ENCROACHMENT AGREEMENT
ACREEMENT made this , f'� day of r��lir,�,a2�', 2014, by and between the
CITY OF ORONO, a Minnesota municipal corporation ("Cit�'), and ANTI�ONY A. KUZNIK
and CARRIE L. KUZNIK,husband and wife as joint tenants ("Kuzniks"or"Owners").
1. BACKGROUND. The Kuzniks are the fee owners of certain real property located
in the City of Orono, County of Hennepin, State of Minnesota,legally described as follows:
Parcel ID No. 07-117-23-14-0066
Parcel 1:
Lots 6, 7, 8, and 9, "Linden Beach", and that part of vacated Linden Lane which lics
westerly of the center line thereof and its southeasterly extension, and between the
easterly extensions of the North line of Lot 6 and the South line of Lot 9, Linden
Beach.

Parcel2:
That part of Lots 10, 11 and 12,"Linden Beach"described as follows: Beginning at
the Southwest corner of Lot 10; thence East along the South line of said Lot 10, a
distance of 84 feet; thence Northwesterly along a line,which would intersect the
North line of Lot 12 at a point 185 feet East of the Northwest corner of said Lot 12
to a point in said Northwesterly line which is 52 feet Southeasterly measured along
said line from the North line of Lot 12;thence West parallel with the North line of
Lot 12 to the West line of said Lot; thence Southeasterly along the Westerly line of
Lots 12, 11 and 10 to the point of beginning,inchtding one-half of Linden Lane,
vacated, adjoining said Lots on the Westerly boundary, and the vacated Linden Lane
in its entirety, adjoining said Lot 10 on its South boundary,according to the map or

plat thereof on file and of record in the office of the Register of Deeds in and for said
County and State,Hennepin County,Minnesota.

having a street address of 1065 Linden Lane,Orono,Minnesota("Subject Property"). The City
owns easements for utility purposes over portions of the Subject Property. The Kuzniks want to
construct a sidewalk and staircase on the Subject Property which will encroach into the City's utility
easement areas as depicted on the attached survey sketch.
2. ENCROACHMENT AUTHORIZATION. The City hereby approves the
encroachment in its easement area on the Subject Properiy subject to the conditions set forth in this
Agreement. The City shall have no responsibility to maintain the sidewalk or staircase located
within the City's easements.
3. HOLD HARMLESS AND INDEMNITY. In consideration of being allowed to
encroach in the City's easement area,the Owners for themselves,their heirs and assigns,hereby
agree to indemnify and hold the City harmless from any damage caused to the sidewalk and
staircase in the City's easement area, caused in whole or in part by the encroachment into the City's
easement area.
4. TERMINATION OF AGREEMENT. The City may,at its sole discretion,
terminate this Agreement at any time by giving the then owner of the Subject Property thirty(30)
days advance written notice, except that no notice period will be required in the case of an
emergency condition as determined solely by the City and the Agreement may then be
terminated immediately. The property owner shall remove the sidewalk and/or staircase to the
effective date of the termination of this Agreement. If the owner fails to do so,the City may remove
the sidewalk and/or staircase and charge the cost of removal back to the owner for reimbursement.

5. RECORDING. This Agreement shall run with the land and shall be recorded
against the title to the Subject Property.
