I'he Orono Council met on the above date with the
follo�ving rmembers present: P�layor Van 21est, Council-
members Butler, P4assengale, and Paurus. Councilmember
Pesek arrived at 7: 20 P.M. Also present: City
Adr�linistrator Benson, City Planner Olson, City
Engineer Cook, Public Works Coordinator Gerhardson,
and Deputy Clerk Strom. Absent: City Attorney
Malkerson. Councilmenber Pesek lef_t the r:ieeting
at 8: 10 P.M.
Mayor Van Nest announced that this was the time and PUBLIC HEARING
place for a public hearinc� regarding BlocY. Gr_ant Block Grant Funds
Funds under Title I of the Housing and Cor.u�unity
Development Act of 1974. City Administrator Benson
presented the Notice of Public Hearing, the Affidavit
of Publication, and the Certificate of Mailing. _
Mr. Larry Blackstad, member of the Hennepin County
Development Planning Department, was present to
discuss the Year V Program.
Pdayor Van Nest asked if anyone was present concerning
the Block Grant Program. No one was present. Pdayour
Van Nest closed the public hearing at 7: 08 P.t4.

Discussion was held concerning hours of operation for
the station. It was agreed that the hours 6 : 00 A.r2.
to 10: 00 P.M, would be included in the resolution.

Pdr. Alan Olson, City Planner, entered into the SUBDIVISION
record the following concerning Victoria Estates 580 North Arm Drive
dated December 6, 1978 , which states : #200
Victoria Estates
This subdivision proposal has now been returned
to the City for final plat approval.
The initial application was made in November, 1976.
During 1977, much discussion and time was spent
resolving issues concerned with riparian access
and dock construction. Preliminary plat approval
was granted per Resolution #868, adoPted on
January 23, 1978 , based on the lot layout as in
Exhibit X. . (Continued)

On October 10 , 1978, Resolution #954 directed SUBDIVISION
that the developer cor,lply with the testing 580 North Arm �- ; �.-_-

The test results failed to locate suitable sites
on Lot l, Block 1 and Lot l, Block 2. Discussion
between the developer and City staff on Plovenber 27,
1978, produced a lot line rearrangeMent wherein
all lots do have acceptable drainfield sites. This
resulted in relocation of Outlot A and reduction
�in size fror.i one acre to 0 . 73 acre. See proposed
resolution for the revised layout. This new
arrangement and reduced outlot size was reviewed
by the Council on rdovember 28 , 1978.
The Council should review the proposed language
changes to Resolution '�868 and advise staff accord-
inc�ly.
The final plat contains six lots plus the existing
house on Tract C, RLS 924. One house is corzpleted
on Lot 6. The dock authorized bv Resolution #868
has been cortpleted and extends to the channel across
Outlot B from the tip of Lot 4. T�7etlands are shown
on the plat (including an area on Lots 4 & 5) and
are protected by conservation easement.
The final easements are being completed by the
applicant' s attorney and are quite lengthy. They
will meet the City Attorney' s approval before filing.
I recommend final plat approval according to the
attached resolution.

The applicant originally proposed to construct a
house that would require five variances and a
conditional use permit involving an alteration of
a wetland.
The proposed driveway borders a pond's south side,
but the ordinance requires a mini�um setback of
26 feet. Mr. Ploble requested permission to alter
the wetlands so that there will be at least a 50 '
setback. His plan consisted of filling a 3, 000 sq.
ft. area of the pond at its southern end with a cor-
responding excavation of 3, 000 sq, ft, in the northwest
area of the pond.
The approvals required were:
Dry area: 45, 980 sq. ft.
Area variance: 47%
Lot width: 155 ft.
Lot width variance: 230
Lake setback: 75 ft.
Marsh setback: 0 ft.
Side setback: 13 ft./28 ft.
Variance : 57�
Hardcover (House).: 5 ,690 sq. ft.
Total: 11,170 sq, ft.

The plan was reviewed at the Planning Comr�ission
rieeting of October 10, 1978 (��Tor}c Session) �
Commission meMbers were advised after several site
investigations by staff that the designated wetlands
was much larger, almost 1/3 of buildable portion -
of lot, and part of a more extensive drainage
system to the north and east. The City Engineer
recoruaends against any alteration of the pond and
proposes that sediment from runoff of the paved
driveway would be contained in the pond area and
not passed into the main drainage channel.
Staff was requested to complete additional reviews
before the next meeting. .
I'or the November 27, 1978 rieeting, a second plan
was submitted by ?sr. Noble which is basically the
same as the original subr.iittal r►inus excess pavinc�.
The house and pool reriained the same. The house had
been turned around so that the garage was now on the
east side of lot allowing for a more efficient

A conditional use permit is required for filling
and grading within the Flood Fringe (Flood Plain
Management Ordinance) and is subject to DNR review.
The Flood Fringe in the application would be the
land between the 929. 4 contour and 931. 5 contour line.
An additional plan was presented at the r_teeting which
was the same as the first plan but which merely
eliminated the driveway.
To recap, the Plann?ng Comrlission reviewed three
plans for this proposal:
Plan 1: At the October 10 , 1978 rleeting, the
original plan with garage on west side.
Plan 2 : At the rdoverlber 27, 1978 r_leeting, a
revised plan with garage on east and a proposed 75 '
lakeshore variance.
Plan 3: At the November 27, 1978 meeting, same �lan
as #l, except driveway is omitted with a claim that
an old highway allows use without dedicated driveway.
The Planning Cor_�r_iission requested further plan
revisions, but applicant insisted on action. Planning
Commission thereafter recommended denial.

After the Planning Cormmission meeting, the applicant CONDITIOrdAL USE rER�3IT
subrnitted a new plan #4 which includes a scaled down 1185 Ferndale Road W.
house and conforr:lance with both lakeshore and �aetlands (Continued)
setbacks. The plan still requires filling within
the flood fringe of the pond as would any construction
on this site. The drawing does not indicate the
limits of the fill which should rer�ain at least 26 '
from the edge of the pond.
The revised variances are:
Side setback proposed - 18 ft./23 ft. - 400/23o variance
Hardcover (75 ' -250 ' ) 5588 sq. ft, pernitted = 25a
7753 sq. ft. proposed = 34 . 6°

The revised plan #4 is much improved over the earlier
plans.
On Decer,lber 11, 1978, the Planning Cor.imission informally
reviewed this new plan #4 and indicated that these
were the changes which they had hoped would be made since
October.

Mr. Noble and his attorney, Robert Hoffman, were
present.
The revised plan #4 was reviewed by the City Council
which showed a cut back in hardcover. Discussion
was held concerning t�le direction o� runoff_ from the
roof of the house _ to the pond.
Mayor Van L1est pointed out that a holding tank would
be installed and that the City would not provide
sewer for that area.
Alan Olson stated that a separate pumpout for the
swir.uning pool was necessary as it could not be
emptied into the lake.
Mayor Van Nest also stated that the Planning Cor,uT►ission
moved to accept the decision of the City Council.

record the following variance request of Paul 1388 Park Drive
Clabo, 1388 Park Drive, dated Nover.iber 20 , 1978 , #438
which states : Paul Clabo
Mr. Clabo requests a variance for lot area and
lot width for Lot 18, Block 13, Saga Hill, to
build a house. The lot has been assessed one
hookup and one sewer unit charge. The surrounding
lots have been combined and are not available for
sale.
Staff would like to call attention to the steep
grade along street access line. Applicant should
consult with the public works director concerning
a curb cut for entrance. Mr. Clabo should be
advised that once a variance is granted, the City
will not consider future variances.

Planning Commission P�Ieeting - November 27, 1978
Planning Commission moved to recorune�d approval of
the application for lot area and lot width variances
for Lot 18, Block 13, Saga Hill. Hardship claims
were no other land available and a sewer assessment
against lot because a house-cabin had been there
at one time. Mr. Clabo had the structure rermoved
because it was unsafe.
The vote was four to two in favor of the motion.
The minority opinion was that the lot was "decidedly
too small" to support a single dwelling.
Council Meeting - December 18, 1978
Mr. Clabo was present and stated that he had purchased
the lot in 1969 as a buildable lot, removed-t�e
house to improve the appearance of the area, and that
sewer had been assessed against the property.

Mayor Van P7est stated that there could be a traffic
hazard with the driveway being up a steep hill.
P4r. Clabo stated that he intended to build the
garage into the hill.
Councilmember Butler stated that we cannot deny the
building site as it has been owned since 1969 and
had a house on it.
Paurus moved, Massengale seconded, that a resolution
of denial be drafted for the next meeting for a
variance request of Paul Clabo, 1388 Park Drive.

The Planning Cor:�mission recoru;lended approval of the
lot area and lot width variance subject to legal
cor.tbination of the four parcels, finding that sewer
service is available and finding a hardship of no
additional land being available.
The applicant discussed his house location and setback
variance requests noting the location being affected
by sloping to�ography to the east. The staff notes
above are in error. Park Lane to the west (left)
is unimproved but open for two private driveways.
Clyde Place to the east (right) is undeveloped and
is roughly the location of a drainage ditch. Oak �
Street is also unimproved with private driveway access
only. Planning Comr_lission accePted the applicant' s
setback variance plan because of the topography involved.

Council with a mer:�o concerning proposed changes
to the Park Dedication Ordinance, dated December 5 ,
1978, which states:
On Nover.mber 14 , 1978 , the City Council discussed
revision to the park dedication fee ordinance.
I recommend review and adoption of the atta.ched
ordinance draft. This is an exerpt fror:l the most
recent draft subdivision regulations which have
been under study for the last year. I recorunend
calling a public hearing for the first rneeting in
January.
The revisions include language arising from the .
recent Supreme Court decision involving the
B1oor.lington ordinance. Other changes fror.l the
existing ordinance include:
l. Commercial - Industrial Dedication
2. Increase in rates on certain densities:
Five (5) acre lot from 1-1/4% to 50
'�'wo (2) acre lot from 2-1/2� to 10 0
3. �stablishment of flat rate (minir,tum) fee of
$250 for building permits on existing lots
rather than the percentage rate which of ten
ran up to the maximum $1, 000 fee.
4. Clarification of policy wherein no fee is
charged for existing residences or building ,
sites when a division is made, i.e. ; a lot
split will be charged one fee, not two; a five
lot division with one existing house will be
charged four fees, not five.
Tlie proposed park dedication fee ordinance was
referred to the Park Commission for review and
recor.unendations.
A letter was received frorm Mr. Herbert Klossner, TANAGER LAKE BRIDGE
Department of Transportation, Fiennepin County,

on September 12, 1978 and the contract documents were approved on November 2, 1978.

Dear Richard,
We have reviewed the bill from Hennepin County for construction of
the approaches to the Tanager Bridge.
The cost is somewhat higher than that estimated in the agreement
with the County but unit prices seem to be in order.
The bill appears to be in order and we would reco�end that invoice
��3304 in the amount of $29,300.02 be paid after we have reviewed
our �Iunicipal State Aid funds. We have recently made application
for ttie funds and would anticipate we would receive same sometime in
January.

MSA Streets
Gentlemen:
The City of Orono is required to have a 5-year capital improvement
program for M.S.A. streets submitted to the DOT prior to December 31,
1978. The Council should review the program as outlined, revise as
they feel necessary and pass a resolution approving the capital im-
provement program.
We should indicate to the Council what street construction may be
possible to program the additional $280,000. The City will lose
M.S.A, allo�nent f�nds if the money is not progra�ed for some street
projects. �+Te could indicate that the money will be used for improve-
ment of any segment and then change our plans in 1983.

at Tanager Lake Bridge is done, the County will
also improve the egress to the 47oodhill Country
Club. P�r. Bellows will work out an arrangement ��ith
everybody concerned to correct the problem, such as
putting the gate further into the Woodhill property
line with a cul de sac on the country club property.

the insurance bid dated December 8, 1978, states :
Please find attached a cover letter and bid analysis
from Jeffrey P. Isenberg of �he Williart Peet Cor�pany
who was retained as a consultant to evaluate the
bids and specifications for our insurance package.
Pdr. Kuehn and I had hoped that the clirlate had
changed this year in regard to r.iunicipal insurance
and that we would have more companies participating
in the bids. The climate has not changed and we
received only one bid from The Home Insurance
Company who has insured the City the past three
years. The bid is 33o higher than the 1977 premiums
with an 8% dividend on the workmens compensation
policy paid to us at the end of the year.
We do have the option of cancelling our insurance
at sorne later date should we find an insurance
cor.lpany who would quote a premium at a lesser cost.

December 4, 1978 , states :
In Nover-iber of 1977, the City of Orono bec�an
participating in the employee assistance program.
The program was initiated as a three-year prograr_1
with the City of Orono participating and evaluating
the program after one year to determine the effective-
ness and to decide after the evaluation whether or
not to contiriue. The cost of the prograr,i is based
on the number of employees times a set rate per
enPloyee. For 1977, 44 employees were considered
at $8. 00 per employee.
This program is also funded by the State of I4innesota
and adriinistrered by Hennepin County. The cost
schedule is as follows :
Year one - 90� State funded - l0o City share
Year two - 50°s State funded - 50o City share
Year three- 100% 100g City share
At this time, there is discussion that the program
may receive funding for year three whereby we could
possibly be subsidized by the State for a portion
of our costs. Another change in the program is
the cutoff date being changed to June 30 and the
cost Per employee increased from $8. 00 to $10 . 00
per eraployee.
I have reviewed the program with department heads
and everyone feels they would prefer to participate
in the program until June 30, which would allow
us to better evaluate the effectiveness of the program.
The cost to remain in tlie progra� until June 30 , 1979
will be $165. 00.
It is my recoru�endation to continue the prograrn until

concerning sewer service charges for Calvary
Menorial Church, dated Deceriber 7, 1978, which states :
In July 1978, the Elizabeth Gardener School at
2420 Dunwoody Avenue was purchased bv the Calvary
��iemorial Church formerly located at the intersection
of Shadywood Road and Shoreline Drive.
The Elizabeth Gardener School is now being used as
a church only.
On October 27, 1978, the City of Orono received
from the Calvary D4er:lorial Church a request to review
the sewer service charge, explaining that the present
use of the building has been reduced considerably;
therefore, the sewer service charge should also be
. reduced.
City Planner Alan Olson and myself have researched
the matter and have deterr_►ined that, in fact; the
use of the building has been reduced. L�e feel that
the sewer service charge should be reduced from
30 units per quarter to three units per quarter.
On Decerlber 6 , 1978, City Planner Alan Olson and
� mvself inet with P4r. Neil Bergstrom, Chairr_man of the
' Board of Trustees, and P-ir. Floyd Larsen, Treasurer
of Calvary Meriorial Church, to explain that it will
be our recommendation to the Orono Council that the
above mentioned reduction in rate be applied to
2420 Dunwoody Avenue until such time that either
the use of the building changes or the City revises
its policy on setting se�ver service charges.
Mr. Bergstrom and P+Ir. Larsen agreed with the chan_qe
and assured us that they would most certainly notify
the City of any projected change in the use of the
building or property.
Therefore, Mr. Olson ana myself are recomr.iending
that the sewer service charge at 2420 Dunwoody Avenue
be reduced fror.l 30 units per quarter to three units
per quarter effective October 1, 1978.

Director, dated Decer:lber 6 , 1978, which states : to General Fund
It is recommended that $11, 254. 74 be transferred
from the Federal Revenue Sharing I'und to the
General I'und. This will bring the total lransrerred
during 1978 to $34 , 031. 15 or 590 of the $57, 850
budgeted to be used this year. The approximate
unused balance of $23, 800 has been allocated
prirnarily for recodification costs ($8, 395) ; a new
water system for the Council Char,ibers and the
public works building ($4 , 000) ; and street depart-
ment equipment $10 , 980) .
The current transfer will be used to offset the •
following expenditures :

�•�hich established the Emergency Contingency Account
within the General Fund. It is requested that
Council authorize the transfer of $30,000 from the
Sewer Operating Fund as the initial contribution
. to this account, per Resolution #941.

It is recorunended that a transfer of $5, 000 be
made f rom the Sewer Operating Fund to the P. I.R.
Fund as partial repayment of the original $50 , 000
loan per Resolutions #283 & #343, respectively.
The total repaid on t:�e loan to date �vill be $20, 000.

City Council that we have received a preliminary
engineering report from P�cCor.ibs-Knutson Engineering
to provide sanitary sewer to Medina-P�Iorningside.
I have discussed the project with Lyle Swanson,
engineer with P�IcConbs-Knutson, and �4edina would
like a meeting with us after the first of the
year. .

City Council with a memo frori Thorlas Kuehn, Finance ACCOUNT - Close
Director, dated December 7, 1978 , which states:
At the inception of the Federal Revenue Sharing
program in 1972, the City established a separate
revenue sharing checking account for the deposit .
and disbursertent of these monies. The City also
established the Revenue Sharing Fund within its
books and records. �ahile it is necessary to main-
tain a separate fund to insure proper accounting
for the receipt and disbursement of the federal
r�onies, it is not necessary to maintain a separate
checking account also. By keeping the separate bank
account, it r.leans transfer of these monies to
reimburse other funds for budgeted revenue sharing
expenditures that must be done by check rather
than by journal entry. It also makes investing
the monies more coraplicated and also necessitates _
a separate bank reconciliation each month. Because
of the problems mentioned, it is requested that
Council authorize the City Treasurer to close the
Revenue Sharing bank account and r.taintain it,
henceforth, within the General bank account.

P4r. Dick Benson, City Administrator, inforr►ed the RECODIFICATION
City Council that he had reviewed Bruce Malkerson' s
letter of November 29, 1978 outlining his proposal
on behalf of Pophan, Haik, Schnobrich, Kaufman & Doty
to recodify Orono' s City Code. I am in agreement
with Bruce' s proposal.
Our primary concern has been to accept a proposal
that will allow a codifier to commence work
ir.unediately in chronological sequence, revising
and preparing revisions as legally required.
t4r. Plalkerson has assured r.me that his office is
prepared to proceed with the complete recodification
process using the format as outlined by lsunicipal
Ordinance Codifiers, Inc. �

City Council with a memo from Chief of Police P.ilbo,
dated December 14, 1978, which states:
I aM requesting permission to purchase a Ford Ltd. 2
squadcar from Freeway Ford, which is under Hennepin
County Bid Contract #8318 in the amount of $6, 118
a budgeted amount.
We have received only one infornal quote, at this
time, that does not meet specs as we outlined in ,
several areas, such as , size of tires, engine
configuration, and delivery date.
It is necessary to order by December 15, 1978 to
be included in the County bid.
