February 25, 1980
The Orono Council met on the above date with
the following members present: Mayor Van Nest,
Councilmembers Hurr, Massengale, and Paurus.
Absent: Councilmember Butler. Also present:
City Administrator Benson, City Planner Olson,
City Attorney Malkerson, City Engineer Cook,
and Planning Commission member Jabbour.

Alan Olson, City Planner, entered into the COMPREHENSIVE PLAN
record the following concerning the City of Maple Plain
Maple Plain's Comprehensive Plan,dated January 25 ,
1980 , which states:
Maple Plzin is a City of 680 acres , just over one
square mile, with 1, 460 residents. The City
contains a significant amount of industrial develop-
ment in two areas ,plus commercial developrnent in
the "downtown" core and a strip along Highway 12 .
There is a large undeveloped wetlands in the north-
west corner along Pioneer Creek. (Continued)

Maple Plain' s plans are aimed at designation as COMPREHENSIVE PLAN
a freestanding growth center, acting as an Maple Plain
alternative to scattered suburbanization. (Continued)
Maple Plain has several City parks and is adjacent
to Baker Park Reserve. The plan suggests a new
bike trail connection from the Luce Line to
Baker Park through Independence and Orono.
Al1 but three or four existing homes are served
by municipal sewer and the existing Maple Plain
plant, which "will likely reach its design capacity
in 1980" . This plan discusses the 201 Alternative
Waste Management Study and states preference for
existing plant expansion rather th�n interceptor
construction. This plan states that development
and expansion of the service area must await the
implementation of plant expansion, but at the same
time, this plan does not suggest limiting development;
rather it shows an expected population increase.
Therefore, it is apparent that Maple Plain does
expect some sort of plant improvement.
The transportation plan includes some local street
additions and designates Higwhay 12 as a principal
arterial - but on the existing alignment. I do
not think the planner realizes that principal
arterial means a grade-separated, limited access
highway even though he includes a copy of the
Metro Council classification. The plan also shows
County Road 19 extended north from 19/84 and then
realigned through the west edge of Baker Park.
This would affect portions of Orono along Townline
Road but probably would not affect our Ring Route
use of purpose.
The Comprehensive Plan contains three different
land use concept plans showing various densities
of development ranging from "the existing pattern"
with an ultimate population of 2 ,000 to a pattern
designed to accommodate the Metro Council population
forecast of 2 , 900. The Comprehensive Plan then
presents Map1e Plain' s "Land Use Plan" which is not
like any of the three concept plans. (I don' t
know how they got from A to B) . The Land Use
Plan shows single family and duplex residential
areas and enlarges the existing industrial areas,
particularly along Highway 12 . The commercial
areas remain essentially unchanged. The plan
preserves the large wetlands and is designed to
phase development based on sewer extensions.

1. Orono is diametrically opposed to any interceptor
route through the rural northwest corner of the
Lake Minnetonka Watershed as shown on the attached
map from the 1971 Harza Study of Lake Minnetonka.
2. Maple Plain is to be commended on an excellent
plan, recognizing your unique "town center" role,
yet consistent with the rural plans of the sur-
rounding area.

Alan Olson, City Planner, entered into the record CONDITIONAL USE PERMIT
the following concerning a conditional use permit 1140 North Arm Drive
for KK & Kompany & Leo Duehn, 1140 North Arm Drive, KK & Kompany & Leo Dueh
dated February 12 , 1980, which states: #489
On February 11, 1980 , Mr. Duehn met with the Council
to review the status of the application and discuss
final agreements.
My understanding is that Mr. Duehn was primarily
concerned with being able to store boats in the
rear of his lot (Area 3) and that the Cit_y Council' s
position is that he and his wife could do so, but
only as long as they own and live on the property.
Mr. Duehn seemed to agree with this position at
the end of the discussion, particularly when it
was clarified that the shop (Area 1) could be
continued as a boat repair business beyond his
ownership.
Item 6 of the resolution has been amended to clarify
this point. I have provided Mr. Duehn with a copy
of the resolution and have had Jean P�Iabusth discuss
it with him again. Unless the Council wishes to
change their position, I see no reason for further
delay. I recommend adoption of the attached
resolution.

the following concerning the conditional use permit 280 Orono Orchard Road
request of Timothy Petersen, 280 Orono Orchard #S00
Road, dated February 20 , 1980 , which states : TiMothy Petersen
On January 30 , 1980 , Mr. Petersen appeared before
the Council and promised that he would remove his
antenna by February l, 1980. As of this morning,
the tower is still in place as it has been since
last summer.
Mr. Petersen has refused to meet with his neighbors
as he promised at the December meeting. On
January 16 , 1980 , the City received a letter from
a civil engineer attesting to the tower' s structural
integrity. On February 13, 1980 , the City received
a phone call from that engineer requesting Mr.
Petersen' s name and address so that he (the engineer)
could be paid for his letter, which was now obviously
written withotat ever visiting the site. I know
of no response to Mr. Malkerson ' s letter of February 6 ,
1980.
I submit that this whole after-the-fact application
has been a series of delays, misrepresentations
and broken promises. DZr. Petersen may be attempting
to delay compliance with the ordinances of the -
City until he moves from the property in May as
he stated he will do.
If the tower is still standing on February 25, 1980 ,
I recommend that the Council deny the application
and that additional citations or formal complaints be
issued.

the following memo dated February 20 , 1980 , which
states:
The approval of �4arren Ortenblad' s conditional use
permit application was based on the access issue
being resolved by the staff, the applicant and
the Hennepin County Highway Department. The
safest access for the proposed duplex at 3890 Shore-
line Drive was determined to be off the private
access road.
At the Council meeting on October 16 , 1979 , the
Council reviewed and approv�d an offer by Hennepin
County to accept the private driveway to their
maintenance station as a City street. In their
recent communication, they now propose a permanent
easement for street purposes across the private
driveway subject to the condition that the City
post no-parking signs along said driveway. Hennepin
County will continue to maintain the driveway.
Staff recommends acceptance of the permanent ease-
ment for street use subject to the enclosed resolution.

with a memo from Michael Gaffron, On-Site Systems
Manager, dated February 19 , 1980 , which states :

We have reviewed the time invested by P�r. Gaffron, SITE EVALUATION FEE*
and other staff, in the review of proposed sub- (Continued)
divisions in rural Orono. It has become apparent
that the soil, slope and water table criteria of
acceptable and absorption capacity play a very
strong role in the final shaping and configuration
of these decisions.
Mr. Gaffron does field inspections as well as
office review of submitted site evaluations. His
input is critical to the developer and the City
alike. On the average, he invests from one to
two hours per lot in this review, with a minimum
of four hours per division.
Based on the above , it is our recommendation that
a subdivision site evaluation fee be instituted
in the 1980 fee schedule, Section 39. 350
Special Improvement Review Charges , as follows:
Review Site Evaluation Reports for proposed on-
site treatment facilities: $30.00 per lot.

Alan Olson, City Planner, entered into the SPACE ANALYSIS
record the following concerning a space analysis City Buildings
for City buildings dated February 14, 1980 ,
which states :
To� Jacobs completed an indepth inventory of the
space available in each City building including
the post office , administration, police and
Council Chambers buildings. He inventoried the
number of work stations (people) in each depart-
ment as well as special equipment needs. He
compiled a list of energy, building code and
handicapped-access improvements required in
each structure.
The above data was used to completely review the
housing needs of the City staff with the objective
of achieving good space utilization combined
with improved department functioning. Make-do
improvements were to be avoided while permanent
improvements were to be justifiable by some
energy, access or functional improveMents.

ADVANTAGES AND DISADVANTAGES
-Both Alternatives provide the Police with a separate
structure for security, function and accounting
-Both Alternatives include access and facilities for
Council Chambers
-Both Alternatives move the Public Works Coordinator
into the Adr.linistration Building for better functioning
-Alternative No. 1 utilizes the existing structures and
costs less , but relocates the Assessing Department
away from Finance and Building-Zoning decreasing access
and cooperation; the Building-Zoning area is still tight
with less than optimum circulation; there is no room
available for the Post Office; the energy vestibule on
the Administration Building is necessary for energy
saving, employee comfort and handicapped access but
would be essentially temporary because the restricted
area by the stairs is too small for permanent use of
this door as the main entry.
-Alternative No. 2 costs more because of the administrative
addition but it provides organized housing for all
administrative departments in one building; it provides
room for a Post Office station; it greatly improves
circulation patterns for public by placing reception
and perr.lit areas closest to the parking lot; the
reception area is a permanent improvement not a temporary
use of space, with flexibility retained within the
existing building spaces.

Dick Benson, City Administrator, presented the P•4INNETONKA BLUFFS, ORONO
City Council with the following memo concerning LANE, WEST FERNDALE, #15
the 1980 Sanitary Sewer Construction plans PROPOSED SEWERS
dated February 20 , 1980 , which states:
The City of Orono is preparing to construct
sanitary sewers in the Minnetonka Bluffs, West
Ferndale Road, Orono Lane , County Road #15 ,
North Shore Drive, and Medina-Orono-Long Lake
areas this summer. The projects, although
separate in nature , can be coordinated in one
construction year to reduce construction costs.
We are discussing the projects with our fiscal
people to determine available funding.
The feasibility report submitted to the City
for sanitary sewer improvements for the P�inne-
tonka Bluffs , jaest Ferndale Road, Orono Lane,
and County Road #15 is not complete and has
to be reviewed by the City Engineer, City Public
�aorY.s Coordinator, and the City Planner. Channel
crossings, lift station applications , and force
main applications have not been adequately reviewed
for Council adoption. Statutory requirements
will have been met in that the City Council
on February 25, 1980 approves the feasibility
report in order to call a public hearing. Final
design, approving plans and specifications, will
occur after our public hearing process is finalized.
In order to adhere to a schedule , it would be
timely to request the City Engineer by resolution
to initiate a feasibility study of the proposed
Hennepin County #51 sewer project. �ae can hold
another public information meeting followed by a
public hearing during and after the drafting and
approval of that study.

Diann Goetten, 1385 Fox Street, was present to
review the proposed plan.
Mayor Van Nest stated that the City wants to
assure that all health standards are met. We
want to be sure that the City is presented all
of the facts to assure adequate review of all
construction and future service costs to justify
cost effective alternatives. The P7innetonka
Bluffs, Orono Lane, West Ferndale Road, and
County Road #15 have to be reviewed individually
and wholly to explore unique characteristics (Continued)

Control Commission February 6 , 1980 , states : MENT PROGRAM
"Your attention is called to proposed projects
which are scheduled for consideration and inclusion
in the Metropolitan Waste Control Commission' s
Proposed Development Program (Captial Improvement
Program) .
The projects (listed in the attached Memorandum
dated February 5, 1980) will be presented to the
Commission' s Committee on Budget and Finance at
2 : 00 P.M, on February 12 , 1980 for discussion and
recommendation and approval by the Commission at
its regular meeting at 2 : 00 P.M. on February 19 , 1980.
Should you desire any information regarding these
projects as they may affect your community, please
contact Mr. C. Ray Payne of the Commission.
You are encouraged to attend the February 12 meeting
of the Budget and Finance Committee to make any
comments you feel are necessary. "

SUBJECT: APPROVAL OF DEVELOPP1ENT PROGRAM FOR YEARS 1980 - 1984
The Metropolitan Waste Control Commission is required to submit a five
year development program at least biannually. The Commission is currently
involved in a comprehensive 201 planning effort to fulfill the requirements
of the Metropolitan Council Policy Plan and to plan projects over the next
five year period. This planning effort will be completed in mid 1980 and
it is anticipated that a comprehensive five year development program will
be prepared in late 1980 which will depict all the improvements needed
durinc� years 1981 - 1985.
The staff of the Metropolitan Council has requested that the Commission
submit a developr�ent program for years 1980 - 1984 to then by March 1 to
comply with the Metropolitan Reorganization Act. This program will fu1fi11
the biannual requirements and include only the projects which may be contained
on the 1981 Construction Grants Project Priority List. Approval of projects
in a development program constitutes consent of the Council for the Commis-
sion to apply for federal and state funds for the projects. The MPCA has
requested our input in establishing the proposed 1981 construction grants
list and will include proposed projects if they can be assured of the timely
completion of planning and/or the preparation of plans and specifications
early in the appropriation period.
In summary, the proposed development program to be submitted to the Metro-
politan Council by March 1 is a document to expedite projects for only the
next year and is not a comprehensive five-year program.
The project descriptions and other portions of the prograr� are currently
being prepared. The projects to be contained in the Development Program
for years 1980 - 1984 are listed below along with the estimated total
project costs.

The list of above projects was formulated in late January when the Corrrnission
and Council staffs met to discuss projects to be contained in the proposed
program and their status to the Council 's Policy Plan and their eligibility
to be placed on the MPCA's Construction Grants List. The Council staff
feels that their policy plan will have to be amended to include the Seneca
WWTP projects, the land acquisition and site improvements, the meterinc�
station improvements, and the MWWTP Additional Secondary Treatment Facilities.
The information required by the Council to make the policy plan amendments
is contained in the subject development program,
A71 of the proposed projects will have been thoroughly scrutinized by the
public before they are finally adopted in the program. The projects have all
evolved out of the current 201 planning effort which has been presented to
the public through public information meetings. The staff has sent letters
listing the above projects to the effected local governments for their infor-
mation and corrQnent as per the program procedures contained in the Council ' s
Policy Plan. The corrIInunities and other interested parties may also make
corrments during the Council 's 90 day review and approval period.
RECOMMENDATION
It is recommended that the Commission approve the Development Program for
Years1980 - 1984 and request the Metropolitan Council to approve the
proposed program. It is further recorrpnended that the Commission request the
Metropolitan Council to amend their policy plan as necessary to include the
subject projects in their policy plan.

The following letter was received from Herbert COUNTY STATE AID
O. Klossner, Director, Hennepin County Department Ring Route
of Transportation to Mr. C. E. Weichselbaum,
District State Aid Engineer, Minnesota Department
of Transportation, dated February 11, 1980 , which
states:
"In June 1979, the Hennepin County Department of
Transportation entered into agreement number
PW14-08-79 with the City of Orono for construction
of a segment of roadway which connects CSAH 6/
Watertown Road to CSAH 19/84. This project was
designed and administered by the City of Orono
thru a consultant.
Hennepin County requests encumbrance of County

Dear Sir:
The City of Orono is interested in again reviewing with you the fill vs. re-
taining wall solution for reconstruction of County Road 6. The City does not
plan to condemn the property as discussed but feels that there may be a mutual
financial benefit to constructing the embanl�ent.
The construction of the embankment along your property will require that
several trees be removed and approximately one-third of the pond filled.
The land area which would be taken as a permanent easement is 0.07 acres. The
land area which would be used for construction of the embanl�ent would be
0.12 acres. The replacement of fence�restoration of the embanl�ent and other
miscellaneous items would have to be worked out in some type of agreement.
I have not had adequate time to review what amount the City would be willing
to offer for the easements. The City Attorney and other staff inembers will
review this next week and get this information to you prior to onr February 25
meeting.
In our discussion you requested that I give my opinion on the effects of fill-
ing the pond. The removal of the visual screen provided by the trees would
appear to be the most significant factor. Plantings can be reestablished on
the slopea to minimze this effect. The loss of pond area does not appreciably
affect the downstream velocities in the stream but would result in a less
desirable pond for uses other than water storage.
The financial benefits will have to be weighed against the loss in environmental
benefits in making your decision. If you have any other questions, please con-
tack this office or John Gerhardson at the City office.

Mayor Van Nest and I met with representatives
of the Minneapolis Postal Department to discuss
the future of the Crystal Bay Post Office.
It was agreed that they would review the entire
Orono area and the different post offices serving
it contemplating closing the Crystal Bay office
and routing all mail out of Long Lake. Orono
would keep its identity and use Long Lake' s zip
code for rural delivery.
The same might apply to Minnetonka Beach if they
are receptive to this arrangement.
I held a meeting with the present postmaster
Mabel Belt of the Crystal Bay Post Office
and she does wish to retire this year (July) ,
but would remain until December to finalize any
work that has to be done.
It appears that we are all in agreement. The
postal department will make necessary changes to
accommodate closing the post office, the Crystal
Bay Postmaster wishes to retire, and Orono does
not wish to continue the present leasing arrangement.

commenting that he and his staff had completed
their review of the City of Orono postal delivery
service and determined that attempting to
incorporate a routing system for the City of
Orono using a Long Lake zip code was not feasible ,
which Means, the existing 82 box holders now using
the Crystal Bay Post Office would convert to a
rural route when the office is terminated and
we would not have a City of Orono address as
originally discussed.

as having potentially excessive I/I will be recorrmended to MPCA
for further funding of a detailed I/I analysis . The pattern
interviews will be carried out by a consultant under contract to
the Cornnission.
The continuation of the I/I program will be contingent upon certain
local commitments by each qualifying municipality wishing to participate
in the program. First of all , the municipalities must provide 10% local
share of the study cost. The U. S. EPA will fund 75% of the study cost,
and the State of hlinnesota will contribute 15% of the study cost under
matching grants program. Secondly, each municipality will become re-
sponsibje for the administration of the I/I program in complete conformanc�
with the regulations of the federal grants progran. Finally, the munic-
ipalities will have to enter into an agreement with the Commission
regarding the pass-through of the grant funds because the Commission will
be required to remain the grant applicant on behalf of all participating
municipalities. The CorrIInission will also provide coordination and
assistance in setting up each local study.
The completion of the I/I analysis is a prerequisite to �the funding of
subsequent steps in the federal program of eliminating excessive sources
of I/I . Subsequent steps consist of a Sewer System Evaluation Survey
(SSES) followed by the actual sewer system rehabilitation. The potential
for excessive I/I must be established or verified at each step before
funding for the next step can be requested. A copy of the federal reg-
ulations pertaining to sewer system evaluation and rehabilitation is
attached for further reference.
The Commission is in the process of applying for federal and state grants
to cover the I/I analysis. We expect a grant offer sometime in early
1980. In the meantime, this package of material is being transmitted to
you to serve as an introduction to the I/I program. We will also schedule
meetings in the near future to further explain the program and to answer
any questions which are certain to arise. In addition, we are prepared to
meet with representatives of each corrmunity on an individual basis. Pleas�

Dear Mayor and . Councilmembers:
The City of Orono, as have other cities in the area, has
been individually approached by various cable TV companies
to provide service to our cities.
Certain cities have contacted other cities contiguous to
them requesting their suggestions on this matter.
The City of Orono has been in contact with the State of
Minnesota Communications Board discussing the metro area
cable service territories and other factors and criteria
that should be considered.
Given the low population densities in the Lake Minnetonka
area, it is expected that the best cable TV service can be
provided through a Joint Powers Agreement involving all
adjacent cities.
It has been suggested to us that it would be appropriate at
this time to arrange a meeting of representatives from
interested cities with a member of the State of Minnesota
Cable Communication Board to discuss this matter.

; � Note: This group of communities, interlaced as they are by Lake Minnetonka,
presents a unique economic and design challenge to cable development.
Most are too small for individual development� and hence suggest the
need for cooperative efforts if all are to be served. Co�on interests
and relationship are strong and evident, but the problem of low to
marginal economic viability because of the probable high cost of con-
struction for the entire area demands patient and thorough study lead-
ing to innovative technical approaches to both design and financing.
Variations of the above group might f ind the Carver County communities
of Chanhassen and Victoria developing separaLely toward a possible free-
standing development of cable at Chaska. Chanhassen's developed areas
suggest a probability for independent development, although this nay not
be as advantageous as an association with Shorewood to the north. Other
possible variations might include a development of several smaller CST
municipality groupings that might be developed, despite the customary
advantages of sufficient household numbers to increase optimum economic
viability. Any combination of co�ununities in this general area poses
difficulties because of the natural barriers to 'economical construction.
In order to remain consistent with current Metropolitan Council Policy, no attempt has
been made in this report to deal directly with the free-standing seven-county communi-
ties outside the Metropolitan Urban Service Area. Cable systems already serve

City Council with a memo prepared by John R.
Gerhardson, Public Works Coordinator, regarding
the Dutch Elm Reimbursement and Subsidy Program
dated February 14 , 1980 , which states:
In 1979, the Orono Public Works Department removed
one hundred and sixty-six trees on street right of
ways and public grounds. On two occasions, private
tree firms had to be contracted to assist in removal.
The cost to remove one hundred and sixty-six trees
by the street department and private firms amounted
to twenty-two thousand, five hundred ninety-seven
dollars and eighty-one cents. (Average cost per
tree = $136.. 13) . Because the City of Orono does
participate in the Minnesota Shade Tree Subsidy
Program, we should be reimbursed 480 of $22 ,597. 81,
($10, 846. 94) .
The City of Orono also offers to the residents of
Orono a $25 per tree subsidy. To qualify for the
subsidy, the resident must live in the control zone
or own property in the control zone, have 1/2 acre
or less of land, a diseased tree must be diagnosed
by the Orono Forester, and an official notice must
be submitted at the time of the request for subsidy.
In 1979, Orono residents submitted claims for

Again, because of the State subsidy program, we should
be reimbursed 480 of $675 , ($324) .
The City of Orono' s cost for a Forester for 1979
was $7,539.55. The State subsidy program will also
reimburse the City of Orono 480 of that cost, ($3 ,618. 98) .

City Council with a memo from John R. Gerhardson, BID*
Public Works Coordinator, concerning a diseased
tree removal bid dated February 21, 1980 , which
states:
The City of Orono received notice that there were
eleven diseased elm trees at the northwest end
of the Casco Point skating rink and three diseased
elms on City property adjacent to the Highwood
Nature Trail.
The trees at the Casco Point skating rink are
located such that City crews cannot remove them.
The trees will have to be cut down and brought to
Casco Point Road with special equipment (skidder)
so as not to damage the area other than one path.
The trees adjacent to the Highwood Nature Trails
are located such that they are very close to homes
and cannot be cut down by City crews. Once the
trees are cut down, we can get the trees out with
street department equipment.
I have received three estimates from private tree
firms for the cutting down of the fourteen trees.

Tall Timber Tree Care $1, 035
Therefore, it is my recommendation to contract
the cutting down of the fourteen trees to Tall
Timber Tree Care for an amount not to exceed

Director, a special assessment refund, dated 1700 Bohns Point Road
February 14 , 1980 , which states:
Jack Crocker, 1700 Bohns Point Road, paid the
assessments on a parcel of land that he owns
jointly with several other parties. He paid the
assessments through Title Insurance Company,
his escrow agent. The parcel of land is a common
area surrounded by Bohns Point Road, a private
road in that area. Mr. Crocker is not the owner
of r�cord for this parcel of common ground on the
County records. He is requesting that the assess-
ments in the amount of $192 be refunded to him
(through Title Insurance Company) . It is requested
that the refund be approved.
