June 13, 1977 �The Or ono Council met on the above date with � the following r�embers present: Mayor Van Nest, • Councilmembers Butler, Paurus, and Pesek. Councilnember Massengale absent. Also present: � City Administrator Benson, Building & Zoning Administrator P�Iuhich, City Attorney P�alkerson, � and City Engineer Frank. � � Mayor Van Nest read the following resolution RESOLUTION #788 and presented it as a bronzed plaque to Mr. Gary Gary Welsh � �7elsh for his dedicated service to the City. � RESOLUTION #788 � A RESOLUTION OF APPRECIATION FOR OUTSTANDIiIG SERVICE TO THE VILLAGE OF ORONO i � � 6�FiEREAS, the Village of Orono has individuals who contribute outstanding service to the � community to help achieve basic goals that enhance and perpetuate the "guality of life" � for the residents of Orono; and �WHER�AS, Gary ��Jelsh, as a resident for the past • ten years, has been an active spokesman for the principals and policies that will protect and � preserve Lake Minnetonka and the Village of Orono for future generations; and • WHEREAS, Gary 6Velsh has given outstanding service � to the Village of Orono having served as Councilman and having identified, clarified and drafted into � meaningful legislation the basic goals of the Village of Orono that enhance and perpetuate the � "quality of life" within Orono; and � WHEREAS, the Village of Orono desires to recognizP � the significant contribution Gary �delsh has made to tlie overall welfare of Orono. � NOW, THEREFORE, BE IT RESOLVED, that the Village of � Orono expresses its appreciation to Gary Welsh for • his years of loyal and dedicated service to Orono and special commendation to both he and his family � for the time spent on behalf of the Village of Orono. � Paurus moved, Butler seconded, to adopt Resolution #788, A Resolution Of Appreciation For Outstanding � Service To The Village Of Orono. i�totion, Ayes (4) - �ays (0) . � � f � � REGJL��i r1EETING OF THE ORONO COUNCIL, JUNE 13, 1977 Page 2 � Dick IIenson, City Administrator, administered the OATH OF OFFICE Oath of Office to Mr. C. Licensee, and with the staff of the City of Orono, and � WHEREAS , the City Council of the City of Orono has held a public hearing on May 24, 1977, to receive comments from the � public and from the Licensee to show cause why the license for the Navarre Drive-In should not be suspended or revoked ir�med- � iately, � NOW, THEREFORE, the City Council of the City of Orono � makes the following findings of fact: � 1. That the operation of the Navarre Drive-In in the past year has constituted a pub,lic nuisance. � 2. That th.e operation of the Navarre Drive-In in the � past year has resulted in excessive and unreasonable interfer- � ence with the private property rights of others. � 3 . That the operation of the Navarre Drive-In in the past year has resulted in excessive demand for and use of the � police officers of the City of Orono, all to the detriment of other citizens of Orono who rely upon those policemen to provide � protection in other areas of the city. � 4. That the operation of the Navarre Drive-In in the ` past year has resulted in excessive danger to the police offi- cers of the City of Orono and of other cities who have � responded to the problems on the premises, the patrons on the premises and the citizens of Orono in the area. � � � � � � " � � , � � ' Page 6 � . � 5. The continued operation of the Navarre Drive-In � without additional restrictions is adverse to the health, � safety and welfare of the citizens of Orono and will consti- tute a public nuisance. � 6 . There has been no adequate control of the ingress and � egress of the Navarre Drive-In. � 7 . There were numerous juveniles on the premises who � were drinking and who were present after curfew, all in vio- lation of Chapter 61 of the P9unicipal Code. � 8 . There has been excessive and illegal parking on the street: � surrounding the h'avarre Drive-In by patrons of the Navarre � Drive-In who trespass upon private and public property in order to sneak into the h'avarre Drive-In without paying therefor. � The illegal parking by the patrons has resulted in excessive noise and disturbance late at night in a quiet, residential neighborhood � and the littering of the residential neighborhood by the patrons of the havarre Drive-In. � . 9 . There has been illegal consumption of alcohol on the premises by adults and by minors. � 10 . There is unwarranted tr�spassing upon the private � and public property in the area caused by the patrons of the Navarre Drive-In. � . • 11. There is a total lack of control of the patrons by Licensee on the premises. � 12. The Licensee has been operating in violation of the � terms of its license as granted on March 28, 1977. � 13 . The Licensee has been operating in violation of the Orono Zoning Code which reauires the construction of a six foot, � fifty percent opaque fence around the boundaries of the Navarre • Drive-In. � 14. The Licensee in the past year of operation has allowed boisterous, profane and other objectionable conduct � by its patrons and has not taken reasonable precautions at all times to prevent such conduct and to reject from the premises � persons engaging in such conduct or demonstrating propensity for . it, all in violation of Section 61 . 080 of the I�iunicipal Code. � NOFi, THEkEFORE, in order to protect the health, safety and welfare of the citizens of Orono, the patrons at the � i�'avarre Drive-In, the property owners in the area, and the � Orono police officers who respond to problems at the drive-in, the City Council of the City of Orono hereby suspends indefin- • itely the license granted to Licensee for the Navarre Drive-In on March 28, 1977, for the reasons set forth above and instruct � � � � • Page 7 � . � the City Police Department to take all steps necessary to close . down all access points to the Navarre Drive-In unless the Licensee agrees in writing prior to 11 : 00 A .M. , Friday, May � 27, 1977, to conduct its operations in the future pursuant to the following regulations: � 1 . The Licensee shall continue to comply with provisions � 1 to 12 set forth in the Minutes of the Orono Council meeting • of March 28, 1977, granting the theatre license. � 2. The Licensee shall not charge admission by the car, but will charge admission per individual and issue a separate � ticket for each paid admission. � 3 . The Licensee will prohibit the consumption of beer • and liquor on the premises. � 4. On Friday, Saturdays (and Sundays when preceding a holiday) the Licensee will employ at its expense two off-duty � uniformed security officers of the State of Minnesota, one of whom will be present at the entrance of the Navarre Drive-In � while the patrons are coming into the drive-in, and the other • will patrol throughout the drive-in during all hours that the Navarre Drive-In is open to the public in order to enforce the �� regulations as set forth herein. After all of the patrons have arrived for the evening ' s performance, the security officer at � the entrance shall assist the other officer in patroling the premises. � � 5. The officers will escort from the premises any patrons � who violate any of the regulations as set forth herein. � 6 . The officers will check in all cars where they have � reasonable cause to believe there is liquor being consumed by adults or minors. � 7 . The Licensee will insure that all patrons remain in � their vehicles or in the immediate vicinity thereof except for . traveling by the patrons to the concession stand or restrooms . � 8. The Licensee will insure that there will be no loitering allowed on the premises and no gatherings in excess of six people � other than transitory gatherings that are not disorderly . � 9 . The Licensee will turn off all speakers on the • individual stands prior to the commencement of each evening ' s show and the Licensee will insure that at all times during the � show the fieldmen, as set forth hereinafter, will turn off all speakers that are unattended and unused. � � � � � � . ` Page 8 � 10 . Entry and exit lights will be operational before the � evening show begins. ! 11. The Navarre Drive-In will close promptly at 1 : 00 A.M. , f Central Standard Time, or 2 : 00 A .M. Central Daylight Savings Time, and the Licensee shall insure that all patrons leave the premises promptly at the conclusion of the movie or at the time noted above, whichever occurs first. � . 12. The Licensee will eject all unruly , noisy or intox- icated persons or any individual or groups of people that demon- � strate a behavior or disturbance, unruly actions, intoxication, or other activity which poses a threat to the public health, i � safety or welfare or will violate any of the requirements of � this resolution. � ' . 13 . The Licensee will construct signs and place such signs at the entrance of the Navarre Drive-In which shall state � that there shall be no loud radios or horn honking; no loitering; � no disorderly conduct or alcoholic beverages; that patrons must � retain their admission tickets; and that any violation of the foregoing shall result in a patron being ejected. � . 14 . The Licensee will develop a "trailer" which will be shown at the commencement of each show and at least once during � the show at intermission, which trailer shall set forth the regulations as noted in the paragraph above. The Licensee shall � also announce over the loud speaker system the regulations as � set forth in the above paragraph at the commencement of each ! � show . . � � _ I 15 . The Licensee will employ in addition to the two off ; � duty police officers, five "fieldmen" , which fieldmen will be � responsible for enforcing these regulations. Two fieldmen may � assist in taking tickets until a majority of expected patrons ! have arrived. The fieldmen will wear orange fluorescent vests i � at all times which will identify them as employees of the i • Licensee to the off-duty officers, to the police officers of ; the City of Orono and to the patrons. � i � 16 . The Licensee will meet the requirements of the � State Health Department at all times. � 17 . The Licensee shall clean up the premises by noon on each day following the show . ' � • 18 . Each patron must have in his possession at all times a valid ticket 'for that evening show or else the patron will be � ejected from the premises. � i � 19 . The two off-duty police officers to be employed by � the Licensee shall meet with the Chief of Police at least once ', prior to their working for the Licensee. In the event that � � � � � - . - � ' Page 9 � one or more of these officers is replaced with another officer, that officer shall meet with the Chief of Police prior to work- ing for the Licensee. In the event off-duty police officers are unwilling to be employed as security personnel at the � theatre, the Chief of Police may approve the substitution of uniformed personnel of a private security service and shall meet with the Chief of Police at least once prior to their � working. � 20 . The Licensee shall comply with i�innesota Statutes, �299H, et seq. relating to the State Fire Code and obtaining � a permit therefor prior to June 3 , 1977. 21 . The two off-duty officers shall be empowered and • instructed by the Chief of Police to erect no parking signs during the hours of operation and to tag all violators of no � parking signs on the streets to the rear of the theatre. � 22 . The names and addresses of the off-duty police offi- cers and the manager of the theatre shall be presented to the - � Chief of Police and Licensee shall notify the Chief of Police . of any changes thereto. Names and addresses of the fieldmen shall be given to the off-duty police officers . � 23 . One of the fieldmen shall patrol the rear lotline � of the premises during and prior to the show in order to prevent trespassing and the entrance of individuals in areas � other than through the authorized entrances to the premises. . � The City Staff is directed to conduct weekly inspections to � insure compliance with the provisions of this resolution. � The City may impose any other supervisory and enforcement regulations as the city deems necessary from time to time � to insure compliance of the Licensee with the city codes and in order t� prot�ct the health, safety and welfare of � the citizens of Orono. � In the event that the Licensee agrees to abide by the regula- � tions as set forth, above, then City Staff is directed to grant a temporary license to the Licensee, which temporary license � shall expire on June 13, 1977, or sooner, if the City Council determines that the provisions hereof have been violated by � the Licensee. � On June 13, 1977, at 7 : 30 P.M. , the City Council will hold � a public hearing to determine whether or not the temporary � � � � � � � . _ � ' Page 10 � license should be continued, revoked, or the City Council S will make such other disposition of this matter as it deems necessary to protect the health, safety and welfare of the ! citizens of Orono. Deferred action on shoreline protection as proposed for west wall because several members of the association did not agree with proposal as submitted. DeGregory: On Thursday, June 2, at your request, I attended a meeting of your neighborhood association for the purpose of reviewing the presentation cf an aluminum sheeting system which has been proposed for rehabilitation of � the boat lagoon shared by the members of the association. The purpose of � the letter is to review the information presented at that meeting and to transmit the conclusions and recommendations which can be drawn from that information. � The proposed system consists of aluminum sheeting which would be driven into the bottom of the lagoon on the water side of the existing timber retain- ing wall. The sheeting would be tied back to anchors consisting of aluminum sheets buried in the bank of the lagoon. The anchors would be coupled to the sheeting by means of aluminum tie rods which would pass through slots cut in the existing timber sheeting. The presentation of the aluminum sheeting system was conducted by Mr. Robert Trees, a representative of Kaiser Aluminum & Chemical Sales, Inc. Mr. Trees' presentation included many slides depicting similar aluminum � sheeting systems which have been installed in other states. The slides illus- trated several techniques which have been successfully used for installation � of the sheeting and the finished appearance of the aluminum system at num- erous sites. Mr. Trees also had several brochures describing the system � and the computer program used by Kaiser for the design of the system. Apparently, Braun Engineering and Testing, Inc. were retained to make four soil borings in the vicinity of the lagoon to explore the subsurface conditions and determine the soil properties to be utilized in the design of the system. Mr. Trees indicated that the four borings were carried to a depth of approximately 4-1/2 feet and that the soils at this depth consisted of silty clays with shear strengths ranging from 300 pounds per square foot to an excess of 800 pounds per square foot. The information obtained from the soil borings was apparently phoned into the office of Kaiser Aluminum & Chemical Sales, Inc. where it was utilized for the computerized design of the sheeting system presented by Mr. Trees. Mr. Trees made copies of the computer output available for review. � � � ' Mr. Robert DeGregory Page 14 Page 2 � June 8, 1977 �� Based on the information presented on the evening of June 2 by Mr. Trees and members of the association, I believe that there are several questions � concerning the adequacy of the proposed aluminum sheeting system which have not been satisfactorily answered. I also believe the design of the sheeting � system which was presented would not be considered adequate by the current standards of the engineerir�g profession. Specific questions and areas of � uncertainty are as follows: � l. The soil borings were not carried sufficiently deep to • adequately explore the subsurface conditions. In this instance soil borings should be carried to a depth of at least 5 feet � � below the anticipated bottom of the sheeting. � � 2. The angle of internal friction apparently used in the com- puterized design was 28.5 degrees whereas the angle of f internal friction for silty-clays or clayey-silts is nor- • mally in the range of 15 degrees to 20 degrees. The angle , of internal friction may be higher than 20 degrees if suf- • ficient sand is present in the soil. In any event, the shear strength and cohesion of representative samples of i � the soils should be verified by laboratory tests in order to provide information which is adequate for the purpose � of design. � 3. Mr. Ellis has stated that the existing timber retaining � walls in some portions of the lagoon are displaced upward from 2 inches to 4 inches per year by frost action. I have + not been able to formulate a theory that would explain the reason for this phenomenon, however, if Mr. Ellis' state- ; � ment is accurate, the proposed aluminum system would prob- ! ably also be subjected to the same type of displacement. � � In addition to the points enumerated in the preceding paragraph, there i � is also a question regarding the warranty of the system. Mr. Trees stated i • that Kaiser Aluminum & Chemical Sales, Inc. would warranty their design only 4 for a period of one year. However, I beleive that under the laws of the � State of Minnesota, it is required that the plans for a project of this nature must bear the signature of a registered professional engineer who � certifies that the design was prepared by him or under his direct super- vision. At the time this � was' approved, we also approved a variance of 29 ' from the width requirement on the south lot because of � a natural tree boundary. � We failed to provide an easement for possible • future widening of North Arm Lane. The original plat shows North Arm Lane to be 33 ' wide. This, i of course, is a result of incomplete data indicated on the plans. I believe we all took this as a � half of a 66 ' right of way. Our new ordinance will provide for this. �is plan is preliminary only. It indicates minimum � two acres on each lot. I believe some revisions S will be necessary however. � We should provide an easement for North Arm Lane which is a public road. We usually require 60 ' width for public roads. We could provide similar easements on properties along North Arm Lane as they � are subdivided so we can eventually have adequate • width for a road and utilities. � The private road shown on the plan is only 33 ' wide. Although this road provides access for only one � lot, I wonder if we shouldti' t require 50 ' as we do on all private roads. If we do require these � additional widths, the dimensions of the proposed lots would change in order to provide the necessary � minimum 2-acre area. � The larger lot consists of some wetlands and also � includes the same channel that runs through the Victoria Grain property. I do not have the area of � the wetlands. The channel is an issue we must consider again. We should stipulate that only the �ne lot has riparian rights and only if the channel • � determined navigable and part of the lake. The 360 North Arm Lane �rmit indicates the dredging permit was conditioned (Continued) approval of all other riparian owners. Up until � now, everyone has indicated to me that Mr. Boeye (previous owner of Victoria Grain Property) never agreed to this dredging, The cover letter of the • permit application also indicates a requirement of notification before commencing with dredging. I � have no document confirming this inspection or investigation. � No park dedication fee was ever collected on the � previous subdivision of the property back in November of 1975. Records indicate the park � dedication fee was waived until we amended this • ordinance. The previous subdivision was up for action the same time the A1 «hitman subdivision � proposal was up for approval. We waived the fee until we would be able to determine a satisfactory � formula. This proposal should, therefore, be assessed a park dedication fee for all th��� lots that have resulted from the two subdivisions. The raw land value of the total 10 acres is $16 , 700 � � (this is less than twice the value of my 1/2 acre non-riparian lot on Forest Lake Drive although it is 27 times larger) . Manager, which states that: Attached is a letter I received from Mr. Keaveny regarding our lease at the liquor store. He �explained that he had just gotten the assessment figures and this increase is necessary at this � time. He also said he should have some figures • this week or next on the space and building we previously talked to him about. � � I do believe our original lease with IDS was � reasonable but the $25 . 00 increase per year since 1970 was not a realistic increase. In � January 1977, our increase was $200 per month„ making our rent $875. Now, in July, another � $125 making a total increase for the last six • months $325. This makes a total increase of $3, 150 for 1977. Our 1977 budget was set for � a $1, 500 increase. If we break the increase down over seven years, it is an increase of � $450 per year, which is out of line I think. One point of consideration is the fact that this � does include heating, maintenance, and repairs • on the furnace and air conditioner plus parking lot repairs, etc. � As you know, I have cut all possible expenses, � expecially the �ayroll to the bare minimum, so any increases in expenses now are non-control- lable and we have to increase our sales and profit. Resol- � ution ,�420 dated November 22, 1971, established the water rate schedule of charges. Since its inception the water rate schedule � for the Navarre water system has not been adjusted. During the � past four years there has been substantial growth in the num- ber of units being served by this system. At the end of 1973 � there were 337 units being charged for kater service. That � has grown to over 500 as of the first quarter of 1977. However, it appears that the operating expenses have risen faster than the operating revenues, resvlting in a net operating loss for the period 1974 thru the 1977 estimates. � It appears from our preliminary findings that the revenues � generated by the Navarre wa�er system will fall far short of the amount needed during 1977. For instance, if the first quarter � of 1977 water operating statement is adjusted for the ef�ects of the Long Lake and Chevy Chase areas the net operating loss before depreciation will increase about $350 from ($1, 637) to � ($1 , 987) . We have estimated the total billable gallonsto be pumped in 1977 at 52, 800, 000. The costs to be recovered are: � l. At the present 27� rate , those of us on the Long Lake wa�er � system appear �o be subsidizing Orono' s water service operation_ � Our second concern is that we see the potential savings of 45G on Long Lake water charges practically wiped out by a planned increase of 33C � in Orono sewer charges. Those of us along Highway �12 who are served by , the Long Lake sewer system and who have paid the excess rate for many years deserve a rate comparable to Long Lake ' s normal ch arges , plus maintenance � of the lines. The highest � quote was from Bergerson-Caswell for $6 , 619 . 70 for i a four-inch well and $1, 633. 75 for the plumbing. We did contact Bergerson-Caswell to see if they � wanted to do the plumbing only. They stated they would not do the plumbing unless they could r install the well. S I did contact Dolder Plumbing in Navarre and received a quote from him for the plumbing for $1 , 725. 00. � I have talked to Tom Stevens from Stevens �4e11 and • he would not object to someone else doing the plumbing, in fact, would prefer that it be done � that way. � There are some unknown factors to be considered on the project and could alter the total cost of � the project. � l. The price for the well was quoted at 190 ' deep. ` If they should have to go deeper it would be $7. 00 per foot additional for the four-inch well. � 2 . As noted on the bid tabulation for Stevens �Jell, � if Northern States Power Company can furnish underground service to the well the price will � be $100. 00 less. � 3. If Dolder Plumbing makes the connection from � the well to the Administration buil�ing, we will use the City equipment to dig the trench, � unless a trenching machine is available. If the trencher is available, I would certainly S recor,unend it because of a quicker and cleaner • job. This should not make a great deal of difference in the plumbing costs as it may � lower the labor portion of this quote. � 4 . When I asked Dolder plumbing for a quote, I asked him to include a freezeless yard hydrant � and to be installed at the location of the well. � ihis will allow us to water the lawn and trees and will also allow us to use the water supply a for steam cleaning equipment in the area of the long gold equipment shed. Of the three � bids received, only one met our specifications . � At the Council meeting held on May 9 , 1977, there . seemed to be a great deal of concern about the total cost purchase method that was used when � writing the specifications and contract. Therefore, it was the Council' s wish to table the bid award � until the Council meeting of May 23, 1977. r During this two-week period, the staff reviewed + all specifications and concluded that it would be in the best interest of the City to reject + all bids and to rebid the front end loader only, without the plow and wing. It is the opinion of � the staff that this will give more manufacturers an opportunity to bid. � � Therefore, it was recommended on May 23, 1977 to � the Orono City Council, by Walter R.
