Elizabeth and William Kallberg,
Regarding: The issue of the deck at 1015 Linden Lane, Orono.
Qn October 19, 1992, the City Inspector, Lyle Oman inspected
the prvperty at 1015 Linden Lane and as a result has required
a survey of the lot to determine if the deck presently on
property requires a variance. Since you (Elizabeth and William
Kallberg) created this condition and failed to resolve this to
the city' s satisfaction and then sold to the buyers without
disclosure, you are now responsible for the following:
Cost of the survey and any fees the city may require
to grant the variance, and any expenses for permits, '
plus any labor and materials that may be needed to
reinforce the footings and/or tear down and rebuild
the deck to comply with city code.
At the time of purchase of subject property, the buyers and
their agent were not informed of the fact that the deck was
not in compliance with city codes and that a permit was never
taken out when the deck was constructed.
As of October 19, 1992 copies of all correspondence between the
Kallberg' s and the city regarding this issue have been provided
to the current owners. (Mary Sapa and Thora Eriksmoen)
The buyers have incurred great inconvenience and frustration
over this matter and expect this to be cleared up immediately.
