concerning the conditional use ermit reneaal
of the Stubbs Bay liarina Cafe, The Commission
noted the absence of Bruno Burak, the 1975
petitioner, but concluded that the permit
went with the roperty and not the petitioner,
• Because the Commission had heard ruriors on-
cening the management of the cafe, Polie
Chief T7el I:ilbo had been asked to appear and
report concerning any problems at the site.
lhe Chief stated that eleven complaints cere
n►ade to the police last year and were in
the nature of sale of 302 beer to minors.
Two of the complaints were heard in court
and charges would be dismissed after the
lapse of proscribed time set by the courtso
Chief I:ilbo felt this was an excessive
S amoun of complaints for this establishment
and called attention to Resolution 617,
issued in conjunction with their 1975
liquor license, in which the otaner stated
he would construct a partition to divide
• the liquor serving area from the recreational
area of the building or to quit allowing
minors in the establishment, He noted that
his had not been done. Chief I:ilbo stated
that the Police Department had no concern or
complaint concerning the soup and sandwich
f art of the operation, It was suggested
, that perhaps the liquor license and condiional
use permit should run concurrently so that

f and recommendations will have to deal with NORTH FERIIDALE ROAD
this difficult public policy fact, i,e. , Elwell Property
that the road is a border between urban (Continued)
and rural uses.
4o The principal public safety problem involves
very short sight distance for traffic at the
• hill aest of the Elwell farm buildingso This
. has sEveral effects:
 a) The accident potential within several
hundred yards of the crest of this hill
. . is high, particularly between vehicles
entering from driveways and through
 traffic.
b) This potential is especially high during
poor road surace conditions. Under ie
• ancl snow situations traffic headed n4th
accelerates in order to be sure to cary
the crest of the hil1, This acce]:e`tiOn
occurs at or slightly north of Chy
Chase Drive, Cars that do not acClerte
under these conditions find themselves
♦ losing traction before reaching the top
of the hille Traffic is customariy
' blocked several times a year by this
 situationo
A Traffic headed south does not have the
p.roblem of the north bound cars, but
♦ does have the more serious one o finding
themselves out of control under ice and
, snow conditions as they pass the cest
• of the hill< Depending on the severity
of the ice or snow conditions, this bu-
 of-ontrol trafic situation continues
at times until the cars intolved reach
 Chevy Chase Drive,
• Consultant will have to baSe his analysis
and recommendations on tlie fact that this
existing accident prone condition does nat
+ appear to have any foreseeable solution
through any major road improvement program,
 (See Paro 2 & 3 above) o
, It would appear extremely imprudent from a
public safety point of view to allow any
traffic ingress or egress on the portion of
the road near the crest of the hill,
• especially between the crest of the hill
and Chevy Chase Drive, hen such ingress
i and egress involves the large number of
trips per day generated by a 180 dvelling
unit subdivisione The consultant should be
sure to include in his reort an evaluation
