Regular P7eeting of the Orono Council, 7: 00 P.Z�2.
February 9 , 1978 .
The Orono CounCil met on the above date with the
following mer.ibers present: Dsayor Van Nest, �Council-
merlbers Butler and Pesek. Absent: Councilmembers
t�iassengale and Paurus. Also present: Assistant
Building & Zoning Administrator Olson, City Attorney
2lalkerson, and City Engineer Olson. Absent: City
Administrator Benson.
t4ayor Van Nest announced that this was the time and PUBLIC HEARING
place for the adjourned public hearing concerning On-Site Disposal
the proposed On-Site Disposal Ordinance.
Mayor Van Nest explained the proposed ordinance
and the reasons for the need for it. IIe stated
that t�ere would be an annual inspection charge
of all spetic systems and recommendations for
repair, if necessary.
P-Zr. Ron Miller, 270 Willow Drive North, stated
his concerns regarding paying a fee for on-site
disposal inspections. I�e commented that his
drainfield is basically a lifetime system and
did not feel he should pay for an annual inspection.
He further commented that he approved the concept
of the ordinance but objected to the fee.
Af.ter all persons present were afforded an opportunity
to be heard, the public hearing was closed at 7:25 P.M.

On-Site Disposal Ordinance until after staff review

tir. Ellis stated his concern about whether or not
the Council did approve riprap for the Ellis,
DeGregory, and Crist properties.

Council did approve lagoon dredging on riay 9, 1977
and Plan 3 for the Association on June 13, 1977,
which included riprap for the Ellis and Degregory
properties and sea�vall for the other properties ,
with no changes to be done to the west wall; however,
there were conditions to be met but several of
ther.► have not been cor.ipleted.

Alan Olson: Plothing from the Corps of Enc�ineers
except a notice that they were going to review the
application. No copy of permit received.
A discussion followed as to what the Homeowners
Association wanted and what the private homeowner
wanted.
P�tayor Van Nest stated that all dealings, permits
and applications were with the Homeowners Association.
Now, as individuals, you are coming with a request •
to do something that the Homeowners Association
� is objecting too. Are we dealing with indivuduals
or the Homeowners Association?

now, te�hnically, the individuals should file
separate applications.

separate applications, show plans to be reviewed _
by the City Engineer and obtain a legal opinion .

matter until property owners submit individual
proposals for which the City will waive the fee.
If the Association wishes to contest the right of
individuals to make separate applications, the
Association must present to the Council, before
the next meeting, legal evidence of Association

Administrator, informed the City Council that
P1Ir. James P'IcCleary, Stubbs Bay P4arina, is
questioning the previous approval of his new
marina building regarding the required floor
elevation and flood plain regulations. He had
presented a topographical survey which was
reviewed by the City Engineer as noted in the
attached letter.

Administrator, informed the City Council 66 � Tonkawa Road
of a request for an assessment waiver requested
by Donald Lindall, 666 Tonkawa Road, dated
January 17, 1978, which states :
P�Zr. Lindall owns adjacent lots at 666 & 660
Tonkawa Road. He has requested the Council to
waive the sewer unit assessment on Parcel 1200
(660 Tonkawa Road) . Psr. Olson stated that the
_ Council could give him a conceptual sense, but
that several problems prevent actual consideration
at this time.
1. Both lots contain an existing dwelling; the

Building elevation relative to Flood Plain Zoning

Dear Mr. Munich: -

We have reviewed the topographic survey submitted by Mr. McCleary which indicates
the general location of a proposed building to be constructed on his property
adjacent to Co. Rd. 84 at the north end of Stubbs Bay. The survey indicates
that the elevation of the property ranges from 930 near the shore line to 934 at
the extreme southeast corner. The elevation at the proposed building location
ranges from approximately 931.5 to approximately 932.5 according to the survey.
Mr. John Holmquist of Hickok and Associates indicated to us that the elevation
of the projected 100 year regional flood on Lake Minnetonka is 931.5 as estab-
lished by the Minnehaha Creek Watershed District. The District further recou�ends
that the lowest occupied floor level be set not lower than 3 feet above the
regional flood level.
Mr. Len Krammer of Barr Engineering indicated to us that the 100 year flood level
for Lake Mianetonka is 930.9, established by the flood insurance studies their
firm completed for Federal Government. Mr. Kra�ner reco�ended a minimum of
1 foot above the 100 year flood elevation for the lowest occupied level as indi-
cated by State law.
The Barr elevation of 930.9 is apparently based on a historical statistical
analysis of rainfall within the existing Lake Minnetonka basin, while the Hickok
elevation of 931.5 appears to be a maximum District �ater management elevation.
We recommend that the lowest occupied level of the building proposed by Mr.
McCleary be set not lower than 932.5, or one foot above the Minnehaha Creek Water-
shed District max imum water management elevation.
It does not appear that the level of Lake Minnetonka is subject to r,apid and wide
fluctuation in water elevation and the one foot safety factor, in our opinion, is
adequate for the 100 year flood occurrence. We are unfamiliar with any of the
details of the pending flood plain zoning regulations relative to Lake Minnetonka
and therefore cannot comment on them at this time.

2. The lots are not combined and cannot be
combined until PZr. Lindall clears the following:
a. Parcel 1610 (homestead) is being purchased
on a contract and is registered to a F. H.
Irrien as fee owner.
b. Parcel 1610 has delinquent 1976 taxes.
c. Parcel 1200 (cabin) is registered to
Robert Vick with no evidence of ownership
by 2'ir. Lindall.
3. Mr. Lindall states that he wants to expand his
homestead onto the adjacent lot and use the
existing cabin as an accessory structure.
The cabin has not been connected to the sewer.
The Assessor' s records from a November, 1977 _
visit indicate an apparent conversion underway
to make a porch into living quarters. No
permit has been requested. The cabin is
20' X 21' with a 1977 market value of $999. 00.
Suramary: Combination of the lots and use for one
dwelling is consistent wi�.h the zoning district
intent and would improve the existing situation.
The problems are technical in clearing the way
for combination and in the use of the existing
cabin. Perhaps Council should require prior
rer_loval of the cabin to eliminate future problems.

A letter was received from Marcy Shapiro, Director W.H.H.S.P.B. FUNDING
of the j9est Hennepin Human Services Planning Board
concerning funding of community planning boards,
which states:
On January 23rd, the Executive Cor.unittees of North-
west Hennepin Human Services Council, South Iiennepin
Human Services Council and West Hennepin Human
Services Planning Board met to discuss the three area
meetings that were held with the County Commissioners
regarding �he proposed County Board resolution concerning
the funding of community planning boards.

The Joint Executive Committees felt that it was WHHSPB FUNDING
the general opinion in all three. areas that a
similar resolution should be introduced in all
the councils of the member municipalities and
that this resolution take the form of the enclosed
resolution.
It was felt that this joint effort of a large number
of municipalities passing a similar resolution would
have the strongest impact on the County IIoard.
The content of the enclosed resolution was developed
out of the opinions expressed by municipal officials
in three area meetings with the Corunissioners.
We would appreciate this resolution being introduced
to your council for discussion. Tracy Whitehead,
Chairperson of the WHHS Board, your municipal
representatives to the WHHS Board, the L�TFiHS staff,
or I can provide information about the background
on this issue, action that has been taken, this
resolution and future action anticipated.
We would also appreciate it if you could send copies
to all of the County Commissioners, if your Council
passes this resolution.

need for the resolution.

�872, a resolution urging funding by the County WHHSPB Funding

Administrator, informed the City Council that 3655 Togo Road
Kingdom Hall of Jehovah' s Witnesses, 3655 Togo
Road�are requesting a temporary trailer permit.
These permits have been approved by Council on
previous occasions. This application is late in
that the requested time period is from February 5
through February 12, 1978.

Administrator, informed the City Council that School District #278
- Pds. Terry Lambert, a school teaCher representing
the Orono School District #278, is requesting
some duck pond dredging on the school property
near the east shoreline of Lake Classen.
She explained to me that time is of great
importance because cost estimates were made on
condition the project was started before
February 13, 1978. She presented two exhibits
for review of the proposal.
�xhibit A indicates the approximate location of
the projected duck pond on an aerial map of the
subject area. Each pond would have a radius of
60 ' for an area of approximately 11, 300 sq. ft.
or a total pond area of approximately 22,600 sq.
ft. for both ponds. Although she did not tell
ne the exact distance from shoreline, scale -
dimensions seem to indicate the ponds to be
approxiraately 250 to 350 feet from the shoreline
of Lake Classen. The projected location would
be within the wetlands surrounding Lake Classen.
Exhibit B is .a plan of proposed project upon
completion. I have transposed location of ponds
fron enclosed aerial map which indicates pond
location as projected by applicant.
The purpose of these ponds is to provide a near-
by location for nature and wildlife study of the
Orono School students.
PZs. Terry Lambert was present and explained the
project to the City Council. The pond would be -
a nesting place for Canadian geese and other
wildlife.
Piayor Van Nest explained the City' s position on
the 6�letlands Ordinance No_ 125 , that this project
would require a variance, and the Cit� does not
grant any variances to this ordinance. In order
to grant a variance, it must be in the public
interest such as educational purposes for the �
students.
Pesek moved, Butler seconded, to approve a variance
to the Wetlands Ordinance No. 125 because it is in
the public' s interest for educational purposes,
subject to necessa�y permits fron other ac-,rencies.

was present concerning the plans, specifications,
agreement, and resolution for the Tanager Lake
Bridge Project.
i3r. Jim Olson, City Engineer, stated that he has
no objections to the Plans and specifications and
restated the need for debris reMoval in the channel
and that the project be done in the same construction
year as the Orono-Long Lake interceptor. •
Mayor Van Nest moved, Pesek seconded, to adopt RESOLUTION #873
Resolution #873, a resolution approving plans and Tanager Lake Bridge
specifications for the Tanager Lake Bridge Project,
ar�d to authorize the P�iayor and City Adninistrator to
sign-off all other necessary documents for the
pro�ect, conditioned on construction being done in
the same construction year as the Orono-Long Lake

also presented plans, specifications and resolution
for the repair and deck overlay for the Noerenberg
Bridge Project.

debris and traffic control.

24ayor Van Nest explained the route for the proposed RING ROUTE
ring route. The City Engineer will present new maps
in the near future.
i4rs. Sara Wyatt was present concerning the ring
route. She commented that the survey she was
making was not completed; that she had contacted
people along Townline Road, Chippewa Lane, Orchard
Park Road and Sixth Avenue North, and would like
to return with her survey when completed.
idrs. Wyatt, 5680 Echo Road, Excelsior, asked to be
notified when the ring route will be on the agenda.

P4ayor Van Nest reported on a meeting he attended I-394 REPORT
concerning I-394. Studies are being done now but
:hat construction is possibly ten years away. I-394
�aill come from downtown tZinneapolis and end at I-494
which will make a freeway into downtown P'Iinneapolis
for Orono residents. The State will upgrade Highway
#12 west of I-494 to the Wayzata bypass. No further
construction is contemplated to upgrade Highway #12
west to a four-lane but rather Highway #212 will be
the major four-lane highway to the west.
P•iayor Van Nest reported on a meeting with. the t4etro- ORONO-LONG LAKE
politan Waste Control Commission that was called in INTERCEPTOR
answer to his letter that we do not agree with what
they are saying to us concerning the sewer line for
the Orono-Long LaYe interceptor. The 2SF7CC is nlanning
a greater capacity and installing ii�s in excess of
Orono's needs. Another agreement had been reached .
concerning the PSUSA line going through Orono. A new
map was presented to the City Council showing sewer
service areas 7 & fi and the P�IUSA line.
t'tayor Van Nest also stated that he has sent letters
to Karl Burandt, John Boland, Bob P4azanec, Bernard
Harrington, and Representative Searles concerning
the Orono-Long Lake interceptor.

A memo from John Gerhardson, Public Works Coordinator, FiACKBERRY PARK LIGHT
was presented concerning lighting at Hackberry Park, �
dated January 11, 1978, which states :
Recently, the Park Commission requested lighting
in Hackberry Park to discourage vandalism to the
newly installed playground equipment.
Lee Tomlinson, Park Commission Chairman, has
checked with NSP in regard to one 175-watt light
for f�ackebrry Park at $6. 70 per month.
On Thursday, January 5, 1978 , I met with Don
Flewelling, of NSP, at Hackberry Park. P�Ir. Flewlling
stated that if a larger light were used and placed
properly, it could serve a double purpose: a) light
the playground area, and b) light the intersection
of 2•saple Lane and Hackberry Hill Road.
The additional cost would be $0. 90 per month or
$10. 80 per year. (Continued)

Over the years, I have talked to several people in HACKBERRY PARK LIGHT
the Iiackberry area, and they have indicated they
would like some street lighting. Therefore, it is
r1y recommendation to install a 250-watt light at
$7. 65 per month ($91. 80 per year) at the inter-
section of Hackberry Hill and Maple Lane.
i'ir. Flewelling stated it usually takes about three
weeks for installation after the order is received.

A memo from John Gerhardson, Public 69orks Coordinator, BID AWARD - 1978
was presented to the City Council concerning the Street Material &
bids for 1978 street material and equipment, dated Equipment
January 17, 1978, which states: .
The City of Orono advertised for two successive
weeks for street materials and equipment rental
bids with bid opening at 10:00 A.Pi. , Friday,
January 13, 1978. ' �
The enclosed tabulation contains a cor.iplete accounting
of all bids received and the recommended low bidders
and alternates.
The accepted low bids for materials are determined
by availability and location of nlaterials. Traveling
distance to a supplier is a considered cost factor
when determining a low bid.
When renting equipment with an operator, we are
guided by the type, size of equipr_ment and hourly
rate. .
It is possible to award the low bid to more than
one contractor when considering materials and equipment.
In order to stimulate enthusiasm for the following �
year' s work, we make sure to divide the work accord-
ingly among these low bidders.
In the event the low bidder is not available, the
City reserves the right to purchase from the next
alternate.
I recommend that the City Council accepts and awards
the tabulation of bidders as presented for the
calendar year 1978.

Traffic Engineer, dated January . 24, 1978, which County Road #151
states:
Enclosed are the results of speed surveys on

The enclosed material contains a complete tabulation
of all City streets in reference to cost accounting
of all extraordinary maintenance which includes
expenditures for blacktop paving, street gravel and
rock, dust control, sealing programs and the distri-
bution of NiSA Funds.
Funds expended for routine maintenance such as
blacktop patching, ice and snow control (sand &
salt) , culverts, signs and drainage control are
not included in this report.
This type of accounting, which was requested by
the City Council in previous years, is very r.iean-
ingful when documenting expenditure of funds that
are budgeted for yearly maintenance costs.
This report, and our yearly traffic count analysis,
shows us where and why street riaintenance costs are
escalating each year. Fire lanes, park drives and
beach areas are not included in this document.

Hansen was presented to the City Council and states:
On Pdovember 14, 1977, Psr. Steven f�ansen was employed
by the City of Orono' s Public Works Department as
a light equipment onerator at a rate of $5. 75 per hour.
Steve' s performance and attitude have been excellent
in the past three months. In January 1978 , Steve
did not recieve a salary increase because of his
late start.
Therefore, it is my recommendation to increase his
salary from $5. 75 per hour to $6. 25 per hour,
effective February 20, 1978.
I will review his progress and salary again at six
months.

The following memo from Thomas Kuehn, Finance Director, REFUND
to the City Council concerning a refund for a demolished Kenneth Rud
structure at 4735 Tonka View Lane, states: 4735 Tonka View Lane
In P'iarch, 1977, P�Lr. Y.enneth Rud applied for a buiding
perr.iit (#3484) for the purpose of demolition of all •
structures located at 4735 Tonka View Lane.
2ir. Rud was billed for sewer service for the periods
ended June 30, 1977, September 30, 1977, and December 31,
1977. The June 30 and September 3_0 billings were
paid but after he received the billing dated December 31,
he wrote to the City to inquire as to the statns of
the billing. In his letter, he states that the
structures were removed as of Psay l, 1977. An inspection
of the above mentioned address was perforr,led on February l,
19�78, and the premises were found to be as stated.
In view of the foregoing, it is recomrtended that P�r. Rud
be refunded the amounts paid on the second. and third
quarter billings and a credit be applied to his fourth
quarter bulling. The amounts paid totaled $45. 00
and the credit to be applied is $22. 75.

Coriprehensive Planning Grant Agreement was

Attached please find a copy of the "Grant
Agreement Between the P�Ietropolitan Council and the
City of Orono" . The application for the grant
award was submitted previously by the City of
Orono and was approved by the P4etropolitan
Council on December 8, 1977._ Before the grant may
be used, the agreement must be executed. Also,
as part of the agreement, the City must submit
Appendix B, Funded Portion of the Work Program.
Appendix B has been completed by the staff and is
also attached.
