Boz 66 � Orono, MN 55356 Crystal Bay, MN 55323-0066 June 6, 2005 Forrest &Renee Burke 380 Leaf Street Long Lake,MN 55356 RE: Lighting Violation @ 380 Leaf Street Dear Mr. and Mrs. Burke: The City of Orono contacted you with letters dated October 1, 2004 and December 6, 2004 regarding a lighting violation at your property (previous letters are attached). The City of Orono continues to receive complaints regarding the light fixtures affixed to the entrance monuments located on your property. City Code Section 78-1573 states the following: "Any use requiring c�n operation producing an intense heat or light transmission shall be performed with tlze necessary shielding to prevent such heat or light from being c�etectable at the lot line of the site on which the use is located. Lighting in all instances shall be diffused or directed away from R districts and public streets. " City policy regarding this regulation is that the source of the light, or the filament, must not be seen by the naked eye. Subsequent contact with you following the October l, 2004 and December 6, 2004 letters led to the understanding that lower wattage bulbs and opaque glass would be installed in an effort to decrease the illumination and sight of the filament at the lot line and over the lot line. An inspection was conducted today, June 6, 2005 which revealed that those efforts have not been seen. While recognizing that you feel there is a safety issue with cars mistaking the private drive as a street, and drive all the way to your front door, staff feels the high wattage lights may be contributing to the unnecessary traffic. Staff would like to offer the following suggestions in an effort to help eliminate or reduce the amount of unnecessary traffic: • Install secured gates between your entrance monuments (building permit is required). • Install formal street signs indicating "No Outlet" and/or "Private Drive" at the Bayside Road/Leaf Street entrance of the private drive. Please take the necessary steps in order to comply with Section 78-1573 of the Zoning Ordinance. To be in compliance, please make one or more of the following necessary changes to the fixtures: ■ Install opaque glass either to the fixtures or the bulbs themselves ■ Aim or shield the light downwards � ■ Decrease the wattage of the bulbs An inspection will be conducted on October 11, 2004 to determine whether the lighting complies with Section 78-1573.
