SPECIAL CONDITIONS & HOLD HARMLESS AGREEMENT
General Instructions:
1. You may be required to obtain other permits, i.e.: well abandonment, sewer, etc.
2. Work must not begin unless the permit card is available on the job site.
3. A 24-48 hour notice is required for afl inspections. Call (952)249-4600.
4. Sewer must be discontinued at the City service by qualified contractor before demo permit is issued.

In return for issuance of said Demolition Permit, the undersigned owner hereby agrees to:
1. Submit a survey, aerial photo or sketch showing all structures on the property. Note which structur�s are
to be demolished.
2. Submit a survey, aerial photo or sketch showing proposed erosion control measures in accordance with
Chapter 79, Construction Site Runoff Control.
3. Submit a copy of permit approval from the Minnehaha Creek Watershed District (MCWD). The City will
not issue a demolition permit without a copy of the permit(s) from the MCWD or documentation stating
permit(s) are not required.

4. Submit a $2,500 escrow and an escrow agreement signed by the property owner(copy attached).
5. Keep all structure(s) enclosed and/or secured until such time as demolition is complete. •
6. Keep all demolition debris off adjoining property and/or the public rights-of way unless specific prior
approval is obtained in writing for temporary use thereof.
7. Completely remove foundation(s) from the ground.
8. Completely dispose of ali demolition debris off site in accordance with all applicable PCA requirements.
9. Abandon water wells in accordance with State Health Department regulations.
10. Call for an inspection when all debris has been removed, before backfilling.
11. Within 5 working days of superstructure removal, a final inspection shall be requested. The site shall be
left clean and clear of all debris, with any excavation filled with earth level with the adjacent ground
elevation (except when such excavation is to be used as part of a new building and such new building is
actually under construction).
12. Abandon septic systems per Minnesota Rules Chapter 7080. All septic tanks must be pumped, crushed
and filled with native soils. An inspection is required after the tanks are pumped and before the tanks are
crushed and filled.
13. The undersigned owner shali and hereby does indemnify and hold harmless the City of Orono, its agents,
employees and assigns from and against all claims, damages, losses or expenses, including attorney
fees, against the City, its agents, employees and assigns arising out of or resulting from the demolition
described herein as performed by the property owner, his employees, agents, subcontractors or assigns.

Some additional follow up relating to the demolition permit for 1515 Green Trees:
1. Residential Dock.The Code dces not permit an accessory structure on a properly without a principal structure.
Once the home is removed the accessory dock may not be re-installed at 1515 Green Trees Road. There is no
way around this requirement. I would suggest that Barbara Burwell propose an amendment to the City's Code
that would permit the owner of one or more lakeshore properties to place residential docks, according to the
LMCD regulations, on the lakeshore of a vacant property so long as there is a principal structure on the adjacent
property in common ownership. I've attached the application for a Ciry Code amendment; the fee for this
�
application is $700. Part of the application requirements would be that you/the applicant provide some research
(from ather Cities) and potential code language for a starting off point. We can discuss this further, but I know
•Barbara expressed concern about the timing of the demolition and the need to re-install the dock for the season
so I wanted to include it in this email.
2. (Potential) Indian Burial Sites. Because there are known Indian burial sites within some of the adjacent
Green Trees Road properties, we contacted the MN State Archaeologist's office for their input on this permit
request to inquire about known burial sites on or near 1515 Green Trees. We received a response from Amanda
Gronhovd in the State ArcheologisYs office. She indicated that she spoke with the Minnesota Indian Affairs
Council (MIAC) about the demolition permit request for 1515 Green Trees Road. Because this site is adjacent to a
recorded Indian cemetery site they felt that our issuance of the demo permit would be acceptable. However they
recommend that the demo and earthmoving be monitored by them in case burials are discovered/present. She
indicated that between the State Archeologists'o�ce and the MIAC, they should be able to do the monitoring at
no cost to the landowner so long as they are contacted early and include them in planning the schedule. You
should Amanda now to determine how much advance notice they will need and then again as soon as you have
confirmed dates for demolition.

I talked to the Minnesota Indian Affairs Council about the demo permit request for 1515 Green Trees Road,since this is
adjacent to a recorded Indian cemetery site. Based on our discussion,we feel the demo permit is fine, however we
recommend that the demo and earthmoving be monitored in case burials are present. Between my office and the MIAC,
we should be able to do the monitoring at no cost to the landowner if they contact us early and include us in planning
the schedu/e.
Also, I am checking on the status of the burial mound database. We are in the process of shifting to an online version,so
I might not be able to get you that information at the moment. I'll let you know!

1515 Green Trees Road
On March 6,2017 the City recelved a demolition permit application for removal of the principa)structure at 1515 Green
Trees Road. Staff conducted a preliminary review based on the information provided and recommends the following
items be submitted or revised in order for your appiication to be considered complete and for the plan review to
continue:
1. Zoning Disclosure Form. Attached is a Zoning pisclosure Form. Please have the owner,Barbara Burweii sign
the form and return.
2. Certifrcate of Survey. 7he 2012 survey submitted with the application shows a shed/accessory structure on
the westerly side of the property. f believe the shed has been removed. Please advise if the cement slab will
be demolished or if it will remain.
3. Estrow Agreement.
a. Based on our records all previous escrows submitted by the Burwell's have been refunded around

On March 6,2017 the City received a demolition permit application for removal ofthe principal structure at 1515 Green
Trees Road. Staff conducted a preliminary review based on the information provided and recommends the following
items be submitted or revised in order for your application to be considered complete and for the plan review to
continue:
1. Zoning Disclosure Form. Attached is a Zoning Disclosure Form. Please have the owner, Barbara Burwell sign
the form and return.
2. Certificate of Sunrey. The 2012 survey submitted with the application shows a shed/accessory structure on
the westerly side of the property. I believe the shed has been removed. Please advise if the cement slab will
be demolished or if it will remain.
3. Escrow Agreement.
a. Based on our records all previous escrows submitted by the Burwell's have been refunded around
09-12-2011;09-09-2013 and 05-23-2016.

Sec. 78-72. -Lots of record.
(a) A lot of record is any lot for which a deed or registered land survey has been recorded in the office of the register of
deeds or the registrar of titles for Hennepin County prior to January 1, 1975,and after approval by the council if required.
(b) A lot of record located within an R (Residential)or RR(Rural Residential)district but not within the Shoreland Overlay
district, RS Seasonal Recreational district, or any of the LR-Lakeshore Residential districts, which does not meet the
requirements of this chapter as to area or width may be utilized for a single-family detached dwelling purpose, provided
that in the judgment of the council or administrative approval by the planning director, such use does not adversely
affect public health or safety and the following requirements are met:
(1) In R districts of one acre or less and served by public sanitary sewer. A lot of record existing upon January 1,
1975, in any R district of the city of up to and including one acre, which lot is serviced by public sanitary sewer
and which does not meet the requirements of this chapter as to area or width only, may be utilized for single-
family detached dwelling purposes without council approval if all other requirements of the underlying zoning
district are met, including but not limited to required yards, setbacks, lot coverage by structures, hardcover, etc.
However,the lot of record shall not be more intensely developed unless combined with one or more abutting lots
or portions so as to create a lot meeting the requirements of this chapter.
(2) In R or RR districts of greater than one acre and served by public sanitary sewer. A lot of record in any R or RR
district in the city in excess of one acre which does not meet the requirements of this chapter as to area or width
only may be utilized for single-family detached dwelling purposes by administrative approval if the planning
director finds that the following conditions are met:
a. It is at least one acre in size, and the average width of the lot is at least 100 feet;
b. It is served by public sanitary sewer; and
c. It otherwise meets the requirements of this chapter or other applicable Code provisions.
(3) In R or RR districts not served by public sanitary sewer. A lot of record in any R or RR district in the city not
served by public sanitary sewer must meet the area and width requirements of this chapter and shall not be
utilized for single-family detached dwelling purposes without council approval. Administrative approval may
be granted for a lot of record not meeting the lot area and width requirements if the planning director finds
that the following conditions are met:
a. The lot area and lot width each meet at least 50 percent of the district standard.
b. Suitable primary and alternate septic sites are identified on the property and are protected from future
development by execution of a covenant.
c. All other zoning ordinance requirements must be met, including but not limited to the following:
1. Setbacks.
2. Hardcover.
3. Lot coverage by structures.
4. Accessory structure requirements.
(c) A lot of record located in any shoreland district, including the Shoreland Overlay district, RS Seasonal Recreational ,
district, and any of the LR- Lakeshore Residential districts, that does not meet the requirements of this chapter for lot
size or lot width shall be subject to the following regulations:
(1) A nonconforming single lot of record may be allowed as a building site without variances from lot size and width
requirements, provided that:
a. All setback requirements can be met;
b. A Type 1 sewage treatment system consistent with Minnesota Rules, chapter 7080, can be installed or the
lot is connected to a public sewer; and
c. The impervious surface coverage meets all hardcover location and square footage restrictions of this chapter
and the total square footage of hardcover does not exceed 25 percent of the entire lot area.
d. All other zoning district standards can be met.
(2) In a group of two or more contiguous lots of record under a common ownership, an individual lot must be
considered as a separate parcel of land for the purpose of sale or development, if it meets the following
requirements:
a. The lot must be at least 66 percent of the dimensional standard for lot width and lot size for the shoreland
classification consistent with Minnesota Rules, chapter 6120;
b. The lot must be connected to a public sewer, if available, or must be suitable for the installation of a Type 1
sewage treatment system consistent with Minnesota Rules, chapter 7080, and local government controls;
and
c. Impervious surface coverage must meet all hardcover location and square footage restrictions of this chapter
and the total square footage of hardcover must not exceed 25 percent of the entire lot area; and
d. Development of the lot must be consistent with the comprehensive plan.

(3) A lot subject to either subsections 78-72(c)(1)or(2)remains subject to the hardcover restrictions of this chapter,
as follows:
a. Where the hardcover square footage allotment as calculated based on the assigned tier exceeds 25 percent
of the entire lot area, hardcover shall be limited to 25 percent of the entire lot area.
b. No portion of the impervious surface square footage allowed shall be placed within in 75 feet of a lake OHWL
or tributary bank, except for those items normally allowed in such location as regulated elsewhere in this
chapter.
(4) A lot subject to subsection 78-72(c)(2)not meeting the requirements of subsection 78-72(c)(2)must be combined
with the one or more contiguous lots so they equal one or more conforming lots as much as possible.
(5) Notwithstanding subsection 78-72(c)(2), contiguous nonconforming lots of record in shoreland areas under a
common ownership must be able to be sold or purchased individually if each lot contained a habitable residential
dwelling at the time the lots came under common ownership and the lots are suitable for, or served by, a sewage
treatment system consistent with the requirements of Minn. Stat. § 115.55 and Minnesota Rules, chapter 7080,
or connected to a public sewer.
(6) In all variance requests, zoning and building permit applications or conditional use requests, the property owner
shall address, when determined as appropriate by the city engineer or city staff, stormwater runoff management,
reduction of impervious surfaces, setback increases, restoration of wetlands, vegetative buffers, sewage
treatment and water supply capabilities, and other conservation-designed actions.
(7) A portion of a conforming lot may be separated from an existing parcel as long as the remainder of the existing
parcel meets the lot size and sewage treatment requirements of the zoning district for a new lot and the newly
created parcel is combined with an adjacent parcel.

A site inspection and monitoring by District staff will be perFormed where the activity involves:
