the property owners. Depth of sewers
determine easement width.
Mrs. Gamble, 1205 Shoreline Drive : We are concerned
with loss of trees and taking of land.
Mayor Van Nest: We will do everything we can to
minimize this problem.

_ SANITARY SEWER PROJECT
NOTICE OF MEETING
The Orono City Council at their regular meeting on Monday, May 12, 1980, at
7:00 p.m, in the Orono Council Chambers, 1275 South Brown Road, plans to make
a decision regarding the proposed sanitary sewer improvement of portions of
County Road 15, Orono Lane, West Ferndale Road, Fox Street, Dickenson Street,
Orono Orchard Road South, Barrett Avenue, Hanlon Avenue, Keene Avenue, and
Russell Avenue. Any persons desiring to be heard with reference to this
proposed improvement will be heard at this mee[ing, This will be the first
item on the agenda.
The response to the questionnaires indicates property owners are generally
in favor of installation of sanitary seWers in the Minnetonka Bluffs, Orono
Lane, and West Ferndale areas. In the County Road 15 (marina) area, responses
indicate that pumping directly into the force main is preferable to the
pressure sewer proposed in preliminary studies, and that the cost of the
pressure sewer as proposed seemed excessively high, as did the gravity system.
City staff concur with [his opinion and are currently working with the
Metropolitan Was[e Control Commission to obtain permission to pump directly
into the force main at the marina location.
City staff has recommended to the council that the entire project be ordered
in and final plans be prepared following the least costly alternatives.

municipal bonds) . The bonds would be due within three years ,

possible. The maximur� amount we could borrow would be that
�,-nount which would not be neeaed for debt service reauirements

this time I estimate tl-�at we have �ror,�� $500, 000 to $550, 000
o� mon�es available for loan purposes. ,
iiowever, I must advise extreme caution at this time i� we consider
this approach. It must be remembered that tne issue coula run
onl;- tnree t-ears, and bezore the end o� the three years� period
per,��anent fin�ncing �aoula have to be ob�aine�. Mr . Chenoweth
stated t'r�at the market has been saturatea with temporary
issues and that means there will be man�� issues requiring
permanent financing at the same time as ours.
If permar�ent financing were available now, we could issue
special assessment improvement bonds and assess that portion of
the costs b�% w'tiich the various proper-ties were benefited.
'I`his would reQuire an appraisal of t]-ie property before �nd after
tne project_ �ne b�lance or the costs, if any, could be put
on a general �� levy. �he City levies about $22, 000 annually
=or bonded debt now. 7`'tie per capi�a le��� li.mit (based on the
latest iederal census) ior bonded debt is $54. 00 generally.
�•�ith a popula�ior_ of 6, 787 in 1970, tris means we could levy
up Lo $366,�95 =or payment of bond principal and interest.

Mayor Van Nest moved, Butler seconded, that all LMCD APPROVAL
future applications requiring City and Lake Minnetonka
Conservaton District approval be applied for at the
City of Orono, and after Council review, forwarded
to the Lake Minnetonka Conservation District. Motion,
Ayes (4) - Nays (0) .
Councilmember Paurus, Orono ' s representative to the GAYLES MARINA
Lake Minnetonka Conservation District, commented that
the LMCD Board will meet May 28 , 1980 and stated that
Gayles Marina was requesting nine additional service
slips.
Hurr moved, Mayor Van Nest seconded, to request the �
Lake Minnetonka Conservation District not to approve
nine additional service slips for Gayles Marina.

of the Regular Meeting of April 14 , 1980 , as amended.

Mr. Steve Wilson, Planning Commission Chairman, PLANNING COMMISSION
was present to hear agenda item #7 , Building
permit for C. Arnold Carlson, 855 Forest Arms Lane.

Councilmember Paurus left the Council meeting
at 8 : 05 P.M.
Alan Olson, City Planner, prepared a memo for the COMPREHENSIVE PLAN*
City Council dated May 8 , 1980 , which reads:
The Comprehensive Plan has been reedited and is
mostly typed in final form. Copies are being
printed and will be available at or before the
Monday night Council meeting. Copies are xerox
drafts with small maps for this round. Final copies
will be indexed with fold-out maps on 11 X 14 paper.
The Planning Commission will hold a public hearing at
7 : 30 P.M. , Monday, May 19 , 1980 . After the hearing,
they should act on a resolution to approve the Plan
and send it on for final Council approval .
At the regular Council Meeting of June 2 , 1980 , the
Council should act by motion to approve the Plan
for distribution to the Metropolitan Council and
other Cities. (Continued)

Final additions and corrections will be made after COMPREHENSIVE PLAN*
June 2 , 1980 with final packaging and distribution (Continued)
scheduled for about June 15 , 1980 . The Plan will
be at the Metropolitan Council before the July l,
1980 deadline provided the above schedule is
adhered to.

Alan Olson, City Planner , prepared a memo for the BUILDING CODE BOARD
City Council dated May 6 , 1980 , which states�: OF APPEAL*
The attached packet of information explains the
facts concerning an issue between Mr . Hannah ' s
architect and the Building & Zoning Department
concerning interpretation of the State Building
Code .
The Building Inspector has identified a code violation
and has ordered corrections. We have received
written confirmation of our interpretation from the
State Building Code Division. Mr . Hannah ' s architect,
Martin Grady, is disputing this interpretation. They
have requested a hearing before an appeal board,
which is their right.
The Building Code Board of Appeals is crea�ed by
Section 204 of the State Building Code, 1976
edition, as adopted by our Ordinance NO. 216 . The
City Council must appoint five members "qualified
by construction" . I have found five local people
whom I believe are well qualified and represent a
broad spectrum of experience and view point.
I recommend that the City Council appoin� the
following to the Building Code Board of Appeals:
Thomas Anderson, Community Development Director and
Certified Building Official, City of Wayzata,
representing professional code interpretation. ,
Gerald Babb, Fire Marshall, Mound Fire Department,
representing fire safety in the Mound Fire Department.
Loren Brueggeman, Project Manager, Benson-Orth
Associates, graduate architectural engineer, Orono
resident and practicing construction manager .
James Hanson, contractor-owner, Efficient Shelter,
Inc .:, Orono resident, residential contract�r .
J. Nicholas Ruehl, Architect, Design Two, Inc . ,
Excelsior, representing the licensed, practicing
design profession.

stipend to each Board member and the City staff �

Dick Benson, City Administrator, presented the SEWER & WATER
City Council with a memo dated May 9 , 1980 which Orono School Area
states:
Long Lake Mayor Diane Gallagher has informed me
that the City Council has determined that they ,
cannot continue to provide the Orono commercial and
school area with City water.
The existing Long Lake water system is not adequate
to continue to suppl� water to Orono and improvements
to upgrade their present system has been determined
through a feasibility study to be too costly.
The present water and sewer agreement will terminate
July 18 , 1981.
I recommend an engineering study be conducted by
Orono ' s City Engineer to determine the feasibili�y
of constructing our own system.

the City Engineer to submit an estimate to perform
the feasibility study at the June 2 , 1980 Council

Dick Benson, City Administrator, entered into the APPOINTMENT
record the following memo dated May 9 , 1980 , Acting Mayor
which states: Mary C. Butler
The Council vacancy created by Mr. Massengale ' s
transfer to the west coast has also caused a
vacancy in the Acting Mayor ' s position.
Councilmember Mary Butler has indicated her
desire to fill this position.
With Council approval , this position should be
filled Monday evening, May 12 , 1980 .

Mary C. Butler as Acting Mayor to fill the
vacancy left by Mr . Massengale ' s resignation.

Dick Benson, City Administrator, to notify candidates, Council Vacancy
Gregg Hannah and Steve Wilson, to appear at the June 2 ,

Mayor Van Nest announced that a Town Meeting will TOWN MEETING
be held at the Minnetonka Center of Arts and
Education on May 22 , 1980 at 7 : 30 P.M.
Dick Benson, City Administrator, announced that JUNE 2 , 1980
the next regular Council meeting will be held COUNCIL MEETING
June 2 , 1980 at 7 : 00 P.M.
Dick Benson, City Administrator, presented the VICE PRESIDENT
City Council with a letter received from Vice MONDALE ' S LETTER
President Mondale ' s office concerning the
Crystal Bay Post Office.

We have withheld resubmitting the I. S. I .S.
proposal pending local meetings with police
chiefs of departr�nts of cities contiguous to
Orono. The I. S. I .S can be beneficial to all of
our cities and the interchange of qualified personnel
is our goal in the West Hennepin County Area.

Wayzata Police Department have joined the I. S. I . S . AGREEMENT*
Mound, Deephaven, and South Lake Minnetonka Public (Continued)

Police Kilbo, dated April 29, 1980 , wh.ich states:
I have requested from Hennepin County Highway
Department Mr. Hansen to install "No Parking"
signs on the north side of County Road 15
eastbound from Orono Orchard Road 500 feet to
the east. This is a right turn lane area that
will also be properly marked as a turn lane .
I further requested "No Parking" signs on the
south side of County Road 15 running east from
Orono Lane 200 feet to the east. This is needed
f�r sight distance for vehicular traffic coming
onto County Road 15 from Orono Lane.
• Mr. Hansen stated on April 29, 1980 that he will
install the signs immediately pending Orono
Council action. I,therefore,request Council
action at the �ay 12 , 1980 meeting.

City Council that the majority of responses to the
Orono Reporter Survey has been affirmative to the
questions printed in the spring issue , which were
in regard to the size of the newsletter, convenience
in reading, and if they are receiving it.
Dick Benson, City Administrator, informed the City PART-TIME SECRETARY*
Council that the position of part-time secretarial Police Department
duties in the Police Department has been vacated and
does require replacement.
The position is budgeted and consists of approximately
16 hours work a week and also filling our full-time
secretary ' s position for vacation and sick day.
We are in the process of interviewing now anticipating
the position can be filled by Monday, May 12 , 1980 to
accommodate an excessive workload in the police office .
The hourly rate will commence at $4 . 00 per hour. I
recommend approval of this request.

, Dick Benson, City Administrator, presented the City INFILTRATION/INFLOF
Council with a memo dated May 7, 1980 , which states:
I arranged a meeting with Medina ' s Mayor Tom Anderson,
Engineer Lyle Swanson, and members of the Pollution
Control Agency, Metropolitan Waste Control Commission,
and the Department of Natural Resources. The object
of the meeting was to encourage participation of the
various agencies in lowering a culvert at the Town Line
Road.
The 24" culvert was installed by Medina five years ago
when sanitary sewer was installed in the area. The
culvert was placed on top of another 18 " culvert which
has caused what used to be pasture land to be converted
into a large holding pond. This has created odor
problems, flooding problems and has generated complaints
from residents in the area demanding the plant be shut down.

Medina, Independence, and Maple Plain are involved INFILTRATION/INFLOW*
because of their town lines being in the affected area. (Continued)
Orono is only involved in attempting to encourage
the cities to resolve the matter allowing the Maple
Plain Waste Water Treatment Plant to function as it
was designed for.
The results of the meeting was that Medina and Maple '
Plain will work together and lower the culvert to
its original grade . Orono will furnish a water jet
to assist in the project, if needed. To further
complicate matters, the DNR might require a permit
because of draining of a wetlands. Determining
if this is a wetlands, which is defined by the
ordinary high water mark maintaining a level of
water over a period of time, will be debated by the
DNR and MWCC. In any event, the correction and
maintaining of the culvert will be a Medina-Maple
Plain function.

one from the liquor account) . It has also made
investing more complicated. ,

record the following dated May 8 , 1980 , which states: City of Orono
The City Council requested information concerning
the property owned by the City which accommodates
the waste water treatment plant.
The property consists of 40 . 45 acres excluding the
access road. The buildable area of the land is
seven acres or 180 . The remainder of the site,
which is unbuildable is as follows:
Effluent pond - 18 acres
Marsh land - 15 acres
The plant site and effluent pond are now being used
by the Metropolitan Waste Control Commission but
will be transferred back to the City sometime this
year with an easement for their lift station,
which is located within the fenced-in plant site.
�he balance of the property is not within the Metro-
politan Waste Control Commission' s domain and is
now being used by the City.
I will be meeting with MWCC officials at a later
date when the interceptor is on stream. ,
Attached is a sketch of the area in question, also
a letter from the Department of Natural Resources
discussing a possible use of the effluent pond
after the MWCC has terminated their use of the
area, and also a copy of our agreement with the
Metropolitan Waste Control Commission.

Dear Mr. Benson:
During our telephone conversation on April 15, 1980, you asked that I
put into writing our interest in the Orono sewage treatment ponds.
The rearing of muskellunge, as practiced in f�1innesota, involves several
distinct stages. Muskellunge eggs are taken from wild fish and hatched at
two hatcheries. Upon hatching from the egg the fry have a large yolk-sac
and are not yet free-swimming. I�Ihen the fry have become free swimming
(called swim-up fry), they are stocked into shallow nursery ponds. These
ponds have been previously flooded and where necessary fertilized to
produce a plankton bloom. For the first few days in the nursery pond
the plankton form the muskies diet. At this time newly hatched sucker
fry are stocked to provide forage when the muskies are past the plankton
stage. The muskies are fed suckers until they reach approximately 12 to
2 inches. At this time they are harvested from the nursery ponds and
stocked into expansion ponds. These expansion ponds have been stocked
with minnows to provide forage. The muskies are grown in these ponds
until fall when the ponds are harvested. The muskellunge, now 8 to 12
inches long, are stocked iynto various lakes and streams. -
� The typical procedure for rearing muskies in the expansion ponds is to
haul minnows to feed the muskies on a weekly basis. This procedure is
both tirne consuming and costly. Here in the Metro Region we have spent
the last several years working on a slightly different technique.
Instead of putting the muskies in drainable expansion ponds and hauling
minnows to them, we have used natural ponds with a substantial minnow
population present and relied the natural supply of minnows to feed
them. As you can see this is far less expensive. To harvest the
muskies we have used a winter rescue pump station similar to that used
to rescue northern pike.
At this point we feel ure have a viable supplementary technique for rearing
muskies. flur major requirement now is that we need good nursery ponds in
this region. As of this time we must obtain our small muskie fingerlings
from Hinckley.

The sewage treatment ponds in Orono appear to have the potential, at this
time, for fulfilling this need. Because these ponds will no longer be
needed for sewage treatment in the near future, we would like the City of
Orono to consider this use of them. Please take this consideration under
- advisement. -
I might add here that we have been working on this project with Muskies,
Inc. who have provided us aid in both manpower and equipment.

North Shore Drive to get to the access. This procedure
is creating a safety hazard and it is recommended to
restrict the use of the access to winter use as was
done at the Smith Bay access on Shoreline Drive
adjacent to Paul ' s Landing.

RESOLUTION CONCERNING JOINT INDEPENDENT SCHOOL
DISTRICT N0. 287 SIX YEAR BUILDING PLAN-WEST CAMPUS
WHEREAS, the City Council of the City of Wayzata has been alerted that
the District No. 287 F�cecutive Board has adopted a six year building plan
which includes $�+8 million for construction of a West Campus in Medina, and
WHEREAS, pro�ections for population and enrollment have changed considerably
since West Campus plans were first proposed, and ,
WHEREAS, costs for infrastructures supporting the proposed campus as well
as for the building of the campus itself have escalated substantially, and
WHEREAS, the proposed campus site lies beyond planned growth areas for
the six year building plan period, and
WHEREA�S, �urisdictions required to provide city services to the facility
are not prepared to do so within the time frame proposed which would cause
substantial sewer, transportation, police, fire and other service deficiencies.
NOW BE IT RESOLVED by the City Council of the City of Wayzata, Minnesota
that based on projected population and enrollment as well as traffic and service
deficiencies associated with the proposed West Campus of District 287 that the
District reexamine its pro�ections and costs for constructing a West Campus in
Medina.
BE IT FURTHER RESOLVED that a more detailed cost/benefit study on the
facility be made prior to going forward with West Campus plans.
