The resolution sets forth the intent of the Council STUBBS BAY P�iARINA
based upon the record of the public hearing, general (Continued)
: City records and the liistory of the area. This is
not the detailed record of findings as staff is
still in the process of preparing that resolution.
Rather than rush a draft to the Council, I felt
that accuracy out�-�eighed tir;ieliness.
I recor:unend that the Council adopt the attached
resolution. I also recommend that the Council
instruct staff to advertise and call a re�oning
public hearing for the first meeting in April. I
recor.lmend that the pending George Johnson application
for a 1979 r.tarina license be denied based uPon the
record of the February 27, 1979 meeting.

PZr. Janes PicCleary was present during the discussion
on the Stubbs Bay P4arina. A4avor Van idest asked if
he had any corunents concerninc� the resolution. 'T'he
i4ayor explained that the resolution included an
intention to denv the request of George Johnson for
a rnarina license.
Pir. I1cCleary stated his objections to the possible
rezoning of the property.
i�ayor Van Nest inforr,ied him that we are continuing
the study of the property to deterr.line whether to
rezone to residential or liriited commercial.

report on a Continuing Land Use Study, which
states :
The Council' s attention has been focused on the
Stubbs Bay Pdarina site because of Psr. Johnson' s
requests for early study and policy decisions.
Even though the final answer of liriited cor.unercial •
vs . residential use has yet to be r.lade, the major
research involverient is conplete and staff has riore
time to devote to the rest o� the study area.
Lot size and housing inventories need to be done an� .
the on-site systerl inspection program must he
cortpleted. A major area of concern is still the
sewer question. I strongly recommend that the City .
Engineer be instructed to reopen the alternative waste
control study. Since active study was dropped in 1975,

At the last rneeting, I believe that all issues were
resolved save that of the additional right-of-c�ay
dedication.
P�r. Neils has sent the attached letter restating
his position and noting that he will not attend the
i4arch 13, 1979 rneeting.
I have researched all our files and find no resolution
. regarding Sixth Avenue 2lorth, although Resolutions
#312 & #326 attached deal with general transportation
planning criteria. .
I have requested written justification from Hennepin
Count� Departr.ient of Transportation and am including
their reply which is r.lore qualitative than quantitative.
It does contain design criteria related to right-of-way
width and a table of recomrnended widths for all County
roads in Orono.
I repeat r.iy earlier statements that the City has indeed
been cons2stent in requests for dedicated right-of-�aay
along County Road Six. The County' s justification is
weaY. and speculative about the future, leadincJ one
to question the imr.iediacy of such rec7uirements.

Council decides to �aaive the requireraent for P�r. Pleils,
then all pending and future divisions should be
treated in a like rnanner.
I recomr;zend adoption of the attached resolution to
reaffirn preliriinary approval of this apDlication,
to reaffirm the conditions of such approval and to
extend the deadline for final plat f_iling to July 13,
1979. The draft will be cor:ipleted to sho��� either
a 40 ' or a 50 ' right-of-way width as decided bI the
Council.
I also recorrunend a followup study and passage of a
policy resolution at an early meeting to extend
this decision across the board to all siriilar
applications. .

The Planning Conmission recortr.lended cienial of this
application because of neighborhood opposition to
attached units and because of the density rec�uested.
The rec�uested PRD density is 0. 836 acres/unit
cor.►pared to R-lA zoning requirement of 1. 0 acres/unit.
The proposal is to construct three new "duplex"
structures and remodel the existing house into an
additional "duplex" for a total of four residential
structures on 6 . 75 acres .
Contrary to the Planning Commission reconu*iendation,
I recor�unend approval of the attached dwellinc�s for
these reasons: Four buildings will have less visual
irlpact on the neighborhood than 6, 7 or 8 individual
buildings; platting into 6 , 7 or 8 individual lots
would have less respect for the topography of the
site, ���ould likely require a longer roadway, and
would likely require houses located much closer to
the existing neighboring residences than the planned
location; the neighboring lots are small �aith houses
located very close to this property, quality "attached"
: condominium units will not detract fror.i neighborhood
" property values , are intended to be ocaner-occunied
and are representative of a growing trend in quality
housing. Attached condominiui*i style housing will
provide a quality housing alternative in Orono.
I believe that this alternative could be appro��ed
as a variance to 34. 029 lir.iiting "duplexes" to
within 200 ft. of a comr.iercial area. A better
approach would be to consider amending the ordinance
to permit double attached condominium units in R-lA,
R-1B, RR-lA, RR-1B and LR-1C districts (now perr.iitted
in R-1B and LR-1C) . I recommend the latter.
The density question ie more difficult. I ari
cor.lfortable with the proposed eight units (four buildings) .
Strict code enforcer:lent would lir_iit the develonr.ient
to six units (three buildings) however, the lot size
is very close to perr.titting seven units. Because
seven units also means four buildings, I would, therefore, �
recor.u�end approval of the proposed eight units as �
being a reasonable use of this property.
As a PRD Conditional Use Permit, the Council can retain
close control over the type of developrient. This will
ensure protection of the neighbors by control over use
of the open space, plantings, buffers, and the tyr�e of .
structures. I recommend that you retain review rights
prior to issuance of building permits and that final �lat
approval include a landscaping plan.

After the February 13, 1979 Council neeting, the
applicant responded to neighborhood concerns by
redesigning his proposal. His February 27, 1979
plan is for seven detached single fariily units,
clustered in a PRD forr,iat.
The new plan has a density of 0. 96 units/acre (up
fror.► 0. 836 units/acre with the eight unit plan) . .
The sketch is rough but purports to show a design
neeting all setback requirements. The City Engineer
should review the road plan to assure proper width .
and turnarounds.
The plan revision anends the application to: 1)
Subdivision, 2) Planned Residential Development,
3) 4 o Variance to lot area requirer:�ent.
This proposal appears to answer the concerns of
the Planning Cor.ir�zission and the neighbors regarding
attached units, and the density iriprovement is
consistent with the cor.iments of the Council. I

application was never finalized because tir. Anderson

The two lot subdivision now involves a 1. 9 acre lot SUBDIVISION
and a 17. 3 acre lot. PZr. Olson requests an area 4645 Bayside Road
variance for the 1. 9 acre lot and a setback variance (Continued)
for t11e pole barn. Hardships following code require-
ments to the letter would result in an unusual and
odd shaped lot. The pole barn is seven feet from
Anderson' s south property line (150 ' required for a
barn - 10 ' required for an accessory building) . The
pole barn is 2, 400 sq. ft. , the State Building Code
requires 10 ' setback fror.t the lot line or the building
must be structurally altered to meet code. A one
hour fire wall is required and all openings within the
wall enclosed. The lot line could be rloved three feet
to the north along building line and a cor:l�ensatory '
southern shift in line could give the necessary two
acres. The septic inspector will inspect the existing
syster.ls . Park fee to be determined.

Planning Commission 2'ieeting - Nover_iber 27, 1978
Staff reviewed the need to either move lot line at
least three additional feet along building line or
to require applicant to make necessary structural
changes in the building to meet the code. Planning
Commission advised that it would be economically more
feasible to adjust lot line and, in addition, the lot
line should be adjusted to bring the lots to the two-
acre r,iinir►um requirer.lent. Planning Cor,unission gave
conceptual approval to the subdivision subject to
north lot line realignment.. Public inforr,iation meeting
.scheduled for January 22, 1978.

Sketch Plan Review - Zoning District LR-1B
P4r. Valek proposes a division of 12 . 6 acres into
eight lots. Lot 1, Block 1 (originally Lots 4 & 5
of the Bergquist & Wicklund Addition) ��ith an existing
house included in the plat because of its involvement �
with the plat road. Portions of the property are
. sewered and there is approximately 1/4 to 1/3 acre
wetland within subject property. Al1 lots meet the
zoning district requirements. �

Mr. Palmer' s lot is already se���ered. �he Public
Works Coordinator will be asked to determine if
existing system could handle the additional units .
The Planning Cor.ir.�►ission must make a recor.u�endation
to Council designating approval or disapproval of
se�ver service to the five additional lots. Applicant
is aware that he must pay for entire installation
of sewer line through property.
Plat Road - The access point for plat road onto
Tonkaview Lane will have to be moved further west
because proposed access is in an extrerlely hazardous
location. The City engineer and staff will make a
final determination and report back to the Corunission.
Staff recommends a 60 ' road easerient for this eight
lot plat because oi probable developMent pressure
resulting from the proposed road opening land-locked
property to the east and north. Unfortunately, the
City does not have a Comprehensive mransportation Plan
for reference, but earlier plattings in area reveal
networks of unir.lproved 60 ' wide road easements that
'�, suggest future City involver.ient. �ae will also ask
.--� for a 30 ' road easer�ent along northern border of
property for future extension of Highview Lane. If
. the Planning Commission does not feel this plat
road fits into this network of City roads and services ,
then the road easement need only be 50 ' .
Wetlands - There is a designated wetland �vithin parcel.
The applicant has been advised of the 26' se'tback
.requirement. Until we determine the eYtent of the
road easement, there may_ be a need for a setback
variance for road.
Planning Cor.unission Pieeting - January 8, 1979
Planning Cor,unission gave conceptual approval to the
subdivision reviewing the follo�aing issues with the
applicant:
1. Planning Corunission wants to clarify that this is
not an extension of sewer system, �but merely an
addition of five units to the existing systeri.
2. Plat road is to be 60' and access point on Tonkaview
Lane must be r.ioved further west. Applicant to be
advised by consulting staff. �

Lot Review - The dry buildable land has been designated
for each lot. The plan is not acceptable for pre-
liminary approval since Block l, Lot 1 does not
show the existirig structures. Side yard setbacks
for BlocY. l, Lot 4 and Block 2 , Lot 4 should designate
35 ' on Outlot B side. All other setbacks appear to
be correct..
Access - Location of new access has been approved by
Public �aorks Department.
Sewer Availability - There is adec�uate capacity for
additional service.

Planning Comriission PZeeting - February 12 , 1979
The applicant was advised of additional corrections
to be r:lade on the preliminary plans. Planning
Corunission requests that all existing structures be
designed on plans to determine the need for setback
variances. Side yard setback for Block 1, Lot 4 , and
Lot 4 , Block 2 be changed to 35 ' .
Planning Corunission 24eeting - February 26, 1979
Planning Commission recommends the plat o� Steven
Valek for preliminary approval subject to the
following conditions: ' _
1. The effects of the proposed plat on the natural '
drainage area defined by neighboring property
o�aners, to be resolved by staff before final
approval.
2. Seventeen foot front yard setbacl: for principle
structure on Lot 1, Block l.
3. Plat road to be designated as a 60 ' outlot - City
to obtain underlying road and utility easer.ient.

building sites per the existing zoning. The lakeshore
width is 294' (1. 47 X zoning required �aidth) yielding �
four to six boats if platted today. The current LP4CD
density of one boat per 50 ft. of shoreline equals 5 . 88
or six boats in a r.lultiple structure not existing before

kno�aledge of an interest. Staff intends no action

The other parcels are 1) Casco Park, and 2) The
Nature Trail Park (t��o parcels) on North Shore
Drive/Park Avenue.
The Casco Park problem comes from an ap�arent
failure to file an abatement when the land was
acquired in late 1971. Also, taxes due for 1972

The I4etropolitan ��aste Control Corunission will be constructing a
sanitary sewer force r.lain along the following county and city
roads starting approxir.latelv PZarch 15th. (See attached riap)
�i�he construction will start at the Tanager Lake Bridge and go
� east to Ydayzata on Shoreline Drive (Co. Road 15) and southwest
fron the Tanager Lake Bridge on Shareline Drive (Co. Ttoad 15)
to Plorth Shore Drive (Co. Road 51) then �•�est on North Shore Drive
to Old Crystal Bay Road (Co. Road 84) then north to the Orono
' Sewer Plant. . .
This force main is being constructe� to eventually elir_iinate
the Orono sewage treatr.ient plant. The second phase of the
construction will be to construct a sanitary sewer force r.iain
on Oronq Orchard Road from Shoreline .Drive north to the Long
Lake sewage treatment plant. - _
That force nain is being constructed to eventually eliminate
the Long Lake sewage treatment plant. -
The third phase oi construction will be the rer*►oval and re-
placerient of the Tanager Lake Bric3ge. This project is being
done by Hennepin County Public j•7orks.
It is inportant that you know that the sewer force main is
being placed in order to eliminate the Orono and Long Lake �
sewer plants only, you will not be assessed for the project
and you will not be able to hooY. up to the sewer force main.
During the construction, the contractor for the sewer force
main will keep roads oPen for local traffic only. Al1 through
traffic will be detoured because of the Tanager Aridge being
replaced. . �

Tanager Lake Bridge construction will begin and the detour will
be in effect_ Hennepin County estimates the bridge being closed

Also, on April 2nd, the sewer pipe construction will begin on
Shoreline Drive from tlorth S�ore Drive east to Orono Orchard Road.
The contractor will maintain at least one lane of traffic during
construction to accommodate local and emergency vehicles, this

review a pedestrian crossing at the fiennepin County Public
i�Jorks 24aintenance Division located in the City of Orono at
. Henne�in County #15. S�ring Park is rec�uesting our support
to install a sidewalk to the Sprinc� Park lake access. It
is our understanding that pursuant to your recommendation
last fall, the Fiennepin County r:iaintenance area is used for
overflow par}:ing for cars that were causing a traffic congestion
problem in Spring Park. -
Our Public ��orks Coordinator has attempted to cali you several
times to clarify concerns we might have; these are: �
l. Nur,lber of cars and pedestrian traffic to use this area?
2. What agency will provide traffic control?
3. ��7Yiat agency will install sidewalk? �
4. Who will pay for these expenditures? -
We understand Hennepin County will Provide only 25$ of the total
r.►onies required for these safety rec�uirements_
Z,Te are concerned with the liahility of a pedestrian crosswalk
in an extrer_iely dangerous area and since we were not aware of
this arrangernent, we would welcorse your in�ut to us as soon as
possible.

has proved to be completely unsatisfactory.
The company does not have c�ualified people
akr�ar_� to satisfy our requirements, which has
created sufficient problems for us to warrent
looking elsewhere for this service.
The LOGIS system which was formed seven years
ago, of which we are a memher, has the best
service available and qualified personnel to
rieet our present needs and to eventually allo�a
us to fully coriputerize our reporting and neet
the riandatory requirements passed by the State
Legislature.
The projected cost is within our capabilities
and the change to LOGIS will have significant
benefits in the ensuing years.
��1e have considered other computer conPanies
but only LOGIS has c�ualified personnel that are �
available at any tirie to assist us in our daily
data processing needs.
Since we are now an associate mernber of LOGIS , a
letter from us will change our mertbership to an
operating associate and within a month we will be
in service. Because of the possibility of not
having a quorurl at our 2larch 2 7, 19 79 Council
rleeting and the need to act as soon as possihle,
I recommend Council approval of LOGIS service�
�i�his is the only action required.
