HomeMy WebLinkAbout#2865-allowing pool to remain-1990 ��� ��� Clt� of ORONO ` .� RESOLUTION OF THE CITY COUNCIL • NO. 2865 • - � • A RESOLUTION ALLOWING A SWIMMING POOL TO TEMPORARILY REMAIN ON TH$ PROPERTY LOCATED AT 1065 LINDEN LANE WITHOUT A PRINCIPAL RSSIDENCE FILE 1476 WH$REAS, the City of Orono is a municipal corporation organized and existing under the 1.aws of the State of Minnesota; and WHEREAS, pursuant to State Statute 412 et. seq. and 462 et. seq., the City Councix of the City of Orono has adopted a community management p].an and zoning reguJ.ations for the protection of the pub�.ic heaXth, safety and general. weJ.fare; and WHER$AS, David and Suzanne Prass (hereir.after "the a�pXicants" ) are the owners of the property located at 1065 Linden Lane within the City of Orono (hereinafter "the City") and ].egal.xy described as fol.lows: Exhibit A, attached (hereinafter "the property" ) ; and WHEREAS, the app�.icants have appl.ied to the City of Orono for special, consideration that wou].d aXJ.ow a swimming pooJ. to remain on a property that does not sustain a principal. , ,�..� residence. NOW, THERBFORE, B$ IT RESOI,V$D that the City CounciJ. of Orono, Minnesota; FINDINGS 1. This appl.ication was reviewed as Zoning FiJ.e 1476. 2. The property is J.ocated in the LR-1B SingXe Fami].y Lakeshore Residential Zoning District requiring 1 acre in area. The property consists of 1.4 acres. 3. In October of 1988, the former residence on the property was demol,ished as a resuXt of a Hazardous BuiJ.ding Action commenced by the City of Orono. An older established residentia]. neighborhood surrounds the property. 5. The City has found the pool in it's present condition to be a potentia3. hazard to the immediate neighborhood arld general publ.ic. 6. The property exceeds the required 1 acre in area and 140' width required of LR-1C zoning standards and can legall.y sustain a principa], residence without the need for further variances. The City Council. has considered the applicants speciax request including the findings and recommendations of the PJ.anning Commission, reports by City staff, comments by the applicants, and based upon one or more of the findings noted above, the Orono City Council hereby agrees to allow the swimming pool. to remain on the property without a principal residence subject to the following conditions: 1. Applicant shall instaXl. a safety swimming pool cover by October 30, 1990, and such system has been approved by the City Engineer. 2. Applicant sha1. J. obtain a building permit for construction of a principal. residence on the property by October 1, 1991 and to comp].ete construction and obtain a Certificate of Occupancy by December 1, 1992. From the present unti7, a Certificate of Occupancy is issued for a principal. residence, the appYicant shall. agree to do the following: a. Provide proof of current insurance coverage for the City of Orono' s official records. b. Maintain snow fencing around poo7. area and maintain pool cover to provide necessary protection. c. Appl.icant shall provide to the City written . confirmation, preferably within the first week of each month, that poo]. is being maintained in a safe manner as recommended above.
