Regular Meeting of the Orono Council, 7: 00 P.M.
February 11 , 1980
The Orono Council met on the above date with the
following members present: Mayor Van Nest,
Councilmembers Hurr, Massengale, and Paurus.
Absent: Councilmember Butler. Also present:
City Administrator Benson, City Planner Olson,
Attorney Desyl Peterson, and Planning Commission
Member Jabbour. Absent: City Attorney Malkerson
and City Engineer Cook.
Mayor Van Pdest announced that now was the time PUBLIC HEARING
and place for the public hearing concerning Stubbs Bay Marina Area
James McCleary' s rezoning application for the Rezoning
Stubbs Bay Marina area. City Administrator
Benson presented the Notice of Public Hearing,
the Affidavit of Publication, and the Certificate
of Mailing.
Alan Olson, City Planner, entered into the record
the following dated February 7, 1980 , which states:
After discussions with the City Staff, Mr. McCleary,
on January 15 , 1980, has requested rezoning of his
property to facilitate future subdivision and
development of the land for three single family
residences.
A public hearing is scheduled for 7 : 00 P.M. on
Monday, February 11, 1980 to review this rezoning
proposal. There has been mailed notice to all
owners of property shown on the attached map and
published notice in the Sun on January 30 , 1980
and February 6 , 1980. Attached are two letters
received from neighbors in support of the rezoning.
The Planning Commission was scheduled to review
the proposal at their regular meeting of February 4,
1980 , but this meeting was cancelled. Consequently,
the staff reviewed the proposal with the individual
Planning Commission members and by poll has received
the Planning Commission' s unanimous recommendation
for approval of the rezoning.
The attached map shows a suggested subdivision
arrangement which has been reviewed by staff for
conformance with zoning, flood plain and septic
system regulations. This is not an actual sub-
division application and may not be the final
arrangement, but based upon this proposal, three
residential dwellings could be built on the
property provided a mound-type septic system was
used for grey-water disposal and holding tanks
were used for all toilet wastes.

2. Approval of an agreement with James McCleary
whereby he will apply for subdivision of the
property including all necessary variances and
wherein the City would authorize commercial
dock use of the property during 1980 while
the subdivision review is in process.
A letter from Dr. & Mrs. Vincent H. Larson
dated February 2 , 1980 , states:
"We will not be able to attend the public hearing
February 11, but we would like to express our
support for the rezoning of the Stubbs Bay Marina
property to single family residences. "

A letter from Mr. Emory Smith, 3420 Bayside Road,
dated February l, 1980 , states :
"Mrs. Smith and myself would be heartily in favor
of an action by the Village rezoning the marina
property from B-2 to LR-lA Single Family Lakeshore
for the construction of 3 single family residences.
Please convey our feelings to the proper authorities
in our absence. "

A letter from Mr. & Mrs. James K. Fulkerson,
230 Tonka Avenue, dated February 6 , 1980 , states:
"In reference to your letter regarding 'a public
meeting on the Stubbs Bay property belonging to
James McCleary.
How can you even consider letting him build three
houses on that property. One house would be great.
It would clean up the awful mess that we have had
to live with because you would not let him rebuild
a public marina (which we would have preferred) .
In the first place, he does not have six acres ,
which would be required for three houses according
to Orono rules and regulations for new houses.
Granted, it has already been plotted, but only for
a marina - not houses.

In the second place, how can he be allowed to PUBLIC HEARING
put in three septic tanks and three drainfields Stubbs Bay Marina Area
when you would not allow others on higher land (Continued)
in the same area to put them into existing houses
or into new ones. If you would like names and
addresses I will give them to you.
If a house burns down, v�ould you let anyone else
put up two instead of one - if they have the
room - but not four acres? Consider it, because
what is good for one should be good for everyone.
I really think, if you let him build houses it
should only be one."

Council Meeting - February 11, 1980
Mayor Van Nest inquired if any persons present
wished to be heard.
Jackie and Peter Meyer, 3407 Eastlake Street,
were present to revie�� the proposal.
Mr. Lou Oberhauser, Attorney representing Mr.
McCleary, commented that he and Mr. McCleary do
agree with the proposed agreements based upon
the language as submitted to them.
Mayor Van Nest: The City of Orono does not want to
leave a small parcel, as Outlot B, to remain as a
separate platted parcel for some speculative future
structure. Outlot B should have an open space ease-
ment as the agreement provides. In the future,
Outlot B can be combined with an adjacent lot or a
lot across the street from it but it cannot be
considered all right used as a separate buildable lot.
Mayor Van Nest: Mr. Oberhauser do you agree with my
comments?
Mr. Oberhauser: Yes, as long as my client under-
stands that Outlot B can be sold at a future date.
We do understand thatthis lot cannot be established
as a separate buildable lot but can be sold to
adjacent property owners as a combined lot.
After all persons present had an opportunity to
be heard, Mayor Van Nest closed the public hearing
at 7 : 15 P.M.

adopt Ordinance No. 228, An Ordinance Amending Rezoning
The Municipal Code Of Orono By Rezoning Certain B-2 to LR-lA
Properties In The City From B-2 Lakeshore Business (Continued)
District To LR-lA One Family Lakeshore Residential
District, subject to City and applicant entering
into a subdivision agreement creating three lake-
shore lots and two outlots. Outlot B not to be
determined as a separate buildable parcel but
eventually to be combined with contiguous lots
or lot across the street from it. Motion, Ayes (4) -

Mayor Van Nest moved, Hurr seconded, to approve AGREEMENT
the Rezoning Agreement For Property Known As The Stubbs Bay Marina Area
Stubbs' Bay Marina Property, subject to amending
paragraph #7 to clarify eventual residential dock
use and ownership of Outlot B. Motion, Ayes (4) -

Mayor Van Nest moved, Paurus seconded, to approve CONSENT AGENDA*
the Consent Agenda* , subject to removing items
6 and 14, with all staff data and supportive
information to be included in the Minutes in the

Mr. Lee Tomlinson, Park Commission Chairman, PARK COMMISSION COMMENT
reviewed Orono School District' s Community Summer Recreational
Education Programs commenting that a program is Program
being formulated to create a position for a summer
recreation coordinator who will establish a program
for all the communities in the lake area. Orono
should receive two,half days each week as their
share of the program.
Hurr moved, Paurus seconded, to conceptually
approve Orono School District' s Community Education
Program, subject to total program and costs being
submitted and final Council approval. Motion,
Ayes (4) - Nays (0) .
Mr. Lee Tomlinson also discussed Orono' s Bike BEDERWOOD PARK, SURVEY,
Safety Program, the Park Commission' s City- BIKE SAFETY
wide survey and the Army Engineer' s intent to
provide a construction team for the Bederwood
Park grading this spring.
Mr. Tomlinson informed the City Council that for
sometime he has been trying to get a commitment
from the Army Corps of Engineers to construct a
ball diamond at Bederwood Park. (Continued)

During the past week, I have contacted Captain BEDERWOOD PARK
Langhoff of the Army Corps of Engineers and (Continued)
hopefully, very soon, we will receive the necessary
forms to initiate the program. Captain Langhoff
has indicated that construction could begin in
July or August, if there are no problems.
Councilmember Paurus , Orono' s representative to LMCD REPORT
the Lake Minnetonka Conservation District reported
on LMCD activities.
No comments from the Planning Commission. PLANNING COMMISSION
No comments from the Comprehensive Planning COMPREHENSIVE PLANNING
representative.
No comments from the public present. PUBLIC COMMENTS
Representative Robert L. Searles, State Legis- ROBERT L. SEARLES REPOR
lative District 42B, addressed the City Council
and attending public, commenting on legislative
accomplishments during the past year.
Mr. Leo Duehn, 1140 North Arm Drive, was present CONDITIONAL USE PERMIT

Mr. Duehn agreed to deferring the matter until KK & Kompany - Leo Dueh.
February 25 , 1980 , when further information will
be available.
Mayor Van Nest moved, Massengale seconded, to
table until the February 25 , 1980 Council meeting
the conditional use permit for KK & Kompany and
Leo Duehn, 1140 North Arm Drive. Motion,
Ayes (4) - Nays (0) .
Alan Olson, City Planner, entered into the STREET VACATION
record the request of Haefele, Martin & Hasse� Part of Navarre Lane
for vacation of a portion of Navarre Lane
dated February 6 , 1980, which states:
The abutting property owners, Richard J. Haefele,
representing the Church, Richard Hassel, representing
the Lafayette Ridge Development,and Erwin Martin,
owner of Martin' s 66 station, have petitioned to
vacate a portion of Navarre Lane from the inter-
section of Navarre Lane at County Road 19 to
the intersection of Navarre Lane at Olive Avenue.

The County has closed the Navarre Lane access off STREET VACATION
at County Road 19 because of its nearness to the Navarre Lane
traffic signal at the intersection of County Roads (Continued)
15 and 19 and dangers arising from left turns
being made by cars going south on County Road 19 .
The County has stated that the Navarre Lane access
will never be opened and that an additional curb
cut will not be approved in the right-of-way if the
City approves vacation.
The applicants propose a general cleanup and
landscaping of the subject area. A corner of the
Church encroaches into the Navarre Lane right-of-
way. The Church has been unable to obtain clear
title to the property. The service . station owner
is concerned that he retain access to County Road
19 and wants to cleanup the frontage along Shadywood
Road. We have heard nothing from the Lafayette
Ridge group except that they signed the applicants
letter.
Please review the Planning Commission Minutes of •
November 26 , 1979 and January 28 , 1980 for back-
ground discussion and recommendation.
The following are summaries of reviews from staff
members and the Hennepin County Highway Department:
A. Comments from the Public Works Coordinator:
l. How costly would it be for the City, gas and
telephone companies to locate the four under-
lying utilities?
The cost for the location of all utilities
should be borne by the party requesting the
vacation. We can assist by making sewer and
water as-builts available to them.
2. What type of access would be necessary if the
entire area were grassed?
If the entire area is grassed, this does not
create a problem as long as there are no fences
or barricades.
3. Would a 10 ' easement be sufficient for each
of the utilities?
We would need a 20 ft. easement which is the
normal utility easement.

4. Does the Orono road department use Navarre STREET VACATION
Lane from the intersection of Olive Avenue Navarre Lane
to the west? Do you see any future use? (Continued)
The Orono street department maintains that
part of Navarre Lane to allow access to the
church parking lot and fire hydrant
accessibility.
I only wish to suggest that we should determine
what effect, if any, this would have on our total
miles in the City in regard to M.S.A, monies. We
should also be concerned that the fire hydrant
at the south end be accessible to the gas station
on the corner, perhaps the street cannot be
vacated all the way to County Road 19 .
B. Hennepin County Highway Department' s Response
"The Traffic Division and Preliminary Design
Section reviewed the CSAH 19 - CSAH 15 inter-
section revision along with your vacation of
Navarre Lane. To allow for channelization
at the intersection, we are requesting an
additional 33 f t. of right of way through the
Navarre Lane corridor, making the right of
way 66 ft. from the center of CSAH 19. I
have attached a half section map showing
the area requested. "
Although Mr. Weigelt' s letter does not respond
specifically to Mr. Martin' s request to maintain
his access off Shadywood Road (Cty. Rd. 19) ,
he has assured me that there would be no problem.
In fact, the additional right of way requested
by the County would assure that access.
The Planning Commission moved to recommend a
partical vacation of Navarre Lane to enable the
Church to obtain a clear title to the property.
The Church must submit a legal description for
the area to be vacated. The City should be
furnished a certified copy of the document
at the time of filing.
Council Meeting - February 11, 1980
Mr. Haefele, Mr. Hubbard, and Mr. Martin were
present to discuss the proposed vacation.
Mayor Van Nest commented that further information
is required to reach a decision on this matter.

absorb all costs that would occur with this
street vacation.
Mr. Hubbard replied they would.
Mayor Van Nest moved, Paurus seconded, to concept-
ually approve the vacation of a portion of Navarre
Lane, subject to:
l. Plan being submitted
2. Relocate hydrants
3. Remove blacktop
4 . Retain adequate frontage
5. Landscape area
6. Provide easements
7. Complete survey showing driveway, street
centerlines, and barr�cades
8. Church drive not to be on property line
9. Vacation to be determined to be in the
public interest

Jeanne Mabusth, Zoning Administrator, informed TAX FORFEIT LANDS*
the City Council that she has reviewed the 1980
list of seven tax forfeit lots. Staff recommends
retaining three parcels for road and drainage
purposes and releasing all others for unconditional
sale.

A memo from Michael Gaffron, On-Site Systems ON-SITE SYSTEMS PROGRAM
Manager, was presented to the City Council SERVICE CHARGE
concerning On-Site Sy�tems Program Service
Charge dated February 8, 1980 , which states:
The 1979 on-site inspection fee was established
at $25. 00 per system. Based on a projection of
program costs for 1980, it appears that the On-
Site Systems Program Service Charge can be lowered

to $20 . 00 for the year 1980 and probably for ON-SITE SYSTEMS PROGRAM
some years thereafter. During my inspections in SERVICE CHARGE
the field, I have received the impression that (Continued)
Orono' s citizens are willing to pay for the type
of service provided as long as the cost is not
out of line. I feel a reduction in the service
charge will improve our public relations while not
increasing the burden on the building and zoning
department.
Along with the reduction of the service charge,
I suggest a more equitable fee system for certain
applications. At the present, construction
inspection of wells and septic systems is almost
totally done by the On-Site Systems Manager.
Permits for this work generate approximately
$3 , 000-$3,500 per year to the building and zoning
department. Our current permit fees generally
cover costs of providing the inspection service.
However, I spend a disproportionate amount of
time (1-2 hours per lot) reviewing new subdivisions
where on-site systems will be used. This time
should be directly attributed to the developer
through an additional charge per on-site lot, say
$15. 00 per lot. This is comparable to the
engineer' s fee charged for review of municipal
sewer lines in new subdivision.
Therefore, we recommend the Council approve the
following fees for 1980 :
l. Annual On-Site Inspection Fee - $20. 00 per system
2. Site Evaluation for New Subdivisions - $15. 00 per
On-Site Lot

Council with the following information concerning #12 & Old Crystal Bay F
the traffic signal for Highway #12 and the Old
Crystal Bay Road dated February 8 , 1980 , which states :
I recommend approval of the resolution designating
layout approval of the proposed installation of
the traffic signal at the Old Crystal Bay Road and
Highway #12.
The City will furnish necessary right-of-way and
participate in the cost of the signal and con-
struction on the Old Crystal Bay Road.
The resolution approval at this time is preferred
rather than to defer until after February 28 , 1980
public hearing.
Spring construction in 1981 is being strongly
encouraged.

Lane, and County Road 15 .
Mayor Van Nest requested staff to set a date for
a review with the affected property owners.

Dick Benson, City Administrator, informed the PUBLIC HEARING DATE*
City Council that a public hearing will be held Traffic Signal
February 28, 1979 at 7: 30 P.M, at the Orono #12 & Old Crystal Bay ]
Middle School leading to the construction of a
signal at the Highway #12 and the Old Crystal
Bay Road intersection next year.
The District Assessor Glenn Hawkyard has reviewed
the area and does recommend a survey be initiated
for Parcels #1 & #2.
We need to determine all right-of-way costs as
soon as possible. Glenn Cook, City Engineer,
will complete this as scheduled.
Council Meeting - February 11, 1980
Mayor Van Nest moved, Paurus seconded, to
approve the above information concerning the
traffic signal at Highway #12 and the Old

Mr. Hubertus Sarrazin, Vice President of Northern CABLE TV
Operations, Mickelson Media, Inc. , presented his
portfolio and discussed a cable TV proposal for
the northern Lake Minnetonka area communities.
Mayor Van Nest requested City Administrator Dick
Benson to contact the following communities and
arrange a communities meeting with them and
Mr. W. D. Donaldson, State of Minnesota Cable
Communications Board Administrator, to discuss
Cable TV service ,territory, factors and criteria:
Long Lake, Tonka Bay, Wayzata, Minnetonka Beach,
Mound, Spring Park, and Minnetrista.
Dick Benson, City Administrator, presented the APPOINTMENTS
City Council with the following information Planning Commission
dated February l, 1980, which states :
Mr. John Hammerel, Planning Commission member,
has agreed, if Council concurs, to accept the
appointment of Planning Commission Chairman for
1980.
Mr. Gregg Hannah, Planning Commission member, has
agreed, if Council concurs, to retain the position
of Vice-Chairman for 1980.
Staff will be available to assist these Commission
members, as well as all other Commission members,
to lessen the work load that is necessary to
evaluate applications and implement the decision
making process.

Dick Benson, City Administrator, commented that
we will modify our Summary of Receipts , Dis-
bursements, & Balances report to show previous
monthly investment balances.

Dick Benson, City Administrator, presented the WEIGHT RESTRICTIONS*
City Council with a memo from John Gerhardson,
Public Works Coordinator, concerning seasonal
weight restrictions, dated February 7, 1980 ,
which states:
Attached is a list of recommended axle weight
limit restrictions for each City street. The
streets will be posted from March 15 through
May 15 , 1980.
The normal length of time that restrictions are
in effect is related to weather conditions.
Certain streets might be closed to school buses
if a street becomes impassable.
In the past several years, we have allowed
solid waste haulers to continue their normal
operations, limiting them to gross weight on
any single axle of seven tons or 14,000 pounds.
If a street shows signs of severe breakup, we
will limit the solid waste haulers to smaller
vehicles.

Mayor Van Nest moved, Paurus seconded, to appoint APPOINTMENT
Michael Kirnyczuk as an Orono Police Officer to Michael Kirnyczuk
start at the two-year 1980 contract level of Police Officer
$1,552 . 50 monthly with a review in six months ,
effective February 15 , 1980. Motion, Ayes (4) -

Dick Benson, City Administrator, entered into the ELECTION CHANGE
record the following concerning an election change Even Number Year
to the even number year dated February 8, 1980 ,
which states :
I recommend the extension of the present terms of
the Mayor and all Councilmembers for one year.
Mayor Van Nest, Councilmembers Paurus and Hurr' s
terms will then expire December 31, 1982 .
In November, 1982 , the City will elect a Mayor
and two Councilmembers whose terms will run until
December 31, 1986 , providing the Mayor' s term is
changed from a two-year term to a four-year term.
In November, 1984 , an election will be held for
two Councilmembers whose terms expire December 31,
1984. Those two Council positions are now held
by Councilmembers Butler and Massengale.
In the interest of saving money and avoiding
duplication of efforts , changing Orono' s local
election to the even number years will be
beneficial to the City and is certainly an
approach to simplifying the local election process.
The present Mayor` s term (two years) does not
appear to allow that position to function as the
chief executive offioer's posi tion should. It
would seem reasonable to distinguish between the
Councilmembers four-year terms with a P�ayor' s
four-year term.
If the City Council concurs, a new ordinance can
be drafted for our February 25, 1980 Council meeting.

and requests a refund in the amount of

On July 16 , 1979 , Mr. John Sass began empl�yment
as a Light Equipment Operator in the Public
Works Department-Streets.
John' s attitude and performance meets all the
requirements expected of him. Therefore, .
it is my recommendation that he be removed
from probationary classification and receive
the benefits of a full-time employee effective
January 16 , 1980.
