Regular Meeting of the Orono Council, 7: 00 P.M.
August 29 , 1978
The Orono Council met on the above date with
the following members present: Piayor Van Nest,
Councilmembers P�assengale, Paurus, and Pesek.
Councilmember Butler arrived at 7: 23 P.M.
Also present: City Administrator Benson, City
Planner Olson, and City Attorney P4alkerson.
Absent: City Engineer Olson. �
Paurus moved, Pesek seconded, to approve the CONSENT AGENDA*

Norman Paurus discussed the proposed LP�CD policies
and actions.
I�ayor Van Nest cor.unented that the City Council and PLANNING COMMISSION
Planning Commission will hold a joint meeting at
� 7: 30 P.M. , September 21, 1978 and that the City �
Planners should attend. At that tirne, it would
be appropriate to plan our future joint meetings.
No comments from the Park Commission. PARK COMMISSION

record a memo update on the request of Tom Leach, CONDITIONAL USE
2535 Shadywood Road, for a subdivision and conditional 2535 Shadywood Road
use permit, dated August 23, 1978, which states-: #344
Tom Leach
All requirements of preliminary plat approval have
been completed. The proposal included consideration
of a duplex unit on Lot 3. Because final planning
has not been completed for the dunlex, final
approval of the conditional use permit will have
to be delayed. The park fee has been paid on the
basis of future duplex approval.
The plat includes a 30 ft. driveway and utility
easement over Lot 1 to serve Lot 3 and a 30 ft.
utility easement along the entire southeast
side for future installation of storm seF�er.
I recommend approval of the final olat according
to the attached resolution and deferral of action
on the conditional use permit pending receipt of
a complete site plan.

i�ir. Alan Olson, City Planner, informed the City SUBDIVISION
Council that all requirements of the preliminary �400 Sixth Avenue N.
plat approval have been completed for Arierican Re- #363 -
builders, 2400 Sixth Avenue North. All sites American Rebuilders
have acceptable septic system locations, although
mound type systems are required due to the high
water table. Conservation easer:lents have been
provided over the pond on Lot 1 and a low area on
Lot 2. Hennepin County requires common access
for Lots 2 & 3.
I recomriend final plat approval according to the
attached resolution.

noted on the attached list. The Citv Engineer
is reviewing the driveway plans. All other items �
have been completed to the satisfaction of the
staff.

parts, etc. plus empty barrels , an old boat and
a vehicle with out-of-date license tabs on the
property. Presumably, this will be stored inside
once a garage is rebuilt but Mr. Wolfe should
definitely be advised that a garage is for
residential storage and use only and cannot be a
commercial garage or workshop.
Planning Commission Meeting - August 14, 1978
Walter Wolfe, Jr. and P�rs. Walter Wolfe, Sr.
were present. Planning Commission discussed
proposal and existing situation. Planning
Commission recommended approval of the variance
finding a hardship in the location of the existing
foundation and house, and the location of the
existing driveway access, with the condition that
the garage be single story, used only for residential
accessory use, and that all debris, equipment, etc.

Sketch plan review. This is a very rough sketch
plan provided for your initial review and comment.
The proposal is to divide the e�isting lots used
by the Texaco Station and a rental house along
Central Avenue for purposes of sale. �
The attached plat �ap shows property ownership:

The attached survey and application for subdivision
(lot line rearrangement) and variances have been
received and a public infor:�lation meeting is scheduled
for 7: 30 P.T2. , August 14 , 1978.
The subdivision proposal involves a combination of
four platted lots and a newly located division line
resulting in two parcels. The proposed Lot 1
contains an existing house. The proposed Lot 2
contains an existing service station. Not shown
are the remaining Tourangeau Lots 7-13 & 20 which
contain the existing Tourangeau house on 47, 300 sq.
ft. (1. 09 acre) .

Public information r�eeting. P�r. Tourangeau and
Mr. Robert Reut7man (lessee of the service station)
were present for discussion. The Planning Commission
reviewed the existing situation with two buildings
on comr.►on lots and the proposed lot line rearrange-
nent to create separate parcel identities. Planning
Commission reviewed the recommendations of the City
staff and the Hennepin County Highway Department.
It was noted that service stations are conditional
uses in the B-1 zone, that this station has been
existing and operating for many years, but that
there was never any formal conditional use perr.►it
or application on file.
Parking was discussed noting that the code calls
for seven spaces for this station. t2r_ Reut�.man
noted that the station only has "parking problems"
when the marina customers use the property on weekends.
He stated that the marina (Paul' s Landing) does �not
have any authorization from him to use this property
for marina parking.

Planning Commission and the applicant (s) discussed
the existing zoning with all parties agreeing that
a zoning boundary change is desireable. It �aas
particularly noted that the station' s fuel tanks -
are located under Lot 26, the residentially zoned
corner lot.
Planning Comr.►ission recommends preliminary �lat
approval as requested with the following conditions:
l. A formal application be made for a conditional
use permit per 35. 022 for operation of the
"motor fuel station" . This permit to set out
in writing all landscaping, curb cut, parking,
etc. conditions per 38. 500.
2. A formal application be n►ade for a rezoning to
revise the existing district boundaries to
coincide with the proposed lot division; all
of Lot 1 to be RR-1B and all of Lot 2 to be
B-l; such rezoning to be pursuant to all required
reviews and hearings and to be effective only
• upon recording of an approved final plat.
3. Concurrence with the Hennepin County requirement
to close access to County Road 15 except for
one cor.unercial driveway app�c�ximately 120 ft.
north of Central Avenue.
4. Applicant to provide a landscaping plan and
schedule of completion for review with the
conditional use permit prior to final plat
approval.
5. Combination for tax purposes of the rerlaining
Tourangeau residential lots (7-14 & 20) .
6. Closing of the rear station window per State
Building Code requirements.
7. Approval of all variances necessary to accomplish
the above finding hardships of no additional
land available and existing structure locations.

#418 , a conditional use permit application for the
station property, which included expansion of the
existing use. Due to this new infor�ation, the
Planning Commission voted to reconsider their
action of August 14, 1978 and then voted to table
the subdivision aPplication (#414) pending complete
and concurrent review of the conditional use �
application (#418) .
Council Meeting - August 29, 1978
P4ayor Van Nest reviewed the past history on this
particular property stating that in 1974 ��hen
rezoning was being implemented and the evening of
the final adoption, P�r. Tourangeau asked if he
could continue the present use of the station. He
wanted to maintain it as it is today. He wanted
it left B-1 commercial.
Discussion followed at that time, and the City
Council decided that the station would reMain
B-1, commercial and all other property would be
rezoned. Now, r4r. Reutiman wants to buy the
property. The previous assurances were the station
would remain as it was and is today. The City
wanted to be sure that the building uses would not
change.
Mr. Tourangeau: I want to sell the house. I own
the property. I want the property divided. 69hat
happens to the station is a different issue.
Councilmember Massengale: Our concerns are, what
is being offered for sale? Apparently, the zoning
lines are different than the lot lines.
idayor Van Nest: We need a survey to show us where
Central Avenue is. The applicant will realign the
zoning line"s. Are we going to create a separate
commercial lot in a B-1 area? The intended uses of
the station are being changed.
Mr. Robert Hornick, 6020 Stoneybrook Court, P�innetonka:
I wanted to extend the service now being provided,
but I would be willing to continue the services
now being provided, also.
Councilmember P4assengale : Our concerns are the
traffic that would be generated by the proposed use.
Mr. Hornick: We intend to sell more gas and provide
beer and grocery items.

Mayor Van Nest: Our or��;_n�l intention was to prevent
this type of use;Mr. Tourangeau assured us that these
uses would not change.
Mayor Van Nest to Mr. Tourangeau: Would you be
willing to request rezoning of this area? �
Mr. Reut�man, Jr: There seems to be some misunder-
standing of what happened in 1974 .
Mayor Van Nest to Mr. Tourangeau: Don' t you agree
that what I said previously was true?
Mr. Tourangeau: Generally, yes.
Pesek moved, Butler seconded, to refer this item back •
to the Planning Commission and staff; also, copy of
lease and option to buy. Motion, Ayes (5) - Nays (0� .
r4r. Louis B. Oberhauser was present to discuss his `��AYZATA COUNTRY CLUB
letter of August 25, 1978, concerning the develop-
ment of Wayzata Country Club, which states :
"I had the architect prepare a conceptual layout
of the building on the site to show its location on
the site in relationship to the site itself and
to the adjoining property.
The structure shown contains twelve units, has a
single heated underground parking garage with some
exterior parking.
I compared the aerial photograph with the aerial
photographs maintained by the City of Orono and
have ascertained that the dividing line bet�veen
Wayzata and Orono bisects the project so that
appro:>imately 3-1/2 units will be in the City of
Wayzata and 8-1/2 units will be in the City of
Orono.
I have canvassed the Allo-Rae Drive neighborhood and
I found no one in opposition to the proposed
development provided access does not require the
use of Allo-Rae Drive.
As you can see froM the proposed plan, access would
come from Highway 12 adjacent to the easterly
entrance to the Country Club and the proposed
development would be totallv isolated from the Al10-
Rae Drive neighborhood. The lot owned by the
�9ayzata Country Club would be sold and a house
would be constructed there. (Continued)

If an annexation and detachment of the property WAYZATA COUNTRY CLUB
could be obtained, it would certainly make it niich (Continued)
easier to develop the property, since we would
only have to deal with one municipality. Since
the sewer and water for the project would be
provided by the City of [Jayzata, it is suggested
that the land required to construct the project
be detached from Orono and annexed by taayzata.
In exchange, I would sug�est that Wayzata caould
detach the property lying northerly of the center �
line of old Highway 12 and west of the east half of
the southeast quarter of Section �, To��inship 117,
Range 23.
If the property is going to be developed linder �
the ordinances of the City of Orono, it will be
necessary for us to ask for the rezoning of
sufficient land to a half acre or a one acre zone
to allow the construction of the residential
units. Since this will be a 12-unit condominiun,
we would probably be required to proceed under the
planned residential section of your ordinances in
order to obtain the right to construct coru�on walls.
Prior to proceeding with the time and effort
required in a rezoning application and a planned
residential development, I would like some pre-
liMinary indication from the Council on the following
points:
l. Whether or not an annexation and detachment
between the City of Orono and Wayzata would be
feasible as being in the best interests of both
�unicipalities for the purpose of allowing the
proposal to be under the jurisdiction of a
single municipality.
2. If the proposal is to be developed under the
_ ordinances of the City of Orono, does the
proposal as submitted run contrary to the
co�prehensive plan of the City of Orono. In
other words, from a policy standpoint does the
development as proposed create a conflict with
the comprehensive plan for the City of Orono
which would nake it iMprobable if not i�possible
to obtain the necessary approval.
The questions are not asked for the purpose of
attempting to gain a commitment in favor of the
proposed develop�ent, but it is being asked ior the �
purpose of ascertaining whether or not the Droposed
developMent has such limited chance of success that
the expenditure of future time an d effort on behalf of
the Wayzata Country Club would be an exercise in
futility. (Continued)

I think that we all agree that the property has WAYZATA COUNTRY CLUB
soMe very unique features which �akes it difficult (Continued)
to develop on a standard which have been previausly
adopted by the City of Orono. If in reviewing the
proposal, the City Council can suggest any alternative
proce�ures to f�llow, they certainly would be more
than welcome.

matter. " -

Mayor Van Nest commented that one acre developr:lent
in the area might be feasible but an ar,lendment to
the PRD would have to be initiated to allow attached
structures.
P�Ir. Louis B. Oberhauser reviewed his letter of DAYTON PARK PROPERTY
August 28 , 1978 concerning the Bruce Dayton Park
property, which states:
"I am enclosing for your review two deeds. The
first deed is for the property that P4r. Dayton
intends to give to the Citl� of Orono for the
purposes indicated therein.
The second deed is a portion of the parcel of land
on the southeast corner of Old Long Lake Road and
Town Road. This portion of the land is that part
of the property which is on the sar.�e elevation as
the park land previously conveyed.
It would appear that the appropriate procedure would
be to deed off this portion of the land so that
all of the property on the sar.ie elevation would be
held by the City for park, recreation, and open
space conservation purposes, and that the upper
level of property go with the hoine. Since all
of the property surrounding the home is dedicated
to public purposes and will not be ir_mproved, the
fact that the balance of the property has less '
than two acres should not produce any problems
regarding the suitability of the property for a
residential structure in a non-sewered district.
It is suggested that the most efficient and least
expensive means of accomplishing the addition of
this land to the park land being dedicated is for �
the City to waive the requirements of the subdivision
ordinances in this particular instance, and accept
a deed in accordance with a description that would
correspond with the natural geography of the area.
The divided property would then be combined with the
park property. (Continued)

Since there is to be no further developr-ient in DAYTON PAR�' PROPERTY
the area as the property has already been developed, (Continued)
it would not appear that it should be necessary to
go through the forr.lal procedures required by the
City in the platting and subdivision of property.
If you would please let us know what your pleasures
are in regard to this matter, I will take the
necessary steps to complete the land exchange
that has been proposed. -

I 'm leaving for vacation on August 18th and will return
August 26th. I wanted to get the attached in the mail to
you although not all of the signatures of our group have
been received and I ' ll have to forward them later.
It' s been no surprise to me to find that those few people who
have become fully aware of what the Park District has in mind
have taken a very negative view of the project. An example of
this would be Mr. & Mrs . Leonard Carpenter. I 'm sure you are
familiar with Mrs . Carpenters earlier involvement in 1974 when
the citizens advisory committee was fo�ed. Mr. Lyman, who
lives next door to the Carpenters , had become aware of what is
going on and has asked to become involved with us . Mrs . Aines ,
who did serve on the citizens advisory committee, tells us that
during her involvement she was not aware of what it would lead
to.
Notwithstanding the July 17th, 1978 memo from Jack Mauritz
describing the involvements of numerous groups and coIIunittees ,
public hearings , and published articles , the residents of Orono
are not aware of what this project really entails . Certainly
Mrs . Carpenter was not. Those residents that do know and that
I have listened to do not like it and will oppose it.
As an aside Brad, we were glad to see Walter Bensons letter of
July lOth to Clifton French. On the other hand, we really
don' t understand why he let an attitude come through in his
letter that asks the Park District to "indulge" the residents
of Orono by "allowing" the City Council time to review a major
development plan within our co�unity. It ' s not only "prudent"
for the District to "allow" input from the City and its
residents, it' s absolutely necessary since if we don' t like what
they finally intend to do, they won' t be able to do it . It' s
really that simple.

Dear Mr. Van Nest:
The following statement briefly summarizes the position of
the signatories regarding the proposal by the Hennepin County
Park Reserve District to develop the Noerenberg Memorial Park.
The signatories basically represent only those nearby residents
who have become aware of the project.
We oppose the proposed development for the following reasons :
I. Inconsistent with the terms and intent of the Will of
Lora N. Hoppe.
A. Property on the north side of County Road 51 shall
"be operated and managed in its approximate natural .
state as a place whereon wild fowl and other wild
game will be allowed to congregate on this land as
a natural area. "
Operation and maintenance of this land by either
the Minnesota Chapter of the Nature Conservancy,
Inc. , the Hennepin County Park Reserve District,
or if the bequest is unacceptable to either of the
above a charitable corporation as specified in the
will, must be "upon the same terms and for the same
purposes as set forth hereinabove. "
B. Property on the south side of County Road 51 "shall
be operated and devoted to public park purposes as
an aboretum for flowers , shrubs and trees , with
suitable pathways and decorative features. " Expressly
forbidden are uses of the land "for picnic purposes ,
, for camping, for boat or water craft launching, or
for any uses incompatible with that of a general
display garden area. "

The will stipulates "that the Park Reserve District
plant evergreens and other suitable shrubs indigenous
to our climate in that area of the property extending
from the site of the dwelling house east as far as �
the line of the Webster property" (now the Raymond
property) . It is my hope that the District will
thereby improve and beautify the area for the purposes
stated above. "
C. Summary
While donation of the land for specified public park
purposes implies the need for public access , the will
clearly seeks to place severe limitations on the extent
of such access in order to maintain the land north of
County Road 51 in its "approximate natural state" as
a wildlife preserve, and the land north of County Road 51
. as a memorial park to be devoted and operated as an
"arboretum for flowers , shrubs and trees" , and for
"general display garden purposes". The specific
exclusion of uses of the land for picnics , camping,
boat launchings or any other "uses incompatible with
that of a general display garden area" as well as the
specific reference to plantings to be made east of the
dwelling house extending east to the Webster (Raymond)
property line clearly indicates that Mrs . Hoppe in her
wi11 envisioned a modest public access to land that wouid
be more or less preserved in its natural state, in
harmony with its surroundings , and pleasing to her
immediate neighbors .
In the event that her interit �o� the �.and to be le�t
more or less in its natural state was unacceptable to
the Park Reserve Di.strict, MxS. Hoppe provided in her
will that the executors shall cause a charitable
corporation to be organized for the same stated purposes .
II. Negative Environmental Impact
It has not been demonstrated to the residents that the
environmental impact o� the project will not be adverse
in terms of i.ts ef�ects on w�.ldlife, land and water as
we11 as the health, safety and wel�are of the surrounding
residents with respect to the above as well as the specific
effects on residential property values, of litter, noise
and safety from addi,tional traffic and people in the area,
additional local law enforcement costs, potential future
need of widening County Road 51, and the aesthetic impact
on the general sense of we11 being of the residents of the
community.

III. Unsound Municiple Use and Plannin�
A park or recreational development in a residential
community should enhance the value of surrounding -
residential property and have a positive impact on the
lifestyle and general well being of the people already
residing in the area. Since the above effects of the
proposed project have not been demonstrated to the
community by the Park Reserve District, proceeding with
the project cannot be consistent with the responsibilities
of the Orono City Council and Planning Commission for the
sound use and planning of land within the municiple system
it serves.
IV. Imprudent Use of Public Funds
We find the proposed expenditure of approximately
$1, 250, 000 of public funds for this particular project
inconsistent with the realities and priorities of life
in Minnesota today. We reach the same conclusion regarding
the scope of the proposed five year Regional Park System
capital improvement program of $139, 000, 000. It will be
our intent to make our feelings we11 known to the 1979
legislature should such a recommendation be made.
With no intention of being al1 inclusive, and consistent with
. the points raised above, we specifically seek to limit the
. - development and use of the land in the following manner :
1) That parking be forever restricted to 25 passenger vehicles
and no buses at one time, and that development of a parking
area not exceed what is practical fox 25 passenger vehicles .
2) That no entrance for publ�c access be allowed within 150
yards of any private property line, no parking be allowed
south of County Road Sl , no parking be allowed within 75
yards of County Road 51, and no parking be allowed within
150 yaxds of Old Crystal Bay Road.
3) That no support or visitor �acility be constructed south
of County Road 51, within 150 yards of Old Crystal Bay
Road, or within 75 yards of County Road 51.
4) That visitor facilities be limited to washrooms , drinking
fountains , and telephones .

5) That access to the park be denied to the public between
November lst and April 30th, and before 10 : 00 a,m. and
after 4: 00 p.m. from May lst to October 31st. �
6) That adequate enforcement be provided by the Park Resezve
District to insure public compliance to park rules and
regulations .
7) That the park, in addition to the use exclusions specified
in the will, not be used for weddings or similaz events .
In suIIunary, the proposed project is unacceptable to us �or the
reasons outlined above. We view ourselves as reasonable people
who are concerned with doing what is right in terms of the
betterment of the community at large as well as protection of
our own personal interests and the interest of the City of Orono.
This project places these natural concerns in opposition to one
another. It is our hope and belie� that the subject can be
disposed of satisfactorily through the public mechanisms which
exist within the City of Orono for the protection of its citizens .
That is where the responsibil�ty is focused. Should that not �
occur, we are prepared to pursue the matter with every means at
our disposal to a satisfactory conclusion.

in the letter from the Orono Committee for the
protection of the Noerenberg Park.
Marge Gasch, 1030 Tonkawa Road: I would like to
see necessary improver�ents but in a limited way.
A huge plan to accomraodate two to three hundred
cars is not in our best interest.

1978 Tree Disease Program .
In 1977, there were 414 cases of Dutch elm disease
in the control zone compared to 732 at August 20,
1978. I would expect about a 2.5 fold increase �
over 1977 by the finish of the season. The total (Continued)

able to record, even those that have been removed (Continued)
without notification. There are a nLu:lber of
unrecorded diseased trees, most of which have or
will be removed, and this figure could approximate
an additional l00 or More.
Only two cases necessitated legal procedure where
the forester took bids and had the trees removed.
Thirty-two samples were taken on suspect oak
trees, but none turned out positive for oak wilt.
Suggestions for 1979 Tree Disease Program
With the increase of Dutch elm disease, there is
also an increase of resident response to the ProbleM.
The er,�phasis here is in the considerable nur.tber of
phone calls and the amount of time needed to answer �
then by phone and field survey. This year I kept
tabulation on the time needed to answer the calls
and to date, it is 286 hours fror_Z iiarch 1 to
August 20. The field time tabulated where there is
need to examine the trees from the phone requests
totaled 367 hours. This includes travel time
between locations. Thus , the total hours based
from phone calls to August 20 is 653 hours, or
alr.�ost 82 man days. If there is a comparative
increase in phone response in 1979 , I have no
solution for handling it, and this is inclusive
of an assistant helping me.
I have had an assistant, Peter Brownlee, helping
me conduct the tree disease survey for 1978. To
Auc�ust 20, he has 324 hours on this program. His
tirie and mileage costs are paid -by me.
The only solution to the heavy man hour der.iand on
the tree disease program for 1979 is to seriously
limit phone calls, and to aim only at the shade
tree elm - the ones in yards and not in wooded
areas. The only other solution would be for Orono
to provide an assistant that I could train and he
could assist me on phone calls and survey. I
prefer the first suggestion - limiting phone
calls and surveying shade tree elms only. The
phone lir,►iting might be done whereby a secretary can
screen and answer many of the calls of a policy
nature (rebates, tree injections, suggested tree
firms , burning permits, rules and regulations,
disease symptoms, registered letters on legal
procedures, and others that cot:ld be ans�aered
in this manner) . (Continued)

I have discussed the shade tree e1M with the TREE DISEASE PROGRA
Council preceeding the 1978 season, and they were (Continued)
in agreement that the wooded or forested trees
need not be pursued. I would like this discussed
again and hopefully voted into program policy.
The exact definition of a shade tree is one that
provides shade to a home within a lawn area. The
forest tree is in a non-maintained area, usually
heavily wooded but not necessarily.
Diseased Tree Disposal Problems in Orono
In the last several years , many meetings have
been a�tended on the disposal of diseased elm
trees. To date,no solutions have been reached.
Present disposal sites are disappearing and others
are L?nder increasing restriction. Costs per load
are increasing rapidly. At the present rate, it
is possible there could be no sites available at
all within a couple of years.
Utilization of diseased trees has failed miserably.
Shade trees do not have the upright straight form
desirable for lumber, have considerable r.�etal and
concrete in tzzem, and chipping for cor.imercial use
has very limited market. Forget utilization in
this form, as it will solve only a small percentage
of the available diseased trees waiting to be
disposed of.
If there are no disposal sites, what do we do?
The best solution might be to let residents retain
the wood for heating purposes. This could be done
in several ways:
1. Untreated elm wood retained withDut consideration
of increasing bark beetles populations carrying
spores of Dutch elm disease. This would undoubt-
edly increase the incidence of the disease, but
does it matter if the bulk of the elms are lost
in eight or twelve years?
2. Elm wood treated with 0.25o Penta Cloro Phenol,
a wood preservative that has both a repelling
action against the bark beetles, and acts as
an insecticide. The rate is extremely low, and �
apparently presents no biological probler►.
Application would have to be by a licensed
Pesticide Applicator.
3. Homeowner burning of the diseased wood. P.C.A.
has restrictions on this , but if the residents
have no disposal sites to haul the wood to, they
are in violation of State Statutes anyway. Thus
they break the law no matter what they do.

Individual resident bidding for each diseased
elm tree costs an enorr►ous amount. The City of
Orono can help them reduce costs up to 50o by
consolidating all of the trees to be taken down
under on� �ontractor. We have a rlodel contract
at this time, which as been processed through the
City Adr_iinistration and Legal Counsel. The
hopeful objective is to get this well _prepared for -
the 1979 season. To do so, we need to proceed
with the final steps now.
There are points of the contract that will need
further qualification. One is that I suggest
the contract specify for the felling of the tree,
cutting it to firewood lengths , and chipping up
the branches. All residue should be left at the
residence for utilization of wood and chips.
Other references to this subject are in the "Diseased
Tree Disposal Problems in Orono" .
An important point in the proposed contract is
that after dropping, cutting and chipping the
trees, the resident is to be billed by the tree
firr.m.
Orono Rebate Program
In 1976 and 1977, the City of Orono rebated $25
per diseased elm tree that was removed within the
specified notice period of 20 days. The principle
restriction was that this rebate applied only to
lot sizes less than 1/2 acre in size, within
the control area.
Most persons that were given removal notice asked
of a rebate, and when told that such applied only
to 1/2 acre or less lot, expressed dissatisfaction
unless their lot was of that size. Based upon such
cor.mment, I would suggest that such a rebate be
rerloved completely in 1979 and forthcoming years.
I would favor other means of assisting the homeowners
in the reduction of the cost of tree removals and
disposal.
State Rebate Program '
In 1976, the Minnesota Department of Agriculture
received legislated funds �to assist cor.ununity action
against Dutch elm disease, and proposed a 45o rebate
to participating cities. This was 45% of the amount
expended by each city on this disease. Based on
actual City participation, the amount was realigned
at 37$ for 1977. In 1978, it was further reduced
to 28�. 1979 is an unknown, an3 it �s p��ssibl�

(CSP) for the City of Orono.
_ The P7etropolitan Council in its review of your interim CSP has
requested that the following information be obtained to allow
them to complete their review.
1 ) Portions of Orono are serviced through inter-community
sanitary sewer connections. Therefore, Orono, in its
interim CSP should indicate their present and future �
(3 years) inter-city connections. Problems areas and
proposed solutions should also be included. Such information
could involve further investigation in our "Alternative
Waste Management Study."
2) Orono, in its interim CSP, should include a time schedule
to the Orono-Long Lake Interceptor. This time schedule
should include a proj ect for service to the Hackberry Hills
Area which as per your inter-community agreement is to be
disconnected from the Long Lake system with the completion
� of the Orono-Long Lake Interceptor.

Orono for the .Medina-Morningside subdivision� The Cities
of Medina, Long Lake, and Orono have held several meetings
to discuss this proposed new .i.nter-city connection to
Medina-Morningside and have. �greed to a basic understanding
of how such an inter-community agreement would be structured.
�As part of this inter-community agreement, Orono would receive
a permanent connection for Hackberry Aills through the City

the routing and proposed costs of the necessary by-pass
through the City of Long Lake to accomplish this proposed
inter-cornmunity sewer agreement. As soon as the details .
of this engineering report are completed, we will submit
them to you for your review and comments. .
T4e will be pleased to meet with you at your convenience to answer
any further questions you may have during the final review of our
Comprehensive Sewer Plan as submitted in October of 1976 and revised
,in April of 1977. At the present tir,ie, the City is engaged with
the process of "restating its Coriprehensive Land Use Plan and it is

Please accept this letter as our official response to the City of
Medina concerning Orono' s participation in resolving 2iedina-
Morningside .sewer problem. The City Councii at their June 15, 1978
; Council meeting authorized me to informyouu _that we will cooperate
' with you and your City Engineer in resolving these probleins
through one common pipe providing that sewer units and sewer.

A review of the Park Comrnission tour and inspection HIGHWOOD ACCESS
of the Highwood access led to the following �
resolution prepared by the Park Cor.unission, dated
August l, 1978, which states :
Resolved, that because, from a recreational point
of view, the Highwood access is not suitable
for any development, the Park Com�ission recommends
that, aside from a general cleanup, no funds be
expended for recreational development of the
property. i�otion passed.

resolution of the Park Commission concerning
the Highwood lake access, per the Park Comr,►ission

Councilmember P4assengale discussed the status WEST HENNEPIN
of the Laest Hennepin Assessment District commenting ASSESSMENT DISTRICT
that the representatives do have concerns with
the effectiveness of the District at this time,
considering that there appears to be some duplication
in record keeping and other functions that Hennepin
County is now doing.
Mayor Van Nest r.loved, Butler seconded, to request
Councilr.lember Massengale to contact Hennepin
County Assessor to request their reaction to the
District and the costs to contract with the
County to provide necessary appraisal and assessing
during the ensuing year. Motion, Ayes (5) - Nays (0) .
Dick Benson, City Administrator, informed the City POLICE BUDGET*
Council that because of overruns in the Police
Budget, we have taken steps to curtail costs that
would otherwise create deficits at the end of the
year. We have reduced the working hours of our
newest appointed patrolman, Mr. Bruce Anderson,
to 20 hours per week, effective ir.unediately. As
of January 1, 1979, he will continue at reduced
hours through February. On March l, 1979 , he
will go on a lay-off status. '
��Then Officer Emerson Dressel retires in 1979, he
will be activated if he is still available to
replace P�r. Dressel. This action is initiated (Continued)

to recover additional costs that our contractual POLICE BUDGET*
cities are not reimbursing to us. I am in the (Continued)

with a memo from Tom Kuehn, Finance Director,
dated August 29 , 1978, which states:
It is requested that a transfer of funds be
approved in the amount of $15,000 from the Liquor
Store Fund to the General Fund as per the 1978
Budget Revenue Source.
This will be the second of three transfers budgeted
to be made in 1978 and will bring the total amount
to $25, 000. An additional transfer of $10, 000 is
scheduled for December, 1978.

of $15, 000 from the Liquor Store Fund to the General

Director, dated August 29 , 1978, which states : Federal Revenue Funds
Enclosed for the P�ayor' s signature is the Statement
of Assurances for Entitlement Period '^en of
General Revenue Sharing Funds. This covers the .
period October l, 1978 , through September 30, 1979 .
The Statement of Assurances is sent to the City
annually and provides that certain conditions �
will be met with regard to use of the funds. The
funds are distributed after the end of each c�uarter.
For example, the payment for the quarter October l,
1978 to December 30, 1978, will be received in
early January, 1979 . For entitler.ment period ten
the City is to receive $33, 253.
