It is too late in the season to initiate grading, seeding, and ag, lining a baseball field. This work will have to be programmed for next _year. The areas of cut and fill are shown in color on my original file copy, cuts being generally shallow drainage s�aales following the arrows inside the wall, fill being over the buried portions of the wa)_J_. Read the key for existing/proposed elevation and contour symbols. Drainage is sheet flow and is retained on this lot, being directed away from the Downe1 boathouse and the Smerling hillside. Al1 surfaces should be seeded or sodded, with extra vegetation required for stabilization of the enbankment. Coffin Company; Alan P. Olson ' s memo to you of September 20 , 1979; and this letter. -� This letter is to state on behalf of the Holzers that they agree to seed or sod all the bare earth areas on their property and also agree to seed onto the Smerling property on the southerly side where dirt has been unintentionally put onto the Smerling property. � The Holzers have further agreed to install extra vegatation along the western embankment so as to further stablize the earth there against slippage. They always did mean to do this and the offer of the grass above and this offer regarding the vegetation has been an ongoing one since the very beginning of this matter. With regard to the slope from the garage up to the side of the house, that slope area will be kept natural with grass. 1 � � i � � INDQUIST & VEN NUM Page 4 City of Orono -2- September 25 , 1979 Regarding the drainage , we believe that the plan attached is the best one that can be achieved on this property considering the problems of the neighbors . The drainage plan does the utmost to direct the water north and south on the Holzer property as the water flows generally to the westward. It is most desirable to keep the water from going down into the Downey residence, or into the Downey patio, or into the Downey boathouse. Similarly, it is desirable to avoid casting the water onto the Smerling residence, the Smerling patio, or down the Smerling embankment which had a landslide in 1978. There- fore the best use has been made of gentle terracing to the west to slow the flow of the water and spread it north and south, but only on the Holzer property, as it makes its way westward. This is a complete alteration from the first plan wllich proposed a pipe system which directed the water directly to the west and directly down the hill. While the plan more or less speaks for itself, we do state that in all respects it does contain all of the elements of Mr. Olson 's letter to Mr. Holzer of August 29 , 1979, except those items detailed above. We would be happy to answer any questions. We respectfully request that based on the plan, the memo , and this letter, that appropriate conditional use permits and variances be granted to the Holzers to complete this project. Rest assured that if these approvals are forthcoming that the Holzers will do their utmost to finish the project as soon as they possibly can, but would appreciate understanding from the Council with respect to the lateness in year when it comes to the landscape work and other detail work required. A lot of 2. 3 acres was created without Citv review � or approval as required by State Statutes for all subdivisions. The lot does not meet the minimum lot width requirement of 200' , rec�uiring a 10' variance. �311 of the other zoning standards for the district have been r.let. rsr. IIrooks explains in his letter of April 18, 1979 , the ���olsfeld Lake Company gave the land first to the Ilature Conservancy who in turn gave it to the State of P�innesota. At this point in time, it is irnpossible to realign the mutual lot line. The septic inspector has approved the septic design. The County has approved direct access of CSAH 6. The applicant has referred to some arrangement with the DNR concerning access off the DNR entry road to the east of the lot. In either case both accesses �vould involve a permit from the Hennepin County Highway Department. The Planning Comriission recommends approval of the ��olsfeld Lake Company Addition subject to the following conditions: 1. Grant lot width variance of 10' - no setback variance will be granted for new construction. � 2. Approve mound system per septic inspector' s recommendation citing necessary design rlodification�. 3. Direct access off CSAH 6 has been approved by County. Applicant may arrange for access of DP7R entry road. The use of either access will involve a permit. 4. Payment of park dedication fee of $200. 00. Johnston, 925 �^Iillow Drive South 925 TVillow Drive South, dated September 13, 1979 , �457 which states: H.R. Johnston t•Zr. Johnston is proposing a division of his property into two pieces; one lot around the existing house and the remainder to be used for construction of his new home. The property is complicated by having onlyo une narrow portion abutting Willow Drive and by intervening completely between Willow Drive and a land locked parcel of land west of the Johnston property on the end of a peninsula, shown as "X" on the sketches. The first proposal �vas for a three lot division including a private driveway outlet. The existing driveway outlet onto 4�illow Drive wasreviewed by the City Engineer with the recorunendation that it be rioved north for better safety and sight lines. The private road was also to be extended west to serve future development of parcel "X" . Plan 2 , These concerns caused consideration of a complete plat involving the whole peninsula including parcel "X" and the pieces between the road and this property. Lot 1 would expand westward to an existing fence line. Lot 2 would _qrow onto parcel "X" , as new lot would be created along 47illow Drive. See Plan 3. This is the ultimate plan of the developer, if all property could be obtained. Unfortunately, the additional land acquisition could not be negotiated as quickly as desired. Pir. Johnston wishes to build his new home soon. The ultimate plan is to accomplish the addition, but of course, there is no guarantee of if or when this can occur. As a result, Mr. Johnston now proposes Plan 4, with lot lines adjusted to accommodate the ultir:iate Plan 3. The new house site has about 1 Z acres (of 7+ total on Lot 2) allowing for the existing driveway would be used �vith an easer.ient to Lot 1. Lot 1 would also be land- locked without the drivewav outlot. The existing driveway location is not adequate (Continued) and should be relocated, especially if riore than 2 units are to use it. 2. Parcel "X" is a legal lot, ��ith an existing easement. If requested, a building permit would have to be issued. Therefore, three units would be using the existing drive. 3. Even though the ultimate division is hoped for, there is no guarantee that it will occur. This proposal must stand on its o��n merits with all normal safeguards for access, wetlands and neighboring property protection. 4. The new house site on Lot 2 , without future land from parcel "X" is effectivel�� only 1-1/2 acres even though the entire piece is 7+ acres. This would include a small variance for lot �aidth at the proposed building site. Staff has spent a long time reviewing the man�� proposals and PRr. Johnston' s objective of getting an ultir.►ate subdivision design while as�urinc� c�uick apnroval so he can start construction of his house. With Mr. Johnston' s concurrence, �•�e recomr.tend approval of Plan 5, a cor.►bination of the ultimate design includin_q all of the Planning Cor.unission' s recomr.iended features. 1. The �roposed house site on Lot 2 is fixed and has approved septic designs. There is no practical reason to include riore area to neet density as the entire proposal does average over two acres . In addition, the desired westward expansion is still possible in the future. 2. The lot line between Lots 1 and 2 is a practical location along an existing fence line and allows rec�uir_ed additional drainfield area on Lot l. The plan is very sl�etchy and is somewhat explained by P�r. Pope's letter of_ September 17, 1979. Apparently, more detailed drawings are to be available at the meeting. The principal changes include building relocation (closer to 19) and redesign, with a result beinc� that all parking and developr.lent is now accorimodated within the 250' deep cor.unercial zone. The building size increased fror_1 the original 10, 000 sq. ft. to 11, 664 sq. ft. net, 14 ,580 scx. ft. gross, larger than the previous plan including the alternate. Parking spaces decreased fror.i 62 to 59 (? only 52 shown on plan) . At 11,664 sq_. ft. , 58 space�s are required. REGULAR iZFETING OF TIiE ORONO CnUNCIL, SF.PmE*'[BER 25, 1979 Page 11 Alan Olson, City Planner, presented a status report COPu�UNITY HEALTI�* concerning Hennepin County Corununitv Health, dated Hennepin County Report September 17 , 1979 , ���hich states: I had a meeting this morning with Roger Carlson and John Urbach of F�ennepin County to discuss the County' s expanding role in environmental health. The State Health DePartment is changing its role frori an inspection a�ency to a resource ac�encv with all health rec�ulation enforcer.►ent being shifted to local units o� government. Hennepin County has stepped in with an active �rogram of cor.u�unitv health services �•�hich should provide benefits to all cities like Orono which have no facilities f_�r local enforcement. The County has prepared ordinances for food service, lodging establishments, nublic swiruning pools and children' s camps. ^hese ordinances are proposed for hearing in October with final adoption in Nover.lber or Decertber. �nforcement including licensing �•�ill be a County function, the same as prior State involvement, but �vith a more accessible administration. The �roposals a�pear well written and should benefit Orono residents by assuring better _ health standards in local restaurants, as well as uniform standards for other establishments in the western suburbs used by our residents as ��ell. One of these studies addresses the South- west Area which consists of P�I�r'CC Service Areas 4 and 5 encom- passing 27 communities. The results of the study for the Southwest Area will be presented as a "Facilities Plan" , prepared in accordance with U. S. EPA regulations and guidelines as the first step toward implementing actions required for water pollution control. Preparation of the Facilities Plan begins with inventory and analysis of the existing MWCC facilities. Based on projected wastewater flows for the 20 year planning period, each facility is evaluated to identify needed improvements. For each problem identified, alternative actions are developed and evaluated to enable selection of the most cost-effective action. The Facilities Plan will present a description of the problems and the rationale followed to select courses of action. Assessment of present conditions is required to evaluate immediate needs as well as to establish a basis for projecting future conditions_ One task of this assessr,ient that has been completed is the analysis of the wastewater f low,s from each community in the study area. Based on reported water use data and metered wastewater flow data, the components of eacn communi- ties ' wastewater were estimated. Of particular interest is the Page 17. amount of clear water component (infiltration and inflow) that enters a community' s sewer system. The infiltration and inflow consist of unpolluted water which wastewater facilities must convey and treat with the sewage. The additional cost of treating infiltration and/or inflow is high enough in some cases tfiat it is cheaper to reduce the amount of infiltration and/or inflow entering the sewers. Other pertinent components . are the residential, industrial, commercial, and institutional � contributions of sewage. P�astewater flows from 27 communities were analyzed for the Southwest Study Area. Characterization of the infiltration/ inflow (I/I) component of these flows indicated that further analysis of I/I was warranted for 15 communities. (For the other 12 communities the available data indicated the I/I is not excessive and further analysis was not warranted. ) Sub- sequent analyses for these 15 communities are part of the preparation of the "Facilities Plan" and are to be presented in the final report. Results of the analysis of community flows were used to estimate future wastewater flows from projected population and employment increases. The interim report which presents a discussion of each corununity' s wastewater flows is on file with the MWCC. The incremental flow was es- timated by summing projected increases in residential , commercial, industrial, and institutional conponents of the flow. Residen- tial per capita flow rates were projected on the basis of results reported in an interim report, "Analysis of Community Flows" . Similarly, future commercial per employee flow rates were estimated. The future incremental flows were estimated based on population and employment forecasts by the D�etropolitan Council. Residential per capita flows in the study area range from � 45 to 135 gallons per capita per day (gpcd) . Most communities are estimated to generate 65 gpcd of wastewater by 1990. Future infiltration rates are estimated to generate about 10 gpcd of clear water from residential growth. This is ny first complaint in nearly 20 years and briefly repeatin myself , I am quite concerned with the apparent lack of interest by our City in the "work" being done to ins�all the sewer lines , es- pecially along Shoreline Drive where our home is located. The excavation or trenching work began in early May causing our main entrance an d driveway, along with culvert under our driveway entrance to be dug up. It has remained in that condition ever since. Our mail box was removed so that we have had to go to the post office in Wayzata to receive our mail. The postal carrier will not drive in mud and the mail box must be exactly 40 inches above ground level . Our entrance is a continuing sea of mud sinc� the culvert was removed and it may never be replaced. The bank along our driveway was dug into so far as to destroy a number of trees . We were notified to remove two very large trees at my ex- pense, that were da�aged by this project. The unsightly piles of debris left along our road and partial dumping of unneeded fill into the nearby lowlands has disfigured this area severely and if I as a resident were to dump one yard of fill in this wetland are I'd be fined for doing so, yet someone permits all this to go on. As you can gather, I am very annoyed by all this and I repeat no one there seems to care. I am on the verge of deciding to commen a class action suit in order to determine exactly who is responsi fo� this boondoggle operation, who permits whoever it is to ob°dc our City codes and what can be done to correct it, get the j and get these clowns out of there. Lee, Associate Cotmty Ac�ninistrator and chief hig�aay engineer has verbally assured me that at least one lane of traffic will be maintained. Co�mty staff has been properly con�erned about safety, engineering, and expense/tax aspects of this needed reconstruction and had persuac7ed ire of the validity of their positi�. Efforts and time e�ended by officials from the cities of Or�no and Minnetr�nka Beach, especially those of Mayors Van Nest and Jahnson, Cotmcilman Bearg, and yourself, were esse.ntial and persuasive. °Zt2ose of us close to this project are well aware of the arg�rents, oonsiderations, and trade�ffs inwlved in this decision. I hape events will justify our c�clusions. Hennepin Cotmty will att�t to co�lete reoonstniction during the 1980 �nstructicai seasan. This is still a priority item we are working on, but in reviewinc� the heating units in the various buildings referred to by 1`4r. Gerhardson, I feel some of these units are so old parts are not available. I recommend the approval of a special appropriation from our Improvement & Equipment fund in the amount of $4, 456 to replace the three heating units serving our office and shops. I recommend the approval of the low bid of Dolder Plumbing & Heating in the total amount of $4, 456 . to replace the police and public works office boiler, public works south garage, public works north garage heating units.
