the City staff and consultants within the Citye

� Construction Company were requested to review all
plans and appear before the Council June 1, 1976

Alan Sweetser, 845 Old Long Lake Road, for a
subdivision, lZro Sweetser presented his proposal.
� Tne Commission had concerns about Lot 2 , which
�a�uld be approximately two acres and would include
� t��o dwelling units and a barn. The matter was
i tabled to give the applicant time to redrau� the
proposed lot lines to either place the cottage
� on a separate lot from the main house or to
increase Lot 2 to four acres or more,

with Hennepin County personnel, that they wouZd 3340 Shoreline Drive
� not permit any egress or ingress onto County (Continued)
Road #k19. After some review, however, the County
representatives agreed an access road from County
Road #19 to the Burger King would be acceptable
if arrangements could be made with the Calvary
i�Iemorial Church, whereby through purchase or
easements of properties, the proposed approach
S could be moved north of the power pole on the
church �oylevard. P�Zro Lambin then presented a
+ redrawn plan that would place the entrance to the
restaurant on County Road #l�, further east of
a the Shell Station driveway. The plan proposed
would increase the parking spaces to 67 cars.
Lambin stated that the restaurant would be
esthetically pleasing on four sides and that no
fill would be needed for the construction.

window, the Commission discussed the classification
status of it being a drive-in or a restauranto
Several members felt that any traffic problems
a would be eased by a vacation of Navarre Lane
that is now barr�.caded at County Road #19 to
the Calvary lZemorial Church. This would permit
` church members to park at their lot to the rear
of the church instead of County Road #�19 and
�would relieve an immediate problem. It was
suggested to Mro Lambin that he contact the
� church concerning this possibility and that he
come to an agreement with them to use the upper
• portion of the road as access way for his
• restaurant proposal. Although several
Cor�unission members felt strongly that the traffic
� was a detrimental factor, it was suggested to
Mr. Lambin that he contact Calvary rZemorial
� Church about possible vacation of Navarre Lane,
prepare a landscape plan and give a square foot
breakdown on the restaurants food preparation
area and dining areaa The Commission then
scheduled a public hearing to be held on T�1ay 3,
� 1976 at 7 a 45 P.PZ.

� The Planning Commission discussed ingress and
egress to proposed restaurant and stressed
that they would desire an access on County t�oad
;�19, perhaps combined with access to the church
parking areao Several area residents were on
hand and a petition with 16 signatures was
presented in op�osition based on traffic on
�County Road �#15, traffic on Navarre Lane, noiseo

conditions from the Planning Commission me�ting of

Gloria McDonald, Planning Commission men�er, stated
her concerns that this decision woulci encourage
Hennepin County to renew plans for a four-lane
highway for County Road #15.

from the west lot line. Turn�iam Road, w�ich is a 66 "

high.� The natural slope from the str�et to

2130 Shadywood Road, that his previous proposal
� to rip rap his shoreline was approved only to
� the extent of rip rap, Mr. Hagen appeared
before the Commission to request reconsideration
� of his request for gradinga He showed slides
of the existing washouts and dropoffs along
� �he shoreline and an existing ridge left from
an abandoned tennis court located about 45° from
• the shoreline.
� The Planning Commission agreed this existing
� man-made ridge presented problems in maint�.ining
the existing lawn area and recommended approval
� of grading this ridgeo The Planning Commission
�lso recommended removal of the hazardous pump
ouse and rip rap of the entire shorelineo P�ir.
Hagen also requested consideration of some
� filling and grading in one narrow area to
� facilitate access to the lake. The Planning
Commission felt properly designed rip rap

�ection 475067, and applicable Federal laws and Internal Revenue Service

to those services which have been provided, Ehlers &

incurred by the City of Orono, with its bond
� consultants, Faegre & Benson, in this matter, and
pay all other debts as related to the public sale
• of the general obligation refunding bonds, even ,
though the City Council may decide not to offer
� the bonds for sale at some future time, or may
� decide not to accept the bid if such bonds are
offered for sale.

2. Ehlers & Associates, Inc. has agreed, in
� c:�operation with The First National Bank of Saint
Paul, to purchase or otherwise at its own risk
� provide for the sale to the City for deposit in
� the escrow account to be maintained for the bonds
being refunded, securities of the type authorized
a by Section 475.67, Subd. 8, Minnesota Statutes,
which will be sufficient to satisfy all requirements
� of said Section 475.67 and the proposed arbitrage
regulations under Section 103 (d) of the Internal
• Revenue Code of 1954, as amended, so that the bonds
shall not be arbitrage bonds thereunder. Ehlers &
� Associates, Tnco has further agreed to assume the
� expense of the services of the escrow agent, bond
counsel, and such accountants and actuariPs as may
� be deemed necessary in connection with the trans-
action and shall arrange for the preparation and
� distribution of information to prospective bidders
� and for printing of the bonds, all subject to approval
and ratification by the City Council. The City
� assumes no obligation to Ehlers & Associates, Inc.
for any fee or expenses which may be incurred by
� Ehlers & Associates, Inc. , it being understood
that Ehlers & Associates, Tnc. is not an agent of (Continued)
