A RESOLUTION GRANTING A VARIANCE
TO MUNICIPAL ZONING CODE
SECTION 78-420 (B)
FILE NO. OS-3071
, WHEREAS, Anthony Thomas Homes, I�lc., (hereinafter "the applicant"}
is the owner of tlie property located at 400 Leaf Street within the City of Orono
(hereinafter the "City") and legally described as follows:
Lot 30, AUDITORS SUBDIVISION No. 230, Hemzepin County, Mi�inesota
(hereinafter the "property"); and
WHEREAS, the applicant has made application to the City of Orono for a
lot area variance to Orono Municipal Zoning Code Section 78-420 (B) to allow
construction of a new residence on an existing lot 0.835 acres in size when 2.0 acres is
normally required.
NOW, THEREFORE BE IT RESOLVED by the City Council of
Orono, Minnesota:
FINDINGS
1. This application was reviewed as Zoning File#OS-3071.
2. The property is located in the RR – 1B, One Family Rural Residential
District, which requires a minimum lot area of 2.0 acres.
3. The Planning Commission reviewed this application at a public hearing
held on January 18, 2005 and recommended approval of the variance
based on the following findings:
a. The lot is an existing lot of record created prior to adoption of the
cunent zoning regulations.
b. A house has existed on the lot since prior to the early 1960's. �

5. The City Council finds that tl�e COIlC�1t1011S existing oil this property are
peculiar to it and do not a�ply generally to other �JI'O�eI't�' ::11 t�115 Z011lllb
district; that granting the variance would not adversely affect iraffic
conditions, light, air nor pose a fire hazard or other danger to neigllboring
property; would not nlerely serve as a convenience to the applicant, but is
iiecessary to alleviate a demonstrable hardsllip or difficulty; is necessary to
preserve a substantial property riglit of the applic'ant; and would be iil
keeping witli the spirit and inteilt of the Zoning Code and Comprehensive
Plui of the City,
CONCLUSIONS, ORDER AND CONDITIONS
Based tipoil one or more of the above findings, the Orono City Council hereby
grants a lot area v�uiance ta Orono Municipal Zoiling Code Section 78 - 420 (B) to 111ow
construction of a new residence on ail existuzg lot 0.835 acres in size wlzen 2.0 acres is
no��mally required, suUject to the following conditions:
1. Couilcil approval 15 based on the site pl�n submitted by the al�plicll�l and
aiu�ota�ed by City staff, attaclled to ihis Resolution as Exh:bit A. Any
ameudments to the siie plai�. which are 110t 111 CO11fOT11Z11y Wltll Gity codes will
require fiutlzer Pl�uuung Conlrnission and City Coui�cil review.
2. Required removals of structure shall be completed by the frst inspection for the
proposed new home.
3. The City Engineer shall approve the �roposed grading plan prior to issuance of a
building��ermit.

4. Authorities grinted by this resolution run with the property noi with the applicant,
but are perinissive only and inust be eaercised by obtaiiung a building permit for
the new construction within one year of the date Of COL117C1I approvll, or tlle
vari�ulce will expire on th�t date (January 24, 200�}.
5. Violation of or non-com�liance with aily of the terms aild conditions of this
resolution shall COI15tltllte a violation of ihe zoning code, sh�ll automatic�lly
terillinate ai�y authority gr�ulted herein, and shall be punishable as a misdeme�nor.
6. The undersigned applicant has read, uiiderstood and hereby agrees to the terms of
tlus resolution and on behalf of the applicant az�d the applicant's heirs, sttccessors
: _ and assigns, hereby agrees to the recording of tlus resolution in the chain of title
of the propei-�y.
