Regular P�eeting of the Orono Council, 7: 00 P.M.
SepteMber 13, 1978
The Orono Council met on the above date with the
follo�aing nembers present: Mayor Van Nest, Council-
merlbers Paurus and Pesek. Councilnember Butler
arrived at 7: 07 P.M. Council�ember Massengale
arrived at 7: 10 P.P�. Also present: City Planner
Olson, City Engineer Ol'son, Chief of Police Kilho,
Public Works Coordinator Gerhardson, Finance �
Director huehn, and Deputy Clerk StroM. Absent:
City Administrator Benson.
Mayor Van PJest announced that now was the tir�e and PUBLIC HEARIrdG
place for the public hearing concerning the proposed Federal Revenue Sharing
use of approxir�ately $33., 588 of Federal Revenue
Sharing monies for Capital Outlay and Fire Service
support within the General Fund proposed budqet
of $1 , 145, 140. Mayor Van Nest presented the idotice
of Public Hearing and the Affidavit of Publication.
Mayor Van Nest inquired if anybody was present for
the public hearing. P10 one was present. The
minutes of the Proposed Use Public Hearing ��ere
revie�aed. Action was delayed until later in the
evening. The �ublic hearing was closed at 7: 05 P.M,
Councilmember Butler arrived at 7: 07 P.M.
Butler moved, Pesek seconded, to approve the CONSEPIT AGENDA*
Consent Agenda*, except items 2 & 15, with all
staff data and supportive inforrmation to be
included in the r2inutes in the sequence they
occur. Motion, Ayes (4) - Nays (0) .
Butler rnoved, Paurus seconded, to approve the MINUTES
P4inutes of the Regular Meeting of August 15, 1978 , �

Councilmember Massengale arrived at 7: 10 P .P4.
Mr. Lee Tomlinson, Chairman of the Orono Park PARK COMI��2ISSION COPu�iENT
Commission, was present to review and discuss
the minutes of the Park Corunission concerning
the future of the City parks. The Cor•.trmission
has rec�uested funds from the Park Fund for a
professional planner to present a study for better
utilization and developrient of the City park system.
Mayor Van P1est explained that park fees are .
collected at the time the land is being platted,
according to State Statutes, and that the funds
have been set aside to hold for use at a later
date.

hearing at the Orono Council Chambers on Wednesday, Docks
Septer.lber 20 , 1978 concerning a multiple dock and
variance to allow 20 boats for Crosstown Associates
at Outlot F, plat of Lafayette Ridc�e_
Mr. Alan Olson, City Planner, was appointed to
attend the public hearing for the ne�a dock license
for Lafayette Ridge.

according to the attached resolution draft. All
required items are completed.
tlote that the division consists of twelve (12) lots,
one less than the preliminary. The final Lot 1
includes both Lots 1 & 2 as shown on the preliminary
because only one approved septic location was
verified for these lots. If further testing
proves a second drainfield site, an application for
division of Lot 1 could be made at a future date.

plat.
Mr. Alan Olson, City Planner, entered into the • COiJDITIONAL USE PERMIT
record the following concerning a conditional use 3502 Shoreline Drive
permit for Lowell Zitzloff, 3502 Shoreline Drive, #415
dated August 9, 1978, which states : Lowell Zitzloff
The applicant is requesting permission to operate
an auto parts supply store in the vacant McCharles
building at this location. The business is stated
as being primarily wholesale in nature with limited
retail trade.
The property is zoned B-5, Limited Neighborhood
Business District. The property is 13, 450 sq.
ft. in area and 100 ft. wide. The B-5 District
provi.des for certain "permitted" and certain
"conditional" uses, but auto parts is not specifically
listed in this or any other district. The last use
of this building was for a retail/manufacturing
outlet for redwood burl products. This use was
approved by the Council on April 26 , 1976 . At
that tine, the property was zoned B-4 , Office and
Professional Business District.
Review of this application must include a determin-
ation of the suitability of this proposed use with-
in this use district. Side issues include traffic
generation and parking requirements , outdoor
storage, if any, and a general cleanup of the
debris, old boats, etc. , existing on the property
today. The City Engineer and Hennepin County
Department of Transportation have been asked to
review the traffic controls and access delineation.
Planning Commission P4eeting - August 14, 1978
Work Session. Mr. Zitzloff and building owner,
Rod McCharles, were present. Mr. Zitzloff
explained his business to the Planning Cor.unission
saying this store would serve his local area
customers. There would be 2-3 employees and one
delivery truck based here. Planning Cornmission
discussed major concerns with traffic and parking
and indicated that sor.le curb-cut work will be
required as a condition of approval. Mr. Zitzloff
is to return with a site plan showing parking, �
access, and any intended landscaping plus a floor
plan of the store itself showing retail/wholesale
floor space divisions.

Planning Commission Meeting - August 28, 1978
Lowell Zitzloff (applicant) , Rod t�IcCharles (property
owner) and David Bie (owner of property across
Navarre Avenue) were present for discussion of -
this item. Planning Commission questioned scale
and proportion of drawing presented. r�ajor
concerns involved parking and traffic patterns with
reluctance to approve access onto County Road 15.
Staff noted conversation of this afternoon with
Don tdurphy of Hennepin County wherein his verbal
recommendation w�s for no direct access to County
Road 15. 6�7ritten recommendations to follow.
Planning Cor.lmission noted that if drawing is
correct, the 33 ft. County right of way extends
five feet to seven feet into the parking where
shown. Planning Corurtission noted that if business
really is wholesale, as stated, that parking access
may not be as important as the applicants would
like to make it appear.
Planning Comrlission recommended approval of the
conditional use permit for a wholesale/retail
auto parts store subject to closing all direct
access to County Road 15, providing all access
from Navarre Avenue, and subject to the City
Engineer' s approval of a more detailed parking and
access plan. The applicant is to provide a survey
and/or scale drawing of the site and parking for
review prior to the Council meeting. _

Mr. Zitzloff and PZr. P�IcCharles were present
to discuss their application.
P4ayor Van Nest moved, Butler seconded, to con-
ceptually approve the conditional use permit for
Lowell Zitzloff, 3502 Shoreline Drive, and staff to
' draft a resolution for final approval at the
next meeting. Approval includes adequate curbing
signs and boulevard being paid for and installed
by applicant and/or owner as approved by the City
Engineer; allowing an entrance only off of Navarre
Avenue with exit only onto County Road 15 , to
be properly marked by signs; parallel parking in
front of building only; applicant and owner to
sign off on resolution; access and landscaping

record the following request for a variance of 2677 Casco Point Road
Alexander Holzer, 2677 Casco Point Road, dated #417
August 23, 1978, which states: Aleyander Holtzer
The applicant is requesting permission to reconstruct
his existing 14 ' X 32 ' single stall garage into a
new 21. 5 ' X 31' double car garage. The reconstruct-
ion exceeds 50� of the structure' s value and,therefore,
is required to meet all current code requirements �
including setbacks.
This location is adjacent to the neighbor' s garage
on the south. The yard area is raised about four
feet above the road and is contained by a retaining
wall making it ���rt�cu'_a�-1�� c��_=•`=`icult if the garage
were located elsewhere. There appears to be
sufficient room to park a car between the garage
and street but the retaining wall does severely
restrict vision to the north.

Each proposed lot meets the lot width and lot area

Subject: Noerenberg Park
Dear Mr. French:
It has come to our attention that a $350, 000 grant by the
l�ietropolitan Council has been awarded to the Hennepin County
' Park Reserve District for the improvement of the Noerenberg
Par}: located within the City of Orono.
The purpose of this letter is to outline to you the basic concerns
of the Orono City Council concerning the future development plans
of the Noerenberg Park and to establish a procedure whereby the
City, the Park Reserve District, the Metropolitan Council, and
the Noerenberg Citizen's Advisory Committee can participate in
a cooperative effort that will result in a satisfactory develop-
ment plan for all parties involved. - .
The City's primary concern is the scope and extent of development
proposed by the Park Reserve District. The City wishes to insure
itself that the total developed plans for the Park will remain
consistent with the City's Comprehensive Land Use Plan and zoning
ordinances for that environmentally sensitive area of Lake Minnetonka
where the Park is located. The City' s ordinances do require a
conditional use permit for the changing of any natural contours
requiring grading or filling in addition to City permits for the .
construction of parking lots and structures.
The City Council would like to participate, in some joint planning
meetings with your staff and the Noerenberg Citizen' s Advisory
. Committee to determine the specifics of the development plan for
this Park. Specifically, we are concerned with the size and location
of the parking lot, the size and location of structures, together
with the proposed public programs and usages of the Park that
would have an adverse impact on the traffic patterns along County
Road #51 and other streets within the City of Orono.

It is important that these joint planning meetings be held at.
� an early stage before your development plans are ful�ly established
' and I encourage your staff to contact Mr. Dick Benson, our City .
Administrator, at an early date to establish a meeting schedule _
to discuss these issues.
I am enclosing correspondence received from Mr. Al1an Raymond
representing a group of local citizens who are concerned with the
protection of their property rights as well as insuring that
the Noerenberg Park development plans are consistent with the terms
and intent of 2•Srs. Hoppe' s will, who was the donor of the Noerenberg
Park. The City Council has reviewed these comments from PZr. Raymond
and feels that many of the points raised by this citizens group
ar� valid and must be included in the overall development plans
for the Noerenberg Park.
We look forward to working with the Park Reserve District on this
project to insure that the development of the Noerenberg Park will
be consistent with the Comprehensive Plans of the City and serve
the needs of the general public to enjoy this Park and Lake Minnetonka.

Subject: Noerenberg Park Development Grant
Dear Mr. Boland:
It has come to our attention that the Metropolitan Council has
awarded a $350 ,000 grant �o the Hennepin County Park Reserve
District to develop the Noerenberg Park within our City.
The City has expressed some concerns to the Hennepin County Park
Reserve District concerning the overall development plans and
their consistency to the Orono Comprehensive Land Use Plan and
the City ordinances.. We have requested a series of joint planning
meetings between the Park Reserve District and the City to insure
the protection of the City' s interests in the development of this
Park and the use of the Metropolitan. Council's grant.
I am attaching to this letter recent correspondence with the Park
Reserve District concerning this matter for your information.

Senator Pillsbury and Representative Searles SENATOR PILLSBURY

i�Zinnetonka Conservation District matters. LMCD
Representative Searles presented the City
Council with the Lake r�7innetonka Conservation
District Law which was adopted in 1967 and
anended in 1969, which created the LP�CD.
Mayor Van Nest stated that the purpose and powers
were not very well defined. His one concern was
a statement that had been made that the LP4CD does
not have the authority to regulatel�oat storage
on Lake Minnetonka. The Statute is not crystal
clear that the LP�ICD does have that authority.
Senator Pillsbury stated that the purpose
consisted of governing on the waters of the
lake. He also stated that there are three
issues: purpose, powers , and organization.
Representative Searles stated that the purpose
is defined in the title of the Law. "Conservation"
is the key word included in the title.
Discussion followed relating to docks and marinas,
regulating types and number of docks and boats,
and use of the lake.
Senator Pillsbury and Representative Searles
explained procedures for improving the effectiveness
of the LMCD. Senator Pillsbury suggested that
they approach the LP4CD and explain to them the
meaning and purpose of the Statute.
Mr. Tom Kuehn, Finance Director presented the APPOINT - AUDITOR 1978 *
City Council with a mer►o dated Septeriber 7,
1978 , which states:

Certified Public Accounts, has submitted a
proposal for audit of the City of Orono for the
year ended December 31, 1978. The proposal
states a cost to the City not to exceed $2 , 550.

The Orono City Council was presented with a rmermo REFUND
from the Assessrlent Clerk to the Finance Director
concerning prepayr.ment of special assessrients for
Plat 41317 - Parcel 3420 dated August 29 , 1978
which states:
On iiay 17, 1978, I received a special assessment
search on the above described property frori T�ain
City Federal Savings and Loan.
In my research, I discovered this property had gone
tax forfeit because of delinquent tax since 1966 ,
and the specials had been dropped, in error, in 1975.
I wrote to Hennepin County directing ther.l to respread
the unpaid amount. T}iis has been completed and I now
have new levy spread sheets on these.
The problem is in the fact that when I figured the
assessrient search I did not take off the payment
for 1978, which has been. included in a corrected
tax statement. Since then� we have received and
receipted pa_yr-ient in the amount of $2 ,968. 40 and
the total should be $2 ,500. 92, mherefore, a refund
of $467. 48 is in order.
It is recommended that the resulting overpavment of
$467. 48 be refunded to Twin City Federal Savings and
Loan.

Chief of Police Kilbo concerning a salary increase Bruce Anderson
for Bruce Anderson dated August 24 , 1978, which
states: �
Bruce Anderson started er.�ployment on r4arch 1, 1978
at 1977 pay scale of $1,093. 47 rlonthly, hourly
rate of $6. 31, and over-time of $9. 47. Fie has
performed the duties of a police patrolMan adequately
and in a satisfactory manner. Bruce is eligible �
for a step increase to 1977 pay scale after six
Months to $1, 133. 51 Monthly, hourly rate of $6. 53,
and over-time of $9 . 80. I request he be granted
this step increase. This increase should become
effective Septerlber 4, 1978.

contract for law enforcement for Maple Plain,

r4innetonka Beach informing them of the terms of the
contract for law enforcement and the intent to �
