Also present: City Administrator Benson, Building & Zoning Administrator P�tuhich, City Attorney Malkerson, • and City Engineer Frank. � Butler moved, Searles seconded, that the MINUTES Minutes of the Regular P�teeting of 5eptember 27, 1976, be approved. AZotion, Ayes (4) - Nays (0) . • � No Park Commission comments. PARK CONINIISSION No Human Rights Commission comments. HUMAN RIGHTS COPIMISSION Henry Muhich, Building & Zoning Administrator, � stated that the original proposal for Gerald ` Parten, 985 Tonkawa Road, was to subdivide the 5 plus acres into three lots and that the Partens had changed this request to two lots, both �xceeding two acres. Carl Parten, brother to the petitioner and neighbor to the south, was concerned about the swamp area on the rear lot. • He felt that this wild area should not be destroyed if a new road were built. Mrs. Gerald � Parten explained ta the Planning Commission and � Carl Parten that the road to their property is already there. Therefore, no new road is � required on the south lot. Member ricDonald expressed her concern about drainage at the � existing road. The Partens explained that there is now a culvert urider the gravel road. • Council meeting - August 23, 1976 � Approved per Planning Commission recommendation. Motion, Ayes (4) - Nays (0) . � , ORONO COUNCIL A'lEETING HELD OCTOBER 25, 1976 Page 2 � Henry Muhich, Building & Zoning Administrator, CONDITIONAL USE PERMIT stated that the Council was informed of the 3660 Sixth Avenue North Planning Commission's request for more detailed #154 information for the Park Gun Club, 3660 Sixth Park Gun Club Avenue North, regarding schedule and survey with proposed improvements. The Council also + approved extending temporary permit to continue operation through October to give applicant time � for submitting necessary data requested. Planning Commission Meeting - October 18, 1976 • The Park Gun Club presented a marked calendar showing the proposed hours of operation, a colored plat map showing adjacent owners, and a large aerial photo of the entire property. The Club proposed planting a sound barrier of � trees along Starkey Road between the existing trees at Sixth Avenue North and the wooded area in the center of the property. The pro- posed lighting and night hours will be handled when a separate formal proposal is made. � The Planning Commission recommended approval � of the conditional use permit for the existing operation and approval of the operating license for next year, subject to the hours shown on the proposed calendar and subject to installation of the sound barrier trees by next June. Paurus moved, Welsh seconded, to approve the � conditional use permit for the Park Gun Club, 3660 Sixth Avenue North, as per the P3anning � Corunission Minutes of October 18, 1976. Motion, Ayes (4) - iVays (0) . • Henry Muhich, Building & Zoning Administrator, SUBDIVISION � stated that the Planning Commisaion expressed 511 North Ferndale Road their surprise and concern regarding the #156 � revezsal of their recommendation on the Klaus Klaus Becker Becker subdivision at 5�.1 North Ferndale. The � reason for their concern was that this item was listed as a progress report on the agenda for • the Council meeting of September 13, 1976. The • Planning Commission recommended denial of the proposed subdivision of 5 lots. They offered T�1r. Becker the opporturiity to submit a revised proposal of only 4 lats, or the possibility of acquiring enough additional land for the 5 lots to meet minimum area �equirements. Planning Commission rleeting - October 4, 1976 � Recommended denial of revised preliminary plat due to non-compliance of the zoning ordinance (lot area substandard) . Further action gave applicant opportunity to a submit another set of revised plans consisting of lots meeting zoning code requirements either through purchase of additional land or reducing the number of building sites. Planning Commission recommended approval sub�ect to the payment of a park iedication fee and to approval of the final plat. Will be on �genda for October 25, 1976 Council meeting. � M.r, Jerry Jenson representing Holiday Station ��"tores, stated that all sites that have been nsidered by Holiday Stores have been either �ld or the options have run out. Mr. Jenson �equested Holiday's request to be tabled until ilovember 8, 1976, when Holiday will be prepared -co determine if, in fact, property is available -�o them for a Holiday Station. • �ORONO COUNCIL MEETING HELD OCTOBER 25, 1976 Page 4 I�-Zr, Douglas Carney, representing Mr. Tom Ryan, SUBDIVISION 1060 Tonkawa Road, presented a survey of the 1060 Tonkawa Road yproposed subdivision stating that this proposal #170 meets Orono's setback requirements. Mr. George Tom Ryan Johnson on behalf of Mr. Ryan stated that this is the last of the original Partenwood Estates and �his proposal is consistent with the balance of the area. TZr. Henry Muhich, Building & Zoning Administrator, reviewed the previous Planning Comnlission P4inutes, which state that I�Ir. Ryan resubMitted the original subdivision proposal after having the Commission members visit the site again. Some members felt that the lot lines could be arranged to r.ieet the lot caidth requirement at the building line, while others felt that this would amount to gerrymandering without affecting the actual buildability or density of the site. The Planning Commission recommended approval of the preliminary plat with a lot width variance subject to payment of a park dedication fee, to County approval of any new access road to the south parcel, and to retention of the ponding area on the south lot. i�Totion approved - 4 Ayes, 2 Nays, and 1 abstention. PZinority reported their concern was the approval of any subdivision containing any variance. "�iro I��iuhich also stated that this preliminary plat will meet all setback requirements. Butler moved, Paurus seconded, that the subdivision request for Tom Ryan, 1060 Tonkawa Road, be approved per the Planning Commission r-linutes of October 18, 1976. Motion, Ayes (3) - Nays (1) . Van Eeckhout is requesting 400 Old Crystal Bay Ro� 3 approval of a subdivision of approximately 18 �17G acres into 8 parcels exceeding the minimum lot Van Eeckhout size of 2 acres located at 400 Uld Crystal Bay S Road, The proposal includes a private road which would exceed 600' in length. Easements of 60' across the right of way and 100 ' at the cul de sac would he required, None of the property is designated as wetlands on the Hennepin County Conservation wetlands map in our office. Van Eeckhout presented the original proposal with notations showing no change in the existing drainage patterns across the property. Communication from the City S Engineer indicated that he had no objections to the drainage pro�osals. Planning Commission was very concerned about extent of non-conf�rmity and l�otential effect on health standards from inadequate onsite sewac�e systems especially after determining two acre sites as minimum lot area for sustaining an adequate onsite sewage disposal system. Planning Comnission requested applicant consider replatting entire plat and submit revised plans for Planning Commission and Council consideration. Applicant , �aas somewhat doubtful of obtaining approval of replat from the two other adjoining property , owners. The Planning Commission then requested statement irom neighbors along with revised plat. Applicant aqreed to comply with request and also include a perc test for the subject � lot to eliminate the possible danger of pollution from inadequate septic system. Staff - October 7, 1976 Applicant in office to discuss information concerning possible replatting. No written statement from neighbors has been supplied. Robert Birkeland, ilildhurst Trail, has NOISE .CONTgOL expressed his concerns with extra-ordinary (Continued) �noise and other disturbing annoyances and caould .ike to discuss the possibility of initiating � an ordinance to control such disturhances. • i-1re Robert Birkeland addressed the City Council � and reviewed the letter he received from the I;nvironmental Protection Agency which stated that � the �nviror�inental Protection Agency (EPA) shares your concern over the annoyance, disruption of � concentration and sleep, interference �aith conuaunication and other irritations that noise ! can cause individualse The Congress of the United States ex�ressed its concern with the , exposure of individuals to noise by enacting on � October 27, 1972, a Noise Control Act "to promote an environment for all Americans free from noise ` triat jeopardizes their health or welfare. " � The Noise Control Act of 1972 states that Federal action is essential to deal with major noise • sources in commerce, control of which require � national uniformity of treatmento To that end, it i� the purpose of the Act to estal�lish a Means � for effective coordination of Federal research and activities in noise control, to authorize � the establishment of Federal noise emission tandards for products distributed in commerce, � and to provide information to the nublic respecting the noise emission and noise reduction characteristics � of such products. The Noise Control Act, hoc�ever, � nlaces the primary resnonsibility for the control of noise i�ith State and local governmentse �� One responsibility of the Federal Government is � to assist State and local governments ��ith technical inforMation on noise and its effect � on the health and welfare of the nublic. Should your corimunity at this time be without a local S noise ordinance, I would urge you to contact � your local government and express your interest in noise control. Pde are presently working with � municipalities interested in establishing a noise control ordinance. Region V also has available � sound level meters for loan to communities interested in surveying their noise environment � �rior to proposing a noise control ordinance. The'.r ineters can be loaned for a short period � of time at no cost to the communitye If your � community does not have noise control regulations at present, we will be glad to review a draf_t of � any regulations which they might propose. Should �ur community indicate a need for assistance, • ..e �rould be pleased to respond, In oraer f_or us to loan equipment to your community, we need a request � froin an elected official from your community, • preferably the mayor or the City Tlanager.
