Alan Olson, City Planner, entered into the VARIANCE record the following riemo concerning the variance 1388 Park Drive request of Paul Clabo, 1388 Park Drive, dated #428 January 25, 1979, which states : Paul Clabo On December 18 , 1979, the Council voted to deny this application. On January 9 , 1979 , the applicant requested reconsideration which action has been tabled until the February 13, 1979 rieeting. I have provided two resolutions for your consideration. One resolution for denial; .one resolution for approval. It is my recor.uaendation that the application be approved as noted in the resolution. Alan Olson, City Planner, entered into the STUBBS BAY A:�EA LETTEI: record the following letter concerninc� the public hearing for the Stubbs Bay area thatwill be nailed to residents in the area of the marina: "On January 23, 1979, the Orono City Council adopted Ordinance No. 219 establishing a moratorium on development in the Stubbs Bay Area, defined as all the land within the north half of Section 5, T 117, � R 23 located south of the Luce Line Trail. The attached map shows the affected area. The moratorium will last until July 31, 1979. The special concerns include housing rehabilitation, sewac�e disposal systems, flooding hazards and redeveloprient of the ,Stubbs Bay Piarina property. Mr. George, Johnson has proposed plans for redevelop- ment of the marina. These plans ��ill be the subject of a special public hearing to be held at 7: 00 P.Ps. , February 27, 1979 , in the City Council Chambers. Issues include the 1979 iiarina License Application, sewage disposal problems, housing problems , possible rezoning of the marina property, and possible compre- hensive plan ar_iendiaents. l3arina site options include: reconstruction as a full �ervice marina; reconstruction as a lir.lited service marina with dock rental only; and rezoning for residential use only. I urge you to attend this hearing and to participate. The Council needs your opinions regarding the issues and the options. �•7hat can you offer regarding the history of the area, the use of Stubbs Bay, the fishing, etc.? Should the marina be rebuilt? This year, I fully intend to process the applications as soon as possible. I recommend that the Council also act on the applications without delay. In many cases, I have recomr*�ended Council action without review by the P4arina ComTT�ittee, because, 1) the applications are identical or vary only in minor details from last year' s application, or 2) the applications continue to request licensing of installations previously denied. In most cases, I have prepared resolutions for cor�pletion at this meeting. Foxhill Homeowner' s " � The revised application requests one slip for each Association of the 16 lots in the subdivision, five r.more slips (Continued) than ever licensed previously. The issues were discussed last vear. The subdivision now has 14 homes and two vacant lots (which are owned in common) for a total of 15 building sites. The resolution prepared is for the original application with a maximum of 11 slips per last year. If additional slips are to be contemplated, I recomriend referral to the Marina Committee. Mr. Parr was present to discuss the Foxhill Home- owner' s Association joint use dock ap�lication cor.u�enting that the Association is requestinc� 16 slips for 16 lots. Councilr.►ember Pesek: You are requesting five more slips than originally approved. I�iavor Van Nest: We are concerned with granting riparian rights to everyone. Our present ordinance precludes the type of dock structure that you are requesting. Report - North Shore Union 76 - Three transient NORTH SHORE UNION 76 slips as in previous years; application has added License a request for ten on-land boat units as either used boats for sale or winter stored boats. This is a perr:iitted use in the B-2 zone. The units were not -indicated last year, but they are consistent �vith past practice. There are nine or ten �vinter stored boats on the property today. I recor•�end approval , of the 1979 license resolution. Gus Gunderson was present to discuss his application commenting that,"I do sell boats and bait, the area is classified for marina uses. I do plan on buying the station in the future. " Mayor Vari Nest: There is a two acre requirement for a full-scale r_►arina. If we are e;tpanding the use of the area, this application should be reviewed by the P�iarina Cor.►mittee. The type of business approved � for this area is for a �gas station and this B-2 area � has been approved for selling gas on the lake to boats. � . Application still shows 325 ft. to 345 ft. dock extension into Maxwell Bay. I recommend denial of the 1979 license application as made because of the continuing dock length violation. Applicant should be rec�uired to resubmit showing docks in compliance. I, therefore, recomnend adoption of the attached resolution. Robert Favorite along with the 1979 Ski Area license requesting additional information if he wished to pursue tubing. To date, we have received no response. I have sent Tom Jacobs out to inspect facilities at other areas .including "Green Acres" in Lake Elmo which already offers tubing. His reports are attached. It appears that there are increased needs for supervision and cor.ununication but that other wise the facilities needed are similar to those in place at Ski Tonka. I still recoru�end no approval until the licensee answers the guestions • asked in my letter of January 26, 1979. � From these inspections, we also have a better idea of equipment safeguards and signing improvements that should be made to the existing facilities. The license expires on September 30, 1979 per ordinance. The license approval is conditioned on the following: 1. For same use and operation as 1977-78 license. _ _ 2. No tubing or mechanical amusement devices pending review - - of separate applications for these. 3. Current use of tows 1-6 only as these are- the only tows which have been safety inspected (the others were not operated on 1-16-79 on Primus representation that they were not to be used) . The Council will require relocation and/or construction of control facilities before approval of the 1979-1980 license such that the full length of each tow line be visible from each operator control position. One operator may control more than one tow if the visibility criteria is met. 6. Compliance with the general housekeeping and safety - recorr�endations of the City Engineer. - The ski area property is in a residentially zoned area and does operate under authority of a conditional use permit. The Council determined that your proposed inclusion of inechanical games would constitute expansion of the existing use permit and would therefore be subj ect to zoning review. You must make a revised conditional use application which will then be subject to review by the • Planning Commissinn. I have attached the application form. You also have copies of the mechanical amusement device Iicensing ordinance. � .. As to tubing, the Council has said that they will consider this within the ski license,� but only after proper �eview. They request that you submit information regarding yo� proposal, including: 1. - The number of expected users. � 2. The number and function of attendants. 3. Which hills will be used. 4. What special provisions will be ma de for using the tows. 5. Show details of the tube storage proposed (for fire safety) . Lowell Zitzloff, 3502 Shoreline Drive, dated #415 February 6, 1979, which states: Lowell Zitzloff The staff has been concerned that the large boat stored to the side of the property has interferred with the �parking and traffic control re�uired by the conditional use permit issued Septei*tber 26 , 1978. All other conditions of approval have been met. The business has operated since December with apparently few parking problems, although, it has been noted several times that employees and/or custoMers have parked on the construction site across the street. �9e have notified the property owner and are prepared to enforce the p�rmit and other applicable ordinances. The owner has, however, requested . special consideration to leave the boat there until ice-out. rsy recommendation is that such � a request is reasonable and should be approved with the clear understainding that the staff will issue tags if the parking area is not clear by that time. The schedule break . ' occurs at the zone densities. I also recor.unend adoption of the resolution providing a schedule of cash fees. The schedule is proportional to the land dedication schedule and is in line with our current schedule and the schedules of nearby cities. Upton, dated October 16 , 1978, which states: The attached notice is a request for refund of a . $1, 000 park dedication fee paid with buildinc� perriit #3721 on l�iarch 13, 1978. The house has been cor.lpleted and was issued a Certificate of Occupancy on� July 24, 1978. This notice is the first word we have had concerning the question of a refund. The perr►it was issued pursuant to receipt of a variance for lot area and lot width (Case No. 301) issued on Septeriber 26 , 1977. There was a prior house on the site which burned several years previously. There is no record of any park fee being paid except with this building per-rtit. The staff has been charging park fees based upon the authority of Ordinance No. 184. Park fees have been charc�ed at the tine of final subdivision �.3 approval or, on previoulsy platted lots, at the � tir.ie of a building permit. I think there are two areas for policy decisions and/or possible ordinance revisions: 1. The practice of charging fees with subdivisions on the lot or lots which have existing dwellings. _ I suggest charging fees only on the new building sites. . 2. The practice of charging fees with building pernits on previously platted lots. I suggest that if any fee is charged, it be the riinimum fee (r.iaybe $100) . Either would be some contribution but would not be out of line with the reriaining part of the permit fee. 3. A separate issue is establishing some type of fee for comr_iercial or industrial developr�ent. It seems that the rural style of life in Orono conflicts with the running of hard-surfaced streets in front of our houses. If o�r street were not in existence now and the City asked to blacktop our little private area, we would be most upset. We cannot keep the public out of our ]ittle area; it should be � private: Look at the nice privacy the Lukes and the Wilsons have. 3. City'.s Error. I have spoken to some of the �uncil and planning commission members about why this street went in. They said it slipped by them because of a previous planner's error. They wish it had not gone in. Our close neighbors do not like this street either. There is no reason for Scotch Pine Lane. Each of us can get good access to t�orth Shore Drive without that five ton road. � 4. Noerenberq Gardens The county plans to improve this area in the near future. Parking lots, buildings , walkways, etc. He re are some exe rp ts from their proposal : . . "This site is located within the estate area of the Lake Minnetonka Region . . ." � � ' "Travel to the site from other parts of the Metropolitan A rea is by.private auto and public bus transportation." • "With existing bus service .to the site f rom downtown Minneapolis, this •site will be readily available to all population groups. " Scotch Pine Lane is the only public street between County 15 and the - gardens where "ali population groups" can view the homes of "The Estate � Area". I feel we might be on display during the warm months once these gardens are improved. That does not appeal to me. - 5. Too much blacktop. I would like to remove all the blacktop from this street except for the area between Hill 's driveway and North Shore Drive. The City constantly discourages hard surfacing near the ]ake. Here is a ctiance to get rid of most or al] of this blacktop that sends water running into Whalen's marsh. The access from the bottom of my present driveway to Hi,ll 's would be replaced � by gravel . I also suggest that the drivev�ay next to Whalen's be removed and sodded. • Page 26 .� _ .
