Planning Con�-nission determined the area of qualify-

3740 �•,ayzata Boulevard. The Zoning Adm�nistrator
• ��xplained that the applicant was requesting
Guproval to operate a kennel near the intersection
S of Higriway �12 and County Road n6. Rezoning would
be necessary due to the fact that this pr�posed
� o��eration is in a residential zone. Although
�he Co;nmission felt this proposal deserved sor:�e
S' consideration, they were not in favor of any
rczoning at this time. The Zoning Administrator
� stated that he had consulted with the City
' Attorney as instructed. He advised that there is
no way to approve this request on the basis of
� a club or stock farm as this is defini�ely a
corr��ercial venture. The Planning Com�ission
r r�co���� ended cienial of triis proposal based on the
� ecorru-nendation of the City Attorney. Appl_icant
� �tias advised of the areas in Orono where she
� could opera �e this kenrel.

house was constructed. Mrs. Parten is now living
� in her home and is more aware-.of the problem.

� width requirement. The proposed addition would
meet all setback requirements.

� license to operate Phase I. Mr. Bonner stated
that he had appeared at the Council Chambers for
� rhe I;arch 14 , 1977 scheduled Council meeting but
�e Charabers were dark. Mr. Van Nest iniormed
� ?��r. Bor�ner that the r;arch 14, 1977 Council meeting
had been cancelled for lack of a c�uorum and had
� been rescheduled for ?�Sarch 17, 1977 at 7: 00 P,M. ,
� as the Minutes of that evening indicate.
� T�'ir. Bonner corru-nented -that the tow lines have
iriproved since the last report and Ski-Tonka does
f not fully agree with Mr. Alan Olson' s letter on
his inspections. We have not received any further
� correspondence from City staff on what to do to
• rt�;�ed}� the problem.

c_.palities �hat lie on the rural-urban fringe of this great :r�etro-

� �'he Orono City Council �eels �hat one of the ncst impor��nt ingre-
. dients in their decision to es�ablish rural land Use cens� ties at
a 2-acre dry buildable minimum lot size is the need to develop a
,� comprehensive on-site septic ordinance including annual inspections
�-nd 1_� censing oi all on-site sepLic systems to be constructed in
;he � �nl service area. S�'e are enclosing with this letter a copy
of o��� ;�relim�nary dra�t of the proposed on-site septic system
� ordin<_.�ce we are considering in Orono. I am also enclosing the job
� c3escription that we have established for our on-site septic
inspector and the financial requirements necessary to institute
� ;-_his program which was included in our 1977 block grant fund
rea�est_ .
• I wish to caution you that this propesed ordincnce is just a pre-
� liminary draft and is being reviewed by the Orono Staff and Officials
! as well as by other experts in this field that we have been relying
on for basic informaLion. We have placed several ads for our septic
� inspector and have found several applicants that are highly quali-
fied �or this position_ P_s soon as we receive approval of our 1977
� block grant �unds, we will hire our sePtic inspector and purchase
the r�ecessary equipment to institute our program.

� concerning rninimum lot sizes in the aeneral use region of the rural
S scrvice area. It is our belief that the planning objective that has
been expressed to us by the Metro Council staff of providing a land
� �ank lor future urbanization r�eeds of the ?�Setro area, if ac3opted by
the N,etro Council , should be acco�plished at Metropolitan expense.
� By this I mean we should look at the land b�nk reQuirements the sa;ne
as we look at future park land requirernents -that are set aside �oCay
� wi_th funds provided by the 2ietro Council. It seerr.s an unreasonab] e
, r�quirement for the rSetropoli�an Cotincil to expect 12r�downers who
own land not suitable for co��Tr�ercial agriculture to hold these l�n�s
, �_c be used for some future develop,��ent at urban levels when the
?,ezropolitan sewers and highways are ex�ended into those areas.

� fol_lowing provisions being adhered to as an
S operational policy:
� l. Regulations of Operations : The shows will
not start before 7: 30 P.M. or at dusk.

2 . Control of Traffic: t9hen the traffic is at
� the heaviest, the management will have enough
�r�ployees on duty to get patrons in expeditiously.

� 3. Exit and Entry Lights : A new manager has been
hired and will keep everything in good r�pair
� at all times.
� 4. Time of riovie Closing: Closing time is normally
1 : 00 A. M, and 2 : 00 A. M, when daylight time is
� in effect.
5. Screening Fence : There is a crowth of trees
� between the theatre and the residential area
and to the east is a com�-�ercial section and
� considering that they are both in business
at different times, there will be no problem. '

6 . Speakers Sound & Noise: Al1 speakers will be
� turned off when not in use and volume will be
. kept down.
„� 7. Types of Movies: ihe management will have no
::-rated moveies and will attempt to play all
� the PG and G rated moveies that are available.
0 8. Litter and tiaeeds : The management will make sure \
that the janitorial service cleans up early
� and maintains the grounds.
� 9 . Curiew for Cnildren: Only people who are
� permitted to drive are allowed,except children,
when accompanied by parents.
� 10. Policing Help: The theatre will maintain
personnel to control patrons , but in the
� event of a serious problem, the management
, will call the local enforcement agency to
handle problems.
� 11. No blinking lights.

that to restrict the use of Ivy Lane to a fire
lane would be a miss-use of land and presented

• to detremine what uses are reasonable for this area
that are not detrimental to the safety, health and
� welfare of its citizens, and a public beach does not
appear to be in the best interests of the City.

Dear Council 2�Sembers :
The Orono City Council appreciates the invitation extended to us
for our input to the public hearing considering proposed changes
to your RA zone. It is our understanding that the Medina City
Council is considering a change to its ZA zone that would allow
' for an area-wide Vo-Tech School as a special use. It is also our
understanding that if this a1T,end,-�ent is made to the RA zone, it
,� would give any land owner within that zone the right to use his
land for an area-wide Vo-'I'ech School unless the City of Medina
� could de,.ionstrate that the establishment of an area-wide Vo-Tech
School would be detrimental to the ptzblic health, safety and
'� welfare. The Orono Council feels that this amend.,-nent, if adopted,
� would grant a substantial .property right to all land owners within
the RA zone without adequate control and safeguards that could
� have a substantial impact on the future planning of your City.
The Orono Council also feels that this proposed amendment to your
� zoning cooe could have great affect on neighboring cities , as
well as a proiound i�:��act on the regi onal pl anning of the 1-ietro-
� politan Council. 1
'� Ir.�pact to the City of Orono as an Adjacent Communi�ty:
� l. The City of Orono has adopted a Comprehensive Guide Pl�n
which has bzen implimented by the adoption of a Comprehen-
"'� sive Zoning Code, which has as one of its underlying goals ,
� the protection and preservation of Lake Minnetonka.
` 2. The engineering studies that have been conducted on L�ke
2�innetonka indicate that its major source of pollution
f today co�es from the phosphorous content contained in the
� storm water runoff from its watershed. These studies further
indicate that the level of phosphorous content in the stortn
• w�ter runoff increases as the land use within t�e watershed
becomes more densely used through higher levels of urbanizatic
� .

engineering studies. These policies require that Orono
remain as a rural residential Io�t-density coTs-�unity whose

adverse affect on Lake ?�innetonka.

La};e P�innetonka watershed. and, for the most part, this
�+atershed drains tnrough the City of Orono before entering
?ake i�inneLonka. The Orono Council feels that the establish-
• ing of any permitted or special use for large urbanized
sLructures the magnitude of an area-wide Vo-Tech School that
,� requires �h e installation of saniLary sewers , additional
. �ransportation routes , and urbanized levels of police �nd
-� fire service within the rural service area,would be
detrimental to the Orono Comprehensive Guide Plan.

• Ir-ipact Affecting Metro olitan Council Regional Planning. '
� 1_ At the present time, the 2�Setropolitan Council and the 189
�unicipalities located within the �:�etropolitan area are
� involved in a three-year process of reevaluating and develop-
ing comprehensive guide plans as required by the Land Plan-
� ning Act established by the State Legislature in 1965_
The Land P1_anning Act developes a process whereby each
� co����unity must evaluate its long-range neFds for develop-
� ment within the metropolitan area. The City of Orono would
feel that this proposed amendnent to your RA zone would
� grant a property right that �nay be difficult to remove in
the future, even if in the development of your comprehensive
� guide plan, it can be de�onstrated that this land use would
be detri���ental to the long-range goals and poli_cies of the
City of Medina. It would seer.� more sensible to delay any
, such decision until such t�e that the Medina Comprehensive
Guide Plan has been developed and approved by the Metro-
politan Council.

2. The ?��etropolitan Council is presently oeveloping st:.ndares
for a N,etro�olitan Significance Review. This review is
similar to an environr,�ental impact sta�ement that can be
requested by co,�ununities and groups of residents pertaining
i to any deve�opment plans that may have an adverse impact
on local or regional policies. Although the Metropolitan
S�gniiicance regulation had not been finally adopted, the
proposed draft does cle�rly state the reasons for which a
2�etropolitan Significance Review could be conducted. A
proposed develop.�ent the ,��agnitude of an area-wide Vo-Tech
School would easily fall within the requirements for which
a Netropolit�n Significance Review covld be conducted_ It
would seem unwise for the Ci�y of Medina to grant a property
' right �oday that would be subject to a i•Setropoli�an
Significance Review prior to construction.
3. The j^7aste Nanaoement Plan, as adopted by the ?��eLr_opolitan
Council ,does not include metropolit�n seker interceptor
- ca�aci�y Tor the City of riedina , • at the pr�-sent ti�e. The
plan also states that the metropolitan interceptor capacity
will not be provided for the City of 2�edina for at least
the next thirteen-year period. It would seem unwise to
gra�t a property rignt tocay ror the construction of a
faciliLy that would �;,ost cer�ainly require availability
of a metropolitan intercepLor.
, 4 . During the development of the Orono Transportation Plan,
'� it was neLermi.ned t�at the State of Ninnesota had no pl�ns
- to uparade StaLe Hzghway rl2 west of ti'ayzata for at least
the next twenty years. This major transpor�ation route
� would be the metropolitan link to the rural lands of Orono
- and the sou'-�..hern half of 2�ledina that is necessary be�ore
! our cities could urbanize. It would seem unwise to grant
a property right today that would allow the construction
oi a iacility that would reauire improvements to the
transportation network that will not occur for at least the
next twenty years. �
� The City of Orono understands that this public hearing is for the
p�rpcse of considering �n amendment to your zoning code and not for
Lhe cor.sideration of a propesed Vo-Tech School to be construc�ed on
� �he southern border of Medina_ The Orono City Council, however, would
• li};e to point out that we were requested on Nove��nber 8, 1976, by the
Joint Independence School District a287, for sewer .service to its
proposed West Site Campus located ir:�T�ediately north of County Road
r6 in 2ledina. This request ior sewer service kas in direct conflict
with Orono' s Comprehensive Guide Plan, its Conprehensive�_Zoning Code,
� �nd its Comprehensive Sewer Plan. In considering this November 8th
request by Vo-Tech, the Orono Co��cil spent considera}�le time
investigating the Vo-Tech proposal and its iunpact on the comprehensive
planning of Orono. On December 13, 1976 , the Orono City Council

i �doptFd Resolution ,� 737, which was in res�onse to Vo-Tech' s
request for sewer service. We believe that this resolution sets
down many of the basic concerns of the City of Orono for the
construction of an area-wide i�o-Tech School within the rural
service area of our cornmunit�es. We are attaching a copy of this
resolution for inclusion i_n the public record for this public hearing.
In conclLsion, th2 Orono Council feels that prior to making amend-
ments to our zoning codes, we should first complete the requirer�ents
of the mandatory Land Planning Act. These requirements establish
the adoption of a Systems Statement, which is presently being
prepared by the r4etropolitan Council. This Systems Statement tells
' each of our co;nmunities how the metropolitan systems will affect
our comrnunity to the year 1990. These Systems Statements must be
completed by July l, 1977. Upon their adoption by the Metropolitan
Council, each com�unity has �until 1980 to reevaluate its comprehensive
planning in light of the Systems Statement and present to the 2�5etro-
politan Council for its approval a comprehensive guide plan that will
comply with the Systems State;nent. After the adoption by the Metro-
' politan Council of each co;nr.�unity' s Comprehensive Guide Plan, it
then becomes necessary to implement this Comprehensive Guide Plan
by amendments to the zoning codes. Orono feels that for the City of
2�edina to -amend its zoning code today allowing the construction of
an ur�nizc-�d facility within the rural service area could not
� possibly be consistent with your comprehensive planning or the
Metropolitan Council' s regional plans.

� One basin is dependent on another. French Lake is

� r:ayor Van Nest commented that French Lake is an
established storage area and should be considered.
'� The area is unique in that the location and size
does tell us that this area could be used as a
� pilot study to incorporate a sound basic water
storage plan that will work. This will allow the
� watershed district to sell the total project to
� all the cities. The concerns that have been
stated at the first public hearing are basic and
� can be demonstrated on the French Lake site.
