� 2o Signing of� an easement for Lot 2 would not
� put me in compliance with any Orono ordinance
that I am now breaking,

3o Lot 2 is considered by Orono as wetlands
� and unbuildable. The apparent reason iahy I
a�n being asked to sign this easement is to
� assure Orono that no building can ever be
+ i�laced on that loto But since the Village has
the power to grant or deny building permits
� any��ay, this easement proposal appears redunclant
and unnecessary to the Village.

� o There is no apparent advantage to me in
� doing so, The reason I initially considered
� the proposal is that I had heard that sometimes
Village or County or State authorities allow
� d�velo�ment or even develop themselves wetlands
i�roperty to make it more suitable for certain
� types of wildlife (like a duck pond or etc, ) if
that property is sold to or given to ther:l or
� i�� an easeinent is granted, This proposal has no
� such implicationso
��nce all these things have virtually nothing to
do with my request for a conditional use permit,
� �: respectfully request consideration of my permit
based on its own merit and on its own compliance. "

� informed the City Council that on April 19, 1976, USE PERI�IIT
the Planning Commission minutes relating to Pira Ka 2980 Casco Point Road
� t��. Oien°s request for a subdivision and conditional
use permit at �980 Casco Point Road, stated that
• the City At�orney had advised concerning the
• road and right-of-way siutation and stated that
the City can only deduct the street area presently
� used by the City in the consideration of the total
�uildable area at the site. The Commission
+ recorunended to the Council that the subdivision
application be approved as submitted but subject
� co payment of the Park Dedication Feeo
• Rec�arding T�Zr, Oien's request for fill and grading
� at the site, the Planning Commission recommended
to the Council approval of the request �aith the
�, stipulations that he be allowed to fill around
his house and driveway area in an amount to equal
� not more than 200 cubic yards in any one place
and not deeper than 5 ft. or within 120 fto from
• the lakeshore because the road is elevated 20 ft.
above the level of the lot and the lot is at
�' lake level so that the house was constructed
� without a basement and the fill would cor.►pensate
for fi11 normally taken out of a basement excavation
` and used for normal grading; a1so, that the work
�e apQroved by the City Engineer and the underground
� clrain tile and any change in drainage would be the
owners responsibility subject to approval of the
� City Street Superintendent; that sewer and water
• assessnents be determined by the City Engineer
and that no retaining walls be built except wit��
� the approval of the Zoning Administrator.

stated that in considering the reqvest .af r�ir. 2505 Kelly Avenue
�Do To Lindsay, 2505 Kelly Awenue, to rezone, the
. Planning Commission held a public hearing at which
Mr. Lindsay explained �hat they w�.shed downgrading
� of the commercial area to Yesidential as part
of their plans for a Planned Residential Development
� and felt that this rezoning could be sn important
factor in the upcoming subdivision proposal (#104) ,
• The Zoning Department expressed the feeling that
this would be beneficial due to the topography
� of the land, consisting of hills and ravines,
� requiring filling and grading in order to be
utilized for commercial purposeso Commercial
� use would result in additional hardcover and the
problems of storm water runoff and pollution of
A the lake and ground water. Also, it would create
a more natural line between zoning districts.

Because i�ir, Lindsay did not return for the work
� session part of his subdivision application, as
� expected from earlier dis�ussions in the evening,
the Planning Commission �abl.ed action on this
+ matter until after the public hearing on the
subdivision-PRD proposal on April 19, so that
� both matters �oial.d be considered as a whole,

� Van Nest felt that the City would receive no
� bene�it by leaving the strip commercial and
Pesek agreed feeling that if it remained commercial
� it cbuld be made into a parking lot or similar
use at a future time. Mr. Everett Schroder
e objected stating that the present ICeaveny Drug
S par}cing lot blacktop was extending into the
residential area and the rezoning would only
� give a benefit to them and not the City. The
me:nbers felt that this was not the situation
� hut requested staff to verify the matter. The
�pplicants answered this by stating that it was
� more of a benefit to them to leave the commercial
area status quo in order for them to have bette�
� ��sition regarding the zoning �rovision requiring
� duplexes to be within 200 fte of the commercial
area, However, their purpose for the rezoning was
� to provide a better buffer area from the business
districte
�
The Commission tabZed the matter until their next
• regular meeting in order that exact information
regarding encumbrances on the property be
� clarified.

� stated that Jerry Snyder, attorney representing Hill Street
the applicant, I�Tra & Psrs. A. T. Esco, appeared 300 Crestview Avenue
� at the public hearing and re quested that the
Commission review the survey prepared for the
� Escos, It showed the garage and a portion of
the existing house, including the well, pro-
'� truding into Hill Streets The attorney stated
� that the only way the Escos could obtain
mar}cetable title for their property was by
� vacation of that portion of the street where
the house is located. It was noted that Lots 7
� and 18, the easterly properties, had not yet
been developed and so access problems still
� existed for these tractse Van Nest noted that
, tremendous ravines existed on these lands
making it impractical to build an access
� except through Hill Streete Mr. Snyder
explained that the Escos had retreated in their
� request for a complete vacation but were only
asking for 3. 8 ft. so that the house will be
� completely on Esco owned property. He explained
that this was an existing situation when the
� Escos purchased the property and they were
. presently in a law suit for the former owner
concerning ti�e issue.
� After the public hearing, the Comr.iission proceeded
� to discuss the problem. McDonald felt that no
road would ever be constructed but was a possible
� future need for its existencee Pesek felt that
30 � ft. would not be harmful and the balance
� could still service the lands to the east. The
' Zoning Administrator disagreed stating that the
City would need the full road for future utilities
� and maintenancee Van Nest noted that in order
to vacate land a public interest must be servedo
r The members, in turn, felt that the Escos were
public and the situation created a hardship to
• theme It was agreed tha� the City Attorney be
� consulted as to what constitutes public interest
and the City Street 5uperintendent was to what
� maintenance problems might result from the vacation,
� The Commission tabled the application until they
had receipt of recommendations from the City
• Attorney and Street Department,

� The Planning Commission recommended to the Council
• that the City vacate a four foot strip of Hill
Street lying adjacent to the entire extension
� �f the Ae Te Esco property because it would be
unrealistic to believe that Hill Street could
� serve as access to any other property except
Lot 7 and the remaining 36 fte of the street
� would provide ample access to Lot 7 and the

� stated that at the Planning Commission's request, Burger King
John Lambin appeared at the work session review 3340 Shoreline Drive
• of his applicationo The Zoning Administrator
related, from his meeting with Hennepin County
� personnel, that they would not permit any egress
� or ingress onto County Road No, 190 After some
review, however, the County representatives
` agreed an access road from County Ftoad No. 19
to the Burger King wo�ild be acceptable if
� arrangements could be made with the Calvary
I�iemorial Church w�ereby throug�► pur�hase or
• easements of properties, the p'rbposed approach
• could be moved north of the pow�r pole on the
chuich bouievard, t�1r. Lambin then presented
� a rcdr�wn plan that wo�1d place the entrance
to the restaurant on County Road No. 15,
� fv.rther east of the Shell station driv�way,
The plan proposed would increase the parking
� spaces to 67 cars. Lambin stated that the
restaurant would be esthetically pleasing
� on four sides and that no fill would be needed
• for the constructiono Because the Burger King
would have a drive-up window, the Commission
� discussed the classification status of it being
a drive-in or a restauranto Several members felt
r that any traffic problems would be eased by a
vacation of Navarre Lane that is now barracaded
� at County Road #19 to the Calvary Memorial Church.
• This would permit church members to park at their
lot to the rear of the church instead of County
+ Road #19 �nd would relieve an immediate problem.
It was suggested to P4r. Lambin that he contact
� the church concerning this possibility and that
he come to an agreement with them to use the
• upper portion of the road as access way for
his restaurant proposal. Although several
� Commission members felt strongly that the traffic
� was a detrimental factor, it was suggested to
i�Zr o Lambin that he contact Calvary rlemorial
� Church about possible vacation of Navarre Lane,
�repare a landscape plan and give a square foot
reakdown on the restaurants food preparation
area and dining area. The Commission then
� scheduled a public hearing to be held on May 3,

� given approval to add to their existing
operation on Highway #12.
� The previous elevation, landscape and site plans
� have been approved, Although this project has
not as yet been completed, the owner finds it
� necessary for more expansion. The Company is
requesting approval of another addition to the
� original proposal. This addition located to
• the south of the original addition consists of
I,791 sqo ft.
� Our ordinance requires approval of the site
w plans before approving any additions to
commercial or industrial establishments.

, This addition would not have any effect on the
originally submitted site plans,
� I would recommend waiving referral to the
� Planning Commission and approval by the
CounciZ.

Valu Store regarding the PSTC's recommendation
� to locate the newly proposed bus shelter near
the crosswalk across the street from the entry
� into the City°s parking lot located on the north
side of County Road #15.

, They both agreed they would have no objection
te replacing the large existing stone planter
� with the shelter, There would be no reduction
in parking spaceso

them our police department would cooperate in

to the Council this evening. They did not hold
their regularly scheduled meeting last week and
will not be able to appear before the Council
• until May, Mr. Trlalt Lathrop, Park Commission
� Chairman,has all of the material for his review.
� Joint Trails membership was deferred to the JOINT TRAILS MEMBERSIIIP
� June, 1976 meeting.
+ Dick Benson, City Administrator, informed the BIKE TRAILS TOUR
City Council that there will be a bike trails
tour June 6, 1976 at 1: 30 P.PZ. Pzaps will be
• available at the next meeting showing the routes

the dispatcher contact Water Patrol, If the
� �dater Patrol cannot or will not respond, this
� department will take only what action can be
taken from shore as the Police Department is
� not trained or equipped to respond to wa�er
related calls at this time.
