RE: Work Within 0-75' Lakeshore Protection Zone
Dear Ms. Sapa:
Thank you for your cooperation in removing excess hardcover and the illegal deck from your
property last summer. I hadn't anticipated, however, that you would replace the deck with fill
and a retaining wall which, of course, is still in violation of the hardcover and setback
ordinances. If you would have informed us of your intentions, we would have told you it was
not allowed. I am sorry if there was a misunderstanding. I assumed you understood that there
is no hardcover or any work allowed in the 0-75' setback, which is why the deck was required
to be removed.
You have two options to remedy the situation. Either remove the work and return the grade to
original condition or apply to Ciry Council for a Conditional Use Permit and Variance to see if
they would allow you to keep it. Please contact me as soon as possible to discuss how you wish
to proceed.
