While the driveway exceeds the maximum allowed width of 20 feet by three (3)feet. The City does allow for 5-foot
radius flairs at the road. We will accept the driveway width of 23 feet as shown on the 4-22-15 as-built survey.
Please submit an updated as-built survey showing the final grading, berm creating, etc. for our review.

Thank you for the below note. I write to provide you with information regarding your inquiries as follows:
1. Tiered Retainin�Walls: Complete. As you note below,the requested report has been completed and was
previously provided.

2. Gradin : Complete. Final grading of the lot,followed by sod installation, berm creation/tree planting and
landscaping in line with the prior surveys and permits, has been completed.
3. Drivewav Width: We would like to discuss with you the potential to receive a variance for the driveway
width issue mentioned below. Given the curvature of Linden Lane just prior to our driveway entrance, it
becomes very difficult to make the turn into the driveway with even the size of driveway that currently
exists. Any less driveway entrance space would require excessive automobile maneuvering
(starting/stopping/back-and-forth turning) on essentially a "blind corner"that may present a public danger
and could give rise to accidents. Moreover, given our lot size of approximately 1.6 acres, we have not
reached/exceeded our"hard cover" allotment and have plenty of hard cover to spare. As such, please advise
as to how we might obtain a variance for the driveway as it currently exists.
Please confirm completion of#'s 1 and 2 above, and advise as to how we might accomplish #3. We would like
to close out the above as well so as to receive a refund of the $10,000 that is being held in escrow by the City
of Orono as you have noted.

We have reviewed the as-built survey submitted and made a site visit to the property. We have made the following
comments. Please provide an updated as-built survey addressing the comments below:
• Driveway Width. The driveway was proposed to be 20' in width at Linden Lane which meets City
requirements. The as-built shows the driveway width to be 23' at linden Lane. The driveway width must be
adjusted to the maximum allowed 20'width.

• Tiered Retaining Walis. The walls at the Southeast and North corner of the house appear to require an
engineered design. Tiered walls are considered one wall unless they are separated by twice the height of the
higher wall. Walls 4' or taller required engineered plans. Please submit engineered plans for the tiered walls for
our engineer to review.
• Grading. The approved building permit survey dated 12-27-13 proposed grading which directed water away
from the property to the North. A land alteration permit was issued on 11-18-14 which proposed a berm
between the house and Linden Lane and also modified the grading to north, continuing to direct water away
from the property to the North. The as-built survey and site visit revealed the topography on the north side of
the property is currently directing water directly to the property to the North. The topography must be changed
to the approved grading plan dated 11-18-14 or modified to keep water from draining onto the property to the
North. Make the necessary changes to the property and submit an updated as-built survey showing the changes
for our review.
We continue to hold a$10,000 escrow. Once the above items have been submitted,corrected and approved we will
refund the escrow money. If you have any questions, please don't hesitate to contact us.

Bob,
I believe there is some miscommunication on the engineered design requirement. The attached information you
submitted does not meet the City's requirements.
The City's requirement is that all walls over 4 ft in height are designed and signed off on by a registered professional
engineer. Walls less than 4 ft and are not separated by at least twice the height of the lower wall are considered one
wall. The design should be submitted for review prior to the construction of the wall. In this case that was not
done. We need either a signed design that was used or if one was not done then a report signed by a licensed engineer
showing the wall designed properly.
The design and or report should contain sufficient detail for someone in the future looking at the property file to
understand what was built. A typical retaining wall design contains information about the soil the wall is retaining,the
type of fill used,the wall material,the foundation of the wall, any drainage mechanisms in the wall, and the type and
location of any geogrid reinforcement. Normally we also receive a cross section drawing of a typical section in the walt.

Chris,
I noted the following discrepancies between the approved plan and the as built:
1. Drive way is different than plan. Proposed dr/iveway was at City allowed maximum width of 20' at Linden Lane.
As-built driveway width at Linden Lane is 23'1 I'll need builder to modify to a conforming width. Different
driveway layout okay-meets hardcover and setbacks.
2. Path to lower garage missing.,�ie path to the lower garage is part of our assumed hardcover for a lower level
access with a garage door of 6' in width. I will have them add this'assumed' driveway to the hardcover
calculations.
3. Planned Swimming pool missing.
4. Approved swale along north of property not depicted. There needs to be a drainage mechanism to ensure roof
and surface runoff is not directed onto the neighboring property. (INSPECTOR TO VERRIFY DRAINAGEWAY)
5. Additional retaining walls on South east corner. Based on As built they appear to require a engineered design.
Walls 4' or greater in height must be designed by a licensed professional, and plans must be submitted to the
City for review prior to the approval of the permit.Walls less than 2X the height of the.�wall apart shall be
considered one wall. (INSPECTOR TO VERRIFY DIMMENSIONS) �0�.

We have reviewed the as-built survey submitted and made a site visit to the property. We have made the following
comments. Please provide an updated as-built survey addressing the comments below:
• Driveway Width. The driveway was proposed to be 20' in width at Linden Lane which meets City requirements.
The as-built shows the driveway width to be 23' at Linden Lane. The driveway width must be adjusted to the
maximum allowed 20' width.
• Tiered Retaining Walls. The walls at the Southeast and North corner of the house appear to require an
engineered design. Tiered walls are considered one wall unless they are separated by twice the height of the
higher wall. Walls 4'or taller required engineered plans. Please submit engineered plans for the tiered walls for
our engineer to review.
• Grading. The approved building permit survey dated 12-27-13 proposed grading which directed water away
from the property to the North. A land alteration permit was issued on 11-18-14 which proposed a berm
between the house and Linden Lane and also modified the grading to north, continuing to direct water away
from the property to the North. The as-built survey and site visit revealed the topography on the north side of
the property is currently directing water directly to the property to the North. The topography must be changed
to the approved grading plan dated 11-18-14 or modified to keep water from draining onto the property to the
North. Make the necessary changes to the property and submit an updated as-built survey showing the changes
for our review.
We continue to hold a $10,000 escrow. Once the above items have been submitted, corrected and approved we will
refund the escrow money. If you have any questions, please don't hesitate to contact us.
