Dear Mr. Oman :
I have your letter of October 3 , 1997 and will respond to
each of the issues you raised in your letter.
We purchased the 1065 Linden Lane property to use as , and
we do use it as , a contiguous extension of our 1067 Linden
Lane homestead residence. In essence , our residence
property is now four (4) acres instead of two-and-one half
(2 T /2 ) acres which we first had at 1067. And, of course,
it does have a principal residence on it. The 1065 property
is considered as part of the homestead for real estate
taxation as shown on these two enclosed copies of the 1997
property tax statements. Incidentally, you will note that
the 1065 address has been dropped from the tax statement,
and it simply says , "address pending".
I am puzzled about the statement that the pool is considered
to be a hazard to the public and animals . The pool is
fenced in and situated away from the public (and animals ).
In fact , there would have to be severe trespassing for the
public to even get near the pool . As I understand it, Orono
ordinances do not require a pool to be fenced. Since ours
is completely fenced it would appear that we have exceeded
existing ordinance requirements.
I am also puzzled about the mosquito breeding statement in
your letter. After we purchased the 1065 property, we talked
with the DNR mosquito control person who was taking mosquito
egg samples in the area (on Linden Lane low areas , in the
slough accross from us on County Road 151 , and so forth ) .
We asked him if the pool would be a breeding ground. He said
no . He said that standing water does not breed mosquitos
because mosquitos do not lay their eggs in standing water.
Rather , he said , mosquitos lay their eggs in places where it
is dry but will later catch and collect rain and serve to
hatch mosquitos. That is why mosquitos appear a week or two

after a rain. The new accumulation of water triggers the
hatch. We cfid go even further iand ask the DNR mosquita
control persan to check the pool. as a kreed.ng site. He
did check i ad said it was iot a problem for mosquito.
As an aside, a cauple af timeslaovex the pst years we have
seriously thotght abvaut trying to fi11 the pool. ButT from
a practical stan,;dpoin,t, it is sjueh a dauning task to try
to get heavy equi, pmrtt nea:r thej poo.l beeause af the restrcited
access to the praperty and" the isiting of ,he pool . There
Jrst isn t a decsnt way to get 1at it from the south side
(the 1067 s#de} beause of matue tr;es. This side would
pravide the best access because the elevaion hers is higher
than the 'pooi site. TQ attempt' to f'ill .t from the 1065 side
would be qtite a proec for a ouple of easons. 4ne is
that ths drivewy going into the s:te is eally nothing more
than a currin•g, rttted tril h ough tree . Then , because
the pool s.te is levated seve1 feet, i 1.oaks like big
earth xmps would have to be bu.lt to get up to the pool
area.

To illustrate the inadequacy of the acces:sl driveway, last fall
when the City of , rort.o as worf:.rg an sew.lrs , an Urono truck
went in on the pr p,rty. It go stuck, i rutted-up the
property and the rivet it part ally brok down an ,apple
tree, and Drono + pl;oye:e°s ended up drivin accross the
property in a difernt place t Linden Laine with another
vehicle. (When elreturned hame we saw the damage, got the
tree trimmed, had ,the ruts filld, an'ct said to ourselves ,
"well , things happen" ). , ;
