Alan Olson, City Planner, entered into the SUBDIVISION record the following information concerning 3201 Navarre Lane a subdivision for Crosstown Properties , 3201 #266 • Navarre Lane, dated January 23, 1978 , which Crosstown Properties states : The City Council approved final plat per the Planning Comr.►ission recor:unendations, plus required title opinion and a developers' agreement, all subject to resolution of approval at the next meeting. Staff = February 9, 1978 - 12 : 00 Pdoon Have not yet received developers ' agreement, plats, revised easements or assessment waiver. As of February 6 in the afternoon, received sketches of road impr_ovements and sewer/water lines which should be approved by City Engineer prior to developers ' agreement or final approval. Motion, Ayes (3) - Nays (0) . Mr. Alan Olson, City Planner, entered into the SUBDIVISION record the following infornation concerning a #309 subdivision request of Durwell Vetter, Bic� Island, B�g Island dated December 12, 1977, which states: Durwell Vetter P•4r. Clifford French was present to discuss the Hennepin County Park Reserve District acquisition plan for the whole of Big Island. The plan is not complete or approved by the District' s Board, as of yet, but Mr. French thought it would be early in January. • The acquisition sequence is planned to be as follows : l. Acquire the Gridley-Vetter property, the Veterans_ Carip and a connecting link between the Veterans' Camp and the existing Park holdings, all within a five-year phase out of the Camp. 2. Acquire the undeveloped properties (without structures) on the entire island. 3. Acquire the remaining developed properties over a total 30-50 year time period. The operating and recreational use plan is very prelir,iinary, but points toward maintaining the wildlife sanctuary and developing the Veterans ' Camp for day use. Discussion on the subdivision proposal centered on the fact that D•1r. Vetter has offered the land to two other parties who seem agreeable working , with the Park District, but those offers apparently expired before the application was ever made to the City. rhe r.latter was tabled until Piarch 13, 1978 for final Park Reserve District negotiation prior to the City action on the proposal. Psr. French advised that there has been no change or progress in the negotiations for park purchase of the Vetter property. He is to let staff kno��� of any progress by Piarch 9, 1978, for consideration by Council. Staff - P�Iarch 13, 1978 , Received call from Denny Kilbane (part owner) advising that the Park District is to proceed with the purchase - subdivision request may be withdrawn. Staff - March 16 , 1978 Clifford French visited me in the City offices and . informed me that the above is indeed the case, although no papers have been signed. Council P4eeting - March 16 , 1978 No one present for this item. Council heard the above information and tabled item until applicants ask to reopen the request. Applicant is so notified. Letter from Alan Olson to Mr. Durwell Vetter dated P�4arch 17, 1978, states: "This letter is to advise you that the Orono City Council has tabled this iteri until such time that you as the applicant should request reappearance to pursue the matter. The lack of appearance before the Council last evening tends to confirm the City's understanding that the subdivision rec�uest is to be withdrawn due to sale of the property to the Park Reserve District. " Council P4eeting - March 30 , 1978 P�r. Alan Olson also noted that P4r. Gridley has requested that this matter be postponed for 30 days. Mr. Dick Benson, City Administrator, noted that Mr. Greg P�Iack, Hennepin County Par]: Reserve District, had called today and stated that Mr. Vetter withdrew his application for a division and was going to sell to the Park District. Alan Olson, City Planner, entered into the SUBDIVISION record the following information concerning the #336 Forest Arms Subdivision for Carol Sue Dongoske, Forest Arms Subdivisi< dated P4arch 21, 1978, which states: Sue Dongoske Sue Dongoske has requested an appearance before the Council to discuss more items concerning the completion of this plat. On NoveMber l� , 1977, the Council referred the item to the Planning Cor.imission for recommendations concerning six items. On November 21, 1977, the Planning Corcunission requested additional information as listed in D1r. P�uhich' s letter of November 22 , 1977. No information was received by the City until March 6, 1978. Regarding r4s. Dongoske 's letter and the previous action, I recor.unend the following: l. Building perr.iits should not be issued until the road is installed and passible. If permits are considered, no permit should be issued until a developers ' agreement is completed and no occupancy should be allowed until the road is certified complete by the City Engineer. No permits should be issued until the Planning Commission has had a chance to review all � pertinent inforr.iation and make recomr.►endations to the Council as directed on November 14 , 1977. 2 . The Planning Comr.iission should be directed to ' cornplete their study of the matter, including the newly defined issue of boat dockage in the channel. The applicant should be reminded t�at reviews cannot be completed until all necessary information is supplied. In particular, the City has no road construction plans for the Engineer to review, has no dock plans or suggested layouts for the Planning Commission to review, has no title opinion or other evidence of any lot restrictions or covenants on the property and has only poor copies of the plat and DNR channel permit from which to work. 3. A developers ' agreement and bond should be required prior to any final approval. 4. Park dedication fees should be paid as should all delinquent taxes. (Continued) Planning Comr.lission - r4arch 27, 1978 Sue Dongoske and Robert Dongoske were both present. The Planning Commission suggested the applicant draft a developers ' agreement for review by City staff and Council. They also instructed the applicant prepare and submit plans and specifications on the proposed street. The Planning Cor*tr_mission suggested the Council review the proposal at the next meeting. They also recor.i- mended no building Permits be issued until developers ' agreement and street specifications and plans be approved and accepted by City staff and Council. _ The Planning Corcunission also requested more data and documentation before deterr.lining status of riparian rights and docks for lots located on previously dredged channel. Council Meeting - March 30, 1978 Robert & Sue Dongoske were present to discuss their division commenting that they will have their engineers complete a survey of the division, a developers ' agreement, review lot rearrangements, and will return _ to the Planning Commission to present further data� determining dock status and riparian rights for the lots in question. Mayor Van Nest requested staff to review park dedication fees and recomriendations on payment of these fees and also to review all other pertinent data. Mayor Van Nest moved, r�assengale, seconded, to table the request of the Forest Arms Subdivision for Carol Sue Dongoske until all data is complete. r4otion, Ayes (3) - Nays (0) . Dsassengale moved, Butler seconded, to refer to the Planning Commission a request for more data and documentation before determining status of riparian rights and docks for lots located on previously dredged channel in the Forest Lake Subdivision. Alan Olson, City Planner, entered into the record SdAPIAi]CES the following information concerning variances for 1565 Orchard Beach pl, 1565 Orchard Beach Place, Arthur Heintz dated P7arch 16 , #�345 1978, which states: Arthur Heintz The City Council adopted a resolution denying variances. and instructed staff to inspect and review garage as hazardous building/non-conforming use. Neighbor present said he would send a letter of cor►plaint with several neighborhood signatures. Staff - P�arch 24 , 1978 The City has received a petition from three neighbors complaining of the garage on this property and requesting City action to abate a nuisance. On March 22, 1978 , the Building & Zoning Department inspected the building and made findings consistent with the neighbors ' cor:unents. Staff will proceed with the . requirements of P�innesota Statutes 463. 15 and present inforr.lation for your attention at the next meeting. Council P4eeting - March 30 , 1978 I�Ir. Olson also comr_►ented that all data has not been reviewed. Mr. Heintz reviewed again the past history of the lot in question and displayed pictures of the lot where it was habited and contained a cabin and dock. Mr. Heintz requested permission to construct a dock on the property stating that he has had an opportunity to sell the property for approximately $7, 000. Mayor Van Nest commented that a dock is an accessory use structure; there is no home on the lot. We have to know when a dock, if any, was on the property. It appears that there are two__ issues here: 1. Hazardous building on lot (garage) 2. Dock - legal non-conforming use status. Mr. Heintz commented that rir. Hooper, 1530 Orchard Beach Place, has housed some of his personal material in the garage. Massengale moved, Butler seconded, to table the above requests until the next meeting to give staff time to review. Motion, Ayes (3) - Nays (0) . REGULAR MEETIPdG OF THE ORONO COUNCIL, PZARCH 30 , 1978 Page 7 Mr. Alan Olson, City Planner, entered into the record JOINT USE DOCK LICENS " the following inforrnation concerning a joint use Kelly Ave. Holding Co dock application for 1978 for the Kelly Avenue #350 Holding Company dated February 2, 1978, which states : Kelly Avenue Holding Company applied for r.►ultiple dock license for 1978 for mooring of six boats. This is for the purpose of providing dock space for each of the six dwelling units in the three duplexes on the Kelly Avenue Holding Cor.lpany property. Exhibit B (sketch) - notes indicate 400 ' shoreline Exhibit C (survey) - dir.lensions noted on survey line adjacent to shoreline appear to confirr.l the 400 ' shoreline. This property is zoned LR-1B (one acre) , r'Iinir.lum lot width and shoreline requirement is 140 ' . From the zoning standpoint, only two docks would be permitted. Sor.►e of the other agencies are currently considering regulating docks by a shoreline footage factor. If we should adopt this policy, the number of permitted slips would vary accordingly. Planning Commission - February 27, 1978 Mr. Lindsay, representing the developer, was present. The Zoning Administrator explained the proposal as � submitted. He expressed concern over the shoreline site plan indicating six individual docks. He felt this plan could provide mooring of 12 boats on only 400 ft. of shoreline. The shoreline and lot width requirement in this one acre zoning district is 140 ft. The total length of shoreline on the subject property lacks 20 ft. froM the requirement as regulated by our current policy. The Planning Cornr,lssion recommended approval of three docks for the mooring of six boats. One boat for each of the six dwelling units in the three duplexes on the parcel. Each of the three docks would be lir,iited to a width of 5' 6" and a length of 25 f_t. The Planning Cor.unission did not stipulate the distance between the docks gr specific location of the three docks. REGULAR P�EETING OF THE ORONO COUNCIL, P7ARCH 30, 1978 Page 8 Mr. Alan Olson, City Planner, entered into the re- SUBDIVISION cord the following information concerning the request 3024 Casco Point Road for a subdivision of Joseph Braun, 3024 Casco Point #002 Road, dated February 23, 1978, which states : Joseph Braun The applicant, Joseph Braun, and purchaser, Steve Plowman, were present, each represented by an attorney. Alan Olson read over chronology of events over the three years since the subdivision was first presented. Important points noted and acknowledged by the attorneys present were that the delays on this application were caused by the applicant' s failure to proceed and not by any action or lack of action by the City. On the contrary, the minutes of each City action clearly indicate the necessary steps for division completion and indeed, the applicants acknowledge that they still cannot agree among themselves over details of whom should proceed with the application. The Council reviewed the entire chain of events and took particular note of the Planning Cor.unission recor.u�endation made February 6 , 1978. The Council instructed staff to prepare a resolution setting forth findings of fact as to why the division should now be denied. Council D4eeting - March 30, 1978 Mayor Van Nest asked the applicant if all parties concerned had time to review the resolution drafted by staff to deny this plat. Mr. Bruce Malkerson, City Attorney, comr►ented that he had forwarded copies of this resolution to the applicants' attorneys. Mayor Van Nest moved, P4assengale seconded, to table the resolution to deny the plat of .7oseph Braun, 3024 Casco Point Road, until the next rleeting to allow the applicants to respond in writing to this proposed resolution. Alan Olson, City Planner, entered intd the r1AVARRE DRIVE-IN THF.ATRE record the following report concerning the Navarre Drive-In Theatre dated February 15 , 1978, cvhich states: The 1978 license application has been received for your review. The 1977 license was approved with conditions on P4arch 28, 1977. Complaints ensued after the theatre opening causing a special public hearing to be held May 24, 1977 and thereafter a special Council meeting held i4ay 26 , 1977 where Resolution #790 was adopted. An additional public hearing was held on June 13, 1977 when �esolution #790 �vas extended. A third public hearing was held October 24 , 1977 at the close of the season. Throughout these r.ieetings , many of the same corlplaints were heard regarding contxol of patrons an� control of access. At the last rteeting, the theatre owners indicated a possible chanqe in land use to a residential development. Pdo sp�cific action was directed at that time due to the possibility of the theatre not reopening. Since last fall, the City staff has had no further contact from the property owners regarding any change in land use. The theatre license application would tend to indicate that the other plans have been set aside. If the theatre is to be relicensed, the lists of previous requirements speak for themselves. The one physical requirement that has never been met . is that of fencing the perimeter for control both during the shows and when the area is closed. Documents in the record show that the City has been requesting a fence since at least 1970. . The Council may wish to hold a new public hearing, to i�sue the license for a temporary time to there- after review the operation or to withhold issuance until any required conditions might be accorlplished. Council r�eeting - February 23, 1978 Applicant has requested tabling until P�arch 16, 1978 because they could not attend this meeting. Council P'Ieeting - P�tarch 16, 1978 Staff reviewed application and actions of the past year. P4el Lebewitz was present for the applicant and he indicated that present intentions were to �pen the theatre, although development of the property aas not ruled out. Council tabled the iter,t after requesting Mr. Lebewit? to send a letter outlining his present intentions for the property and specifically addressing the fence issue. Council t�eeting - P4arch 30, 1978 Mr. Braverman, President of rlorthwest Ciner�la, commented that he is still attempting to find other uses for this property and did meet with Roger Laurence from Tonka Toys and they will be meeting with a developer in the near future to discuss the uses of the propertv; meanwhile, we will upgrade this property, trim, cleanup the area, etc. and we want to reopen the theatre in r.mid-April. idayor Van Nest commented that there are sufficient findings of facts before us that have come before us the past year to support the need for fencing. If the theatre is to be part of the comr►unity, then a fence is needed. If the property is to be developed for other purposes, then we should know it now. Councilmember I�assengale: We do not have other proposals befor.e us. We have no choice but to be concerned with a fence. There is testimony to support need for a fence. Bruce PZalkerson, City Attorney: Conditioned to grant- ing a license, Council can regulate type, height, and length of fence. P4r. Randy -Bloom, attorney representing Northwest Cinema, cor.unented that a temporary �ence would not be appropriate. At this time, we do not plan on operating the theatre long enough to justify a permanent fence. Mayor Van tdest: I think that the time has corle to make a decision on the fence.. �^7e have been talking about it for many years. Councilmember Butler: We need a fence now and we should act now. The application is for a f_ull year' s operation, let' s not wait until the public comes to us again demanding action. THEATR may apply in writing to the Village Clerk for a (Continued) �icense under this chapter, designating the place �rhere the business is to be carried on, a brief description of the theatre and the plan of operation and a plan of the same, with the names of the applicants signed thereto. The Village Clerk shall present such application to the Council and the Council shall at the same or any subsequent meeting pass upon such application and may in its discretion authorize the issuance of such license to the applicant, subject to such conditions as the Council rlay deem necessary and expedient for the protection of the health and general welfare of the Village. " Massengale moved, r4ayor Van Nest seconded, to direct staff to draft a resolution for the next meeting to include granting of license subject to: 1. The Licensee shall cor.►ply with P4innesota Statutes, S299H, et seq, relating to the State Fire Code and obtaining a permit therefor prior to operations in 1978. 2. The two off-duty officers shall be empowered and instructed by the Chief of Police to erect no parking signs during the hours of operation and to tag all violators of no parking signs on the streets to the rear of the theatre. 3. The names and addresses of the off-duty police officers and the manager of the theatre shall be presented to the Chief of Police and Licensee shall notify the Chief of Police of any changes thereto. Names and addresses of the fieldmen shall be given to the off-duty police officers. � • 4. One of the fieldr;ten shall patrol the rear lotline of the premises during and prior to the show in order to prevent trespassing and the entrance of indiviudals in areas other than through the authorized entrances to the premises. 5. Prior to any operations of the theatre in 1978, the Licensee shall erect and maintain in good repair at all times a permanent fence enclosing the north, east and west perimeter of the property to secure those property boundaries at all tirnes, and a fence or other acceptable means of securing the south or front property boundary during all times that the theatre is not in actual operation, mhe Licensee shall submit a plan of the required fencing for approval by the City staff and City Council and shall erect said fencing according to the approved plans. The fence will not add to diminution of value of surrounding properties but shall be esthetically pleasing to the general area. (Continued) REGULAR MEETING OF THE ORONO COUNCIL, r'iARCH 30 , 1978 Page 12 The fencing shall be erected by the Licensee and NAVARR� DRIVE-IN THEATRE inspected and approved by the City prior to the (Continued) effective issuance of the 1978 License by this - resolution. The opening of the theatre or any public showing prior to completion of the fencing and approval by the City shall be a violation of this resolution and a violation of Orono Municipal Code Chapter 61 which violation shall be prosecuted by the City Attorney. 6. The City staff is directed to conduct weekly inspections to insure compliance with the provi.sions of this resolution. 7. The City may impose any other supervisory and enforcement regulations as the City deems necessary from time to time to insure compliance of the - Licensee with the City codes and in crder to protect the health, safety and welfare of t�e Citizens of Orono. 8. Applicant to construct fence according to submitted and appr_oved design standards , fence to preclude ingress and egress on three sides all year and perhaps on County Road #15 side unless applicant can control ingress and egress on that County Road #15 frontag�. Fence should be decorative, 75� . opaque and esthetically acceptahle and high enough to prevent passage. Discussion followed by the applicant on how to design fence, etc. Mayor Van Nest coru;►ented that the applicant should discuss and submit to City staff a plan but if we are to design a fence tonight on the Council table my � cor.unents are a 7-8 foot high decorative fence on all four sides. The City Council directed applicant to discuss this matter with staff and to prepare for Council action on this matter at our April 13, 1978 Council meeting. The issue is whether or not the City would consider zezoning a small portion of the adjacent residential are� to facilit.ate dock rearrangement in lieu of dredging or .whether dredging w:�ll be permitted at all regardless of resulting dock layout. The prc>���sed layout is similar to one submitted in a letter from Mr. McC1E�ary's attorney, received December 22 , 1977. The North Star r�Zarina permit granted last year was approved because they followed a r.master plan for maintenance dredging. They had received a permit years ago from the DNR to dredge and last years' permit was to allow them to maintenance dredge the sarie area. Your request is new. You do have alternatives to dredging such as use of dry land slips, or rezoning. I do not believe that harbor dredging should be allowed. James r4cCleary: I have not studied the alternatives to know what impact no dredging would do, i�Zy docks are substandard and I need to have ther.l replaced. Mayor Van Nest: 66 slips are not a permitted use in the B-2 zone. They are non-conforming uses; additional slips, if any, should be on the shore. Massengale moved, i�iayor Van I1est seconded, to direct staff to send a letter to the Department of Natural Resources objecting to rezoning the area. 2iotion, Ayes (3) - Nays (0) . ..ayor Van Nest also stated that on-land storage is more cost effective and environmentally sound and according to all records, the Stubbs Bay r�iarina is entitled to only 66 slips. Box G6 Crystal Bay, Minnesota 55323 Re : Ring Route Alternate �aluation Our File No. 139 Dear Mayor and Council: Pursuant to a request by the City Council, we have reviewed the proposed alignment of the Rino Route, outlined in the Preliminary Engineering Re- port dated October, 1977, and an alternate alignment along To���n Line Road suggested by a citizens' group. It is our conclusion that the original � alignn,ent proposed in the Preliminary Engineering Report should be selected by the City of Orono. Following is a general discussion of our analysis. We have examined, in a general way, the history involving the City's par- ticipation in the evaluation of Hennepin County Road 15 along the shores of Lake Minnetonka. The adverse affects of widening Co.Rd. 15 to a four lane arterial highway have been �oell documented. The traffic volume on Co.Rd. 15 is at or near the capacity of the existing roadway. The only viable alter- native to enlarging Co.Rd. 15 is to provide an adequate, usable alternate route to remove some of the total traffic from Co.Rd. 15. - The predominate traffic mwement is oriented to the east, towards the down- - town metropolitan area. Based on the configuration of Lake Minnetonka, the only feasible alternative to Co.Rd. i5 is a route that goes north of the Lake to T.H. 12 and then east. We concur with this concept and accept it as a given factor in the analysis of the proposed Ring Route alignment. The Ring Route, as proposed in the Preliminary Engineering Report, is 4,628 feet long (.88 miles) between Co.Rd. 19 and Co.Rd. 6 (Watertown Road) . Ttie estimated cost is approximately $505,000. The right-of-way requirements have been estiriated at 7.3 acres. The construction mentioned above is considered the first phase of a total improvement of the Ring Route concept. Additional work is contemplated by Hennepin County and by the State of Minnesota in order to complete the total route. The alternate aligrunent prepared by a citizen's group in the area is due north along the west municipal boundary, utilizing Town Line Road between Co.Rd. 6 and T.H. 12. No detailed engineering studies have been made of the design of the alternate route so estunated construction costs are not available. Assuming construction of the alternate route was similar to the proposed route, a rough cost estimate based on proportional length ��ould be about $570,000, an increase of about 13%. The proposed roate is designated as a 2•iunicipal State Aid (I•ISA) street. 'I'his designation �aould have to be reassigned to the alternate route for construction. The increase in length, 0.11 miles, is more than the 0.07 miles the City has available to designate for MSA streets, It would be necessary to revoke some other I�fSA designation on an existing street in order to do this. Town Line Road bet�.reen Co.Rd. 6 and T.H. 12 is a narrow gravel roadway, de- ficient in width, cross-section and grade. In order for the ring route con- cept to become worlcable, Town Line Road would have to be reconstructed. The _ length is approximately 3,750 feet (.71 miles) . Ass�ing si.milar construc- tion to the proposed ring route, a rough estimate of cost based on proportional len�th y�ould be about $410,000. In addition, there is a very narrow bridge at the railroad tracks south of T.H. 12 which would have to be replaced. This bridge would cost in excess of $300,000 based on today's prices.. In order for the ring route concept to work, for it to draw off traffic from Co.Rd. 15; a continuous route on an improved paved roadway is necessary. Town Line Road lies within three different cammunities. The City of Orono does not have the financial capability of constructing the entire route from Co.Rd. 19 to T.H. 12. �This cost would be in the magnitude of $1,280,000. Hennepin County has indicated that they are not able to construct this facility �aithin the foreseeable 'f�ture. We have attempted to reduce the various elements of comparispn between the proposed route and the alternate route to a point system, which is outlined on the attached sheet. It must be pointed out that this quantitative number system is very subjective. The danger in this kind of approach is that the various categories do not necessarily carry the same weight, although they have been given the same number rating. For example, if the "construction" and "User Factors" items are twice as important as the others, the "scores" difference �aould change from 55-43 to 75-53 in favor of the proposed route. It is unclear to me whether or not the central system is operated by a homeowners association or whether the system is dedicated to the City. There are several questions that this idea raises as to whether or not fror.t a legal standpoint, a City would be within its rights to require the installation of a central water system by the developer in an area where City water is not generally provided and from an engineering standpoint would such a requirement be desirable. I understand that some cities that use P�1SA funds for the construction of new roads or the major improvement of existing roads also assess the road improvement costs to any property owners that have lateral benefits to those roads. This apparently allows the City to generate cash that may be used for some other purpose from _ its citizens for projects that are paid for by riSA funds. From a legal standpoint, is this permissible under present State Statutes and how could it apply to Orono in the future use of its r1SA funds? Mr. Alan 01son, City �Planner, reviewed his memo concerning the above dated P�arch 21, 1978: l. Central Water Systems Advantages: Generally deeper well with more assured supplies; fire protection water would be available; provide distribution systems which could be incorporated into an eventual overall City system. Disadvantages : Ownership and maintenance responsibility arguments; likely City take- over and operation of disconnected, perhaps labor intensive systems; increased front-end costs for developer; likely to be inefficient for the small, scattered developments Orono sees and encourages. Recommendations : Should probably be considered for developments contiguous or close to the existing City system, or in areas where the City would likely install such a system, or for developments exceeding a minimur.l number of lots (say 20?) . 2. Owner Certification This is tentatively (and unsatisfactorily) done now with the layout of our current application forms. Subdividers do this at the end with the . title opinions. Orono will include in its interim Cor.lprehensive Sewer Plan the sewer service area set forth on Map #1 as ar,lended on March 16, 1978. r4ayor Van Nest requested Bruce Malkerson, City Attorney, to read a letter drafted by staff this afternoon which responds to the Metropolitan Council on our recent Meetings. Mr. Louis Oberhauser appeared before the City WAYZATA COUNTRY CLUB Council to discuss his letter to them requesting Boundary Changes boundary changes at Wayzata Country Club, dated February 17, 1978, which states: "I am enclosing a photostatic copy of a plat sheet setting forth an area which involves property owned by the Wayzata Country Club. The Wayzata Country Club would like to readjust the City boundaries between Orono and Wayzata so that the area lying west of the . east end of the tennis courts, and north of Highway 12, currently within the municipality of Wayzata would be included in the City boundaries of the City of Orono� and the area lying east of the tennis courts and drainage ditch and south of an east- west line running from the northwesterly corner of Lot 8, Block 1, Allo Rae Terrace would be included in the boundaries of the City of Wayzata. The reason for this request is that the Wayzata Country Club would like to be able to develop the property adjacent the 16th fairway. A portion of this property is in the City of Wayzata and a portion of this property is in the City of Orono. To develop this property, it will be necessary for us to obtain services such as sewer and water from the City of Wayzata, and also would require us to get the approval of both municipalities as to any developmental plan. Dick Benson, City Administrator, inforried the City WASTE«ATER MANAGEMENT Council that we are in receipt of a letter from PLAN - 208 John Boland, Metropolitan Council, dated March 3, 1978, which states: "Enclosed is a copy of a Sur.unary Report On Alternatives for 4�lastewater P4anagement. The document summarizes and discusses the concerns raised by the public and local officials at public meetings held during October, 1977, as part of the Council ' s 208 wastewater manac�er►ent planning program. . In addition, the report contains information about the assuriptions used to develop the alternatives, the Council' s responses to the issues raised and the alternatives selected for further study. The selected alternatives will now be the subject of further Council study, including economic irlpact, affect on the social and physical environ- ment and consistency with Council general policy. Work on this should be completed and made available for public review this spring.. The alternatives report is part of a Council planning effort to update its wastewater management plan. The end result will be the formulation of a new Wastewater r�anagement Policy Plan chapter of the Metropolitan Developrlent Guide, now scheduled for cor.lpletion in �Iovember of this year. The proposal was to remodel the store and rent the basement area now vacant and increase storage and selling space, which would allow us to increase sales and net profit. As of December 31, 1978 , $40, 000 is invested from the liquor fund, with $11, 000 cash on hand, and in light of a projected $70, 000 capital outlay cost and a $20, 000 inventory increase, it is obvious that we could not recover additional costs from the liquor fund itself and we would have to look elsewhere for additional funds. �ae also have to keep in mind that we are budgeting through our revenue forecasts $35, 000 per year for transfers to the general fund. Needless to say, �ahen reviewing operation projections, the liquor fund will not have the increase in net income needed for handling the increased cost in inventories, repayment of loans (principal and interest) and continue to transfer funds to the general fund. There is no question that the long-range net profit projection would have to increase substantially before an expansion in the liquor operation could be considered a sound business investment. Again, we held several r�eetings with staff and Dick Keaveny, owner of the present building. ���e adjusted our projected costs, or projected sales and requested the owner to pay for all structural costs to be quoted as a r.►onthly rent based upon a five-year lease. We would still have to assume some remodeling costs for the retail and storage . areas. After reviewing this arrangerient, the revised yearly costs adjusted downward approximately $2, 500 but the net profit did not change appreciatively to cause any optomistic outlook on increasing our present revenues. In view of the declining trend in net profits in the liquor business and the obvious cash require- ment to put this package together, while considering available floor space, parking space, traffic patterns, and the cost of money today, I recommend we not expand our liquor operation at this tir�e and continue to rionitor the operation as it exists in its present location. Dick Benson, City Administrator, informed the LONG LAKE WATER RATES City Council that on Februanl 16 , 1978, the Long La}:e City Council held a meeting to discuss proposed changes in the water and sewer service agreer�ent with Long Lake and the City of Orono. The Council did agree to gropose that the City of Orono maintain, operate, and assume utility costs to operate the pumpinc� station located in Long Lake. This issue did cor.le to us in 1968, after the station was put into servi�ce and a dispute follo�ved on who was to assurie these obligations, which was not resolved until 1971, when at that tir.►e, the City of Long Lake did assume the responsibliity of paying all utility and maintenance costs to this date. I have reviewed the files on this matter and have asked Bruce Malkerson to review the data with Mr. G. Marc Whitehead, who was the City attorney at that time. As can be interpreted from the February 16, 1978 rtinutes, this is all leading up to granting a reduction in water rates to our industrial and school area, which we apparently will not be - addressing ourselves to at this time_ With Council concurrence on this matter, I �vill state our position to the City of Long Lake and request a meeting with them if they so choose. I would like to hire John Thompson to replace him. His application has been approved by the Police Department, and he is well qualified to work in our store. Due to his experience and qualifications, I would like to have him start at $3. 00 per hour, e�fective March 27, 1978.
