Councilmember Paurus absent: Also present: City Administrator Benson, Building & Zoning Administrator Muhich, City Attorney Malkerson, Chief of Police Kilbo, Public Works Supervisor Gerhardson, Mr. Lebewitz, Mr. Braverman, and Mr. Blohm, representing Northwest Cinema, � Navarre Drive-In Theatre. Dick Benson, City Administrator, announced that PUBLIC HEARING the City Council at their May 23, 1977 Council Navarre Drive-In Theatre meeting had moved to declare a special public hearing this evening to reconsider the Navarre Drive-In Theatre license because of the emergency situation that does exist affecting the health, safety and welfare of Orono residents. The following were present: Audrey Kullberg, 3600 Shoreline Drive Leona Koehln, 2394 Blaine Avenue , Walter Jarl, 3740 Togo Road Ron Kullberg, 3600 Shoreline Drive Jerry Zell, 3680 Northern Avenue Leo Slechta, 3700 Northern Avenue Barbara Zel.l.`�680 Northern Avenue Lowanda Griffin, 3670 Northern Avenue Mel Lebewitz, 8139 W. 18 Stteet John Gerhardson; Public Works, Orono - Wayne Shellum, City of Orono - - Gary Cheswick, City of Orono James �`ranklzn, City of Orono Randy Blo'�tm, 7452=01son. Highway, Golden Valley Mayor Van ilest stated that the City Council is very concerned with the apparent lack of proper management of the Navarre Drive-In Theatre and based upon the information provided by the City staff, it is the City' s ob�ligation to review conditions previously set forth and to consider other steps to provide for adequate controls to protect the safety, health and welfare of its residents. It was noted that the Navarre Theatre management representatives have received staff reports that are attached at the end of the minutes. (Continued) � . • SPECIAL PUBLIC HEARING, ORONO COUNCIL, MAY 24 , 1977 Page 2 � Police Chief Mel Kilbo also informed the City PUBLIC HEARING Council that he was informed this afternoon that Navarre Theatre �he Navarre Drive-In Theatre has not been issued permit by the State Fire Marshall. Mr. Braverman �Continued) • replied that he would instruct his manager to comply Q immediately. � Mr. Jerry Zell, 3680 Norther Avenue, complained about excessive traffic, noise, and dust. • Dick Benson, City Administrator, read into the record � a letter from Russell T. Aslesen, 2394 Blaine Avenue, stating that: � � My mother and I live adjacent to the Navarre theatre and for the past few summers have found the situation � deteriorating. The speakers are on loud until after 2 : 00 a. m. , making it almost impossible to sleep. � Just recently, there were only 15-20 cars in attendance and still the speakers were going full • blast. � The flashing signs also are kept on until the � shows are completed and they, too, cut into a person' s sleep. , • The dust makes it impossible to have windows • �pen in the evening and the noise made by the �utgoing cars is very disturbing. The noise made � by the customers who engage in carhorn honking • contest almost drowns out attempts at conversation. � End of Letter � Mayor Van Nest reviewed Chief Kilbo' s memo dated May 24, 1977 stating conditions that should be • met before continuing the theatre license, which • states: � Below are listed conditions that should be met before the Navarre Drive-In can function as a safe � and secure business: � a) Prohibit beer and liquor on premises. b) Limit car limit to six adults per car. • c) Uniformed security at the entrances subject � to approval of the Chief of Police. d) Fencing around area that restricts access , at + all times, to be installed before operations commence, subject to approval of the City. � e) All patrons to remain in vehicles except for concession stand or bathrooms. � f) No loitering to be allowed on premises. • . ,) Actual supervision and enforecement by management in aisles of loud speakers and other violation. M. closing time to be absolute. (Continued) j ) Management to eject unruly patrons. � � k) Management to make up signs and place cards • for Sub. A & B. 1) Management to employ sufficient help to enforce � rules. m) Health Department check of concession stand. � n) Weekly inspections to be conducted by City Police and Building Department. • o) and such other supervisory and enforcement • measures as are deemed necessary from time to time, by the City, to insure compliance of � license requirements and the City code on theatres. � p) Clean up area as needed. • The Council should in�uire of management of the status of the outstanding tag issued May 6, 1977 � for objectionable conduct under the Theater Code. � End of inemo • Added to the above conditions were: • q) Patrons must have tickets at all times. • r) Police officers assigned to duty at the theatre • must contact Orono Police Chief for clearance and proper communication � s) Theatre to acquire proper fire permit t) Regulate exit and entrance when not in operation. • ` Mr. Blo�m, attorney representing Northwest Cinema, commented that there are limits to what a theatre � can do. � Mayor Van Nest reminded Mr. Blohm that it is evident � that the theatre management has not demonstrated ability to manage properly and this hearing is � being held to consider suspension or revocation of the Drive=ln license based upon staff and citizen • documentation. The City Council has to reconsider all conditions past and present and through the � Drive-In management determine if the theatre is � going to comply and establish a long-range plan for full control or suspend the license until compliance � is evident. � Mayor Van Nest asked representatives of Northwest Cinema if they desired a recess to respond to the � City' s conditions. � Mr. Braverman replied, yes, they would. � Mayor Van Nest recessed the public hearing at 9 : 45 P.M. � for 15 minutes. At one and two o'clock in the morning • along with all the noise of the cars leaving, this can be quite a problem, mainly trying to breathe. � � Ki�s hang around the drive, by the trees, on � the fence and on the stairs of my apartment. • End of letter. � 10 : 00 P.M. � At 10 : 00 P.M. , P�r. Blohm stated to the City Council � that his client would agree to comply to all the conditions set forth and request that the fencing � and dust control be deferred until the June 13, 1977 Council meeting. • • Mayor Van Nest commented that the findings of fact tell us that: � 1. More than adequate data to cause concern of Council ` regarding safety and welfare of citizens. 2. Licenses for his operation should be reviewed • for adequate protection of the public interests. 3. Situation appears to be virtually out of control � regarding nuisance of motor bikes and the like. � 4. Ingress and egress appears to be out of control. 5. Noise is substantial to the surrounding properties. � 6. Parking on Northern and Blaine Avenues appears to be associated with drinking. � 7. Unwarranted trespass on neighbor' s property. Seems to be considerable evidence to support the fact the • activities are not sufficiently contained within the boundaries of the property. Alternatives � to a fence are not well understood as to their � effectiveness. � The public hearing was closed at 10 : 20 P.P4. � (Continued) � � � � • ' � . At aRproximatel� 1 : 30. while eastbound on County Road #15, from " �' Spring Park, after getting a call to assist Mound with a fight at the _ Navarre Drive-In,� approached the driveway to the Navarre Drive-In. Z observed three or four vehicles driving back into the drive-in itself. � Of i cer Shellum was behind me. z s�a�d to hi� that we check the situa- tion out. I told him I would go up on Blaine Avenue and he could proceed • into the Navarre Drive-In I would attamnt to see i�f there were any vehicles parked along side oP the road up there,. and had possibly walked in, not � � beine noted. As I .got in the vici��tty of Blaine and Livingston, z observed . four or five vehicles toward the back of the parkin g lot. I _could hear peo��e yell ing �rnm that vicinitvs:_and I to_]`d Officer Shel�um that that is � the location where the problem apparantly is. I told him that I would be � turning around proceeding to assist him. Upon entering the Navarre Drive- � In, I pulled up along side o� him toward the back of the •Navarre Drive-In � �t.� and observed many people standinR around outside their car, talking Land � yelling. I had a chance to talk to two young people, males, who identified themselves as c�.tizens of the City oi' Minnetonka. I asked them what they � were doing here, i'or they were walking out of the Navarre Drive-In. I . . req1�st�d where their v�hicle wasT.�he�t s�atad t _Y�at they d�ci not have a �-- vehicle and that they were going to hitch hike home. I roquested that they � exi t �mmedi ately, and �he�_�rQ�eded t4_ further c_heck on the area. I ob- served Officer Shellum talking to several people. I walked around and told � Quite a few other people that wera in ths vicinity, to get back into their vehficles, that the situation that was exiating must cease: There were many, • many beer bottles and beer cans lvin�n the parkinR lot; many of which Wera broken. As we walked around telling people to get back into their vehicles, � many of the vehicles started to leave. It was very plain that some of the � people were upset about hav'ing to go back into their cars, for there was langua�e directed toward us that was unnscessar9. Dur'in� they�ime we were � there, I was unable to determine if the Navarre Drive-In had anybody that was supposedlY checkinR the parkin� 1ot to keep these kids inside of their � vehicles, but whoever it was, �,rsa not doing his �ob. There was _ still an irruaense amount of noise comi from the s eakers on the osts` and many of the young people that were drinking beer in their cars and sitting ori the hnnd� nf the cars had the gpeakerg turned ttt� li stening �to thern. After a � short time, of walking the parking lot, taking care of the loud speakers and �_ the_�e Znl e that were mi 1 l i nb around� we cleared the �scene. I told Off icer Shellum that I was going to drive around the perimeter of the drive-in lot • t� see if there were any problems existin$ on Northern Avenue or Blaine Ave. As I got back on Northern Avenue , and began to turn around, I could hear again; • ver� cl earl�, 1 oud noi se coming from the s�eakers at the drive-in. He did not know if it was a knife �wound or w a�. but by the looks of the cut, it would appear that i,� was a knife or some �sharp instrument. The fi�ht broke up as the manaQer called for a squad, �and as Sergeant Hudson arrived, the Indlans �juraped in their car and took •off. �he vehicle was �ollowed by two of the Navarre Drive In emplovees and all they could discern was that it was approximately a 1972 Ford LTD, �light in color with a left tail light missin�. Five males and one female were in the vehicle. An attempt to locate was• put out by thie o.fficer at �23•1 3 hours. Also inte��viewed, at this tirue, was- a Charlea David Gemar, oi' ,5200 �Waterbury� in I�gound. Date of Birth: 21 A1on with emar was ' c �Al�n Kokesch, of 3a16 Nortnern Avenue in Spring Park. Gemar stated to this Officer that when the Indians c�me into the drive in, •they opened up their trunk to get their beer, and at this time, he noticed a 12-�-au e shot un in the trunk and he also noticed that n :one f the ndian' s belt was a long knife. At this time there wae noth�much more we could do as the other squads involved had cleared the scene. • � At approximatel� 1 : 30 a.m. on Ma_� 21 , 1�� , Officer Cheswick, of this Department and myself antered the Navarre Drive-In once again. At � this time I observed a �reat ma� beer bottles . beer cans and debris all over the drive-in. 2�Iany parties were outside of their vehicles drinking, � � talkinR loudl.y; the speakers were turned u� quite a bit and the the whole drive-in was in general disarray. As I was driving through the establish- '� ment� I heard a rock hit the side of my squad car; it was a sma� roc an� � I don' t believe it did any damage to it. He stated that he had his family in the theater and was calling re�ardi_ng__the disorderl�con_duct that was �oin� on at • the theater; obscenities that were being yelled and other vulgar language that was bein� used. I also assiRned Officer Ward. of �`6510 unit. to pro �— ceed to that location to assist Officer Wa�nan. IIpon their arrival at _+_ _ the ilavarre Drive In� �he Officers radioed back to me that they had approximately two to th�»ee hundrod cars in the lot and approximately _�__150 to 200 people that were walkin� all ov_er the �rounds in a very dis- orderly fashion. I arrived upon the scene approximately 23:24, at which � � time I observed numerous youn� people , of all a�es, primarily from the age of 20 years and below, parading all over the movie theatre grounds, �---ma�X__�Lth� c�rinking bQer: �mQ��Z�__��owi ng t�eer b'��l�a some � pushing and shoving, matches were going on, and in general, �ust __ harrassment and loud talkin� was �Q�.�g Qn throu��out the �heater. It � was so loud within the theatar, that ae I drove in I was unable to hear --�ha�nn_yi_e_ i��el��ti_th_�11_the s��k�r_s�vrn�d�n_ T eQu1d he ar n�tr,i ng � but kids and persons mumbling and talking. It was at this time that I met w i�h �he man���r_��hQ__��st�nding at �h�_back Q��he 1Qt� savin� • that it was impossible for him to do anything and to keep a�l �hese persons in the cars .due to the vast number of persons that- th�y �had wi,thin tha � theater. He stated that he did have three persons that were working �rith a we����pting to_he1Y�����������uation and keen the9e persons in the vehic?es; however, they had not been ver3r successful in i doin� s�c�h Tt- wa at thi q t�m_�, th�t we advised h�m tQ_m�ke an anno�lnce� ment to have all persons enter back intD tha vehicles at the manager� s !_re��t. It was at this time tii.at the m:�nager .was met �rith loud horn-honkin�, booin�, etc. as he made his announcement. It was very � obvious that they intended not to comply. and obey his request. It was _ a verY short time later tha we made a "second AririoLLn�AmAnf-' ��ating that � the Police were hear to enforce the request that the manager, had made, � and any ners�ns not being_ in their vehi�l�s would be s �b�Qct t� arrest. As the film goes on, it shows the female = Rettin�out of bed and go_ing to tne bathropm_.where_ she_anp6a_r�_���k _____ where a voice was coming f'rom, from the lower part of her body, around tne crotch srea. It shows a f ootage of photographers taking pictures and suggestive langua�e from the voice in the crotch area which could be readily heard to � the audience. A� the time the film was 9howing, I was sitting on Blaine Avenue and Livin_�ston, standi�outside of_ tne sq_uad car. The speakers were turned up loud enough so as I could hear the individuals in the film � talkin�• I was joined by Officer Ward� who was off duty, verifying the fact that the sound was loud enough to be able to be heard in that vicinity. � SerReant Burmaster was_sittin� _in the drive-in� and several minutes later I proceeded down to his location. Af'ter walking down several aisles, and • findin� several of the speakers still turned on at the posts where there were no vehicles next to them, and also several speakers that were attacned � to the side of several trucks loud enou�h for me to hear it from outside. � It should be noted at this time, in regards to the report from 7 "j7, that the youth that I had talked to previous� nfthat date were asked their age, � and at least four were the ages oi' 15 and 16 years old. This film is, in fact, rated "R", and it is sua�ested that no one u.nder the a�e of 17 years � old be admitted. I proceeded through the parkin� lot and observed youths in two dif�erent locations appro�imatel.� te� t��welve_��� ��� talki n� an�___ � smoking cigarets wnile waiting for the drive-in to start. the film. I had a talk with _ the individual about him racing_ bac� and fs��h with hi�ms��Qrcvcl e,�n_d — he stated that the manager had given him permission to run it. I told him • that because of the p6ople being_there, the vehicles_,__and�_ e � ed that he • was traveling, I considered it reckless driving, and that if he did not want a citation for that, that he would have to Aet his motorcycle out of there � and proceed �back to the location that he came from. After talking with several of the people, I cleared the area and_�roceaded back on patrol � answering calls. I �hen- came back, several times, to the vicinity of Blaine Avenue, Livingston, Lyric. Crvstal Place and Northern Avenue . Each time, .� while making a pass through there, there were vehicles sitting alongside the Blaine Avenue road. which is a ver_y narrow road, watching the show, and had to be asked to remove tharnselves or be issued citations for obstructing � traf'f'ic. I also observed ten female��uveniles sittin� on the �ront lawn of a home adjacent to the water tower watching the show. The parties were, at that time, makin� noise loud enou�h that I could detect it as I had driven down Livingston Avenue. I requested o� them, also, to exit the area. � They stated to me that their f'riend wae down at the drive-in and they were �ust waiting for him; that he had the vehicle, that he was going to pick � them up. After talking to the females, I then turned off of LivinRston _ . northbound on Blaine and observed five more male youths standing adjacent to Crystal Place and Blaine. At that time I observed a vehicle sittinR down in the ditch with the front end of the vehicle stuck in the brush � ad�acent to the parking lot of the Navarre Drive-zn It appeared that the � ` parties were attempting to get in through the back area of the driva-in, and wnen asked wYiat had happened, they stated that they were tryin� to � turn around and i'ind tne entrance for the drive-in so they could get in and watch the show. A tow had been called i'or this v.ehicle. I observed, at that time, approximately six to e�ht�ouths runnin� throuyh the trees of the i--back of the parking lot toward the drive-in show. It is believed that these youuths ware from these vehicles that had been_parked on Northern Avenue. i It is my su�gestion that this area of Northern Avenue, where the problem _ is existin�, and has existed for the last several Years. be posted "No Parkir� on both sides of' the street. At 22 :15, while sitting back on _�_Northern Avenue , lookin� at these vehicle9, &p�arently during intermission time, I was able to hear very clearly, young people yelling from within the _• drive-in. I could also hear several of them shooting off firecrackers and • also vehic�es making loud noises with their exhaust. It is believed that _ this was approximatel� the time the showhou9e had intermission between their � S'ilms. A check of the confirmation letter thAt was sent • to I�Ir. rielvin Lebeweitz�_Northwest_ Cineina C4r�orati�n,_ sh�wed that .p4_ss�ble vi.olat�ons_____ ,� of the letter exist. At the time of approximately 19:15, I discussed the situation of the situation of the ouths standin�, around with Mr Bob � Becl�auan, who I believe is the mana�er of the drivo-in. I roque�ted if' Yhe __ had anv peQ�l��ha�__w�r� wa����g__��Q��_�h�_driy�=in��Q��nd_�� �nntrol the � oiterin� of the young people. He stated that he had two youths that were =�rk�� for him _in th�s ca�ac�ty_,I�e s�ated__pn�was_ dQw�_at tha t��tet booth assistin� them, and the other was inside the snack bar. I requested _ that he have thom walk around the �rounds so this problera could be �lleviated of them walking all over the area. Also, regulation #3 on the letter, , states that the entr�_l�hts wil� be kept i�ood repair. Several days ago, the entry lights caught afire and are inoperative at this time, possibly • repair of the li�hi,s wil� be at a later ti�ne. The fi].m showing this evening • is one of three which is an "R" rated movie, by the name of '�hatterboa". _ Ser-r�ean� Burmaster observed this film_, although not in its entirety. it � also, approxiin�tely 19;�5, I observed many of the speakers, on, playing loud music prior to the film startin�, The music that was coming over � the speakers was that of a rock station from a radio. These were several of the problems that I observod existin� that I balieve that �he Cit Ztining Adninistrator should be aware o�. A ollow up to this report from Sergeant Burmaster concern�n� the contents of the film "Chatterboa" � is as follows: Sergeant Burmaster states that in the short time that he � observed the film, the film carzmenced with a scene of a ma1.e and fema].e in a position tnat is believed to be that of se�:ual intercourse. Further �__ foota�e of the film showad two females, one of which was liftinR her dress up, t]ie other pulling her panties down with her face next to the _ vaFina area listenin�. It appears that the film is based upon the one female having a vagina that has a voice. ::����her::on in the film, the � i'emale makes an appoin�ment with a psychiatrist to de�ermine what the problem was. RE: Navarre Drive In Theatre � On Wednesday, April 21, 1976 Orono Inspector Alan Olson, Orono Police Chief Mel Kilbo, and Ronnie Kullberg (owner of Ronnie' s Cleaners) and myself inet with Mr. Melvin Leibowitz, � owner of the Navarre Drive In Theatre. � A visual inspection showed that a good cleanup of the area� : � was very rnuch needed. Also, because pedestrian traffic through the area cannot be stopped unless the whole area is fenced, several safety hazards were pointed out: broken posts, microphone standards lying down, cement chunks scattered through the area, playground area in need of repair, and a � tree broken off about ten feet off the ground and just hanging there. Mr. Leibowitz was very much aware of these problems and assured us that all these things would be taken care of as soon as possible, but it was still very early in the season and they had not had time to do �all these yet. � Mr. Kullberg complained of the speakers not turned down or off when they are not in use. Mr. Leibowitz assured us that it e is definitely pointed out to his manager that this must be done before each first showing of the evening, Mr. Kullberg was also concerned with the curfew. It was pointed out that they rIIust close at 1: 00 A.M. until daylight savings starts and then ' the curfew is 2: 00 A.M. , It was also suggested to Mr. Leibowitz that the Blaine. Avenue side of the theatre property should have some type of screening so as to eliminate parking on Blaine Avenue and watching the show. This could be done by planting trees along that side. Benson � � - • FKCM: Hank Muhich � DATE: May 8, 1975 � RE: Navane Drive-In Theatre License, 3660 Shoreline Blvd. The management of the above theatre made application for a license to operate for 1975. The application and insurance certificate have been submitted. � We found litter and debris scattered on and around the property and received some complaznts on lack of policing of the area during operations. � � I notified the management by letter with which I enclosed a copy of theatre regulations and indicated license krould not be approved without better policing and cleaning of the property. I also � recarrunended better marking to regulate traffic at the points of egress and ingress. Mr. Bravern�n� has replied by letter that steps would be taken to • improve these conditions. �n receipt of the letter I called b'fr. Bravennan and informed him t if I received any fi�rthPr ��,7A;nt� t regarding these problems I would include them in a report xith next , years license application. : Since receiving the attached insurance certificatby�I have received . notice of cancellation of this insurance policy as of June 2, 1975. � I called Mr. Bravern�n ir.mediately and instruCted him that a new insurance_ certificate was necessary before June 2, 1975, Dr rth� licens'���„rould be rewked. -- _... _ I have also disciLssed this operation with Police Chief Kilbo. He informed me that many of the c�nplaints regarding patrons was actually about non-paying viewers from surrounding properties and he wwld , instruct the departrnent to observe and regulate this nuisance. � , • �
