Br_os. , was present to discuss the progress of the County Road #15 At
Orono interceptor along County Road ,',E15 at Tanager Tanager Lake Bridge
La}:e bridge. He stated that it would be necessary
to rebid the repair work for the road due to not `
being aware of a concrete base on County Road #15.
Several horles in the area will only have access
at night but that during the day, eriergency runs
will be possible with helicopters and barges, if
necessary.

Dick Benson, City Administrator, presented the City AR�"Y CORPS OF ENGINEERS
Council with a r,ierto concerning the Army Corps of Clean Water Permits
Engineers regarding clean water act perr►its , dated
P4ay 4, 1979 , which states :
Everyone is probably aware that the U.S. 8th Circuit
Court ruled against the Corps of Engineer' s authority �
to regulate usage of the Lake by rejecting their
appeal.
The Court did rule the Corps would retain jurisdiction
over dan construction and placenent of riprap. If
the State Department of Pdatural Resources ' peri*tit
prograri is approved by the U.S.E.P.A. , the State
would then have prir.�►e authority over riprapping and
we would eliminate costly time-consuming oaper work
and frustrations of more government.
I am contacting the DPJR to have the� work with us on
this and possibl�. have sormeone at our Council meeting
Tuesday evening.

Council that he wrote a letter to P�r. Charles
�aeaver, Chairman of the P�etropolitan Council,
regarding our concerns of the Ploerenberg Gardens
grant of $266, 400 from the A4etropolitan Council.

I.t has cone to our attention that the P7etropolitan. Council
approved a $266, 400 grant to develop the Noerenberg Gardens
in the City of Orono_
During the past year, the City of Orono and the Orono Comr.►ittee
for the Protection of the Noerenberg ?4er.�orial Park have expressed
many concerns to the Pietropolitan Council and the Hennepin County
Park Reserve District regarding the development of this park and
t�e use of the r�etropolitan Council ' s grant.
S7e were assured by the t�letropolitan Council t�at there were
several steps to be taken befbre a grant is approved, these were:
� 1. Approval by P4etropolitan Parks and Open Space Commissions,
and t?-�e P�3etropolitan Council to add t�e rdoerenberg Ga�dens
into the Council' s Regional Recreation Open Space System Plan.
2 . Approval of master plan.
3. Approval of Capital Ir.iprover�ent Plan.
4. ApProval by affected nuniciPalities of the r�aster plan.
5. Consistency with affected City' s Comprehensive Land Use
Planning and Zoning Ordinances.
6. I�otification to us of conforr:�ance to these guidelines
before iunds were approved. �

During 1978, we discuss�d our concerns at public l�eetings with
I�Ir. Clifton Frcnch, Superint�ndent of the Henn�pin CounLy Park
Reserve District, and his assistants . After many lcn�thv Jneetings ,
we requ�sted a series of joint Planning meetings with the Park
Reserve District and our City to insure tl�e protection of the
City ' s interests in the oevelopr�ent of the park and tne use of
the I�,etropolitan Council ' s qrant. Tae rave r,ot been approached
by the Hennepin County Reserve District to review �:ny proposed
changes to their plan nor have we been advis�d as to �he status
of the ivoerenberg Gard�ns until April 20 , 1979 , ���hen �ae discov�red
that the grant �•:as approved.
Because of our total lack o� knowl�oge of I�ennepin County Park
Reserve District' s overall develoj�ment plan for the area and
its irnpact on Orono' s environmentall_y sensitive area of Lake
77innetonka, the Orono City Council is requesting that the funding
for any ir�provenent to the I7oerenberg Gardens be delayed until
all the six steps in the process outlined to you are satisfied.
I am enclosing for your review all of our previous correspondence
on this matter.
�ae have anticipated working with the Park Reserve District to
assure consistency with the planning process and we wish to
continue doing so until an overall plan is approved. �

Dick Benson, City Administrator, presented the CitV CASCO POINT TRAFFIC
Council with a memo concerning the Casco Point PROBLED4*
traffic problem, dated May 4 , 1979, which states:
On April 25, 1979 at 7: 30 P.t2. , we attended a meeting
at the Good Shepherd Lutheran Church to discuss with
Casco Point residents their concerns with numerous
traffic problerns at that area. The results of that
r.ieeting were:
1. Install "Hidden Drive" sign
2. Review Dunwoody-Casco Point Road intersection
for controls and three-way stop sign
3. Review possibility of striping
4. Review speed limit reductions �

On April 30, 1979 , I sent a letter to David �orks CASCO POINT TRAFFIC
discussing our r.leeting. PROBLEr�*

On ��Tecinesday, PSay 2, 1979 , I invited tir. Yorks to
attend our meeting with the State Dist�ict Traffic
Engineer to allow him to provide input to the State.
The results of that meeting were : - the State will
initiate a study in the Casco Point area and report
back to us within 20 days with their recorinendation
on sPeed limit rec�uirements. The State law dictates
that any speed lir.lit reduction on any City street
must be approved by the State Traffic Engineer unless
the area in question is within a school zone w!�ere
children gather.
I recorir.iend that we review all of the requests when
the Traffic Study is conpleted (P4ay 22, 1979 Council
meeting) and then call a public hearing for all the
Casco Point residents. There are 207 residences
in the Casco area. By examining the petition and
the Casco Point meeting held at the Good Shepherd
Lutheran Church, 39 residences are accounted for.
It appears that when considering that 190 of residences
have expressed desires to have traffic controls in
the area, we should request comments from other
residents in the area also.

Dick IIenson, City Adr.iinistrator, presented the City HEI1rdEPIN COUNTY PROJEC'.
Council with a list of Iiennepin County projects. Of
particular interest to us are the Projects included
in their 1979 Bituminous Program and the 1979-83
Bridge Construction.
The 1979 Bituminous Program is self-explanatory.
Added to that will be safety improvements at the
inter-section of our new street (P�i.S .A. Project)
C.S:A:H. 6.
The 1979 Spot Safety Ir.tprover�ent also include �•�oodhill
Drive at C.S.A.H. 15.
The 1979-83 Bridge Construction includes the bridge
at the Arcola Channel which is to be bid in 1979,
construction in 1980. The bridge at the Plarrows
Channel is to be bid in 1980, construction in 1981.
Not included is the Hendrickson bridge which is to �
be bid in 1981, resurfaced in 1982.

County concerning the future bridge construction
projects with the request that one bridge be

Dick Benson, City Administrator, informed the City SANITARY LANDFILL SITEi
Council that Hennepin County will hold a public
hearing in the 2�aple Grove City Hall on Wednesday,
May 16, 1979 at 7: 00 P.Pd, to consider a sanitary
landfill site selection.
A letter to the Hennepin County Board of ComT*iissioners
was sent April 26, 1979 , regarding our concerns of
Ba}�er Park as a proposed site for the landfill.

A letter dated May l, 1979 was received from the
Clerk to the Board of Hennepin County Corunissioners
which states:
"Your letter of April 26, 1979, regarding the proposed
Baker Park landfill site was received by the Hennepin
County Board of Commissioners at their meeting today.
The contents were noted, and Chair Olkon directed
that a copy be made available to each Commissioner. "

Re: Sanitary Landfill Site Selection
Public Hearing - I�Iay 16, 1979
Dear County Cor.uT►issioners:
With this letter, I wish to transrnit the official position
of the City Council of Orono regarding the proposed Baker
Park landfill site.
The Orono City Council, upon revie�•� of the Februarv, 1979 site
selection report, officially objects to location of a landfill
at the Baker Park site.
Location of a landfill operation in the Park is
contrary to purposes for �vhich the park land �aas
acquired.
� Location of a landfill operation in the Park _would
adversely affect the recreational use of the Park and
would adversely affect the natural character of the
surrounding park environr_�ent.
Location of a landfill operation in the Park �aould
adversely affect the adjoining wildlife habitat.
The proposed site is a unic�ue pro�erty which has
drainage to three separate watersheds: Pioneer
Creek, Eln Creek, and P�linnehaha Creek. Any adverse
seepage conditions would pose unknown pollution
potential for a vast area of the County stretching from
the Crow River to the Psississippi River. The City of
Orono has a direct interest in assuring that the quality
. of water of Lake P•4innetonka are r�aintained to the highest-
sta�dards .

Location of a landfill operation on the proposed
site would tend to increase truck traffic on County
Roads #6 and #19 and State Iiighway �12 through Orono.
In addition, the proposed location would likely
encourage such traffic to use �9illow Drive, a local
City street, ��hich is inappropriate for such use and
which is incaoable of sustaining such use. Transportation
route alternatives are scarce .
The City of Orono respectfully submits these comments for
consideration of the Board.

dated r4ay 2, 1979, which states:
Jeanne A. Mabusth joined us Septerlber . 5, 1978 , as
Orono' s Assistant Building & Zoning Adr.iinistrator.
Jeanne has shown strong interest in Orono' s policies ,
and has proven to be very congenial and capable in
citizen contact concerning zoning matters.
Jeanne completed her six months probationary period
March 5, 1979, and during the past nonth, we have
been evaluating the position of Building & 7.oning
Ad.r.tinistrator to assure everyone what is expected
of that position. Until this is cor_ipleted, I am
recommending an extension of Jeanne' s probationary
period frori six to nine months.
I will have a recomr,iendation for Council approval
June 12, 1979.

Dick Benson, City Adninistrator, entered into the FOX STREET PROBLEDi
record the following concerning Fox Street, dated
P�ay 4, 1979 , which states :
The Fox Street traffic situation between Eiennepin
County #146 to Orono Orchard Road caused by the
closing of Fiennepin County #15, the Tanager Lake
bridge, and Coffee bridge has created an intolerable
situation that is deterimental to the safety, health,
and welfare of not only the residents living in the
area, but also to the people using the street to
avoid the detour system that has been imposed on us
by Hennepin County.
The traffic count on this particular street has
increased from 650 cars per day to 3, 701 cars per
day. Considering the type of street Fox Street is
(five-ton street versus the detour syste� which is
designated for nine-ton) , we are experiencing a
coriplete breakdown of the street in general. Estimated
costs to restore the street to its original condition
is estimated at $15, 000 simply because we are not
only losing all our surface but the increased
traffic is literally pumping the bad soils to the
surface of the street because of the swamp conditons
in the area. It has become impossible to police the
area because of the terrain, narrowness of the street,
lack of shoulders, and the unwillingness of motorists
to adjust their speed to the conditions of the street,

assist us in our requests for aid. I have personally
seen people having to jump out of the wav of speeding
motorists driving on the edge of the street, and
cars simply driving all over the place attempting
to avoid areas in the street that have completely
broken down. We cannot work on the street with our
Public ti�orks Department to even attempt to fill
holes because of impossible situations with traffic.
We are now calling each resident living on the street
to receive their approval of closing the street. We
are rer,.uesting Hennepin County to install a street
closed sign on County #146. We are requesting inout
from the postal departnent, bus companies, fire and �
other services. I have talked to P4aybr Van P1est for
his input but have not had the opportunity to contact
other Councilrler,lbers. Legally, we can under these
conditions close the street with Council approval.
If we have everything together by Tuesday evening anci
with Council approval, we will close Fox Street
bet��een #146 and Orono Orchard Road with barricades
on the east end also at the s�ort service drive into
Orono Orchard Road and signing at Hennepin County #146.
This will allow residents ingress and egress and other
emergency vehicles to respond to any emergency. (Continued)
